Bond Scam: Arjun Aloysius Won’t Give Evidence

In a lengthy order the Bond Commission today said that the Commission cannot compel Arjun Aloysius to give evidence, if he is unwilling to do so, although his evidence is required to ascertain the truth.

Chairman K. T. Chithrasiri reading out the order which lasted close to 20 minutes said that the principles of natural justice and others which protect the right of those “implicated” prevail over the need to ascertain the truth.

Earlier, Gamini Marapana the brother of Thilak Marapana made a submission saying that Aloysius is implicated and as such an accused cannot be compelled to give evidence against himself.

The Commission agreed with Marapana’s submission but went onto list down reasons as to why Aloysius must give evidence.

Among them were his insider dealings, who his friends in “high places were”, his relationship with Ravi Karunanayake, and his threatening of witnesses were cited.

However, the Commission said that they cannot force Aloysius to give evidence as he is quite rightly implicated in the scam.

Following the order Marapana said that his client was not willing to give evidence. Justice Prasanna Jayawardena then told Marapana to re-think about his position and convey the decision to the Commission tomorrow.

Aloysius was present at the Commission today.

His father-in-law Arjuna Mahendran would also most probably take the same stance, rendering the entire process a sham.

        CLOSE THE SHOP.

        There is no point of having this Commission anymore as everyone who is summoned to the Commission can claim the Right Against Self-incrimination and stay away without giving evidence. —

        In USA “Miranda Decision”, in Sri Lanka “Aloysius Decision.” —

        Right Against Self-incrimination should be a Constitutional Right. Commission’s decision is bloody wrong.–

        Commission’s credibility is now questionable and the conclusion of the Commission will be bias. There is no point in spending public funds to maintain this Commission.

        In a funny scenario, Commission is now handicapped as it cannot use other evidence also to finalize their conclusion if others who already gave evidence object. —

        Ravi K is off the hook. Now Aloysius is off the hook. Then Arjun Mahendran and Ranil Wickremasinghe will also follow the suit. This is bloody wrong. —

        As everybody has a Right Against Self-incrimination, Tri Forces personnel should not answer any questions by the FCID/CID even in the Courts. They should say that they are NOT willing to record a statement against themselves and they should quote Aloysius case. —

        The Intelligence Officers who are in jail can refuse to record their statement and even the previous statements recorded cannot be used against them as they were not aware that they have the Right Against Self-incrimination. They need not to ‘expose themselves’ in and out of Courts. —

        Every criminal defendant has a right not to testify. This covers all testimonials and communication, verbal and paper evidence.

        But this is bloody wrong!!!! Aloysius have no right to claim a right against self-incrimination as this is not included in our Constitution. The accused should plead the relevant “Amendment” or “Clause” in the Constitution. —

        One law to the super-class another law to the ordinary class. Class discrimination can be seen everywhere in Sri Lanka. Money talks. Disgusting.

          The present situation in Sri Lanka can now describe in ONE WORD – the F Word!

          The President, the Prime Minister, the Judiciary (except High Court Judge Gihan Kulatunga who is the only impartial Judge in the Judiciary. One day he should be the Chief Justice.), the PCoI, Yahapalanaya Government, Ministers, Government MPP, JVP, TNA, JO (except Wimal Weerawansa who is the only politician in Sri Lanka who has no deal with the rogue government. Every other politician has a deal one way or the other).

          Maha Sangha, Wimal Weerawansa and the general public are one side and all others mentioned above are F Word.

          Anyways, as our number supersedes the F Word, we can make the necessary change to get rid of F Word and save the country.

          My dear Wimal, we should demand mid-term elections, as you predicted what is next is a Referendum not PC elections.

          PCoI is a fact finding mission not a Criminal Trial. I don’t understand why they gave into Marapana obvious intention to hide all vital facts in possession of Aloysius?

          Was there any political interference? What is the reason for them to make such a feeble decision? After giving all the valid reasons, what made them to act the opposite?

          It is pretty sure Aloysius will never be tried in Courts???

        Surely, there is enough evidence now to try the financial criminals Aloysius and Mahendran and convict them father in law in a trial at bar and then get the despicable thief Ranil Wickramasinghe.

        Also, the funds looted from the people of Sri Lanka must be tracked and recovered, Chitta Ranjan Hulugalle who is also an owner of Perpetual Treasuries Group and did overseas money laundering as a US Citizen should also be brought in for questioning. He has acquired many condominiums and beach properties in the last year.

        Rosy’s son is not implicated – he was mentioned in a conversation regarding COPE that ended a year before and where the reports were in the public domaine. If you see that press articles where is nothing more but he media has used it to get attention ion to their articles. It is a clear case of guilty by media – let us go behind the facts and see how the money was lost. That is the real challenge.

    This commission is a sham from the beginning.

    There have been more than 15 commissions todate and let me know other than in one instance nothing has hapenned. That is the truth.

    It is only a fact finding exercise and entirely upto Sirisena as to what should be done.

    What can Sirisena do?

    1 keep the report in a secure place and do nothing.

    2 appoint another committee to look into some aspects in the report and buy time

    3 request AG to take action on some aspects in the report as selected by Sirisena

    4 make the report public

    5 ask AG and Police to fully action the report.

    What will Sirisena do????

      Fellows should be before the criminal courts. Commissions in SL are appointed to hide the truth. They should be before courts and in remand prison so that they could not scoot off before the verdict.

    Don’t ridicule the highly competent judges of the bond commission.The y performed to their very best according to their limits. This is not a court of justice & they can’t mete out punishments. But at the end of the day they will recommend certain actions & then I am sure this case will go to court. Then Arjun Alosius will have to give evidence.His lawyer’s argument is a valid one in keeping with the law of the land. is what the commission judges have said.

    Just hope the case will be heard as a trial at bar.

    Rule against self incrimination applies only if you are giving evidence in a court of law who will use your evidence to punish you but this commission has no power to sentence or put you in jail. ,Therefore this decision or opinion of the Commission is wrong.Pls comment if I am wrong

    Justice should be meted out example middle east system.
    Magistrate had said Namal could be arrested for threatening FCID officer and so far Ranil has not taken any action.
    Its point blank clear DR Ranil is protecting the fraudsters and murderers of the previous regime.
    Dealmaker Malik Samare , Sagala all should be punished for protecting the crooks.

    The fact that Arjun Aloysius doesn’t want to testify because he can incriminate himself implies that he has already accepted his guilt.

    If his father in law Arjun Mahendran takes the same position it proves who colluded with whom.

    We the voters of this country assume that the commission will then investigate who gave political patronage to these people to rob peoples money.

      Certainly from the body language it is the PM who defended Arjun Mahendran to the hilt.

      Now everything is clear these politicos robbed the country and people’s wealth using these people and they used their immunity of being in high positions to cover this day light robbery.. This beggar PM should resign or be chased out.
      The very government has robbed the people. and that is the stark reality. If this happened in European country the PM will be forced to resign but in this banana republic he goes on as if nothing has happened. He should have been summoned to the commission.

Or is it as a special Advisor on Bonds , because Dr Ranil needs Zillions of them again , to send Yahapalana suckers to visit Malwatta on Kandy Expressway……….I think the latter will be a good fit to complement the current Advisory Board based at the TT, which already has the FIL Dr Mahendran and Aunty Rosie as well……..What would young Akila thinks is a matter of conjecture…….     Use the PTA. Aloysious is LTTE Tamil. PTA freely applies to him. There is nothing as self incrimination in PTA. The targeted victim reads out the statement trusted by the rapist police into his hands.

    Champ, It has been the practice of the Sri Lankan courts to regard the privilege of not to self incriminate as a fundamental right of an accused in spite of explicit statutory provisions. Instead of commending PCoI for respecting rights of the accused however despicable he is, you are complaining like an ignorant fool.

      It is not a “fundamental right”. If it is a fundamental right, it should be clearly mentioned in the Constitution and they should plead the relevant Article.

      Yeah, it is the practice of Sri Lankan “Courts” ONLY. I said that clearly in one of my comments.

      PCoI is not a Court. It can’t punish Aloysius. But it can investigate and present the truth supported by all evidence nicely compiled in its Conclusion so that the Attorney General can take action against Aloysius, Mahendran, and if he has the backbone, Ravi K and if our Judiciary is as impartial as the Kenyan Judiciary, we can even see Ranil W in Courts. The PCoI was established and maintained all this time spending public funds exclusively for that purpose.

      PCoI should not have accepted Marapana’s logic. They have the capacity and authority to do so. Now it has lost its credibility to be impartial because their decision can be used as a precedent by all other high profile crooks. I can be nasty and say it is a deliberate attempt to save the super-class. This is me. I am generous in complimenting and I am vehement in criticizing. What is wrong is wrong. I don’t see people. I only see the action.

      I don’t think even the Commission has realized the gravity of their decision which could affect the entire findings so far to a mere zero. I am serious. All the material evidence, documents or instruments provided by witnesses so far and all the verbal evidence in possession of the Commission so far will not be used against Aloysius and Mahendran if previous witnesses summoned before the Commission inform them that they were not aware or the Commission never told them that they have a right against self-incrimination until “Aloysius Decision” and if they knew, they would not have given evidence incriminating themselves and therefore, none of the evidence already given to the Commission by them should not be used against them or any others including Aloysius. I am 100 percent sure Central Bank officials will not do that. I hope others will follow the suit. But money talks and also one might want to avoid being in the Courts as a government witness and even one might think why should he be punished or undergo trouble if Aloysius is off the hook.

      So the PCoI will be handicapped without all the vital information against Aloysius and Mahendran. Then everything they did so far will be in vain.

      Only solution what I see is, President granting exclusive authority to the PCoI to replace Marapana’s logic considering the Central Bank Bond scam as a “Special Case of national interest where rights of citizens supersedes the rights of those involved in the scam”. Then the Commission can issue fresh summons to Aloysius and recommence their commendable work.

    It is said .one is judged by the company one keeps’. Having said that, if anyone has the good sense to judge the right / good from wrong / bad, one can figure out who might be guilty or not guilty of alleged crimes without any conviction in a court of law. One may not be found guilty in a court of law due to technicalities and/or weak prosecutions. Steer away from those you think might be guilty of such ‘alleged’ grave crimes, for if you decide to associate with them, you are also likely to be judged by mere ‘Association’. Those who associate with ‘Rajapaksha’s, Aloysius’s, Mahendran’s come to my mind in this relation. In my mind all of them are despicable crooks who have swindled tax payers’ money and so have a tarnished reputations. Who will want to associate with such goons, unless one is looking for favours / part of the pie of ill gotten wealth?.

    President Maithripala Sirisena is considering appointing former Deputy Minister of Tourism Development and Christian Affairs Puttalam district MP Arundika Fernando to a new ministerial position after he apologized to the President yesterday.

    His apology comes a day after President Sirisena sacked him from his position using executive powers vested in him in Section 46. 3 (a) of the Constitution, for making statements in support of former President Mahinda Rajapaksa.

    The former Deputy Minister had met with President Maithripala Sirisena yesterday for a private meeting, the details of which were not made known to the media.

    This is a failed state and Banana Republic the way things are happening! Disgusted and i am taking the next available flight out of this corrupted country.

    If there is non-co-operation to this extent, and outright defiance of public interest, can’t something be done to outlaw Perpetual Treasuries from this time forth? I mean that they could be de-recognised, even by passing some simple new legislation so that we have nothing to do with these guys.     CB Bond Scam is above the Sovereignty of Law of land, while the country law authority have no power to search or warrant to even called for an evidences from CB Bond looters?
