Exclusive: Secretary General Hides Two Key Legal Findings On CJ Impeachment From CMAG

Commonwealth Secretary General Kamalesh Sharma may have covered up two key independent legal opinions on the legality of Sri Lanka’s impeachment of Chief Justice Shirani Bandaranayake, withholding the content of those opinions even from the powerful Commonwealth Ministerial Action Group (CMAG), Colombo Telegraph learns.

Speculation in Commonwealth and diplomatic circles is that the Secretary General has decided not to disclose the content of the opinions because they may have forced him to act against Sri Lanka which is the next host of the Commonwealth Heads of Government Meeting this November, a top diplomat told Colombo Telegraph.

It is learned that CMAG Chair Bangladeshi Foreign Minister Dipu Moni is unhappy about Sharma’s lack of disclosure of these key legal opinions.

Sharma has responded that the Secretariat’s “good office engagements” were privileged communications but admits to having received several legal and other opinions on the controversial impeachment of Bandaranayake.

It is likely the Secretary General was hoping the legal opinions he sought from two Jurists, from South Africa and the UK, would cast some doubt upon the illegality of the Sri Lankan process to remove its 43rd Chief Justice, top diplomatic sources said. When these opinions mirrored the conventional legal opinion that the impeachment was flawed, Sharma buried the reports, the sources allege.

The South African lawyer is reported to have passed away a few weeks ago and the jurist from the UK does not wish to disclose his involvement in the Sri Lankan impeachment case, Colombo Telegraph learns. However both jurists are believed to be eminently credible and are unlikely to have gone against the general consensus that Bandaranayake’s removal was patently unjust and in violation of Commonwealth and other international values and covenants.

On May 30, 2013, Canada’s High Commissioner to the UK, Gordan Cambell writing to Secretary General Sharma asked to be provided the opinions as a member of the CMAG that is the organisation’s key decision making body.

“As these legal opinions would be germane to the deliberations of the Commonwealth Ministerial Action Group with respect to Sri Lanka, I request that these documents be provided to High Commissioners whose ministers sit on CMAG so that they may consider their findings. I would appreciate receiving the opinions today,” Cambell said in his letter in May.

The Canadian envoy said that the Secretary General had “rightly sought” independent legal opinions from two eminent Commonwealth Jurists, Pius Nkonzo Langa of South Africa and Sir Jeffrey Jowell QC of the UK, as to the constitutionality of the dismissal of the Sri Lankan Chief Justice. In his letter Campbell notes a statement by Sharma on January 13, two days after Bandaranayake’s impeachment in which he claimed: “The dismissal of the Chief Justice will be widely seen, against the background of the divergence between the Judiciary and the Legislature, as running counter to the independence of the judiciary, which is a core Commonwealth value.”

In a response to High Commissioner Campbell issued by Sharma the same day, the Secretary General claimed there was a  longstanding practice of successive Secretaries-General that communications in support of Good Offices engagements were privileged.

“Indeed, it would be injurious to the discretion, trust and ultimately the effectiveness of the Secretary-General’s Good Offices if the sources and nature of privileged communications were to be compromised,” Sharma’s response to Campbell that was copied to all High Commissioners whose Ministers are members of CMAG said.

“It is these longstanding parameters of Good Offices – a breadth of informed sources and their privileged nature – that have served Secretaries-General and the Commonwealth extremely well. And within these important parameters, you will know that I have introduced the practice of providing regular and more detailed briefings than hitherto to CMAG about the full scope of my Good Offices engagements with member states,” Sharma tells the Canadian High Commissioner in his letter.

Kamalesh Sharma has been widely criticised for soft-peddling the Sri Lankan state’s increasing violations of Commonwealth core values and the incumbent administration’s erosion of democracy and human rights. It is believed Sharma used his good offices to prevent Sri Lanka from being included in the CMAG agenda for its meeting in April. Sources say the cover up of the legal opinions could be part of those moves. More recently, in a bid to help Sri Lanka to pick up a dwindling economy, the Commonwealth seconded a former employee, Indrajit Coomaraswamy to help Sri Lanka to frame its economic policy and achieve stability in the run up to CHOGM 2013. Coomaraswamy is paid by the Commonwealth Secretariat and functions from the Presidential Secretariat where he reports directly to Presidential Secretary, Lalith Weeratunge. Sharma’s reticence on taking stronger action on Sri Lanka which will not only host CHOGM this year but also assume the chairmanship of the organisation for two more years, has been roundly criticised by Commonwealth scholars and experts around the world.

Can you ask him to let the willing judge, Justice Udagama, to inquire into the numerous outstanding murders ?

    As much as the services of Dayan, Rajiv and Tamara were made use off by MR in 2009, to ward off pressure for any War Crimes Probes promising Devolution and the Implementation of the LLRC proposals, the services of the then AG Mohan Peries was the man behind the Sri Lankan Delegation to answer queries raised at the UN Sessions. This is because, before every UN Session Mohan Peries had made a trip to America for a briefing before hand. Therefore MP’s services were of great importance for Sri Lanka at the UN Sessions to defend Sri Lanka as he knew before hand what will be asked and what the reply was. Like how Nivard Cabral is the chosen person as Gocernor Central Bank, Mohan Peries is their choice as the Legal person. That is why although the CJ’s post was vacant after the retirement of Sarath N Silva, though it was speculated that MP would succeed as CJ, Shiranee Bandaranayake was appointed because MP’s services were required at the UN Sessions. However when MR found that CJ Siranee Bandaranayake was not towing his line, and the pressure of Crime Probes at the UN have been meticulously diluted, the nod was given to MR to replace SB with MP with the full backing of the Americans. Otherwise does one believe MR would have succeeded in removing SB and appointing MP, violating the Common Wealth Principles and risk the CHOGM?

      Former could be right, but appointment of MP cant be what MR planned long before. If MR is that pragmatic, how could he ever deploy troops to control the protesters in Weliveriya to that silly manner – big blunder or not ? The question who may have ordered forces to fire the innocent protesters stay as UNANSWERED BY THEM to this day. MR is not an able leader, he has proved it dozens of times. I really don t think his capacities are appropriate to lead a country. See, all the foreign missions today, are there any qualified personnels appointed by the current regime ? No.

        Sun, you are sadly mistaken about Mohan Peries. MP was awarded a PC by CBK for the canvassing done by a senior Minister in the CBK Cabinet, who was saved by MP appearing in is case for murder. Thereafter MP from day one after MR became the President has been a chosen Candidate to serve as a Director in MR’s Private Companies as Lanka Logistics and Rakna Private Security. Do you know that MP had a short stint at Harvard where the Americans cultivated him for his ability. MP is no different to Nivard Cabral because both are American sleuths working hand in glove with the lot, looking after MR for their own benefit.

    They should be well informed about the security in the Island when arriving for the scheduled Summit in Nov. An Island where people are being assaulted, tortured, abducted and gun fired on broad day light some times for no reasons – how can it provide the required security to prince charles and other foreign delelgations.

    Instead of discussiong about CW values, they would need to be ready to discuss the VALUEs of SAFEGUADING HUMAN RIGHTS in the summit. Unfortunately countries like OUR island under MR and co.will never learn these values. The R2P approach will well be the only option in saving the nation.

    Mr Sharma is determined to hold the Commonwealth Conference in SL. Although the opinions sought are privileged
    It is important to realize that in taking into consideration that SL does not abide by the core values of the Commonwealth
    this important opinions provided by the two eminent Jurists should have been provided to all the High Commissioners.
    Members of the Commonwealth at their next meeting should decide that all opinions, whatever the subject matter be made
    available to all the countries in the Commonwealth. The Secretary General should not have the authority to decide
    what opinions should be divulged and what should not be.
    I hope that in the interest of the Commonwealth all opinions sought by the SG be passed on to the Members
    of the Commonwealth in future.

      Dear Sir,

      Just imagine, if President Mahinda Rajapakse paid 150 Million US Dollars to Uganda for one UNHRC Geneva vote, how much the scumbug may be paying to you and other countries to safeguard the [Edited out] from Law suits.

      Also now that CJ Shirani Bandaranayke’s case has gone to Bribery Commission and a Law suit is brought against her, I was told the following about her.

      1) CJ Dr.Shirani Bandaranayake is the only CJ in Sri Lanka’s history who refused the free offer of Three Duty free car permits which she is been offered legally and she is entitled for.

      If she is in for money making, surely she could have sold these Permits for a minimum of five million rupees per each permit, or she could have impored the cars and then sold them and could have made minimum 15 Million rupees. But she refused this free offer because she is a honest CJ.

      2)Dr.Shirani Bandaranayake is the only CJ that never went abroad,either for Personal Vacation or as Official duty or for Seminars during the course of her period as CJ. She never spent Government funds nor used official leave for official duty or for personal vacation which she is entitled for. She saved money and her time for the country.

      Only if anybody could check how many foreign tours this new CJ MR Goon Mohan Peiris did for these few months will show how the crook spent Tax payer money and Time wasting on foreign tours.

      3)CJ Dr.Shirani Bandaranayake is the only CJ in Sri Lanka’s history that never took a single day off as Vacation or Personal Leave during the course of her period as CJ. She is entitled for 21 days Vacation and seven days of Personal leave per year, but she never used a single day during her time period as CJ.

      Please check as to how many day’s leave this new CJ MP has taken for this short period after he became CJ……….You will be surprised to see the results.

      Therefore how come this [Edited out] Mahinda Rajapakse [Edited out], bring lawsuit on a CJ who did her duty well and honestly to the country and it’s people.

      It’s time to Impeach [Edited out] Mahinda Rajapakse.

    It is possible and I have no evidence of this that Mr Sharma has been asked to pussyfoot around Sri Lankas thug master by none other than his fellow Brahmins in mother India. They are not going to act against a thug since they hail from a type of human who cannot say boo to a sheep.

    Mr Kamalesh Sharma is determined to have the CHOGM here and is another under the carpet sweeper wimp. I wonder how much of a Commission he is getting to have it here. We, as the public of the C Wealth never understood what reasons are given to persist in having it here. The CMAG too is a bunch of buffoons not to insist on cancelling this farce. He never wanted to push this on the CMAG or get the Heads of State to decide on nother Venue. Shame on the UK which can be in cahoots with the US to bomb innocent Iraqis, but do not have the spine to change the Venue or cancel or postpone. What a rigid institution the Commonwealth is. never evolved with the times.

    In any event, the Commonwealth of Nations is little but a joke and the fact that Britain’s support for the CHOGM was bought with Rolls Royce engines with which to refit Sri Lankan Airlines’ aircraft and RR cars for the Rajapassa family’s use after the CHOGM, shows that there is no hope of anything resembling decency from any member of this bunch of corrupt losers.

    It is a shocking disclosure to note the manner Kamalesh Sharma; Secretary General has conducted himself on a matter which is said to be germane to the deliberations of the Commonwealth Ministerial Action Group (CMAG) with respect to Sri Lanka in deciding hosting the next Commonwealth Head of Governments (CHOG) meeting in November in Sri Lanka.
    Commonwealth Secretary General Kamelish Sharma quite strangely has suppressed the fact that he has sought, among others, two independent legal opinions from two eminent jurists, one from South Africa and the other from UK on the legality of Sri Lanka’s impeachment of Chief Justice Shirani Bandaranayke and withholding the content of those opinions to the powerful CMAG.
    The Canadian envoy by letter of 30th May 2013 addressed to Commonwealth Secretary General Sharma has requested the copies of two opinions be provided to all High Commissioners whose Minister will be sitting on CMAG.so that they may consider their findings in respect to Sri Lanka. However, Secretary General Sharma, in his response of the same date has refrained from providing the copies to the Minister setting on CMAG in the disguise of these being privileged communications of his Good Offices.

    It is outrageous for Secretary General Sharma, even after it was called for by the Canadian envy, to suppress the contents of these opinions, on grounds of privilege, from CMAG.to consider for their findings in respect to Sri Lanka.After all these opinions have been proactively sought by him out of commonwealth Funds.

    The way Sri Lanka was strenuously lobbied for the hosting of CHOG in Sri Lanka and against backdrop of the Government’s corrupt and criminal political culture it is manifestly perceptible that Secretary General Kamalesh Sharma has been bribed by Sri Lanka government to soft-.peddled the illegality of the removal of Sri Lanka’s 43rd Chief Justice from office.
    On the revelation of the above conduct of the Secretary General on a crucial matter of independence of judiciary in respect to Sri Lanka, Kamelish Sharma should step down from office Secretary General as he failed in the performance of duties.

    Sir Sridath Ramphal was a Secretary General of the Commonwealth in the 1980s. He was an honourable man from British Guiyana of the West Indies. He was of Indian origin. Sharma is an Indian coming from India epitomising the corruption in India. One cannot expect anything better. He should be accredited for bringing down the Commonwealth to its lowest level so far.     Some decent diplomat should be appointed to an International body like commonwealth, not a shit fellow like Sharma or Barma, now it looks like the bloody SAARC they had sometime ago.

    The norm is that any country that hosts a high-level forum is praised by other participants. Can we expect that at this CHOGM? I doubt it. Some countries with influence are collecting data to present at this meeting that could embarrass the hosts. It will not be praise all the way as in other instances. The government too is providing more and more ammunition with Noori, Weliweriya, Grandpass, etc., for them to fire in November. Can you expect Canada (although the PM will not attending some responsible politician/ official will attend) to be silent at this meeting? I am sure it will be interesting to see how it proceeds. Will it be another “Black Mark” for SL.
