Constitutional Council Approves AG Jayantha Jayasuriya As Next Chief Justice

The Constitutional Council has today unanimously approved the nomination of Attorney General Jayantha Jayasuriya as the next Chief Justice, and the nomination of Additional Auditor General Chulantha Wickramaratne as the next Auditor General, Speaker Karu Jayasuriya has said.

    Outrageous.
    For the first time, someone who has a history of downright partiality and lack of integrity is about to appoint as the esteemed Chief Justice post in Sri Lanka.
    As the Attorney General, Jayasuriya gave two wrong determinations in total bias towards the President, namely;
    1. Presidential term has 6 years.
    2. The President has the power to dissolve Parliament.
    In both cases, the Supreme Court has unanimously gave OPPOSITE rulings!!!
    However, there was speculation, no actually Dayasiri said that the President will seek SC’s ruling once again to determine whether the latter’s term starts from January 2015 or May/June 2015, ONCE A NEW CHIEF OF JUSTICE is appointed, giving the indication that someone who is partial to the President will be appointed purely to get a ruling in favour of the President!!!
    That appointment is made now.
    This is outrageous.
    Now that Maithri and Ranil’s last straw was also diminished with the no-show of race riots in the aftermath of suicide attacks, they will resort to seek a ruling from the new Chief of Justice who is partial to them, to postpone the Presidential Election.
    Anyways, whether there is any NEW ruling ABOUT HIS TERM or not, People’s Court ,which is Supreme, has already decided that Maithri’s term will be ended in January 2019.
    Therefore, Maithri will have to hold the Presidential Election at the end of the year definitely.
    If not, unlike today, there will be street protests demanding him to hold elections.
    People have already given extra 6 months for him even after knowingly killing 360 people and injuring over 500 other people by deliberately avoiding the arrest of suicide bombers prior to blasts.
    People have no room for anymore tolerance
    He should hold the President Election at the end of the year. Period.

    In Sri Lanka everything unlawful is given the trappings of lawfulness.

    At a high powered meeting discussing the date of the presidential election, it was agreed that it would have to be before November unless the President smuggled in a stooge as CJ and then dictated to him by telephone that he should rule that the clock measuring his term of office was set to zero when the 19th amendment was passed.

    Well, that seems to have happened. I do not know how the Speaker and the CC went along with this.

    Can such notices be released to the media without a signature from the person issuing the notice? Who takes responsibility for this? If this is the practice adopted, then it will be so easy for someone to take an official letterhead and release a notice to the media!

      This is not an official release. The person, who leaked it, has cut off the tail part of the letter to save his head. It appears that’s all what CT too got.

    I am inclined to believe that the Lawyers attached to the Attorney General’s Department has a prosecuting mentality. Hence the IG would not be an exception. Further they have been accustomed to safeguard the governments (to safeguard themselves) and the government departments when any disputes arises between the members of the public and the government. I believe, they are paid by the government for their services, on a monthly basis and the need to look far beyond their nose may not arise. Invariably they would like to satisfy the government in power. In the recent FR petition against the President, it appears they have failed to advice the government as to what is right and what is wrong for fear of antagonizing the President. If only, the Attorney General had put his foot down, the need to go through the FR petition may not have arisen.
    On the contrary, if a Senor Lawyer, with varied experience, who could continue to be on the bench for not less than 5 years, is appointed, preferably, with the concurrence of the Bar Council, may be an acceptable solution.
    Appointment of a Chief Justice should not be considered a ‘gift” given to some body when he/she nears the retirement age, for the services rendered to the ‘satisfaction’ of the government. The last two Chief Justices were appointed in a manner which is not conducive for the general public. In that the period they served as Chief Justices was inadequate.
    Incidentally a friend of mine who communicated with them to complain about the delay in receiving the verdict on an FR Case, did not receive a reply and they have gone.
    Invariably, all the Chief Justices and the Supreme Court Justices, at their inaugural speech give promises to ensure that Justice will be dispensed without fear or favour expeditiously, but it is seldom or never adhered to.

    Lankawe banned 14 international organizations and sought to International governments’ helps to arrest 350 international Tamil citizens under UN resolution 1373. They all Tamil speaking organization registered as many different Political or Charity organizations in Western democracies and operation black white in their lands. Later Mangala by the pressure of West brought it down as 240 citizens and 4 organizations. Ranil said they don’t have provision to arrest ISIS in Lankawe. He government was too happy to use resolution 1373 to attempt to have arrested foreign Tamil citizens, but he did not even talk about at least introducing a legislation to arrest ISIS members in Lankawe. This is because Ranil had his hand in the planning and executing ISIS sponsored Tamil Churches bombing on April 21st. If the law to arrest ISIS activists in Lankawe is introduced the Trio &some prominent ministers in cabinet & many Muslims ministers out of the 23 will go inside for having connection the ISIS activists. Arabian Oil well will go dry in Lankawe Ministers’ bank accounts. Many Lankawe traders too will be going in for dealing with ISIS activists. A government prize winning two years ago manufactured the bombs for ISIS partners to use in Lankawe. Can I inspect the bank statement of the dirty rascal, who inspected the factor to release this prize? Now, most of the ISIS operators in Lankawe are going to walk free for having helped Appe Aanduwa for bombing Tamil Churches, but for more than 20 years, Tamils who were doing pavement business in LTTE operated areas are in prisons without inquiries or cases for having sold products to LETTers.

    Saddam used Chemical bombs on Kurts. Aanduwa in addition to Chemical, Gas and Bio bombs using legally ISIS to help wipe out Tamils.

    In October Ranil struggled to hand over PM position to Old King. Main hurdle on that was SC, which supported TNA. Now that is removed while they were using the ISIS to camouflage their new pre-coup preparations.

    What I heard Jayantha Jayasooriya came from humble back ground. He studied and wanted to excel in that way. We know how he had to solve the bond Scam issue. So, we can understand how the rest in the future will be.
    I know one thing. Ministry of LAw and Order is highly wired and infiltrated. So, need some one like Jayantha Jayasooriya.
    Now, I can understand why Mrs B. selected Sarath N silva as the CJ.

    This appointment is the last straw that braked the camel’s back. The whole country knows the character of this man. Need of the hour is a regime change. People should get together and chase away these 225 crooks and force them to hold parliamentary and presidential elections immediately. This country cannot afford to allow these crooks and idiots to rule us any more.

    Previous Attorney General appointed as CJ was Sarath N de Silva. His tenure in High Office was the darkest chapter in Sri Lankan Judicial History, typified by so many partisan judgement which led to public apologies after he left office. New incumbent has already demonstrated his partisan nature by his previous decisions as stated by a previous commentator. He also overruled interrogation of PM in relation to Bond scam and instead he himself interviewed the PM. Hush hush under the carpet. Can Sri Lanka expect justice under honourable new chief Justice! Sri Lanka need to brace herself for 5 years of injustice unless a new saviour emerges and lead a future government which has courage to impeach.

    I totally disagree with Ali Sabry’s endorsement of the emergency law.

    It need to be amended , no one under the emergency law should be denied legal councel and not be detained more than an hour without the approval of a Judge .

    From 70’s to the end of the last war , we have some miserable memories of victims of all communities.

    Some people abused the law and used it to take revenge and in some cases to take advantage of sexual assaults and a lot of incidents were blamed on security , most of it todate are not been proved, which means most of the accusations against our Security forces were false and the real crimnals are free, very unfair.

    The danger of the emergency law is criminals too can abuse it and have abused it in the past.
    So I kindly request HE The President to move a motion to amend the law in a away that no innocent citizen suffers or no Criminal abuse it to take revenge.
    Our Emergency law is out dated and not in line with human rights .
    No Innocent must suffer of pay for the crimes of real Terrorists.

    Our international image is most important.
    May God bless Sri Lanka with peace and protect it.
