34th Session Of UNHRC: FM Mangala Samaraweera’s Speech – Full Text

Excellencies

Distinguished Delegates

Ladies and Gentlemen

It is an honour for me to be here today at the 34th Session of the UN Human Rights Council which I believe has the highest number of dignitaries in attendance.

I stand here today at a time when the very basis and fundamentals of human rights are being questioned around the world. Many of the universal values that we subscribe to are being challenged in the name of ‘populism’, with populists spinning webs from threads of ignorance. The role of this Organisation, in this context, is becoming more important than ever.

Mr. President,

This Council is familiar with Sri Lanka’s story. After years of denial, disengagement, and self-isolation, the National Unity Government of President Maithripala Sirisena and Prime Minister Ranil Wickremesinghe, proceeded to set our country on a transformative trajectory in terms of human rights, good governance, rule of law, justice, reconciliation and economic development.

The people of our country voted in large numbers granting a resounding victory to President Sirisena at the election in January 2015. The voter turnout was the highest recorded for any Presidential candidate, and in the North and the East, President Sirisena’s share of the vote was also the highest ever as people placed their trust in President Sirisena who they believe will not short change them as in the past. Therefore, we not only owe the people who voted for us 2 years ago, but also to history to uphold that trust, and we are committed to do so.

Mr. President,

It is with this firm conviction, that soon after the August 2015 Parliamentary Election, we co-sponsored Resolution 30/1 titled ‘Promoting Reconciliation and Accountability in Sri Lanka’, which was adopted unanimously by this Council, on the 1st of October 2015.

I speak today, just over a year, or 15 months since Sri Lanka took the historic step of co-sponsoring Resolution 30/1. Many in our country criticised and continue to criticise us for this step. Some even see this as an act of treachery and betrayal of the nation. We have a simple message for them, as we journey towards 2018, our 70th year as an Independent Nation:

The Sinhalese, the Tamils, the Muslims, the Burghers, those of different faiths and beliefs, across gender, caste and creed, that constitute our country, worked together to gain Independence for our nation in 1948. That achieved, we failed to forge the perfect nation of individuals who all hold equal rights, working as one to achieve the heights our nation could attain. As a result, for 69 long years, we journeyed through pain, violence, loss of life and precious human resources, ruining chances of socio economic progress. This was clearly an experiment in nation building that failed, which is certainly not worth pursuing further. We must have the courage to acknowledge that truth, and that era must now end. The Sri Lanka that we seek to build here onwards, should be one where justice reigns; where human rights are valued; where every individual’s dignity is upheld; and where civil society and the media play their due role; a society that believes in the importance of the independence of the judiciary, and the rule of law; and where everyone has equal rights.

Mr. President,

As we move forward in this journey, the forces of extremism and regression on both sides of the divide are creating road blocks for narrow, short-term political gain. While stubbornly refusing to acknowledge any of the far-reaching gains we have made in the last 2 years, they argue that we have either done too much or too little. I would, in this backdrop, like to say that the recommendation of the GSP+ concessions from Brussels, and MCC compact assistance from USA were announced recently, in recognition of the progress made in Sri Lanka in the last two years, and we await their formal approval in the coming months.

Mr. President,

Since I last addressed this Council, on the 29th of June 2016,

  • legislation to give effect to the International Convention for the Protection of All Persons from Enforced Disappearance was approved by the Cabinet of Ministers, and published in the Government Gazette, and is expected to be tabled in Parliament shortly;
  • the formulation of the Policy and Legal Framework of the proposed Counter Terrorism Act has progressed in keeping with accepted international practices;
  • Sri Lanka’s Parliament has enacted legislation to establish a Permanent Office on Missing Persons. The Act that has been certified by the Speaker of Parliament, is now the law of the land, and awaits the assignment of the subject to the Prime Minister, by the President, for its operationalisation. The budget for the year 2017 has, in the interim, allocated over a billion Rupees for this Office.
  • a National Policy on Durable Solutions for Conflict-affected Displacement was approved by the Cabinet of Ministers;
  • the Registration of Deaths (Temporary Provisions) Act No 19 of 2010 was amended by Parliament, and the issuance of Certificates of Absence was enabled;
  • the UN Secretary-General at the time, Mr. Ban Ki-moon, and the Special Rapporteur on Minority Issues visited the country, at the invitation of the Government;
  • the List of Designated Persons under Regulation 4(7) of the UN Regulation No. 1 of 2012 was further amended;
  • Sri Lanka’s periodic reports were considered by the Committee on Migrant Workers, the Committee on the Elimination of Racial Discrimination, the Committee Against Torture, and the Committee on the Elimination of Discrimination Against Women;
  • the Reports of the 6 Sub Committees of the Steering Committee tasked with deliberating and submitting reports on fundamental rights; judiciary; law and order; public finance; public service; and centre-periphery relations; have been completed, and handed over to the Constitutional Assembly;
  • the National Human Rights Action Plan for the period 2017-2021, evolved through a wide consultative process, was approved by the Cabinet of Ministers;
  • the Right to Information Act was brought into force on the 3rd of February this year;
  • 11,253 houses were handed over during 2016 to the internally displaced; and Rs. 4,785 million has been allocated for 5,732 houses for the internally displaced for 2017;
  • the Rehabilitation of Persons, Properties and Industries Authority (REPPIA) payments for beneficiaries in 2016 amounted to Rs. 605,809,359.00; and Rs. 574,000,000.00 has been allocated for 2017;
  • 5,515.98 acres of state land and 2,090.03 acres of private land were released in 2016; and 1,383.51 acres of state land and 30.54 acres of private land were released last month, in January 2017;
  • the first ever National Integration and Reconciliation Week was observed from 8th to 14th January 2017, with all public officials as well as school children taking a pledge, resolving to work together, hand in hand, respecting the richness of our diversity, to foster peace, understanding, and mutual trust, for a new Sri Lanka that is united in its diversity;

Mr. President,

Another important undertaking that was successfully concluded during this period, is public consultations carried out by the Consultation Task Force on Reconciliation Mechanisms, the first of this nature carried out in the country. Over 7000 written submissions were received from persons from all walks of life, many of them victims of human rights violations who came forward to give their views. The Report of the Task Force is presently being studied in the context of designing the relevant Mechanisms for Truth-seeking, Reparations, Justice, and other reconciliation processes.

We expect the draft legislation on the Truth-Seeking Commission to be presented to the Cabinet of Ministers within the next two months. Our resolve to bring justice to the victims of human rights violations remains firm.

While taking the allegations of widespread torture seriously, the Government has a zero-tolerance policy towards torture. Although the National Human Rights Commission has recently indicated to us that there is a downward spiral of incidents, even one incident of torture is one too many. The Human Rights Commission of Sri Lanka, the Police Commission, the Ministry of Law & Order and other relevant agencies are working together to prevent and combat torture. As in many other areas, this too is an area in which we require technical assistance, and I hope that countries with experience in this area will come to our assistance.

Mr. President,

The Constitution drafting process is for us both central and essential not only for democratisation, but also for ensuring non-recurrence of conflict. As this Council is aware, the Parliament of Sri Lanka, in April 2016, unanimously adopted a Resolution to prepare a draft Constitutional Bill for the consideration of Parliament. As we approach the 70th year of our nation’s Independence, we seek, for the first time in our country’s modern history, to engage in this process wholeheartedly as an exercise that would unite our people who have been divided for far too long. The Parliamentary process and referendum are for us, imperative. We want to ensure that this Constitution, the 3rd Republican Constitution, unlike those before, that did not involve consensual and consultative processes, would reflect the true aspirations of our people. An exercise where, after years of conflict, the executive, legislature and sovereign – that is the people of our country – will unite to define and chart our nation’s future, guaranteeing equal rights, justice, and dignity for all citizens, honouring the multi-ethnic, multi-religious, multi-lingual character of our nation, upholding the right of citizens to participate more fully in decisions that impact their lives, and guaranteeing non-recurrence of conflict.

Mr. President,

The journey we have undertaken, arising from our commitments to our people and the mandates received at elections, is challenging. This may be a journey strewn with both success as well as some setbacks. In the face of roadblocks and other obstacles in the day to day world of realpolitik, there may have to be detours from time to time, but the destination will remain the same. Our resolve to see the transitional justice process through has not diminished. With the help of all our citizens in all walks of life, our friends and partners in the international community, and Sri Lankans overseas; with patience, understanding, and constant and consistent effort and perseverance; we strongly believe that we can make the reconciliation process a success, and establish a progressive and united society, working in harmony to take our nation towards new heights of socio-economic development. We believe that we can make Sri Lanka a shining example of a country that is prosperous, united in its diversity, upholding human rights, justice, and the rule of law.

        You got to understand that the current govt is a highbred of the elected party and a good portion of the corrupted politicians of the last govt that includes the current president.

        A real investigation will make the country ungovernable as most from Diyanawa will be taking up residence at Walikada. When facts come out “I saw nothing, heard nothing, did nothing” will not cut it. This is what the current president has implied during the last two years.

      Tell them that Rome was not built in a Day and Nero destroyed it, and had to be rebuilt.

      Tell them that Sri Lanka, the Land of Native Veddah Aethho, was not built in a Day and Mahinda Rajapaksa and cronies, destroyed it, and had to be rebuilt by the National Unity Government.

      Mahinda Rajapaksa and cronies legacy is a song and “training” for many of the current caretakers as to how to fleece the populace..Many of the crooks and criminals are still at large, including those who committed war crimes.

    The same speech with a few modifications will be made on the 36th/37th/38th sessions of the UNHRC,until every one gets tired of the whole saga and consequently will not be bothered to raise any issues with Srilanka.

    This is why the French Statesman Henry Queville famously remarked….

    Isn’t this song only too familiar that we have heard too often? Let us ponder the sequence of events?

    First gleefully co-sponsor the UNHRC resolution. Truth be told, even the Tamils were taken back at the “sincerity” and “honesty” at last coming from a SL govt/regime.

    Then the usual slideshow starts – that there wouldn’t be any foreign participation in the process even though that was exactly what was agreed when co-sponsoring the resolution.

    Back to the slime game – there won’t be any investigation even locally on the army because all of them were/are angels who never lifted their finger to harm any civilians. They only committed mercy-killing, so it looks like. This coming from no less than the President and Prime Minister. Not only this smacked of gross and indecent racism but there is not even one leader in that country with a backbone. Expecting to trust such a spineless regime is to say that the sun will suddenly rise in the west.

    Of course, shame to a liar is a scarce commodity but expecting the affected victims to believe that there can be hope is really foolhardy.

    By the way, what is this story that there are extremists who believe that too little has been forthcoming? Report after report from a number of world bodies have taken the SL regime to task. Torture still happens, rapes and women sex slavery is still around, a lot of private lands are still held by the army, the army is the business in the North. Although no one seems to know when there will be finality for all these, if there is one, the sense on the ground does not seem inspiring. Talking about all those laws and legislation is meaningless for these people unless you believe you can feed them with the papers on which these alleged changes/progress have been written on.

    The fact of the matter is, who really cares about all these committees and bodies anymore as if these have been in short-supply in SL? Do you think these people still believe all those crap after close to 70 years of being taken for a ride. Show real tangible results Mangala. That is what matters now. You need not have to sweat so much straining yourself to show good light on your govt if you or or your govt had done what you promised to this world body. What you say now will only appear as lies with no conviction to mean what you say. And all these road blocks are lame excuses to cover your unwillingness to honour what you say.

    You know what is the “secret” mantra? Whether one really is honest and has the will to do what this broken country needs? When people like you Maithiri, Ranil, the Rajapakses are thinking of only the next election and with daggers at each others throats, what remains then are only spineless and greedy creatures. Looks like even God has given up on Sri Lanka.

      You could be one of them or your uncle, father, grandfather, son, brother, brother in law, son in law, neighbour, grandson, friend, ….

      However I am yet to see studies relating to the effectiveness and efficiency of various home grown techniques adapted and invented by the elites.

          How long can you go on killing and brutalising people before they attempt to hit back, the rise of the LTTE was the hitting back part. Of course rarely does a non-state actor beat a state in the act of violence. The state has far more violent tools in hand than a non-state actor. But the underlying issues that gave rise to the LTTE still remains.

    He says that vast tracts of land were ‘handed over’.
    He did not say why the armed forces occupied them against the wishes of the owners, and kept them in military custody for years.
    And, that the Air force is even now occupying vast tracts and have forced those who lived there out, and even now that this continues though the owners are protesting for many weeks.
    He does not say that the military is cultivating peoples’ lands using ‘slave labour’ under threat,
    and, that military has taken over businesses, fisheries by force – and denied livelihoods including fishing by those living in the north.

    In short, he has not divulged the military regime in the north and east.

    No body is amused at this performance. The speech can be summarised as :
    1) Glorification of the present Government and the International Community
    2) What was done so far, whether they are relevant to the UNHCR or not.
    3) What is to be done, whether they are relevant to the UNHCR or not.

    The question if the UNHCR is real and wishes to raise is to what extent has Sri Lanka fulfilled the mighty big co-sponsored resolution. The present Government personnel while in opposition accused Jarapassa of playing double games with the International Community. What is it being done now?

    Mangala’s speech is not that of the UNHRC. And what is there to be disappointed with Mangala’s speech. As if this is something new. What you should be more concerned though is how the two Sinhalese camps are going for each others throats. Shameful isn’t it – what more a so-called Buddhist country. I understand that donkey’s are very good in resolving disputes among donkeys and your services will be put to better use.

    By the way, you are dancing for what? Shameful that the Sinhalese can’t even manage a country that so many are poking their noses into the country and donkeys like you can’t even lift a finger. In short, SL is just a door-mat.

    Recently CT had brought a speech of Hon. OL R.Sampanthan, (Sampanthar), at parliament during an adjournment proceeding, tilted The Whole Country Must Know The Truth. We do not have to repeat the points in that speech. While Sampanthar indicating that Tamils have lost faith in Yahapalanaya government, he explicitly asked the government to be sincere and honest for its words : ” it is absolutely essential that these processes be taken forward in a genuine and purposeful manner, so as to ensure permanent peace with justice and equality to all citizens.”

    There was a speech by Hon. FM Mangala Samaraweera (Mangala) answering to first speech. It was purposefully made in English, to reduce Sampanthar’s speech’s effectiveness outside of Lankawe. CT had brought that too, titled Enough Is Enough: We Have A Long List Of Unresolved Cases. It is important to note the title of the second speech where Mangala has accepted the amount of the unsolved problems.
    In total of these two speeches is: the Tamils’ current position was conveyed by Sampanthar to the entire Lankawe and Mangala had accepted of no progress so that the whole world can know Mangala’s government was working with TNA.

    We have seen many similarities between Chitanta government and the Yahapalanaya government. In the past, Old Brother Prince used to call the Tamils as LTTEyers. Mangala is calling the entire Tamils as extremists. Sampanthar, who officially represents 80% of the North-East and impliedly many more outside, has said there was no progress. Mangala accused Sampanthar like Tamils extremists “ sides of the divide are creating roadblocks for narrow, short-term political gain. While stubbornly refusing to acknowledge any of the far-reaching gains we have made in the last 2 years, they argue that we have either done too much or too little.”

    After two years of Mangala’s government coming to power, there is no legislation to improve the Tamil- Hindu-Christians rights has been enacted.

    In Eastern province where TNA has won the election, Mangala’s government has forced it to third place so that the Muslim-Sinhala Government can urgently finish colonization and take it permanently from TNA. The North and East Governors have been openly active against the CMs during the last two years. Mangala’s government has refused to implement 30years old 13A as a jester.

    In that condition, Mangala has listed 15 bullets as government’s achievement on the implementation of resolution 30/1. The comic is he has listed this as the 6th achievement on implementing the resolution:
    “the UN Secretary-General at the time, Mr. Ban Ki-moon, and the Special Rapporteur on Minority Issues visited the country, at the invitation of the Government;” This is clearly indicating that Government has been spending time and money on buying the UN and UNHRC official to cheat the implementation.

    Further, the visited officials have not cleared Mangala’s cheating or lying. Many of 15 points are not relevant to the resolution. The rest are mainly at Ministry level. There is nothing related to the resolution 30/1 in any progress.

    GSP+ commission wanted Mangala’s government to implement all 58 agreements that it has consented to UN. Mangala Government watered it down to 11. Mangala’s Government is not going implement 47 of them. But EU has not confirmed the remaining 11 are fulfilled. It has to yet make a decision on it. In the last UN meeting at New York, Ex. State secretary John Kerry had accused part of SLFP had blocked the resolution implementation. Without reviewing those words, Obama government approved MCC money for political reason. But Trump’s administration has not confirmed that fund.

Because of the matters in that report, EP refused to accept in many of the attempts by the commission to give it to him. At the end, the commission handed it over it to CBK. She accused the commission of having violated the terms of references and commented the report was wrong. She further went ahead and talked against implementing the resolution 30/1 and insisted a constitutional change is enough.     As this Council is aware, the Parliament of Sri Lanka, in April 2016, unanimously adopted a Resolution to prepare a draft Constitutional Bill for the consideration of Parliament. This constitutional making is the biggest fraud in the world ever happened in political negotiations. This is worse than the earlier two, in the real nature, though Tamil MPs are allowed to give their suggestion too. The 6A of the 1978 constitution is violating Tamils’ rights on asking for a solution. This was not present in the previous two occasions. 1976 Vaddukoddai convention is about self-determination. TNA’s 2013 election manifesto stated for internal self-determination. This is being legally challenged by Southern Sinhala activist like they did in 13A’s North East-Merger. In due course TNA’s 2013 victory can be declared void. The Tamils’ representatives are practically kidnapped, held in the name of the “Last Opportunity to Tamils accept the Sinhala Chauvinism” to extract what the government want them to say rather than consulting with the Tamil community.

        Doctor has Gut. Isn’t it why Mangala sought gurukula vasam under the PhD Doctor? Isn’t Mangala had shown in this speech who his guru is?
        Doctor has gut so mouthed it out with his tongue. But not surprisingly, Double Doctor has those in double the numbers. So one of his tongues turns out Tamil (like 13A Plus) in the North and the other one Sinhala in the South, Colombo Pong Cing for China.

        But still what is the use? Isn’t while Doctor leads the Yahapalanaya, Double Doctor is leading the Joint Comedy Club?
        When Doctor was forming the government, most of the SLFPyers went with Double Doctor. Same way, when Double doctor was forming the government, most of the UNPyers went with Double doctor. I don’t see any change here to get alarmed by any guts. So, for your peace of mind, let me guarantee that nothing different than Banda-Chelva pact, Dudley-Chelva Pact, Indian Accord, 1972 Constitution or 1978 constitution can happen here.

        The Wahhabi on Yahapalanaya’s bed is not a concern for Tamils. Wahhabi, like Panchali, she just goes with whomever in the house on that night, but doesn’t herself bring anybody to house. So not Panchali, but Sinhala Mahajan decides who gets the bed and Panchali sleep with him. Further that is from MMDA- Indian Pakistani Citizenship act time. In that aspect either, nothing is changing for this occasion.

        Only change here is what Vella Sampanthan did, thinking he was stealing the secret solution. FP, TULF, TNA never slept with Colombo, unlike Wahhabi Panchali. Vella Sampanthan slept with CC on 2015 election. No Tamil leader ever gave assent to Colombo to make a constitution for Tamils. But Vella Sampanthan got the gut, but no mouth or tongue to firmly ask what went wrong with the promises of CC.

    It must be highly embarrassing for Minister Samaraweera to ask for patience and time, from the international community time and time again. Much as his speech is commendable, and much as he is now becoming the best FM we have had in many decades, I have not the least doubt that both the President and the Prime Minister are undermining all what this man says and promises, through irresponsible statements uttered to satisfy the howling and ignorant masses here.

    It is a shame that 8 years after the war, we still talk of the effects of war and ask for more time. Indeed this is a very ancient country. That must be the reason why we move at a snail’s pace if at all and nobody seems to be responsible for anything.

    If politicians cant make decisions and implement them, they should then quit politics.
