Constitutional Changes Create Dynastic Rule

With all the debates, controversies and rigmarole surrounding the issue of abolishing 19th Amendment with 20th Amendment, and the demand from certain quarters for a new constitution, there is perhaps one historic outcome from the whole episode, and that is, the virtual establishment of hereditary rule by the Rajapaksa dynasty, at least in the short and medium terms. This feat is about to be accomplished quite unobtrusively through the democratic process but with the help of some shameless Muslim parliamentarians. Sri Lanka earns another first in modern politics.

The direct and immediate outcome of this constitutional exercise is the reemergence of an all-powerful executive presidency, originally created by JRJ.  With little modifications, 20A will effectively roll back 19A empowering the president and make him almost a virtual dictator. This reversal will in turn lay the foundation for the Rajapaksa dynasty to remain in power unless another Buddhist family rises to challenge its dominance. In practical terms, the changes would result in the simultaneous empowerment and disempowerment of the President and Prime Minister respectively.  What is so unique about this inter-positional power reshuffle is that it involves the status of two septuagenarian siblings of whom the junior is gaining at the expense of the senior. Had it been two others from different families this transfer of powers would not have been as smooth as it is happening now. In fact, this was the crux of the problem for the unbridgeable split between MS and RW in the Yahapalana regime. The situation is exactly the opposite between MR and GR. The Prime Minister, who is the patriarch of the family earlier denied a rumour based on his disappointment and frustration that he intended to resign in two years, but vowed instead to continue in office for the entire five-year term, even though he would be virtually reduced, according to one constitutional expert, to the position of a “peon” during that period. The reason for his surrender is obvious. It is all in the family and there are several in line to continue that family rule in the foreseeable future.  

Already five members of the Rajapaksa family are sharing cabinet portfolios and ministerial roles. Commanding sectors such as Defence and Urban Development, Law and Order, Economic Development, Finance and Planning, and Ports and Highways fall directly under them, and it was once reported, though denied later, that almost seventy percent of the national budget fell under their control.  With such control and influence, government departments and offices have become virtual appanages distributed within the family. Power corrupts and absolute power corrupts absolutely is an old dictum. Even otherwise, as Montesquieu said, “any man with power is led to abuse it; he is bound to find its limits”. But who is going to question the abuser when constitutionally gained omnipotence enables the President to control and shut every avenue of criticism and protest? He is above the law. Period.   

The Rajapaksa dynasty will build its tower of dominance on the strength of three strong pillars: Sangha, the tri-forces and an ethno-centric Sinhala Buddhist business class. Although historically, Sangha had been a highly respected institution that injected and monitored virtuosity in governance, in the current political climate its role goes beyond promoting virtuosity and into a commitment towards establishing at least a de facto, if not de jure Buddhist state in the country. The most powerful prelates of the Sangha hold the supremacist view that Sri Lanka belongs only to Sinhala Buddhists and that only Buddhist manufactured laws should govern the whole nation. Behind the so called one country one law mantra lies this supremacist ideology. Homogenization of Sri Lanka’s kaleidoscopic pluralism is the ultimate vision. Rajapaksa stalwarts have not cleared the air about their commitment to this supremacist ideology except parroting inn public that there is freedom under their reign for all communities and religions.  From the running vocal encounters between pseudo-historians from both sides of the ethnic divide, provoked by the maiden speech by a Tamil representative in the new parliament, in which he referred to the seniority of Tamil language and Tamils in Sri Lanka, one could understand how politically risky and dangerous would it be for the dominant family to distance itself from the supremacist position. This is why President GR adamantly holds the view that the solution to Tamil nationalism is economic development and not power sharing. Given Rajapaksas’ close alignment with supremacist prelates one could expect that even the India initiated 13th Amendment would be plundered of its substance as a result of the amendments.    

Like the Sangha, tri-forces, by virtue of the fact they are under the command of GR, will automatically provide support to the family. The changes GR introduced within those forces soon after he was elected in 2019, by promoting some, demoting a few and rewarding several, was to ensure that his wishes and orders would be carried out without questioning. Military has become an inseparable arm of government public administration under the new regime. The several Task Forces appointed by the President headed by military personal still continues with their terms extended. Moreover, GR came to power on the issue of enhancing the security and sovereignty of the country, and no doubt he would extend that security to his dynasty also. While the Sangha would rally the masses behind the dynasty, the tri-forces will protect it from any threat from extremist elements. 

Finally, the ethno-centric Sinhala-Buddhist business class is destined to make hay while the Rajapaksa sun shines.  One of the reasons for the anti-Muslim violence that marked MR presidency before 2015 and Yahapalana regime after that was commercial envy. The ubiquity of Muslim traders and the remarkable success of a few among them especially in Sinhalese districts was an eyesore to ultra-Buddhist nationalists reported to have been funded by a class of Buddhist businessmen. This class along with members of the Sangha worked hard to bring Rajapaksas to power. As long as the regime looks after the interests of this class the dynasty is assured of its backing. 

Given this rosy scenario that promises at least short to medium term political stability even foreign powers like India and USA that are currently unhappy about Sri Lanka’s heavy tilt towards China, would prefer to resolve issues smoothly without embarrassing the regime too much to create instability. Even though the economic and financial difficulties currently facing the country would tempt these powers to take mean advantage of the situation, a politically stable regime is diplomatically more preferable to build long term relationship than a regime mired in instability. This does not augur well particularly in relation to the Tamil issue. Modi’s Delhi would like to strengthen its economic ties with Sri Lanka rather than rocking the boat by insisting on the implementation of amendment 13. Similarly, USA’s MCC and SOFA would also become realities through negotiation with Rajapaksas much to the consternation of the regime’s opponents.  

However, there is one important element that can create a headache and nightmare for the rulers. The economy, which had started sliding already under Yahapalana is collapsing under the Rajapaksas, because of the pandemic and global recession. The economy will be the number one enemy for the dynasty and the first budget of this government will show the gravity of the situation. The future of the country’s exports, prospects of foreign investment inflow, declining foreign remittances, declining tourism revenue, pressure of national debt, falling public revenue and increasing budget deficit and so on are issues that cannot be tackled in ad hoc manner. There is need for a comprehensive plan for economic revival. President GR is issuing economic directives without an overall strategy. His idea of achieving self-sufficiency in food and condiments is good but by simply banning imports he is not going to achieve it. There is one fundamental requirement for solid economic revival, and that is the need for national unity. GR’s grand vision of “prosperity and resplendence” cannot be achieved without national disunity, and that unity cannot be forced upon the communities. It has to evolve from below out of mutual cooperation, understanding and tolerance among the different components of the nation’s plural polity. The regime’s refusal to distance itself from demagogic Buddhist nationalism is a bulwark to achieve it. When economic disaster combines with inter-ethnic and inter-religious convulsion that would be the recipe for the collapse of the ruling regime and the ruling dynasty along with it.

        Given that you claim to have an eagle eye, you surely cannot have failed to note that Sri Lanka comes in 86th out of 109 in the global IQ rankings (see: https://www.worlddata.info/iq-by-country.php).

        Now, if, as you say, the Sinhalayo (sic) comprise the majority in Sri Lanka, shouldn’t this alert you to something that should make yourself ashamed, and also make you realise that there is more than an iota of truth in what you claim is only an implication?

          The way Sri Lankan Government as well as people handled COVID-19 pandemic so far shows that IQ figure is rubbish. Those countries with very high IQ (eg. USA, UK, France, Germany, Japan) miserably failed.

    Yes, the Rajapaksa Mafia Dynasty is going to rule at least for the next 20 years by consolidating their alliance with the Sangha, the tri-forces, and the Sinhala business class. The monks will continue to brain-wash the Sinhala masses with the ideology of Buddhist supremacy in return for the Rajapaksas genuflecting before them and granting them a preeminent position in the social hierarchy. The military will keep the people manacled in return for the Rajapaksas elevating their social prestige, power and remuneration. The Sinhala business class will back the political interests of the Rajapaksas in return for being allowed to exploit the people and destroy the environment. The Sinhala people don’t realize they’re being led into a nightmare by the Rajapaksas by tantalizing them with the quaint project of ascending the World Stage – at last – to fulfill their historical mission and establishing their rightful, pre-destined position in the international arena.

      Ajay, There are many things in the Universe that humans cannot manipulate. One such thing is the Natural Law (can call Karmic force). People thought Premadasa will rule forever. Did it happen? Same way people, including MR, thought MR is undefeatable in 2015, which was proven wrong. Who thought Senanayaka, Bandaranaike dynasties will vanish? Who thought Maithreepala will be the President? For that matter who thought MR will be the President in 2005. When he became the President a member of famous Athapaththu family of Tangalle said “මහින්දයත් රජ උනා” (Mahinda became the President!!) as if unbelievable thing happened. This 20 years prediction is beyond us. No one can predict, or plan anything in life. There is a way of Mother Nature gives back to the people who try to go against her. By going to Thirupathi, or by being vegetarian or having ropes of thread around wrists, or squeezing magic balls, her wrath cannot be avoided. Good example is COVID, and how it started in China. Going against the Mother Nature is a serious business. Rulers should be good leaders. Buddha said “Devo vassathu kaalena……Raaja bhavathu dhammiko”. Unfortunately we don’t have RIGHTEOUS leaders. We have world class crooks as leaders.

        Yes , I know the Atapattus of Tanglle. My father was from Baddegama but taught there for twelve years. My two eldest siblings were born there. I was born in Uva. There still are Edirisinhes in Tangalle, and Mahinda Rajapaksa knows that.

In relation to what you have said, I would like to reproduce a short statement that was in an article by Lord Patrick Devlin – “Every moral judgment unless it claims a divine source, is simply a feeling that no right-minded man could behave in any other way without admitting that he was doing wrong. It is the power of common sense and not the power of reason that is behind the judgment of society”. That power of “Common Sense” rather than the “Power of reason” now dispensed as “Judgement” in these Constitutional game playing will definitely face its deserved “Destiny” by the all powerful “Natural Law”.

        Whenever I say in order to create a Tamil only Homeland in the North Tamils (all Tamil speaking people scattered across the island irrespective of their religion, caste or the date of arrival) in the South must be relocated the resistance is unimaginable.

        I am one Sinhalese who supports the proposal for a Tamil Homeland but the main obstacle is this stubborn unwillingness of Tamils themselves. They are not ashamed of exposing their naked hypocrisy.

          I agree with Soma here. I too support Tamil Elam provided there is a Sinhala Only Elam too. I never supported the war. Instead of war that killed 140,000 humans, in August 1983 SL should have been divided into Sinhala Only Elam and Tamil Elam by relocating people. Muslims had no desire to join Tamil Elam so Muslim and Sinhala combined majority districts will remain with Sinhala Only Elam. But greedy Tamils and greedy Sinhalese wanted the whole island = war.

            Division is based on the language.. They are Tamil speaking people. They will be included in the Tamil Ealam. Next time you will say Tamils in other parts and estates can be in the Sinhala Ealam if they wish so.

            They all will have to relocated into the Tamil Ealam

    You continually gets this wrong. 20A is different. It is not to give Rajapaksa Dynasty more powers. It is to give more powers to one Rajapaksa. If I say, most intelligent Rajapaksa in the clan. One good thing is Sinhalese can replace that Rajapaksa by another individual if they choose to do so. If 20A gave more powers to PM and Cabinet or Parliament, changing a Government having a 2/3 power to a different one is more difficult. 20A has extreme and absolute powers . It it is on wrong hand, it would be a problem. It is like a knife. How many people have died in the world due to stab wounds. That is not justified not to produce knives or use those for legitimate use. GR will get this approved by parliament. There is a possibility that a few changes if someone goes to court. However, majority of powers will be given to GR. He will use if for one year and show People the good side of having powers. That will prepare the ground for new constitution and it will be approved by people in a referendum. So, stop crying and let people to decide at the next Presidential and Parliamentary election. Please remember the 100 off people who reads these articles and comments here are not the reflection of general public mind representation.

Don’t wake up, because when you wake up, the things you are assuming is going to happen, will be very different, if ABSOLUTE POWER goes to GR. “Power tends to corrupt; absolute power corrupts absolutely”.     When the 20th Amendment gets legal sanction, it is neither the Rule of the Siblings, nor the evolution of the Sibling Dynasty that would spell disaster. What needs to be watched is the precise wording of the 20 th dispensation (the small print), that would vest power in the incumbent President and his chosen wielders of authority.

    There are many things bragged about the Aanduwa’s 20A. Yet what is going to be the use of 20A is a question even few in the top tier of the Aanduwa cannot answer, while many others fears about the tyranny it’s going to extravasate. Yes, even Michelle Bachelet, UNHRC High Commissioner, has expressed her concern about 20A. On the 45th sitting’s opening speech HC said the 20A is going to suppress the NGOs and HCRSL, which is hiding under the table after the November, 2019 election. That commission’s Yahapalanaya appointed Chairperson Dr. Deepika Udagama is resigning. High Commissioner Bechet with many other concerns mentioned the intimidation and oppression taking place to the freedom of expression. Dharisha, editor of Daily News was forced to leave the country because she had talked to Garnier Banister, Swiss Embassy employee, who issued the Visa to Nissanka leave country. Dharisha’s home was searched and later her computer was forcefully obtained from family. But Ms. Dayani Mendis, Lankawe Permanent Rep at Geneva, picked item by item of High commissioner’s points and flatly denied any of them as true.

    She, after patting on her back for Lankawe’s Covid-19 record & conducting the last election without blood, insisted that the 20A too, will be passed democratically in the parliament, after a fair chance for member to discuss about it. But that is not people feels; they think at whatever the cost to them, the 20A will go though.

    Ms. Dayani Mendis, in replying for the UNHRC, HC, stayed in Lankawe customary ways; flat denial & blaming others for having done same mistakes. This is the famous techniques Lankawe uses repeatedly again & again to delays, evade, and then to completely dodge taking responsibility for its heinous crimes. Before Ms. Dayani Mendis made this speech, Core Group countries’ spokesperson Rita France has said her group has no faith in Lankawe Local Mechanisms. But Dayani Mendis still insisted that her government has told that when it was cancelling the resolution one sided that they would implement the resolution locally. Then she denied her Rapist Army official having done any crime and bragged about the Paranagama Commission and LLRC’s work. The Only part Resolution asked was when War crime investigation was going it has to be open to IC. All other section on that resolution was for local mechanisms.

    Now Dayani Mendis is saying her Rapist army didn’t commit any War Crimes; So Lankawe is not going to investigate the War Crime. Then even if Lankawe wants to implement the rest of the resolution, locally, then what is the point in one sided cancelling the resolution? It was UNHRC’s earlier, High commissioner, Jordanian Prince, Zeid, who forced the Paranagama commission’s investigation closed because that commission openly used the CID criminals to go homes of missing persons, threaten them and control missing persons’ relatives. LLRC refused to accept an offer by UNSG’s Expert Panel or allow its officers watch the LLRC commission’s proceeding. It refused to meet the Panel’s members, who all were world renowned Human Rights Activists-Lawyers. At end it refused share commission’s data with Expert Panel. Still LLRC said that there were evidences of Armed forces having committed excess to amount War Crime; as they didn’t had mandate to work on that area, they recommended to appoint another commission to clarify that part. Now 10 years have passed form Commission’s decision. Nothing happened on that part. The Hakeem submitted a National Action Plan for American State Secretary, out of which nothing has been done.

    If Dayani Mendis is saying that her government is going to do something left on the withdrawn Revolution 30/1 and if that is true, as they know there are now many changes have come and lot of grey area has devolved, they might have given a new action plan at time of withdrawal of Resolution. Their word that they will do something locally is really a shameless lie. Now Ms. Dayani Mendis is reading the report written at home probably by GLP or Ali Sabre. When Ms. Dayani Mendis was sitting on the internal stage and lying through her teeth, on the camera focusing at her relayed that scene worldwide. How could be the Sinhala Intellectual can be such pathological liars not minding anyone or even paying attention to Core Group’s statement?

    One more ‘Adonawa’. I guess because:
    1. This time Sinhala Buddhist Supremacists made so called ‘King Makers’ redundant;
    2. Curtailing imports is going to affect Muslim traders who imported everything under the sun during ‘Jadapalana’ Government using foreign currency earned by Sinhala women toiling in Middle East and got rich;
    3. Very interesting things are coming out at the PC on Easter Sunday terrorist attack by Muslims; things that never came out at the Parliamentary Select Committee ‘Naadagama’;
    4. Opportunities are slim for Muslim politicians to play the usual ‘Monkey Game’ jumping from one tree to the other;
    5. Fear that Muslims are going to lose some of the privileges they enjoyed. Ex. Muslim men having fun with young chicks legally.

But Bald Eagle has abandoned the Mahawamsa and digging deep into the ground to lie with Balangoda Veddas a civilization wiped out long ago.     Today in PCol MP Harin told, prior to Easter a CID personal ( he gave the name too) who was involved in the case of statue demolition , had contacted his father who was then in an ICU and warned about the bombing next day , and soon after his father had called and warned the daughter NOT to attend Easter mass. Harin did not hide and was explicit about it. (Lankans have tendency to shoot the messenger). Harin the previous day told probably the churches were aware of this warning too. Now just sit back and think for your self. Of course the Lankan voters attitude/mentality is “who cares now, we got our man in power”. (MS too ). It matters to families who lost their near and dear ones. Harin is giving this evidence under oath. If true , just think about the statements then made by MS the crook, Ranjith the cunning hypocrite , CID/TID/Intelligence/security —etc. You can have all the constitution you desire but it will not stop such acts ,planned by the very same who create those constitution.

      chiv: What Harin said was under “Oath”. Now think of the otherside of the coin. What made that CID man tell that to Harin’s father in ICU? What do you think? My opinion is the “SLAVISH” and “HYPOCRATIC” mentality and the behavioral patterns of those in Law Enforcement. Why he selected a “Politicians” father? Nothing to get surprised, when even the “Top Boss”, IGP becomes a “SLAVE” and says: “Yes Sir, Yes Sir. I will not arrest him. I will get the file”. After that conversation with the “Politico”, he issued immediate instructions to the Police not to arrest anyone without his permission. This was the situation in the country under “Yahapalanaya Maralaya” that sent the people mad and frustrated to “Bring Back” the “Devils”. Now the “Devils” have been brought back, the people cannot and must not look for those “Protruding Deadly Teeth” that are ready to “PREY” on everything and anything.     If such a ‘dangerous’ proposition can be passed through the Parliament what does it say about our Parliament? Logically this shows that bad things can happen even when the Parliament is powerful. So whether Parliament is powerful or the President is powerful it is all the same.

    This Westminster model is not a democracy run by our representatives. It is a committee of Party Leaders. So long as our representatives have no right to vote CONFIDENTIALLY according to their own conscience we are fooling ourselves.

When the secret voting is in place, how is it, for 72 years, only radicals, war criminals, rapists, murders, drug dealers, male prostitutes and uneducated 8th graders being selected to Parliament? The truth is Sinhala Buddhist voters know nothing about democracy or Westminster Parliamentary System. They know only Briyani- Arrack voting and their reps.know only kleptocracy. You just try to white wash the Kandy Ayatollahs system as equal to democracy. But it is 1000 times worse than Sharia.

      In fact if the MPs had b***s, and could vote CONFIDENTIALLY most of the bills/Acts/Laws, Constitutions …. would not become part of the statute book, including constitution 1972, 1978, PTA 1978, various citizenship Acts, Finance acts, … none of the war criminals would be still controlling the state apparatus.

    My Grandmother whom I loved a lot and still miss her, always had a saying for every situation. Last night when I was in bed and thinking about 20A, subsequent PM’s commission and after decision made by the President in the Cabinet not to accept the suggestions but wanted the way it was gazetted, my mind shifted on to a question – what would my Grandmother say in such a situation. Well got the answer “Its like rain pouring on a buffalo”. I think that would be the most appropriate view.

    With all the opposition from all groups of voters, democracy loving professionals and learned religious leaders, its clear that the Government we have today is made of Buffalos.

    How do you treat a Buffalo if you want it to do what you want it to do? Well you shout and beat. We cannot beat our Rajapakse Family-SLPP Govt members but we can shout at them. How can this be done?

    There are two ways –
    1) Walk into every MPs home and office and demand immediate withdrawal of 20A gazetted clauses where dictatorship is introduced.
    2) Shout, what I mean by this is “Hoooooot” at every SLPP MP including the President, when ever pr where ever you see them, it can be that they are in a car passing you…

    The current position is that no body in SLPP is going to open their mouth against GOTHAPAYA. most SLPP AND SLFP MPS are just watching the situation without knowing what direction the government.there are more catchers who supports MAHINDA wants him to take the upper hand as they are not sure about their CABINET AND STATE MINISTER positions once the 20th amendment comes in to effect.there are lot of muslim MPS who can not eat or sleep with out 1/2 or 1/3 minister position waiting in line thinking and fighting among as to who should jump out first.if this situation arise the leaders like HAKEEM AND RISHARD will jump out first to make sure about cabinet positions.SAJITH HEMADASA will have a tough time to keep his party intact.but most ardent supporters who voted for this government will see the moon with in 2 years after 20th is passed.the match between SLPP-SLFP-ELIYA AND VIYATHGAMA AND ANOTHER MINOR GROUP WILL START SOON AFTER NEW CABINET FORMED AFTER 20TH AMENDMENT.GUYS LIKE WEERAWANSE ,GAMANPULLE,WEERASEKARA must get ready to find excuses once muslims are given positions in government as they were shouting from roof top against muslims during and after elections.no politician in srilanaka is worried about the country,every body needs minister positions-JAYAWEEWA.

Today Hemasiri told PCol, MS promised unlimited retirement perks and offered a diplomat position of his choice to Pujitha, for taking the blame after Easter. Rings a bell buddy. This is about Lanka and its politicians elected by the very own people, and nothing to do with Democracy. It is not the Tamils/minorities alone who elected such criminals. Denial seems to have no limits and now Democracy has become the scapegoat. Whats next ????
