  5. This isn’t an issue where its okay for any of us to even consider a joke about. Mr Kodituwakku is brave an honourable lawyer unlike many other, with his selfless attitude to life is putting his own life in risk doing what no ordinary man would do to correct the justice system of a country that has been regarded as a ‘lawless state’ by proving how unsuitable and thug like the new CJ is. These threats made to his life should not be looked upon lightly by any of us as this gives all of us an insight into what kind of indivudual the Mohan Peris is. The work done by Mr Kodituwakku should recieve our support and be commended to ensure that justice is served to those who disobey the law, therefore proving what a joke and fraudster the CJ Mohan Peris really is.

    • Yes indeed, this is NOT a joke and Ones that would make it a joke should be really sick.

      On the other hand, many would not grasp it because it is the country^s president who appointed MP as the next CJ. Presidents in general have good advisers before them being fallen onto decisive appointments.

    about the unwillingness of any other lawyer to appear in this case

    and

    AND WHEREAS on 27th March 2012 the bench included Dep J, who on 30th
    Sep 2011 had clearly indicated his unwillingness to hear the case, and accordingly the matter was postponed for 02nd July 2012

    about the behaviour of SC judges as recorded in a petition before SC

    do we need any more proof that it’s all make believe set up – the courts, parlaiment, officialdom, businesses, the executive – warts and all.

    And this also points finger at Upul Jayasuriya who seems to think he can do a better job than outgoing president of BASL, as well.

    All we can say is we hope this brave lawyer, who also wrote some pieces to CT keeping faith in the President to correct himself in the impeachment will not be harmed and the petitioner will be speared too.

    As for trusting the judicial and other systems which claim to protect us, we would be fooling ourselves as these are all but clear evidence of systematic and all pervasive injustice, across all aspects of life.

    After more than 100 years, each of us, the ordinary citizens in the country, are treated no better than Silindu in Baddegama was, and who lucidly chronicled that injustice and underlying inequality? A foreigner with a sympathetic and sensitive touch. pathetic!!!

For Mr. Kodituwakku to come forward on behalf of the peace-loving Sri Lankans and file a case against the illegal and illegitimate Cheeky Cheap Justice is a huge risk for his own life as well as to his immediate family members as things have happened for all those go against and talk against the Rajapakses the dictatorial and uneducated criminal family. This Mr. Kodituwakku should be brave and bold enough to fight against the aspirations of the “REMAINING DICTATOR IN THE WORLD”. I say so as all the other dictators have been killed like dogs by their own people and/with support from Democratic countries and this thrives due to the weakness of the Opposition and gullible poor masses majority of whom living in rural areas who get only GOSL’s highly biased News. All our good wishes to this extremely brave Sri Lankan Lawyer and please take extra precautions when leaving and coming to your Sri Lankan residence as you have given your address. I think it is better if you avoid that address during your stay in this “CRIMINAL COUNTRY” which was really a beautiful one with smiling people. The peace-loving Sri Lankans wish to see that we go back to that period. We don’t mind even if we have to queue up for food, rice barriers, drink tea without sugar, eating yams instead of bread and rice, etc. etc. as long as there is peace of mind and very much less crimes like killings and corruption by the Politicians and Government Officials. We could have expected this if the real winner was elected at the last Presidential elections but for our fate, the computer jilmarts and other frauds like removing ballots crossed for Gen. Fonseka made the results upside down. Only two bundles marked for Gen. Fonseka are found but there would have been over hundreds of bundles removed and an equal number of bundles exchanged at the counting centres or in other places as they had their own people manning all those places. GOSL knows that over 66% of the population are against and that is the reason why they are doing all other tactics to suppress an uprising but the day an uprising comes up, even the innocent general public will join and protest against the dictatorial family like what happened in countries. It will be another Libyan type victory for the Sri Lankans.

Anyway, now this same Weerawansa is silent about the bribery case which is not against a family member of Mohan Peiris but against MOHAN PEIRIS. Wimal, where are the ethics now! How come President appoint a man, against whom a serious charge of dishonesty and gross misconduct is pending before the Supreme Court, to the office of the CJ. DGC’s observation on the Petition filed by the Petitioner simply stump the Mohan Peiris giving third umpire no chance. Mohan Peiris’s appointment to the office of the CJ is disgrace to the entire Judiciary now under the absolute control of the Executive President.

Thief Judge was his choice, appointed iaw the rules but in reality propped up by those 3 dastardly committee of MPs one of which was Ranil I believe. So, is the President and the 3-goons going to volunteer to be impeached by the parliamentary jokers. We have to wait and see, but the writer beware!

This news item published with credible facts proves a very valid point; the right person who would tirelessly defend the lawless regime is chosen to head the Judiciary over others, where the other judges of the Supreme Court and the Court of Appeal are forced to sacrifice their moral integrity and are made to extend their support to Mohan Peiris, apparently under duress threat or promise.

  20. My name is Vikum Kodituwakku, 22 years of age and the eldest of Nagananda Kodituwakku’s children. I would like to thank everybody who have shown his or her support and commented on this article. My dad is my hero; he is a very inspirational figure in my life. He is a loving father and a Sri Lankan who never gave up on his mother nation. For most that may be unaware of this is now the second time he has received threats to his life in his legal career, in 2001 he also received threats to his life and of his children during another fraudulent case. As I have mentioned before he never gave up on his motherland and believed in doing what is right. This is evident through his actions in returning to undertaking the case mentioned above in 2010, which holds the current CJ Mohan Peris guilty of dishonesty, misconduct, concerning the defrauding of 619million rupees of public funds. Yet again his actions have resulted him receiving further death threats to his life.
    I admire my father’s courage and bravery he has shown during the proceedings of this case, which at one point resulted in him having to abandon the case during September 2012 and return to the UK for his own safety. Yet his persistence and belief in doing what’s right as a Sri Lankan he carried on forth with the case. Which has now resulted on another threat to his life with the hearing just days away (31st Jan).
    Is this what would happen to any of us if we were to stand up against this MR distatorship?
    We as Sri Lankans need to stand up against these corrupt, power drunk tyrants who call themselves our leaders and therefore support brave and selfless people like my own father, Nagananda Kodituwakku, to make change in what is now classed as a ‘lawless state’.
    Please keep showing your support and interest in this case as my dad; Nagananda Kodituwakku will very much appreciate everyone’s support.

      • Thank you for your kinds words. These threats in his career has effected our family, specially in 2001 when we had to flee Sri Lanka and immigrate to the UK. Every time i come back to visit Sri Lanka i realise how much i miss it. My dad is a man who is not easily intimidated by threat to his life, as he has dealt with issues as such all through his career whilst fighting for the right side of the law. So i believe he will be able to succeed and i am glad to see so many people are showing their belief in him. Thank you again for all your support.

Startling revelations of this case is food for thought for all the judges who conveniently sacrifice their moral integrity and did welcome this Cheat as their Head, making the judiciary a laughing stock in this country. First they ruled that the whole impeachment process was unlawful and the Lady CJ remains stand as the legitimate CJ. And then these very same judges had the audacity to surrender their morale integrity wholeheartedly and to betray the trust place in them by the people of this country under pressure. I can remember one fellow layer saying that Mohan Peiris summoned all the judges in the Supreme Court and the Court of Appeal, one by one to the CJ’s Chamber, that is before the ceremonial sitting and compelled them to support him, having promised them Mercedes Bens in recognition of their solidarity. yet those who respect their morality and had insight declined his request, but attended the ceremonial sitting under compulsion. This case seems to be a good lesson for those who compromise their integrity, to all powerful Mohan Peiris. As someone had rightly said, now we have a ‘Executive Judiciary’.

Most judges in the Supreme Court thought that Rajapakse would instal the rule of law in the country and instal the most suitable person accepted by all learned judges to be the CJ or Al least a senior credible judge like Shirani Tilakwardena J, who simply help Rajapakse to get rid of Shirani B. Sarath Silva, who was made to believe that Rajapakse would appoint Shirani T as the CJ, did everything under the sun, to get right of the CJ. But his and his compatriot Shirani T’s dream never came true. yet, the fire is not settled yet, and when the right time comes the disgruntled judges will show Mohan Peiris the door.

      His 40 year experience in lanken politics contain more corruption filled issues than anything else, not even good enough to become a minister of earlier times in SRILANKA. They have now completely forgotten the Lady CJ, who was unlawfully removed, and now back at their usual practice of sucking the blood of innocent litigants. I was wondering why those thugs clogged at the Supreme Court entrance cheered both Mohan Peiris (on his first day of arrival at the Supreme Court after accepting the unlawful appointment as the head of the judiciary) and Wijedasa Rajapakse BASL President. The BASL head cleared my doubt with his post conduct (after Mohan Peiris’s resumption of duties as CJ). Now these people happily eat and drink, as if nothing untoward had happened. The absolute silence of the BASL in this particular matter due to come up before the Supreme Court only shows that BASL is nothing more than a body of irrelevant bunch of selfish and disintegrated people who are prepare to compromise their integrity for private gain.     • I would like to place before the Azdak of Hulftsdorp the issue raised by Minister Wimal Weerawansha for an interpretation. Minister WW stated during his speech in the Impeachment Debate that “like Eve was created from a rib of Adam, the judiciary was created by the parliament”. (About 25-years ago his party wanted to destroy the parliament, which he now says supreme.)

      While watching him on TV I thought otherwise. That is the Parliament, Judiciary and the Executive were created from bones, flesh and blood of people of the country, whose sovereignty is inalienable.

    I have been trying hard to argue that scolding, criticising etc is very inadequate. People must get together to organise and function with long term perspectives about ACTION to turn back the juggernaut and protect democracy.   61. I am a lawyer and a keen observer of the case against Mohan Peiris, whose appointment as CJ had ridiculed the Judiciary. In my view, it was predetermined to dismiss this application today. First it was scheduled to come up before Justice Marsoof at Court No 502, who had allowed the Petitioner to amend the initial Petition with all ‘specific’ material that exposed Mohan Peiris’s gross misconduct and dishonesty, that were removed by the previous Counsel for the Petitioner.

    Just half an hour before the Court session commences it was announced that this case had been transferred to Court No 403,where the Presiding judge Ratnayake, who had already noted that for personal grounds he do not wish to take part in the proceedings. Yet the AG was determined to proceed with the matter with the other two Judges, but the Petitioner objected and the objections were raised on the basis that he cannot expect justice from hettige J who had been already reported to the CJ Shirani Bandaranaye for his bias attitude towards Mohan Peiris in this case. That objection was simply overruled by the Court and Hettige J himself decided to proceed with the case and heard the submissions made by the AG and allowed the ‘unfounded’ preliminary objections raised and dismissed the application, absolutely denying fair trial to the Petitioner.

    Sri Lanka is a failed state, where the rule of Law clearly is undermined and the judges have meekly surrendered their integrity. The Counsel Nagananda Kodituwakku, may have fought a valiant fight for his client for justice, but the truth is that in this country, one should understand the ground realities, no one should expect justice from the Judiciary under this Chief Justice and the outcome of this case simply reaffirmed it.

All the Judges attended the sham ceremonial sitting demonstrating their solidarity to Mohan Peiris PC, with no participation of the BASL, conveyed a unambiguous message to all citizens in this country. It is sad that these judges (except one or two attend by compulsion) have conveniently forgotten that they are the servants of the people, who exercise peoples’ judicial power in trust and that they are steadfastly committed to uphold the peoples’ civil liberties and fundamental rights. The ruling pronounced by the Fundamental Rights violation case (SCFR/536/2010) supported by the Counsel Nagananda Kodituwakku yesterday is a strong statement to all the citizens. “Do not expect justice and fair play from the Judiciary under Mohan Peiris”. This ruling has set a precedence that would be followed in all the future cases. It is a startling warning to all citizens, which states that no one should dare to come before the Court seeking justice when their civil liberties are infringed. The people should notice that already tens of millions of rupees worth of required gear necessary to inflict damages on the people have been already imported and necessary inducement have been already provided to the Police with 100% increase of their allowances approved. Under the new setting the people should prepare to suffer degrading or inhuman treatment in the hands of the Executive, as going before the Court seeking justice, is likely inflict further damages.

  68. People with insight know why Rajapakse was so hurry to remove Shirani Bandaranayake. When this matter was taken up before her on 20th Dec 2012, she firmly gave assurance to Mr Kodituwakku that she would take it up for hearing on 31st of Jan 2013 and Govt was so determined to remove her before that date. If this case had been heard before her, the Cheat Mohan Pieris would have been surely behind bars. Once he is freed from the allegations of dishonesty and misconduct, in his role-played in defrauding of millions of public funds that would clear him from the ignominy. Being the head of the state Rajapakse is required to allow Judiciary function independently, which he had denied by making it executive controlled Judiciary.
    The Counsel risked his life to show the people the true character of this cheat. The President should be ashamed of himself of his style of governance. He has shown the people that he would do any disgust act to remain in power. But he should not forget that, although he can deceive the locals easily, he cannot do the same with the International Community, as they are following every moment of the government with keen interest.
    Fully drunk with power, Gadafi and Saddam, until their downfall, thought that they would remain in power for ever, like in Sri Lanka, and all media institutions painted a totally deceptive picture to the outside world but the history has now shown that such acts would never work.

I cannot think of any lawyer present in Sri Lanka today who would have the courage to risk their life and present this case. I do believe it was you, Mr Kodituwakku that conducted a solo peaceful protest in December outside the supreme court against the undermining of the judiciary by the Executives. You are a truly remarkable man, and your actions are admirable. It is a true shame that this case was not heard under the previous CJ. The judges in this country are pathetic and lack conviction to justice; they hide themselves underneath their pointless wigs and are ignorant to the blatant scandal presented to them. All of the judges hearing this case should step down from their duties, if they cannot uphold the rule of law what is the point of having them. I understand there may have even been strict communication between the MP party and the judges to prevent this case from progressing by any means necessary. JRJ (1977-1989) appointed Neville Samarakoon as the Cj thinking he was a stooge. When Nevil J proved otherwise JRJ impeached him. CBK (1994-2005) appointed a proven crook Sarath Silva as the CJ who amply proved his wickedness and finally turned against the CBK herself. MR appointed Shirani Bandaranayaka as CJ, when CJ did her duty he impeached her and then appointed one of the most dishonest men, Mohan Peiris, whilst number of cases pending against him in Courts. Why should the people make a big fuss about this? It is a case of President following his predessors and it seems that this is the accepted style of the democracy in this country. Let’s spare this man, do not disturb the will of the President as Mohan Peiris is the Peoples’ President’s most trusted man for the job.

The evaporation of the valued in the society suggests that the DNA of the Sri Lankans have been completely changed.In early days they had the character and will to fight the injustice and oppression. Not it seems that all that qualities is in the history. Probably new information technology, tv and radio, that day in and day out feed the people with utter falsehood, had washed the brains of the entire nation for good.

  88. We, all Lankans should ashamed of ourselves for not been committed to support a deserving case. If there is an iota of self respect all ‘Back- Coats’ should unreservedly apologize to the foreign lawyer who fights this case with no support whatsoever from the other members in the profession.

    It is pathetic that these so-called members in the ‘noble profession’, have no guts even to extend their moral support to the lawyer despite the final outcome of this case which would likely decide the fate of rule of rule of law in this country, and the failure of the AG’s department to uphold the rule of law.

  89. The rule of Law is crucial to term-prosperity. Respecting legal system is part of cultural heritage of any country. Therefore, Mohan Peiris who faces a serious charge of misconduct in this should have informed the President Rajapakse that he was a respondent in a case pending case of fundamental rights.

    He should have pleaded with the President Rajapakse not to appoint him as a CJ until at least this case was disposed of.Therefore, people addressing him as the de facto CJ or Chief Injustice is amply appropriate.

I honestly believe that at least few young lawyers would come forward to support Mr Nagananda Kodituwakku, to expose the absolute lawlessness and dishonesty of the public officers employed at the AG’s Department. None of these fellows have been chosen on merits or otherwise. All have been selected purely on the basis of their connection to the sitting judges and most senior staff of the AG’s Department. This practice should surely come to an end and no fellow employed at the AG’s Department should be appointed to Judiciary. Right now our of 11 judges except Immam J and Ekanayake J all others are from the AG’s Department. These people would do their utmost best to protect the interests of the AG’s Department. Naturally, they don’t won’t to see the dishonesty of the AG’s department exposed.

  91. The AG Department is extremely concerned about this case. They know that this case poses a great threat to their own survival and if allowed proceeded, it would expose the lawlessness and the corruption at the highest level prevalent at the Department.Genuinely hope that case would survive and the outcome would help to restore the rule of law at the AG’s Department.
