Brig. Priyanka Fernando Found Guilty On Three Offences Under Public Order Act: Arrest Warrant Issued

Brigadier Priyanka Fernando, a senior officer of Sri Lanka Army, has been found guilty of two of three offences under Public Order Act by signalling a death threat to Tamil protestors on February 04, last year.

The Westminster Magistrate Court issued an arrest warrant on Fernando ruling that his actions were threatening, caused harassment, and that he intended them to be so.

Following this judgement an international arrest warrant is likely to be issued for Sri Lanka’s ex defence attache Brigadier Priyanka Fernando. If the Sri Lankan government refuses to cooperate, its High Commissioner in London will be summoned to appear before the Court, informed sources said.

      There is news that secretary to ministry of defence Hemasiri Fernando had stated that charges will be brought in SL courts against 11 army personnel involved in war crimes. After slumbering for four years government has woken up not in a sincere manner but to hoodwink the world as Geneva UNHRC meeting is due in march, where they will go and say that they are taking action against war criminals. Once heat of the meeting is over and pressure deflected this case will be swept under the carpet until the next sitting of UNHRC in Geneva. This is another fake trial and no one will be punished.

    Wondering what happened to Adele Balasingham? Perhaps, she did not break any British laws or international laws for that matter. Confessing and photographic evidence of her training Child soldiers.

    Until such people are brought to justice, Sri Lankans with diplomatic immunity such as Brig. Priyanka Fernando should treat British courts with contempt.

You may have forgotten that your defence secretary sent the No 2 of LTTE (Karuna Amman) in a fake passport to UK and he was punished for 9 months in UK courts. When he came back you gave ministerial posts. For what? For killing 600 Sinhalese policemen in the East and attacking Daladha Maligawa. What a beauty of justice?         You miss the point! Adele Baasingham should be held accountable for being a party to promoting young children and women into an armed conflict. What if the British Army calls young women and children to war and to add to that, issues suicide pills?! Why has the British Government and the E.U and all these very “holier than thou” organizations raised any concerns on that? Suicide pills may have caused the death of countless young Sri Lankan Tamils during this LTTE issue. Why no reaction from any of us?!

        This is my point and WHY this unfortunate episode in our national history will never be properly addressed. Its all POLITICS, which is why the British Government raised and will never raise any objections to the LTTE supporters carrying the “Lions head” flag, the flag banned as it represent a banned organization. It is understandable why this Brigadier did what he did, though he should NEVER have done so but exercised disciplined conduct.

        If I am this officer, I would go and face the judge and let the whole world see the fiasco.

LTTE was not a charity and it was a terrorist outfit which was a creation by the successive governments of SL. How many academics did they murder…………..case in point is the Principal of St. John’s College. How could intelligent people with a heart support this menace which was in existence until 2009? If Adele and the high command of the LTTE placed a cyanide capsule around these innocent children with guns who were forcibly conscripted, then why didn’t the very same high command use what was around their necks in 2009 and decided to surrender? Brigadier Fernando should have realized that he is a Diplomat ( Military Attache ) representing his country and making crude gestures in public in army uniform is not of a good soldier of a good army. The Sri Lanka army is not like the armies of the banana republics in Africa. Those armies are thugs, murderers, rapists, and you name it in uniform.
      The Lankan army has been and is one of the best in SE Asia.

    Unlike in Sri Lanka where the justice system crawls like a snail, the British justice system is swift and decisive. In Sri Lanka the justice system is corrupt. Cases drag on for years and years until the ligators are dead and gone. The judges don’t bother, so are the lawyers. Lawyers make money everytime a case is postponed and even if they lose the case at the end.NoPresident, no Prime Minister, no Minister is prepared to tackle this problem. It is reported there are well over750,000 cases pending in courts. This is a goldmine for lawyers!

        The latest development about the conviction of Brigadier of Priyanka Fernando by the Westminster Court Magistrate, I am told, is about the SL Foreign Affairs Ministry summoning the British High Commissioner for a briefing.

        I will not be surprised that in light of the recent news about the shredding and destruction of hundreds of papers from the 1980’s and after during the Thatcher and Blair eras on the uprising in SL till 2009 which saw the end of the LTTE.,
        The role played at that time by the UK government could be embarrassing for it now, as it was during that period that SL’s Defence Secretary Sepala Atygalle visited Belfast in 1984 after his forces massacred Tamil civilians to discuss counter insurgency methods used by the Royal Ulster Constabulary.

    He went through the courts system, and was found to be guilty. Fair enough.

    No Sri Lankan officer, wearing the uniform of his country, should behave that way. Just because the protesters annoyed him, it does not mean that he should respond in that ugly way, making violent gestures. He should have shown some dignity and not stooped down to thuggish gestures. Just because he was treated like a hero in in this country, does not mean he will be treated like one in the real world.

      Sri Lankan security forces and police do not need an excuse to abuse innocent people. Abuse is in their blood because they enjoy life long impunity from all kind of human rights violations. They join the forces and police precisely for that reason.

      Look at the Sri Lankan armed forces who were deported back to Sri Lanka from Haiti for child sex abuse.

The British are certainly no saints but that has no bearing on whether what this guy did is right. But never mind that, lets say you are genuinely concerned about the Child soldiers of LTTE and want to bring it up, even though it is not directly connected to what the war criminal Brigadier did. Sure, the LTTE is certainly responsible for the crime of recruiting child soldiers, but did Adele have a big hand in it? Personally I doubt it. She is a white women with no connection to Tamils, and probably could not speak tamil very well. The Tamil children cannot relate to her at all. She would have been a very poor choice as a motivator or recruiter. All the recorded evidence suggests that the biggest child recruiter of LTTE is still alive and well in Sri Lanka – that is none other than Karuna. Child recruitment was much more rampant in the East compared to North, and if you just look at the pictures of his forces during his ‘rebellion’ against Pirabaharan, you would see that he was setting boys against men (of the northern LTTE). American missionaries working in Batticaloa called him the ‘Ogre coming down from the mountain (of Thoppigala) to take children’. If you really care about child recruitment, why don’t you ask the Sri Lankan government to arrest and punish Karuna? Oh, while at it, you might also ask for punishment for all other war crimes committed against Tamil children who were non-combatants (not even by force). These crimes range from Aerial bombing of schools to grabbing infants from mothers’ breast and smashing their heads in Mullivaikal. Come on man show us that your concern about poor Tamil children is real!

      The much-decorated Brigadier no doubt must have done a lot of good in his life. That does NOT excuse his provocative behaviour at anytime, even on our National Day when goaded by others. If a foreigner in Sri Lanka shows off, say a tattoo, something that is unacceptable to OUR laws and customs, we will punish them. It is our sovereign right. Similarly, We Sri Lankans should be law abiding and do nothing illegal when abroad. If the much-decorated officer stood inside the High Commission, pulled out his little willie and waved it at the protesters, it would have been just as unacceptable.

      About the same as the war hero returned, the Sri lanka government bravely accepted the resignation of the decent Amari Wijewardena.

      Perhaps we should send our local hero Sajin Vass Gunawardena to see the Westminister magistrate and sort this out.

      I think our people s attitude should be corrected else, many would end up in difficulties. I have heard most living in abroad regardless of their edcuational backgrounds, very often, feel that they deny to see things in terms of the countries where they are located. Most living in ME countries get caught not knowing the basics about laws. So is the case heard from the communities living in Korea and Italy. Most of these people belong to skilled worker category.

          I for one don’t see any contradiction. Whether Adele committed any crime is debatable, but what is not debatable is that she did not commit the alleged crime of child recruitment in British soil. So why should they charge her? The war criminal brigadier did, and it is on camera, so naturally he is charged. Remember, he is charged for the gesture he made, not for the far more heinous crimes he allegedly committed in war, because they were outside UK. If you think you can do whatever in your own consulate, let me remind you that even the Saudis did not invoke that argument. Turkish police did enter Saudi consulate many times recently, and the Saudis are still trying to deny the murder rather than saying “The consulate is our jurisdiction”. If a crime is committed the host country can investigate and punish.

    I do feel the entire Armed forces [Navy/Airforce/Police/Army/Homeguards] need RETRAINING on how to interact with the CIVILIANS—be it Sinhalese/Tamil/Muslims/Burghers/Malays/Veddhas.
    Treat them as HUMANBEINGS & not as animals for sacrifice. Tamils after seeing the KILLINGS at point blank range by armed forces and rape and tortures of innocents [+BURNING of the Precious Jaffna Library]
    would definitely do NOT want to see them in the North and East of the country.

      In Canada, sometimes I go to Pickup my Grand kids from their elementary school. I have never heard any of the Kids shouting anything to my Grand son or daughter. Of course, they go to a Private school. Perhaps, that is the reason. Or maybe just that the kids in Canada are more civilized than their British counterparts.

      In any case, if I hear something like that I will grab the SOB by his collar and shove him. And if it’s parent’s are nearby I will tell them off as well. And I see fit, I will get physical with them as well. When it comes to combat, there is nothing they can show me that I haven’t seen already.

      Besides, we didn’t travel thousands of miles to hear this nonsense from inbred punk.

    Here’s a hypothetical situation.

    Let’s go back to early 2009 or December 2010, when the Sri Lankans organized protests in front of the British High Commission in Colombo. And let’s assumed that a British military attaché walks out to inspect the protesters and makes beautiful gestures like what our War Hero, Brigadier, Commando, Zero Casualty, Civilian Rescue Operation Head did. How will we Sri Lankans, who now fully believe in collective rights, respond to such beautiful gestures?

    As I review the comments, I see only a few rational thinking people and great many idiots in these columns. Little wonder why we paddle into shit creek in just about every front that has become an affront. Thus, I am saddened by the bleak future I envision for the country. We cannot expect any goodwill, reconciliation or recovery if we are not conscious, truthful in accepting our faults that are bigoted and arrogant. What Taraki mentioned is serious stuff. These kind of cheap remakes whether at insulting each other or trying to defend this incident itself will only embolden those like Goatabaya Rajapaksha who is prima facie murder suspect. If not for him, some other communal minded racist will replace him. Whether we are educated or uneducated, rich or poor, disciplined or undisciplined, war monger or pacifist, there is some goodness in everyone of us. We all have a cognitive neuron to endorse moral decency and common sense to think and act rationally. Even if we cannot agree on anything else, at least we can agree on this premise. What is bizarre is that our civility and sense of decency is not common anymore as in the word “common sense”. The meaning is deep and I am sad that only a few will ever get this. What Brig. Fernando committed was disdainful. He disgraced our country, our commonwealth standing, international goodwill, our diplomats and foreign service, the military and the uniform. What Brig. Fernando wished for and built over many years during his service for his own good were besmirch by a vulgar hand gesture that decapitated not only his own but ours’ as well.
