Former Sri Lankan Naval Officer ‘Complicit’ In War Crimes: Canadian Immigration

One of Sri Lanka’s top naval officers has fled to Canada but federal officials are refusing to accept his refugee claim on the grounds he was complicit in war crimes during the troubled island’s long civil war against Tamil rebels.

Nadarajah Kuruparan was Commodore of the Sri Lanka Navy, third in rank behind the Admiral, when he retired in June 2009 — just weeks after his forces helped defeat the separatist Tamil Tigers in a conflict that left untold civilians dead.

On Aug. 4, 2009, he arrived at the Canadian border with his wife and two children and made a refugee claim, a development that has only now emerged with the release of a court ruling on his case. He has apparently lived in Toronto since then.

One of only five ethnic Tamil officers in the navy, he said he feared the government, pro-government militias and rebels but the Immigration and Refugee Board ruled he was not a genuine refugee because he was complicit in crimes against humanity.

His appeal to the Federal Court of Canada was dismissed on June 13, and he and his family now face deportation to Sri Lanka. The court ruling was significant because it upheld the finding that the Sri Lankan military committed atrocities.

“The extensive sources of evidence and the reporting contained therein, including references to tens of thousands of disappearances and the institutionalization of torture, supports a finding that the navy and security forces’ acts were part of a widespread or systematic attack on Sri Lanka,” Justice John O’Keefe wrote in his 50-page decision.

Since the end of Sri Lanka’s civil war, evidence has emerged suggesting the Liberation Tigers of Tamil Eelam rebels recruited young children and used civilians as human shields. Government forces, meanwhile, have been accused of shelling civilians and executing captives.

Western governments, the United Nations and human rights groups have been pushing for an independent investigation into the war crimes allegations. Sri Lanka has refused to co-operate with such a probe and defended its wartime actions.

David Poopalapillai, the Canadian Tamil Congress spokesman, said the court ruling gave credibility to the war crimes allegations.

“Now our judicial system, one of the finest in the world, is echoing this same thing. It means the Sri Lankan military apparatus have committed war crimes and it should be investigated,” he said.

While ethnic Tamil civilians and former rebels commonly seek refuge in countries like Canada, it is unusual for Sri Lankan military officials to do so. Mr. Poopalapillai said only a handful have turned up in the United Kingdom and United States, but none as high-ranking as Mr. Kuruparan.

According to the court ruling, the commodore joined the navy in 1981 but he said as a Tamil he faced challenges. He was approached repeatedly and asked to help the rebels, he said, and while he refused, the navy still suspected he was a sympathizer.

A month after he retired, he said his wife was abducted by the Karuna Group, a pro-government Tamil militia. He said the group demanded a large sum of money and threatened to kill the entire family if it didn’t get paid.

The Kuruparans travelled to the U.S. and asked for asylum at the Canadian border. But the IRB found that while he had never personally committed a war crime, Mr. Kuruparan “participated in facilitating the navy’s operations, which included the darker aspects of those operations.”

Although aware of the atrocities committed by the Sri Lankan forces as early as 1985, he made no attempt to leave, even when travelling abroad, the IRB found. The board found he “had been complicit in the crimes against humanity because he had a long service with the navy, an organization that was known to regularly and systematically commit human rights abuses against the LTTE, the Tamil population and individuals suspected or perceived to be LTTE collaborators or sympathizers.”

    That says a mouthful.

    Now that War Crimes has been accepted by Canada, it needs to be fully investigated independently…..This is just the tip of the iceberg.

      1. Sri Lanka must and will sooner or later account for abuse with in her Institutions. As a Sri Lankan patriot, I fully support that. It will strengthen our country. It will be done by the Sri Lankans for Sri Lankans. Will never be done by foreigners with a hidden agenda or under pressure from LTTE Die-Ass-Pora.

They provided the funds and propaganda required by the LTTE terror outfit to commit massive war crimes in Sri Lanka over 30 years against Sri Lankan men, women and children. They must caught and punished swiftly and severly.

      Make no mistake net will be cast. Even you might have to run for cover very soon. Hope you will not destroy the evidence you have of LTTE war crimes in the meantime.

        It is very interesting to note that this Donald G fella has all of a sudden become a human right activist. As raised in many other forums, I am curious where was this Donald Fella during the time when LTTE ran amuck killing moderate Tamils, poor Sinhaleses and Muslims. May be his mouth and other end may have been plastered well to not to talk against those carnages.

        As you indicated in your comment, it has been well known fact that [Edited out] was carrying out fund raising activities in the western world and pumping funds for LTTE monkey terras to carry out the futile war for last 30 years. Surely [Edited out] needs to have [Edited out] share on the so-called war crime.

      The fact that they cannot find any evidence on Commodore Kuruparan, but are simply rejecting his claim on the grounds that he was in the SL Navy is what actually speaks volumes. It’s the same old story, lots of allegations, but no evidence to even charge one individual. His deportation will only convince any fence-sitters never to come forward and admit anything.

    He should be given “protection” and held in some “unknown” country
    as a crown witness, for the benefit of the War Crimes pending case
    is I believe a wise course of action for consideration by Canadian
    Tamils?

    If V.Perumal could have been held under Protective Custody, why not
    this Officer, of course not in India, who are also with skeletons
    in the cupboard as far as SL Tamils are concerned, concurrently.

    In Sri Lanka there never was a WAR to claim WAR CRIMES by the Defense Force trying to save the country from an Armed Terrorist group called LTTE. If Donald is talking about War Crimes, then he and his brother and many others are also responsible for killing and maiming thousands and thousand of Civilians as they supported the LTTE to prolong the Armed conflict with the Sri lankan government.
    When we talk about war crimes, the present Sri lankan government has failed to charge the present LTTE leader and others who supported the LTTE arms struggle and making the LTTE to take 300,000 civilians with them to save them from the fire powers of the Sri lankan Forces.
    Sri Lankan government should report and charge KP (Kumaran Pathmanadan) as a MASS murderer for supplying weapons for the LTTE during the 30 years conflict.Then the government should [Edited out] and [Edited out] along with Adele Balasingham, [Edited out], George master, and many others who was responsible for collecting money to buy weapons for the LTTE, and forcing the LTTE to keep the innocent civilians as Shields for the LTTE.

    In addition to this every one who is now in the World Tamil Forum asking for a separation also should charge for supporting the LTTE for killing over 180,000 civilians. This should include those LTTE supporters who collected millions of Dollars to buy weapons to kill the people. If LTTE never commenced this Arms struggle the Sri lankan Army should not have gone to annihilate the LTTE and in the fight to annihilate the LTTE they were forced to fire at the LTTE masquerading as civilians killing some civilians, and this can be call collateral damages.

    While charging these Tamil militants like [Edited out] and others, the GOSL should establish a very independent panel to look into any deliberate killing of Tamil civilians, and if there is evidence then they should cahrge those Army soldiers and officer responsible for unwanted killings.

    What I suggest is a very fair game as [Edited out], his brother [Edited out], Adele , KP are also guilty in killing Tamils as well as Sinhalese and Muslim people by supporting and supplying weapons to the LTTE.

    Only the Sri Lankan Defense Force can fight a WAR or a TERRORIST uprising for 30 years with out a opposing fighting group.

    This guy will be in more danger in Canada from Tamil terrorists pretending to be “innocent refugees” that Canadian politicians warmly welcome, for their “campaign donations” and promised votes… The refugees are hell-bent on fabricating a story on any given matter, just to protect their ‘refugee status’ in the greener pastures of the west.

    Canada can have these extremists if she wants. Sri Lanka will be better off without them.

    How come the Canadian courts declare that Sri Lanka committed war crimes without any evidence to prove that. It is like heresy.

    Again here, even if husband did something Criminal, wife won’t be condemned because of what the husband did. How come they say he involved in any crimes, even if some one proved that SL NAvy engaged in war crimes, without evidence and just based on he said, she said stories..

    What are the War crmies of SL – Navy, sinking the LTTE ships and attacking LTTE – suicide boats ?

    This guy is from the famous Jaffna Hindu College, where so many Eelam Heroes came from. What a shame.
    During 1981/82 period for of his classmates got admission to the newly created Kothalawala Defense Academy. All of them either selected for engineering of medical stream. They were selected after repeated requests by some anti- Tamil “Tamils” as a “show pieces” to blunt the argument that the SLGov is heavily biased towards Tamils.
    After 1983 riots where Sinhala mob looted and killed Tamils and Tamil property all but him left the Kothalawala Defense Academy. He stayed on and “served” in the navy. Now after his job is done now he claims that the Sinhala Gov discriminated him. What a crap? I think the Canadian gov can’t help. It is so ridiculous that he says is afraid of SL gov. It is true that there are so many people both Sinhala and Tamil who are scared of SL Gov! But this guy is an insult to the Canadian peoples intelligence. What a crap!
