Sri Lanka’s President Mahinda Rajapaksa today sacked Chief Justice Dr. Shirani Bandaranayake. Lawyers of Dr. Bandaranayake acknowledged receipt of the removal letter sent by the President this morning and said the letter is dated January 12, 2012.

Look at the growth of the per capita income level and the commensurate growth of the Gini Coefficient in Sri Lanka. You would see that the wealth now increasingly gathers around a niche group closely known to the president. To give you one corrupt example, how did Basil Rajapakse get more than 20% shares in Mico Car Company? Did he invest any money? No. Those shares were given as a bribe. Then Basil ordered all Government Institutes to buy Micro Cars. This is more or less the Suhartho Family approach that led to the collapse of Indonesia, because businesses cannot grow with such corrupt business models. This situation will worsen with the Divi Naguma act, which the Chief Justice held to be unconstitutional. Rajapakses are now immune from normal fiscal laws. They will bribe underworld thugs in the name of giving micro-loans, and nobody who does not offer party favors will get any loans. Already the Samurdhi officers are enslaved for political purposes. The Divi Naguma Department will be a true PARALLEL STATE CENTER that runs against the constitution, if you truly care to worry about. I am sure people like you will be OK with it. So, a parallel independent judiciary is needed to protect the people of Sri Lanka from this greedy and corrupt family and friends like you. Rajapakses started to hate the CJ after she made recommendations to revise the Divi Naguma bill to be a more PEOPLES’ friendly one. So, with the greed of people like you around Rajapakses, the normal people must get courage to peacefully overthrow the Government. They cannot expect any good coming out in the future.

I think Sirisena and Dushy is wrong. When the SC has ordered that the PSC is unconstitutional and the proceedings are not meeting the Articles of the Constitution, if the CJ leaves her post because Mahinda as a Bull in a China shop wanted to smash the whole country then it may make a big problem. I listned to MP Sumathithran’s speech, during the debate and he provided all the ammunitions for the UNHRC to take Sri Lanka to what ever place they need to take the country. The joker MP’s provided the back ground music. Sri Lanka is not in isolation to do what Rajapaksa and his brothers want to do. Our Country is watched by others and in this hi-tech world any information will be around the world in few seconds. If in March UNHRC revive goes bad for Sri Lanka, CHOGAM will be full-out from Sri Lanka.
If President Rajapaksa wanted to impeach CJ, he should have done it in a proper and in a leagl manner as the answer is yes or no from the inquiry, he can still impeach her. Now he created a mess and he may satisfy the locals but the IC will be going to look at this in a differnet manner. The Sinhal saying “Hadisiyata Koraskateth Thatha Danna Bariya” is proved correct by Mahinda Rajapaksa.

It is sad that President Rajapakse, demonstrated his sheer ignorance and greediness of absolute power over all organs of government, (impotent legislate already under him and he is determined to have the Judiciary as well). He simply refused all advises given in the interest of the country by all learned people and simply showed his egotism and lack of knowledge of all norms of the governance. Rajapakse knows the whole process adopted to dismiss the CJ was absolutely unlawful and his actions effectively made Sri Lanka a ‘failed state’ in the eyes of the international community. Yet, his sheer greed for power ruled over everything and displayed the extent of his blindness for absolute power. It is sad that he had failed to realise that all this time he was somewhat safe under the majority Sinhalese which is no more there. The Divineguma Bill was deemed to be inconsistent with the constitution unless approved by all provincial councils,by a Panel of the Supreme court including the Chief Justice.
But only the CJ was targeted for scrutiny of her private finances by the PSC,and now removed by the President after impeachment by parliament.
But, why were the other members of the Panel not similarly examined by the PSC?

Let us look back at the post-independence history of our country. Every Govt. the two major political (UNP and SLFP) parties have always used divisive methods to mislead the majority of the people, win their votes, gain power and then again use divisive and undemocratic methods to hold on to power. So on they have been responsible for the unnecessary conflicts and unwanted shedding of blood, loss of valuable youth life, etc. Such trends have continued in an increasing scale and now it is to destroy the systems of justice which had some of relief to the people to defend their rights and freedom. The politicians who are in the lead do not care what happens to the people or the country but do care only their being in power and abusing if for their self gains. What leader of the UNP has been doing in the impeachment issue is a clear example. He was never clear and straightforward in his stand as he, when he comes to power again, if at all he does, would want to use the same methods what is being done by the present rulers.

How could the parliament take vote for appointing a PSC and then speaker informS the president that impeachment motion was passed?
How could the president seek constitutional provision to remove CJ when there is a Supreme Court determination that the PSC process is unconstitutional?

As Sri Lanka has blatantly violated to share the Commonwealth values which include the judicial system which gives great significance to the doctrine of the Rule of Law, will Commonwealth countries participate in the Commonwealth Conference to be held in Sri Lanka this year. Now the Judiciary in Sri Lanka is strangled to death, signalling the erosion of democracy. The illegal dismissal of the CJ is a great abuse of human rights and as such will the UNHCR Chairperson Navi pillai visit Sri Lanka. Canada, UK, USA, UN and UNHCR has expressed concern over this issue. As this is the situation will the Queen as head of the Commonwealth attend this Conference. At the same time, there is also suspicion that the illegal dismissal of the CJ dends the message that either Sharia Laws or the Chinese Communist laws will be introduced in Sri Lanka. China has been a silent watcher while Iranian Minister said that he would like to improve the existing Sri Lankan Judicial system. If this happens then there is danger awaiting for SAARC and also to India. It will not be surprise even Idiot Wimal Weerawansa & Co will become an Attorney-at-Law without sitting the Law Exam. I think it is better to strike out the Sri Lankan membership from the Commonwealth.

Mahela, I agree with you 100%. It was heart breaking to see how Rizana’s family is living. Even cattles, pigs and goats live in sheds better than that. While this poor girl was suffering in a Saudi prison for 3(?)years, at least MARA’s regime could have given her family a half decent place to live from the colossal sums of money they waste on show-off functions. This is the reality.

I still feel so sorry for our innocent children been forced to work as slaves. On many occcassions when I land in the ME Airports I come across many time that SL housemaids are languishing in the Airports for days without having food or sleep, simply because the owner or the agent has not come to pick them. So when they see some Sri Lankans to support them. There was another house maid, after working for over a year, the owner had not paid her…..and she carried only a small plastic bag of clothes. These children go simply to get some better food to eat and earn little money, but end up in the cruel hands with no food and no money….but feel shy to tell outside. They are treated like slaves and made to sleep with the saudi males….who are very violent and act like beasts. I know them how they behave. Soon their women will be homeless and will end up in other countries houses.
Also I believe how we treated our Tamil brothers and sisters by our Chauvenistic crazy and jealours Sinhala racists is coming back to haunt us.
Let’s see how it’s going to end.

Adding to Weera’s comments, one wonders what these various Ministers from the Muslim community have done to improve the housing standards of
their own people in the Eastern Province. One of them was the Minister of Housing from 2004 for several years. Because of the hullabaloo created by the media and the wave of sympathy for Nafeeka the family is likely to get a decent house soon – thanks to the personal intervention of the President. I too heard from some of my lawyer friends a talk along these lines. What I heard was that the judicial coup was to come in the form of a challenge in the Supreme Court by way of review of a case involving MR. A lobby group that included American funded NGO wallahs masquerading as champions for human rights, rule of law, forum for democracy and policy alternatives were suspected to be hehind this alleged plot.

The real reasons for the removal of Shirani Bandaranaike will eventually come out. It is very clear that government MPs did not dig up the mud only recently. Government sources would have been aware of Shirani’s misdeeds at the time she was appointed as CJ. May be they thought she would continue to give favourable decisions.
Perhaps her association with people like Pakiyasothy was her undoing.

There we saw educated, long-standing, healthy institutions brought to their knees. But these eventually collapse but not before harming millions of people and turning the land topsy turvy.
