After Geneva Resolution: What Next?

The adoption of the UNHRC resolution against Sri Lanka is a setback not only to the government but also to the country and the people. It is however not the end of the world. The government as the elected authority by the people should now seriously think about the effectiveness of their foreign policies, foreign relations and perhaps personnel who are handling these crucial matters.

Defeating the resolution undoubtedly was a difficult task, among other factors, given the last government was completely following an opposite policy. Who was correct may be a debatable matter for some, but not for all or the majority. If Sri Lanka had a better profile among the OIC countries and a counter strategy for ‘reconciliation and accountability’ along with preventing terrorism, defeating the resolution could have been feasible. 

Motives Behind?

The recent statement by Mangala Samaraweera that resolution 30/1 in 2015 was not only something co-sponsored by his government but in fact drafted by Ranil Wickramasinghe and a group is quite a revelation. Why did Samaraweera wait for such a long time to reveal the truth is the question?

Whatever the different nuances or tactics between governments, foreign policy should be a common endeavor that all governments should adhere to. National interest is the primary concern of any foreign policy, political, economic, or other. The ball is now with the present government to build that consensus with the main opposition, as Wickremesinghe and his UNP are now categorically defeated.

During the campaign for the resolution against Sri Lanka the last government’s position was a major trump card in the hands of the UK and the US to win over around 14 countries other than their own Western countries. It was primarily a campaign against the present government on political and on other grounds. As a report by the Universal Rights Group stated,[1] 

Two country situations in particular dominated the Council’s attention during its 46th session: Myanmar following February’s coup d’etat, and Sri Lanka following the return to power of the Rajapaksa family. At the end of the session resolutions on both situations (the former led by the EU and the latter by the UK) were adopted, by vote in the case of Sri Lanka (22-11-14) – the first time a vote has been called since 2014, and by consensus in the case of Myanmar (though many LMG States disassociated from the text).” (My emphasis).

The report was equating the election of Rajapaksa leadership to coup d’etat in Myanmar! It is very clear that motive behind the resolution was political, against an elected government whatever its main composition. This was also very clear from the High Commissioner’s report on Sri Lanka that paved the way for the resolution. They were angry with the government as it was not subservient to the international forces. One may agree or disagree with the government, but it was overwhelmingly elected by the people. It is still not known how far Ranil Wickramasinghe and his followers campaigned for the resolution. We may have to wait for Mangala to reveal it later! The politics of these people apparently are so treacherous to the country. 

Legality of the Resolution?

There are people who wonder whether the recent UNHRC resolution is legally binding on the country or not? On this count, some have been even criticizing some Ministers on their statements. I have looked for authoritative statement from the OHCHR itself, but unfortunately clear procedures are not explained in their website for some (dubious!) reason. The best I could quote is from “The Human Rights Council: A Practical Guide” from the Swiss Mission in Geneva as follows under ‘HRC Resolutions.’[2]

“HRC resolutions are the political expression of the views of its members, or a majority of its members, on specific human rights issues and problems that are of particular concern to the international community. They are sometimes also used to recognise the existence of certain ‘soft law’ principles (cf. e.g. Declaration on Human Rights Education and Training, annexed to res. A/HRC/RES/16/1). Regardless of their content, HRC resolutions are not legally binding.” 

The emphasis in bold in the above paragraph is not mine. They were there in the Guide. According to this authoritative guide, (1) HRC resolutions are political expressions of member countries, of course on human rights issues, thematically or on country situations. Therefore, it is a political task for countries through diplomatic means to canvass and bring support for their positions. (2) Except in the case when the HRC approves UN General Assembly’s ‘soft laws,’ the HRC resolutions are not legally binding on member states or the target countries. However, the High Commissioner and the Office are legally binding in implementing them.

In May 2009, Sri Lanka successfully managed to obtain 29 out of 47 votes for its own resolution at the UNHRC when a UK lead group was planning to bring a resolution against the country. That was the success of diplomacy of the country that time. Of course, when such a resolution is proposed, the incumbent country has a duty to implement it. It is something that you do positively, and not negatively. Not as a tactic but as a commitment.

After that resolution, there were no resolutions on Sri Lanka until 2012. Thereafter it was a period of tumble down for the country particularly in diplomatic terms ending in Ranil and the group proposing something completely disastrous to the country. Under the circumstances, Sri Lanka’s defeat at the last occasion is not a surprise. Most of the independent countries were puzzled because of the zigzags of different governments.

It is doubtful whether the Ranil Resolution in 2015 was proposed with a genuine effort for reconciliation or accountability. It must have been done as a tactic. This is also clear from Mangala Samaraweera’s statement. The purpose appeared to be to satisfy the Western countries (the US and UK) and not necessarily the Tamil community or the victims although the TNA also supported that effort.

Although Sri Lanka is not legally binding on the HRC resolution, there are political imperatives and customary practices that the country may have to follow. As the first struggle is over (with a setback of course), the country may have to use different tactics. More than being tactical, Sri Lanka can be straight forward and true to its beliefs. It should restart good relations with all countries irrespective of how they voted or behaved at the HRC, including the UK, USA, and the EU.

Although Sri Lanka is not legally binding on the HRC resolution, the High Commissioner and her Office are legally binding. Therefore, they may have to soon start fact finding and even visits to Sri Lanka. A Budget of $ 2.8million is indicated for this task. Although I said in my last article that Sri Lanka should not allow anyone from the Office to visit Sri Lanka that could be handled tactfully and cautiously.

Conclusion

The most important is to be true to Sri Lanka’s beliefs and interests. This is political realism. Although some foreign countries and Tamil diaspora believe that accountability is the priority matter, Sri Lanka believes reconciliation is the most important. Some are even asking for the ‘pound of flesh.’ This is all after supporting LTTE terrorism unashamedly. No sustainable accountability or reconciliation is possible without allowing the government of Sri Lanka to protect national security, prevent terrorism and develop the country. These should have been included in a true resolution in ‘promoting reconciliation, accountability, and human rights’ in the country.

On the question of accountability, there is another difference. Sri Lanka has shown that the country is ready to ‘forgive and forget’ most of the past atrocities of the LTTE for the sake of the future of all communities if the perpetrators genuinely repent. This may even apply to Adele Balasingham. At the same time, it is not ready to punish the military leaders who must have made mistakes in their judgements or directives. This has nothing to do with any actual or factual crimes committed by anyone in the field. The government should be ready or cannot prevent even today anyone filing such cases in the Supreme Court or before in the High Courts. Instead, going behind foreign jurisdictions cannot be acceptable for the great majority of the people.   

Even at this stage of great controversy, there is a possibility of the government, preferably with the agreement of the opposition, making a statement to all member countries of the UN on something like “Prevention of Terrorism and Promotion of Reconciliation, Accountability and Human Rights.” This should have been done even in the 2009 resolution that Sri Lanka initiated. It should be made clear to the international community that without measures for the prevention of terrorism through national security, sustainable reconciliation and accountability cannot be achieved. It should also be made clear that in Sri Lanka’s view human rights should go along with promoting human duties and responsibilities.

    As a Buddhist Sinhala Fundamentalist, we cannot expect anything different from you from other fundamentalists. Whether it is UNHRC resolution is legally binding or not there is a necessity understand the fundamental behind the Buddhist Sinhala Fundamentalism which is practiced using the opportunity given by UK to Buddhist Sinhala Fundamentalists. You try to justify the crimes against humanity against Tamils by just a word called “LTTE terrorism” which was introduced by USA and UK as a weapon against the so called Islamic Terrorism. LTTE was branded as a terrorist organisation not by Sri Lanka but by USA and UK. LTTE youths are a liberation army from the parents of Sri Lankan Tamils, not from Indian or any other Tamils because of continued violence, massacre and genocide. They never bombed schools or hospitals unlike Buddhist Fundamentalist military. They never burnt libraries, They never raped Sinhalese girls.
    You accuse that Tamil speaking people not belongs to this country. What a human being?

      As usual trying to become saints by putting the blame on Sinhala Buddhist Fundamentalists.
      Sinhala Buddhists who accommodated Dravidians brought to Sinhale by colonial rulers and abandoned in this country had no reason to attack or kill Tamils. It was Malabar Vellala Tamils who started killing Sinhalayo after Sinhalayo gained independence and introduced some changes as a free nation. First major attack of Sinhalayo took place in Yapanaya after the Government changed the English letters in car number plates to a Sinhala letter. What a dumb reason to attack the people of the host nation. After that in all the instances of conflicts between Sinhalayo and Tamils, Tamils attacked Sinhalayo first.
      Worst situation started after Malabar Vellala Tamil politicians passed the Vaddukkodei Resolution to create a separate State and asked Tamils to take up arms and fight until their objective is achieved leading to the creation of the Tamil terrorist outfit LTTE that massacred Sinhala men, women, children and even unborn babies using suicide bombers, claymore bombs, AK47s and chemical weapons for three decades.

      Laksiri, your conclusions prove that you are nothing but a Sinhala racist. It is possible to forgive and forget only when truth is admitted and justice is meted out to the victims. Ii is empty rhetoric when in Sri Lanka truth is not forthcoming and justice is being denied. How can you achieve reconciliation when majority of Sinhalese believe that there is no ethnic problem and their interest lies on keeping Tamils subdued both politically and economically. This is the political realism in Sri Lanka which fair minded international community has understood and want it rectified so that there will not be any repetition of the past. When you say prevention of terrorism, it should include state terrorism where Tamils should have the power to prevent it. Not only the security of the country, security of Tamils is as paramount. your asking Tamils to file cases of war crimes in SL supreme court is hollow as Tamils do not have any confidence in SL legal system.

        Only Rogue states have voted with Sri Lanka. Remember India has given a chance to reform and if it is not forthcoming, India will present the next resolution which will be harsh. If any attempt to refuse entry or place hurdles for their work after entering, consequences will be disastrous. UNHRC wants three matters addressed. Of which all Sinhala parties are united in protecting war criminals and sabotaging reconciliation based on truth and justice. It is only in human rights that opposition parties have concerns, that too they are prepared to turn a blind eye to human rights violation on minorities. With this set up, confrontation course with UNHCR is inevitable. India has deliberately included 13th amendment in the draft and has got it approved, to lay the foundation for future intervention. If you do not comply, expect further set back, reducing Sri Lanka to pariah status.

        I have lost count of your Mutually Assured Destruction (MAD).
        The question you should ask yourself is “why haven’t the state charged gun runner KP and mass murderer Karuna/Pillayan?”

        Why hasn’t the state charged those who supplied arms, medicine, funds, …. to VP and LTTE during Premadasa presidency?

        Why hasn’t the state charged those who bribed LTTE/VP to rig the 2005 presidential elections? Where did they get the from? They should be charged for not only funding terrorism but for money laundering as well.

        Why isn’t the state demanding deportation of Adele Balasingam from UK? Is there any deal exist between the clan and UK?

      Yes, Laksiri is correct. But why is Laksiri so dense that he can’t see where Sri Lanka’s interests lie? Russia an China are not going to buy our exports. Those are taken by the EU,. UK, and USA. Already , in case Laksiri in his comfortable Aussie hide- out doesn’t know, there are shortages of everything from cooking oil to turmeric, due to the govt cutting imports. Bandula Gunawardana tells us to use soya oil for cooking. This is like Marie Antoinette telling people to eat cake if there is no bread!
      The solution is to give up the village chandiya approach, recognise that there are indeed problems, and, most of all, stop treating people differently according to their ethnicity or religion. Of course the West doesn’t like the Rajapaksas. It is the Rajapaksas that have to change. Is that so difficult to understand?

Now whom to believe – You based in Australia OR our own Minister of Foreign Affairs? I await an answer. In your essay, the facts presented in relation to the resolution are pertaining only to past HR violations and accountability issues arising from the civil war with LTTE. Is that all this resolution is about? I find, there are numerous references in HR violations attributed to this Government’s activities after assuming the Governing functions in Nov. 2019. Didn’t you find any ONE at least of such instances? Did you avoid mentioning such instances due to your “obligatory” beliefs or that would have made your essay too lengthy? Or could be both?. In another line, you say: ” The Government should be ready or cannot prevent even today anyone filing cases in SC or HC”. Do you really trust that such cases would receive serious attention and consideration under the present set up of these courts? You, being far off our seas would not have seen how this President, “GR” “Pardoned” and “Released” an Army Personnel who was Convicted” for “Murder” of persons who were under the “Army’s custody”. You might “Argue” that “Pardoning” is a preservation of the “Convicted Murderer’s” HR – the “Right to Live”.

    Laksri ! Where did you get your Doctorate. ? Even Gota, Mahinda etc also got honorable Doctorates from Sri lanka. They always behave as in-human, thinking that no human beings reside in Sri Lanka except their supporters. The latest example is how they treat Mr. Ranjan Ramanayake M.P. just because he belongs to an opposition party .That poor- man had he been supported the ruling party he should be free now , similar to Pillaiyan a notorious killer( Mr. Chandrahanthan M.P ) and another M.P. from Ratnapura who was even convicted as a murderer by a judge. What kind of judicial system prevails in Sri Lanka ? Even the Supreme court , Appeal Court and the Attorney General Dep’t are behaving partially with the Gov’t , may be due to duress and fear of losing their Jobs . Any Gov’t could deceive some of their local supporters but not all the people all the time. Similarly , if a country has to be recognized by other majority of countries who believe in rule of law, human rights , Democracy , equality , justice and fair-play , Sri lanka has to change its present mind-set and if not , the whole Sri lankan would lose their respect, dignity, prospects , help and friendship of the whole world except the tyrants like China ,Russia Somalia and Ethiopia.

      According to the Pali chronicles, Sinhabahu’s eldest son Vijaya and his followers who were banished from Hindusthan (Sinhapura) landed in the island Lanka. Kuveni was the Queen in Lanka when he arrived (Kuveni on the other hand is regarded as a descendant of the Rakshas of the Ramayana). Vijaya used Kuveni to get a foothold in the country and seized power by annihilating most of those aboriginal natives (he goes on to slay all the aboriginals with Kuveni at his side very similar to what happened to the aboriginals/natives of USA, Canada, Australia and New Zealand). Once he had achieved that, he abandoned Kuveni and his two children to marry a princess from the royal family of South India (a Pandyan princess of Madurai). His followers married women from the land of this princess and from this union sprang the Sinhala race. Kuveni then went back to her left over relatives, only to be put to death for the crime of betraying the country and its people to the foreign invader (Kallathoni) Vijaya, the creator of the Sinhala race. The Sinhalese people are made up of half North Indian (men) and half South Indian (women) and the poor aboriginal Veddhas (the original natives) had to live in the jungle forever. Even today the Veddas venerate Kuveni as Maha Kiriammaleththo.

    True to form and like other Sinhala – Buddhist supremacists Dr Laksiri Fernando is defending the government. Like others, he is referring to the LTTE as a terrorist organization. But how come a terrorist organization sprouted in a Buddhist country committed to Pancha Sila?
    The LTTE is a product of Sinhala – Buddhist racism. This was stated by none other than ex-President Chandrika Kumaratunga Bandaranaike. Prabhakaran himself has said he would not be carrying an AK-47 gun on his shoulders if JR Jayawardena was a good Buddhist.
    It was the series of pogroms mounted by the Sinhala – Buddhist extremists in 1956, 1958, 1977, 1979, 1981 and 1983 against defenceless Tamils with impunity that compelled the Tamil youths to take up arms in self-defence. The army and the air force bombed schools, churches and killed innocent Tamils as they pleased.
    The UNHRC resolution stressed the importance of a comprehensive accountability process for all violations and abuses of human rights committed in Sri Lanka by all parties, including those abuses by the Liberation Tigers of Tamil Eelam, as highlighted in the comprehensive report of the Office of the High Commissioner on Sri Lanka.
    If the investigation is also against LTTE why did the government voted against Resolution 46/1? Should not the government welcome the opportunity to nail the LTTE for human rights violations, war crimes and crimes against humanity?

      Prabhakaran never meant it, if not AK-47, he would have got KP or other mules to buy a few, AK-103, one of the most reliable automatic deadly weapon.

    I am not saying the LTTE did not violate human rights violations. They did, but they are not terrorist acts. LTTE was a non-state actor. They had clear-cut aspirations and they fought for a cause. Above all, they enjoyed mass support. It is mass support that distinguishes nationalist organizations from terrorist organizations.The use of the terrorist card is calculated and intentional. The world knew LTTE was a liberation organization engaged in an armed conflict, but they use the terrorism card to their advantage.
    The Sinhalese dominated government had almost 73 years to demonstrate to the International Community that they can have a multi-ethnic, multi-lingual and multi-cultural state and all they have shown is that they can have a Sinhala – Buddhist theocratic state lording over the minorities.
    It is sad to see the learned Doctor holding a brief for an authoritarian racist state. I have one question for him. What happened to the hundreds of LTTE cadres, some with white flags who surrendered on 18 May. 2009 to the 58th army division commanded by Shavendra Silva at Mullivaikkal in the presence of their spouses and friends? Please give an honest answer! 2/2

      LTTE set off suicide bombs in a bank, airplane, Dehiwela train, buses. In all cases, with many people inside. Murdered hundreds of Muslims in a mosque. Attacked Sinhalese villages and cut throats with machetes (Dollar & Kent farms). Murdered monks in broad daylight and attacked Dalada Maligawa. Assassinated multiple heads of state and government ministers. Used child conscription. Engaged in narco-trafficking, human smuggling, money laundering, and arms smuggling. Practiced racial discrimination/apartheid. Your Tamil diaspora wants to convince some naive Westerners that LTTE were just victims of discrimination. That will not work, as the CIA has extensive evidence on all the crimes committed by LTTE. What happened to the LTTE cadres who surrendered? They were executed. It was an accelerated system of justice. Why waste time with a trial, as these buggers were guilty of holding 30K civilians hostage for more than a year (war crime). By the way, it was Kadirgamar who convinced the West to ban the LTTE.

    After the Resolution educated Sinhala Buddhists have a tedious job. Don Stephen’s demockracy failed. He though he fooled Britain and have captured Tamils under him. That had ended as disastrous. Colvin said “one Language, Two countries”. But soon it started to be clear that one Language not country. Lankawe was pester with pogroms, and Rapist Army’s murders. So he came out with an idea to undo that maxim. That is, one religion, one law. So he made Sinhala Buddhism as the country’s constitution. Recently Jaffna MP CV said that the unitary constitutions of Lankawe failed. That may sound as there is nothing new about that. But after the resolution, it has taken a new meaning. If the educated Buddhist Sinhalese are ready to think beyond them to protect Lankawe, then a new road, that was not there until now has opened. They need to approach UNHRC to dismantle this Don Stephen’s Demockracy. They need to willingly bring the Singapore-Malaysia relationship for Tamils and Sinhalese peacefully live together. That is only way now to keep China buying out all the land in the Sovereign island.

      T o Laksiri the LTTE is terrorist but not the Sri Lankan state or armed forces , despite the LTTE not raping looting not bombing orphanages , hospitals and killing around only 3000 civilians, as per Sri Lankan state statistics. On the contrary the Sri Lankan state and armed forces have deliberately committed and killed around 40000 innocent Thamizh civilians even as per the UN but the reality is it will three times this number, bombed hospitals , orphanages and other civilian targets as well as using chemical weapons. However these do not matter as the victims were all Thamizh and the perpetrators of these atrocities are the Chingkalla golden heroes.
