Political Splits & The Rule Of Law: Pledges & Practice

Political divisions are not new to Sri Lanka. Nor are they unique to our country. History is littered with disputes, breakaways, and betrayals – often among those who once marched under the same banner. The left, in particular, has long been characterised by factionalism, ideological feuds, and the inability to reconcile competing visions of reform and revolution.

From Stalin and Trotsky’s bitter clash after Lenin’s death, to the Sino-Soviet split of the 1960s, disputes within the socialist camp have repeatedly undermined its broader cause. Sri Lanka’s left has followed a similar pattern. The Janatha Vimukthi Peramuna (JVP) itself was born of these divisions, drawing from Moscow and Peking lineages. Later, its own offshoot, the Frontline Socialist Party (FSP), emerged after yet another rupture.

Today, with the JVP at the helm of the National People’s Power (NPP), and the FSP on the outside, these old tensions continue to simmer. The recent violent seizure of the FSP’s office in Yakkala, allegedly by JVP-aligned actors backed by the state, has brought these rivalries into sharp public focus.

The NPP insists the matter was settled by a court ruling in its favour. The FSP claims it was political thuggery dressed up as legality. What is clear is that violence was used where the rule of law should have sufficed. If there was indeed a binding court order, then its implementation should have been left to lawful authorities, not party loyalists with fists.

This dispute cannot be brushed aside as a mere property squabble. It goes to the heart of the NPP’s own election promise: to restore faith in the rule of law. Its manifesto, A Thriving Nation, A Beautiful Life, pledged an “independent and efficient administration of justice” as central to building democracy. That pledge rings hollow when political actors take the law into their own hands.

It is worth remembering that such conflicts are not confined to the left. The capitalist camp has fractured repeatedly too – the UNP giving rise to the Samagi Jana Balaveegaya (SJB), the Sri Lanka Freedom Party (SLFP) splintering into the Sri Lankan Mahajana Party (SLMP), the Sri Lankan Podujana Peramuna (SLPP) and others. These splits often revolve around power, wealth, and access to state resources. Property disputes are not new either: the UNP headquarters itself was built on contested land once earmarked for the JVP.

But the deeper issue is this: Sri Lanka has suffered for decades from political actors who place party, power and personal interest above democratic principle. When the state apparatus is used to intimidate or settle scores, citizens lose faith not just in the parties involved, but in the very idea of justice.

The rule of law is not a slogan for election platforms. It is the bedrock of any functioning democracy. It means that all – government and opposition, powerful and powerless alike – are subject to the same law, applied fairly and without fear or favour. Where it prevails, stability and legitimacy also follows it. Where it is absent, fear, disorder, and ultimately societal collapse are never far away.

If the NPP truly wishes to distinguish itself from the discredited political traditions of the past, it must demonstrate that it is willing to subject itself to the same rules it promises for everyone else. Violence, intimidation, and political repression will only tarnish its credibility and give ammunition to its opponents.

Sri Lankans have waited too long for a government that honours the principle of justice over the expedience of power. If the ruling coalition fails to live by the rule of law, its vision of A Thriving Nation, A Beautiful Life will remain little more than words on a page.

    Splits were there from long before.
    There were socialists who defended imperial powers and wars of conquest. Splits were inevitable, but to handle them well is a matter of cleverness.
    The Palestinian movement had numerous splits. But they did no go on to kill each other, until the discredited PLO refused Hamas its due place in government. Even after, they have patched up in the face of Zionist attack.
    How come that the JVP has gone on to grab the FSL office despite a court order granting it to the FSP?
    The JVP is not a principled left party. It was not for very long. Now it has tasted power and has begun to abuse it.

      It is true that JVP is not a principled political party. But not all the powerful so called left Parties fall into the hands of racism and religious terrorism. They all after 75 years just brought bankruptcy. People gave them 75 years and still they not prepared to change. People have no choice but to choose NPP or JVP. I don’t understand why those who blame JVP or LTTE to ask their all traditional families to change even better alternative rather than continue with the same old tactics to misuse power and misuse buddhism and misuse democracy.

        I can name principled left parties and leaders who stood by their principles, and were disliked by Tamil nationalists
        Honest people will remember them.
        The LSSP and CP, as parties, despite their alliance with the SLFP never indulged in racism.
        Their worst moment was when they opposed the Tamil Language Special Provisions bill in a fit on anger with the FP for making a deal with the UNP in 1965.
        I had never heard of any of them utter anything a fraction as sick as the declaration about “drinking Sinhala blood”.

          You can talk about JVP. But you can also talk about the past rulers at the same time because Past rulers ruled this country more than 75 years. You accept that the major left parties like LSSP and CP but once they joined the past rulers they lost their left name and they have to accept that they were part of racism and religious terrorism. Tamil nationalists had their own political parties. When did this so called leftists were near forming a government? Those few leftist parties never represent more than a few parliamentary seats in the elections.IF JVP can now make a government after they formed only after 1965, Why the so called leftists failed to get the support of the people?

          A former EPDP person called Suppiah Satha today revealed how EPDP murdered many and put the blame on LTTE. He said he will ready to give evidence if a proper investigation.

    Wijeweera operated a chauvinist party within a party in secret when he was in the CP (Pro-China). It came to light when Wijeweera participated in the shameful demonstration by the SLFP-LSSP-CP(pro-Soviet) in 1966 to reject the Tamil Language (Special Provisions) Bill. He was disciplined for it.
    His chauvinist politics had nothing to do with Marxist ideology, and showed itself in 1969-71 but in full form in 1988-89.

    Yakkala, a Peratugami office, was destroyed and its ownership taken by the NPP government using force and physical attacks on anyone present at the time. This was done without following the law.     Despite being a Sri Lankan living overseas, I concur with the party secretary’s statement to the world yesterday that the incident was a well-planned and ruthlessly executed act.
    However, nothing approaching justice measures have been taken for the victims as of yet, even though this terrible incident was reported three days ago.
    It is clear from a number of pieces of evidence that deputy minister Mahinda Jayasinghe was found at that exact incidental location at that exact moment.

    To say I’m disappointed is a gross understatement. I never imagined the NPP would descend into such ugly infighting, especially after people voted en masse to restore faith in the rule of law. Yes, the JVP has a violent past—haven’t they paid dearly for it already? So who’s behind this idiocy, flaunting their wild side just as the public began trusting them to eliminate violence from our society? Isn’t that what the JVP and NPP preach around the clock? Utterly idiotic and disappointing, AKD—this unfolded right under your blinking nose. Unless the culprits are punished, a brick in the wall of public trust will collapse. And that’s a terrible look, especially with scavengers circling, desperate for prey.

            LTTE had its own ships, supply routes, suppliers, ….. and lost nearly 55,000 + countless innocent civilians. Though LTTE supporters claim that the LTTE silenced its arms and wouldn’t say where they keep them we know Sri Lankan armed forces collected most of unburied arms.

            If JVP had no arms why did they start the second armed rising?

              NV, what you mentioned about LTTE’s significant military capacities are correct. The reason for their perishment was solely due to for the strategic decisions by the USA and India to align with SL finally and pass the advanced GPS tech to SL defence forces at the right time that they thought fitted their agenda. Do your own research and you’ll be enlightened 😊. If you’re comparing JVP with LTTE then it is comparing mustards with apples. JVP probably had only a couple of well-functioning T56s, hand grenades and maybe a few AK47s. Otherwise, they would have definitely done their version of Punarin or Elephant Pass! JVP tactics were limited to a couple of successful hit-and-run operations, which collapsed after DM Ananda was captured and when he spilled the beans that led to end the saga for six of its top leaders.
              As for your take on Rohana Wijeweera, I never dispute that. He was a narcissistic figure with deep malice. Personally, I never supported him or the violent JVP insurgency of the late ’80s. My support for NPP stems mainly from their commitment to fight our national pastime – corruption! Needless to mention that I value AKD’s clear departure from Wijeweera’s destructive legacy and NPP commitment to progressive, socially democratic policies that prioritize economic and social well-being.

              I believe that many intelligent people lost their minds because they could no longer handle the repression that has begun to happen under NPP leadership today. I’m not exaggerating, but the brutal incident that followed says it all.

              My careful research indicates that they have not changed their prior criminal activities even after they entered the democratic process and assumed power.
              To suppress the others, they might embrace that way of thinking. The way they behaved during their breakaway party last week and when they took over their party office in YAKKALA was exactly what the JVP should do.

              Despite their criticism and attacks on individuals over 80, their behaviour was unacceptable, despite their apparent disregard for democratic methods. However, the government hasn’t yet called for a thorough investigation because they explicitly state that Peratugami members weren’t physically attacked, which is by far the biggest fabrication regarding the incident.

            Thank you for your feedback; it will please more “green thumb” fans.
            However, I have the patience to observe that my predictions will come true soon.To see the big picture, I believe you need a lot more time. Like OC and HUMANTOUCH, I am patient. As you are aware, I love jazz and I’m naturally thoughtful. Your “over the top” remark this time significantly altered my initial assessment of you. Everyone is aware of my strong antipathy toward the Rajapakshes-led SLPP. My close confidants have recently asked why “Jit” and similar behaviour are caught by other bashers at the same speed. I was unable to speak, but I knew why.
            Before 89-92 barbarians were elected to power, the alternative was promptly explained to commenters. However, none of the commenters took it seriously. Furthermore, I do not belong to the group of critics who frequently combine it with improper attention to the facts.
            My suggestion was that rather than having well-known “L-board” politicians crowned needlessly, a small island nation should be able to succeed with an interior commission that represents the major parties, as Germany did after the war. And each party, in my opinion, has gifted politicians who can resolve the issues at this crucial point.

              LM, I wanted to express my disappointment about most of the comments you made in the past but kept for myself because it is your freedom of expression. However, when you said that “… and others like him, in my opinion, cannot be cured…” I wanted to respond.
              What I simply want to tell you is, I like that hard working educated person with advanced academic qualifications in highly prestigious field of medicine serving thousands of humans. And the one with good taste of music and a good rationalist. What I don’t like is the person that doesn’t do any research, explore or brutally attack others in social media. What I cannot fathom is, how such a person keep posting comments full of third party clips, no verification, some utter junk by vested interests. And attack those who don’t agree with your version of the current government!
              You have every right to write what you think. But keep it civil, tolerable and provable. If you want to attack someone, then by all means be satirical!         Marxist parties emphasize discipline and correcting mistakes.
        Members go through almost ritualistic self criticism after serious mistakes.
        A party that blundered twice to lose thousands of its members and supporters but never admitted to the blunder cannot be a reliable left political force. Worse were opportunistic acts since 1994 that led to the three-way split in the JVP and its loss of credibility among voters.
        The electoral strength of the JVP in 2024 lay in the pathetic plight of the UNP and SLFP and their more successful offshoots.
        The JVP cannot divert attention from core issues for long. It has already failed to act on serious pledges and the only pledge that it seems to fulfl to entertain its supporters is a hora-police game. But when people notice horu among the police the game will cease to amuse.

          The only good thing to come out of a Marxist enterprise is high-quality education, at least in the STEM area. Ironically, that might have to do with lack of “freedom of stupidity” (called “freedom of expression” in the West), which doesn’t exist in Marxist countries. If you are stupid, they will send you away to some camp, as the CCP does with political dissenters and especially Uyghurs. Those in STEM areas don’t need “freedom of stupidity” for their work. As far as I know, a dictator has never shown much interest in real numbers.
          Now some idiot will say why doesn’t the JVP make Nobel Prize winners out of Sri Lankans… because the statement describes the general case , not every case. I have no such expectations for the NPP.

        Just the idea that everyone under his leadership should be treated equally under the law is currently being broken by AKD leadership. Despite their gullible behaviour, people are now realizing that his government has not implemented any of his policies in the ten months since taking office.
        When there are thousands of other serious problems that require the government’s attention to be resolved, I question why in the world his visit to Kachchathiev Island was so important.
        What has AKD been doing as head of state today, making flimsy excuses for not taking part his government to the ongoing Beijing Summit when all other leaders waited for the opportunity?

    Even if some bad or unethical things happen among many good things, we must wait for the full story. Just like when one step is broken, there are still other steps that can help us reach the goal. This doesn’t mean the past is the present—NPP has already said they are not magicians, but if something unethical happens, it will be corrected It muat be noted what what secrete involment that Yakkala, a Peratugami office was to not who did who attacked.

    Leaders in general should be able to act quickly without compromising the nations’ role during such times. For this reason, leaders need knowledgeable advisors by their sides. Unfortunately, our nation is more backward now than it has ever been. Following his state visits, AKD has not brought much from any of the countries, and not a single foreign visit has been deemed mature enough. I recall how some international allies spoke well of former President RW after his state visits.
    While AKD is accused of being caught by India by signing some bilateral agreements that his government is still keeping secret, previous leaders, including MS, have reported some sort of positive outcome from each of their visits.

      It has now been established that a government needs a certain number of ministers to function, but incumbent governments that are limited to 25 ministries have been in a stagnant state for the past 12 months.
      In addition to Rajapakshe politics, JVP catalysts may have made society worse by opposing other opponents. JVP: Subjective arguments against viewpoints have squandered decades of valuable human time.

      I had many disagreements with my Indian colleagues regarding their pejorative use of the term “Allopathy” for Western Medicine. “In the early 1800s a schism developed between medical practitioners who espoused the beliefs of Joseph Hahnemann, the inventor of homeo­pathy”
      Homeopathy is Juju Magic Medicine. “It was Hahnemann himself who coined the term allopath”.
      So for you “Astrology” is merely “research in a non Western mode”?
      My Indian Colleagues ran away with their tails (or should that be tales) between their legs, when Turmeric did not prevent Covid19 deaths in India.

    I wonder if not for the local saffron clad recruiting agents was it be possible for Fonseka/Gota to recruit 200000 village boys in a short period of time? At that time the economic condition and employment opportunities also were conducive for large recruitment.
    Patriotism not really.

    Most patriots opted for civilian clothe or dressed in saffron garments and not in Army uniform, for example Dinesh, Gamanpilla, Champika, Somawansa, Weerawansa, Dyan, ….. Ferdinando, Malinda Seneviratne, Palitha, ……. .
