Easter Sunday Attacks: Dappula Steps Into Save Sirisena’s Favourite SIS Director Nilantha Jayawardane

Current Attorney General Dappula De Livera is proving to be one of the most corrupt and political appointments to the high office made in the recent past slavishly doing the bidding of President Maithripala Sirisena at every turn Colombo Telegraph can reveal.

Legal observers are shocked at how willing AG De Livera has been to ingratiate himself to Sirisena and his corrupt political ploys.

In a latest twist the Attorney General has his decision to order criminal investigations in to certain police officers for security lapses ahead of the Easter Sunday bomb attacks. Colombo Telegraph learns that Dapula De Livera has decided neither State Intelligence Service Director Senior DIG Nilantha Jayawardane or STF Commander Latheef should face disciplinary action or criminal investigation. The decision has been arrived at by the scrupulous AG on the basis of the final report of the three man committee appointed by Sirisena himself to look into the 21 April terror blasts that killed 250.

Colombo Telegraph has previously revealed how SIS Director Nilantha Jayawardane who is well known to be President Sirisena’s pet has escaped the axe for the Easter Sunday terrorist attacks while former defence secretary Hemasiri Fernando and IGP Pujith Jayasundara were made scapegoats. This is despite the fact that it was the SIS that received the original Indian Intelligence about the impending attacks. Colombo Telegraph has also revealed that Jayawardane briefed Sirisena about the warnings on at least three occasions including on the morning of the 21st of April.

It is a well-known fact that President Sirsiena’s main opposition to the Parliamentary Select Committee investigating failings that led to the Easter terror attacks is based on his fear that SIS Director Nilantha Jayawardane would also be summoned to give testimony at the committee. During that testimony Jayawardane would have been forced to admit that he had informed Sirisena about the attacks before Easter Sunday. To lie in testimony to a committee of parliament is as good as lying under oath in a court of law and would amount to perjury according to legal experts.

Dapula De Livera was appointed Attorney General after the Constitutional Council approved his nomination by the President on 7th May only two weeks after the shocking terrorist attacks in Colombo Negombo and Batticaloa. In less than two months he has proved to be worse even than his predecessor who shamelessly defended Sirisena in two cases – the 6 vs 5 years term and the dissolution of parliament case – that caused humiliation for the president making arguments in court that were anti-constitutional. Yet legal observers said that never had Jayantha Jayasuriya who has since been appointed Chief Justice stooped so low. Since he was appointed in May AG De Livera has performed the following tasks for President Sirisena:

(1) The day after Defence Secretary Hemasiri Fernando and IGP Pujith Jayasundara gave testimony on 5th June before the PSC that was deeply damaging to the President, Sirisena made angry calls far and wide blasting politicians and officials and even Speaker of Parliament Karu Jayasuriya for publicly humiliating him. He also gave AG Dapula De Livera orders to immediately move on the Central Bank Bond Scam case in order to embarrass and humiliate Ranil Wickramesinghe and the UNP Government. An Eager Dapula moved heaven and earth to do this bidding. On 6th June the AG issued a media release announcing that 10 suspects in the bond investigation would be indicted and the Chief Justice had been requested to transfer the case to the special high court for trials to take place daily.

(2) On 3rd June Sirisena ordered his Secretary to write to the AG demanding an opinion on the PSC looking into the easter attacks at a time when cases had been filed in court. The same day De Livera delivered. He wrote back to the President’s Secretary, Udaya Seneviratne that the PSC sittings could adversely impact the cases and also the investigations into the attacks itself. Sirisena then sent a letter to Speaker Jayasuriya by his own signature referring to De Livera’s letter which he himself had requested.

(3) Now just two weeks after he ordered the police to investigate Nilantha Jaywardane who heads the SIS Dapula De Livera has changed his position again. Colombo Telegraph learns that President Sirisena was extremely angry with the AG for having included the SIS director’s name in the last list. Dapula De Livera duly complied with instructions from his boss.

Colombo Telegraph learns that Dapula De Livera is eagerly doing Sirisena’s bidding in the hope that he will be appointed as a Judge of the Supreme Court before the President leaves office in a few months.

Legal circles argue that Dapula De Livera’s political servility extends beyond Sirisena to the Rajapaksa family as well. De Livera is actively sidelined officials at the Attorney General’s Department who are actively involved in prosecuting cases involving the former Rajapaksa regime. De Livera who is very active about the Bond case has managed to get his officers to file a motion to get the Courts to stop overseas leave for Geoffrey Aloysius who is the head of Perpetual group. However AGs officials do not even murmur when other indicted persons are granted months of medical leave – such as Gotabaya Rajapaks.

It is not clear why the highly dubious Attorney General is also trying to serve the Rajapaksas and whether that is also an attempt to curry favour with Sirisena who has one foot in that camp. But close associates who have watched his career say he might be trying to buy insurance with the next government that comes to power in Sri Lanka.

Senior lawyers told Colombo Telegraph that it was shocking that not since Mohan Pieris’ controversial term as AG has an Attorney General acted in such a blatantly political way. It is worse because the 19th amendment has given the office of Attorney General a lot more independence than before. “Even Yuwanajaya Wijethillake who was unremarkable in many ways had his moment of standing up to a President like Mahinda Rajapaksa who was much more powerful than Sirisena,” the lawyer said.

I think RW has not done anything against the national security but SIRISENA and his secret agendas against UNP weakened the national security. Even today Sirisena HAS NOT made any public statement on apology… he should long have done that since all is now becoming clear the lack of BP Sirisena paved the way easter day sunday boming.

          I beg to differ.

          Both Sirisena and Ranil Wickremasinghe have allowed their private grievances against each other to cloud over or over-rule public duty. That paints them both in very poor light.

          Just as much as it is the duty of the President to ensure that the PM and the DY.MINISTER OF DEFENSE be present at Security Council meetings without fail, it is the duty of the PM to at least keep parliament informed of their exclusion, given the importance attached to such meetings in the first place.

          Ranil’s attitude to stay quiet over his non-inclusion makes him – in my opinion – also responsible to a degree, since it indicates a lack of responsibility towards public duty.

          The lack of a public apology to date as mentioned, is truly regrettable. Two things matter in such things.:

          1). Conscience or an acute sense of responsibility 2). Caliber or “Class”.

Wonder, if it has something to do with the low mean IQ of 79 or the teachings of Para-Sinhala “Buddhism” that is an insult to the Enlightened Buddha? That is where the problems lie. This had become an epidemic in the land of Native Veddah Aethho. The Asgurita Para-Dinhala Monk wants to stone Para-Muslims.       Right at this critical juncture of lanken JUSTICE affairs, brave judges that have balls should come forward calling a spade a spade. We only want justic being served to the victimized in that blood bombing on the easter sunday that killled over 250 and injured over 500 of innocient prayers.

    What else can we expect from the appointees of “Illiterate” President Sirisena! His appointees have no character and like those “Pinata Seat Guys” SB Dissanayake, “Bookie King” Sumathipala, “Foul Mouthed” Dilan, and the “Party Jumping Deal Dasa” like those in the trees Wijedasa Rajapakshe are the most vocal ones today who are trying to direct the future of the country. What a shameful person we all have voted for to be the President.

    I vehemently opposed to the first para of this news item.
    Dappula de Livera was the Solicitor General before becoming the Attorney General. He succeed Suhada Gamlath, the former Solicitor General, who retired last year. (I guess Gamlath didn’t get an extension due to political reasons.)
    The Solicitor General is Attorney General’s deputy. (Please check the organizational structure of the Attorney General’s Department.)
    Therefore, when the Attorney General’s position is vacant, it is filled by the deputy by seniority, who is the Solicitor General. In fact, Dappula acted as the Attorney General last year, when the then Attorney General, Jayantha Jayasuriya was overseas.
    The President cannot hand picked anybody for Attorney General’s position, other than appointing the deputy. Therefore, Dappula de Livera, the current Attorney General is not under obligation to the President. Having said that, it should be noted that he has to work in collaboration with the government as the Attorney General is the Legal Adviser of the Sri Lankan government.

      Doesn’t the AG has the responsibility to make legal decisions independently of the government and the presidency? Otherwise, justice cannot be served. That Independence is imperative.

      Surely, the government can seek legal guidance from the AG, but it cannot direct the AG on legal decisions.

    Let AG do whatever he deems fit. In this particular case of “MASS MURDER” of innocent people, a case must be filed in an appropriate court by the “PEOPLE” naming all the “High Rankers” in the Security and Law and Order and NOT excluding, but INCLUDING the Minister. I am of opinion, that action must be immediately taken by the Cardinal Malcolm Ranjith ( he has a spiritual duty to protect his flock)l and he should be assisted by the Legal Fraternity and other Civil Society Organizations., irrespective of their political affiliations. Importantly, such a litigation must not be allowed to be used by any Political party for its advantage. How far that aspect could be safeguarded is debatable; because already this situation has been USURPERED by many unscrupulous politicians and heir goons.

    What is happening with the AG in SL has an eerie parallel with what is happening with AG in America right at the moment with only one difference: In America, AG is s direct political appointment by the Prez while in SL he supposed to be independent. In both situations, the resolution to the problem has now hangs in the hands of politicians b’cos it is either up to presidents own party to request him to resign or to make a bipartisan decision to impeach the president. In both cases, it is the lack of bipartisan support for an impeachment that has push the nation into a turmoil.
    However, there is a major difference between the two cases as to the reason for lack of bipartisan support: In SL, the chaos creating by the Prez are blessings for the major opposition party – SLPP & therefore, they are trying hard to defend him even amidst the revelation of a huge security blunder & lying to cover it up while in the US, the opposition is willing to go ahead but waiting without the support of the ruling party. In this situation, SL has no choice but to wait a couple of months for the next election.
    The biggest irony here is that Prez is ruining not just the Gvt he himself preside, but also the party he was made a Prez. With such a Prez, it is not very surprising to see an AG who got the job with the blessings from the Prez acting as the way he does – not necessarily illegal; but, highly immoral! This case will stand to show the eternal truth in politics: No matter how well the constitution is written or how impartial the appointment process is, there won’t be a higher level of democracy as long as the the rulers themselves fail to keep themselves at the highest level of ethical standards.

    Dappula looks untidy with disheveled hair. His mind too seems to be muddled like his appearance. During the Bond Commission hearing the Commissioners reprimanded him for his behavior and said that it is unbecoming for a Counsel.
    Quote “Commissioners, Justices Prasanna Jayawardena and K.T. Chitrasiri both said that in their lengthy careers, they have never seen such unbecoming conduct and also said that they have never witnessed anybody who kept making submissions following an order”.
    And now we have such a man for the Attorney General.

    Livera was a Hero here Last Week for organizing the Arraignment of poor Nandasena to attend Dr Ranil’s Special HC ,even with the Stitches still on the cheset after his CGB .

    Now Livera has become a rotting piece of Liver which our Diaspora mates use to Catch Crabs in Summer..

    On a more interesting development, I wonder why Kabir Hasheem and A.H Haleem who are the most Senior Muslims in Dr Ranil’s Yahapalanaya, and true Green Hardcore UNP Members, returned to their Minister Jobs without telling Dr Ranil?…
    And have left the Wahabis, Jihadhis and SLMC affiliates in the lurch.

    Could it be that the Sinhala Muslims have done the same as the Sinhala Catholics did , after the Jihadists Blasted Kochchkade, Zion and St Sebastian????…

    I don’t know if I am wasting my time. But this man’s partisanship was well known. Between him and his buddy the former AG who is now the chief justice Sirisena was able to block thwart and delay all the major corruption cases right from the beginning. When the bond scam case came to light however, maximum effort was made to humiliate the government and proceedings were started at record speed. At the beginning the public was generally unaware of who was behind the stalling of cases. But now it is no secret who the real culprit was. The UNP suffered then and it suffers now as a result of these two scoundrels. But it has yet to explain why both of them were promoted to their current positions where they can do even more damage. The AG’s department is supposed to function independently of the executive. Under the current situation with all the evidence that has come out during the PSC inquiry this scoundrel should have opened an investigation of the president followed by a recommendation of impeachment if found guilty. What is abundantly clear is not only is the AGs department completely politicized and compromised but the UNP has prooved beyond any reasonable doubt that they are eunuchs. No matter how well they have done at the grassroots if they carry on this way they will not be returned to power. Eunuchs cannot govern lichchavi or not.

When Hizz lost the election he went to MY3 and got nominated as a national list MP and then as Governor of east. Just watch how these fellows work and creep in between to achieve their objectives. He is writing Arabic to attract Arab tourists who may see Arabic for fist time at Kathankudy. Still the corrupt Sinhala fools are being enticed and trapped by these guys for money and votes.

    To me it is important to be fair and objective. Leave Mohan Peiris out. All others in the scene, starting from Yuwanjan Wijethilake, Suhada Gamlath, Jayantha Jayasuriya and Dappula Livers, are they all bad eggs? Some were accused as pliant to MR. Others were accused as pliant to MS. It is interesting to note that none of them were accused of being pliant to RW. It must be noted that top jobs in the legal machinery appointed in recent times, endorsed by the constitutional council, were unconventional, mainly citing some political connection of the “next in line”. But having received an appointment accusations are levelled at the appointee. So was the CC wrong? We must search our souls.
