Grant Amnesty To All Tamil Political Prisoners: Wiggie And The NPC

Both the Northern Provincial Council and Chief Minister C.V. Wigneswaran today called on the President to grant an amnesty to Tamil political prisoners who are languishing in prisons all over the country, even after the war coming to end 5 years ago.

Chief Minister Wigneswaran in a letter addressed to the President said that authorities should file indictments without delay if there are any credible charges against those detained or should take immediate steps to release them.

A media statement signed by the NPC Chairman C.V.K. Sivagnam said that many hundreds of Tamils arrested on suspicion during the war were still detained in prisons without any court action.

“Therefore this council requests the President, Minister of Justice and Attorney General to grant amnesty at least on humanitarian grounds and release all political prisoners who are detained in prisons”.

Tamil political prisoners detained at the Magazine Prison in Colombo today launched a hunger strike urging the authorities to release them. The detainees were refusing to take their food and were staying in their cells, according to a prison officer.

Simultaneously Tamil political prisoners detained in all other prisons across the country too launched a hunger strike today.

Meanwhile Chief Minister Wigneswaran in his letter addressed to the President said that Tamil Prisoners were staging a fast today to register their protest at their prolonged imprisonment.

“There is concem that the fast may be violently dealt with by prison officers, as has happened in the past. The problem is a human issue that should be dealt with passion and empathy, given the number of years that these unfortunate human beings have been kept incarcerated without trial” he added.

Wigneswaran went on to say “if steps could be taken to give those unfortunate persons the assurance that measures will be taken in respect of their cases within a specified period of time they would be satisfied”.

Wigneswaran in his letter to the President suggested several measures to address the issue.

These included the preperation of a list of the prisoners, categorizing them according to the offences in respect which they have been taken into custody. Secondly grant an amnesty or at least release on bail those who are suspected of committing minor offences.

Next the chief minister suggested that all detainees suspected to come under the provisions of the Prevention of Terrorism Act, but against whom no cases have so far been filed, could be released on adequate bail.

He also called on the President to give urgent directions to the Attomey General’s Department and the Police to file indictments within a specified period of time.

Also Wigneswaran suggested to release on bail, the detainees charged under the PTA, but whose cases have not been taken up for trial or are pending, where the only evidence against them is a so called confession.

The Chief Minister proposed legal aid for those against whom cases have been filed and other evidence are available and finish cases on a priority basis.

Meanwhile the Commissioner General of Prisons Rohana Pushpakumara, had met the fasting prisoners at Colombo Magazine prison today and had requested them to give in writing, their grievances while promising to hand over the document to the President.

The government is yet to reveal the exact number of Tamil political prisoners but according to prison sources the number exceeds 300.

        Successive Sri Lankan governments killed tamils in the most inhuman way since independence. Starting with peaceful unarmed sathyagrahis to the government sponsored pogroms thousands of tamils were butchered.

        Since the armed conflict started the government military massacred thousands of people in schools, churches and in their homes by aerial bombings and with multibarrel rockets, not forgetting the mass killings and burials in villages all over the northeast by the locally stationed military. Government sponsored crimes by its military were far worse than that of the LTTE.

        You can’t whitewash these crimes because these crimes are documented and known by everyone. The impeding UNHRC investigations will reveal more of the abominable crimes of your war “heroes”. Get your head out of the sand and accept the truth.

            It is correct that if the late “lamented” Velupillai Prabakaran was still around, “Wigi” will even live in the North, leave alone open his mouth! If these militants are set free, we will be looking over our shoulders forever. And bombs and terror will start again. One other point: Dr. Ben Carson who is a contender for the U.S Presidency said that respective African-American(or Black American) leaders have, over generations made-out as if the Blacks were badly treated and such treatment was more the norm than the exception. He went on to say that the Liberals of both The Republican and Democratic Parties continued to make a big deal of this and show the world that there is a problem with the minority, namely the Blacks. A Black is therefore marginalized in a manner of speaking and always regards himself as a lower class of citizen. This is exactly what the high-cast Tamils, Tamil Politicians and writers are doing. making a big issue of the “non-issue”. Now, this is going to raise the hackles of many but CONSIDER. Are we going to forever be contending with each other, have the international media give undue attention, never really be regarded as a member of the civilized colony of humans?

            You would have heard Dr. Carson go on to say that if he becomes President, he will surely do everything to bring changes.

        I read the Hybrid Resolution even as late as yesterday,

        And the Bedouin Prince has inked in the starting date as the year 2002 AD for War Crimes against Humanity by the Sinhala Buddhists..

        These must be innocent people who have been locked away for no reason.

        President Sirisena and the PM Batalanda Wickremasinghe can also save money for the renovations of the new Presidential Palace .

        Plus make room for the Sinhala Buddhists from the South who have been bit agitated by Batalanda’s micro Economics of culling their jobs , stopping their infrastructure,and stopping their Mahavidyalayas.

        And the first batch of detainees will arrive soon from Hambantota.

        Can you please tell us from which TN tribal area (Dalit) your ancestors came to SL and got converted?

        According to Jaffna Tamil Vellala elite politicians (the Colombo 7 group) of the past, the Sinhalese are nothing but low caste South Indians (Kerala, Tamil Nadu & Andara) who got converted into Sinhala-Buddhist.

        Unfortunately today, the genetic studies show that more than 50% of the Sinhala population is having South Indian genes proving what those Colombo 7 Vellala Tamils said, that is most of them (Sinhalese) are South Indian converts.

        Even Sinhala elites like J.R. Jayawardene (grandson of Tamil Thambi Mudaliyar) and S.W.R.D.Bandaranaike (a direct decedent of Nilaperumal, a Tamil from South India who arrived in Ceylon in the early sixteenth century) are included.

        On the other hand, according to the Mahavamsa, the Sinhalese (Sinhabahu’s grandson Vijay and his men) are criminal convicts who were exiled from India, Sinhapura (Bengal/Orissa). Their boat came and landed in the Veddha country called Lanka.

        G. G. Ponnambalam in his 1939 Nawalapitiya address said that ‘the Sinhalese are a hybrid mongrel race split from the aboriginal Tamils and mixed with Aryan invaders’. This was the spark that ignited the first Sinhala-Tamil riot in Sri Lanka in 1939 but the British were quick enough to put it down.

      Siva, to give the devil his due, it was mooted and accepted by Pres Rajapaksa. To release those who had not committed violent crime and then take court action against those who did. Of the latter, to put it mildly, bad and very bad type. The bad, if found guilty was to get a pardon considering time served. The very bad, if found guilty had to serve time.

    Not if they were terrorists or terrorist suspects. Neither USA nor India does that. USA waterboards them, tortures them in secret locations and India of course has no compunction in torturing Muslim Kashmiri terrorist suspects. Look at how rule of law was applied in the case of your Tamil HINDU TIGER TERRORISTS who were responsible for attempted murder of CBK. They were tried in court and found guilty. Better thing to have done was to do what USA, INDIA and even SL did with JVP in 1987-89. Dispose of them.

      There are precedents in this island.

      JR freed JVP terror leader and his supporters.

      JR freed Tamil youth who were detained under PTA in 1988 and after.

      Chanrika freed members of JVP terror group just after she was elected president.

      A few Tamil terrorists were released after Army/Police were being bribed.

        Discussing about your Salagamma ancestors. Actually they did not come from Kerala but from Tamil Nadu.
        There are rituals that were performed when Brahmins crossed the seas. You are not from the Brahman community so stop posting rubbish. Nowadays Brahmins cross the sea and migrate everywhere. There are around 93000 Tamil Brahmins in Sri Lanka( Jaffna Brahmins not sure is all of them now live in Sri Lanka as many like all other Sri Lankan Tamils have migrated)

        I am still finding it difficult to understand your above statement. It does not have any logic. You are saying the Sri Lankan Tamils/Saivites are tobacco farmers brought by Dutch from Kerala. Is there any proof for what you are saying or is it just a made up story?

        If what you are saying is correct then I have some questions for you to answer.

        1. The people of Kerala are known as Malayalees and they speak a language called Malayalam. How come those Malayalee tobacco farmers from Kerala became Tamils and adopted Tamil language/culture instead of Malayalam language/culture after coming to Sri Lanka?

        2. During the Dutch period, the Dutch Predikant Philippus Baldeaes has mentioned about the inhabitants of Jaffna Patnam as this part of the country was times past peopled from Coromandel Coast. He talks about ‘times past’ and not present time (Dutch period). So, how can you say Dutch brought them when the Dutch were saying, a part of the country was peopled TIMES PAST from Tamil Nadu?

        3. We all know about the Jaffna kingdom that existed from 13th century on words (long before the Dutch came) and the last Tamil king of Jaffna Cankli Kumaran was defeated in the battle with the Portuguese in the 16th century. What happened to all those Tamil people of Jaffna who lived during the Jaffna kingdom?

        Could you please answer these questions without running and hiding like you did before. Can you also show some reliable evidence to your story?

        The well-known fact is throughout history from before the arrival of Vijay to almost until the independence in 1948, immigrants from South India (Kerala, Tamil Nadu, Andara) came to Sri Lanka in many different forms, as Peaceful immigrants, as Invaders, as Warriors, as wives of Kings, as Kings, as marriage partners, as maids, as craftsmen, as weavers, as solders, as tobacco farmers, as cinnamon peelers, as Tea/rubber/coconut estate workers, as fishermen, as pearl divers, as toddy tapers, and so on who later settled in the entire Island and were naturalized (Sinhalized and Tamilized) during the course of time, except a few like the upcountry estate (Indian) Tamils brought by the British who are still having a separate identity (not naturalized).

    The government is committing serious human rights violations by keeping these persons in detention without trial. This provides further evidence of sustained mistreatment of people of Tamil ethnicity. Despite what the legal nitwits of the TNA say, this provides further evidence of the structural genocide of Tamil people in Sri Lanka by successive Sinhala governments. It is best that this government at lease seeks to reverse this process by releasing those in custody as soon as possible or file charges so that they could be met in accordance with the law. Whatever Sumanthiran and the TNA say, the diaspora will ensure that the genocide of the Tamils is punished through available means in the law. A fraudulent trial in Sri Lanka will not efface guilt of those responsible. There will open up other lawful ways in which those responsible could be made accountable.

    Honorable CM, I respectfully disagree on the point of giving bail for those arrested under PTA. This could lead to a dangerous precedence as it can be potentially misused in the future by our corrupt politicians.

    As a learned (formed) Supreme court Justice, you are perfectly right to request a special route to expedite for those detained. My hearts goes to all those suffering under the broken, lethargic and lackadaisical Judaical system and officers.

    As CM is well aware, Sri lankan politicians will never walk the talk and your call will only fall in deaf ears.

      The PTA is a draconian piece of legislation contrived to oppress and subdue the democratic of people right for expressing dissent. There are adequate laws provided in the Penal Code for dealing on the subject of maintaining law and order when necessary.
      The word ‘terrorism’ is a convenient label often affixed on those who are compelled to take the step as a last resort to protest whenever authorities who hold the reins of power to override and thwart basic human rights that a civilian has as citizen of a civilised country, and that is something which a non Sinhalese in SL can do without is the general assumption.
      When a person is taken into custody and detained unreasonably for indefinite length of time on mere suspicion or on the basis that he/she has committed an offence and no evidence is used to charge that person in a court of law, the government is breach of the basic human right of that person. It is that what the CM of the NPC is concerned with and has addressed the President about.
      What is the purpose of the Commissioner General of Prisons to request in writing the grievances of prisoners as if he is so dumb as to not to be aware of what is really happening when every one knows it will go into the WPB.

    Every suspect arrested under the obnoxious Prevention of Terrorism Act is presumed to be guilty until he is proven innocent.

    Bad as that assumption is, it is not as bad as refusal by the authorities to take necessary action to determine whether the suspect is guilty or innocent.

    Keeping a suspect in detention for years and years without indicting him amounts to nothing less than an act of prolonged psychological torture.

    This singularly obnoxious piece of legislation was drafted to punish Tamils because almost every person who is incarcerated under this draconian law is a Tamil.

    When it comes to enacting obnoxious legislation, few legislative bodies in the world can compare with Sri Lanka.

    How can we have any respect for a parliament like this?

    There are people who planed bombs in civilian buses in there. The bomber who took out an eye of CBK there too. There are not “political”.

    He wishes to whitewash LTTE crimes. However, does not wish to whitewash alleged crimes by his employer.

    Who really are these “political prisoners”? If they are not LTTE terror suspects they should be released.
    If they are LTTE terror suspects they should be kept in until the UNHRC mandated investigation is completed. These prisoners might be key witnesses and informants that would be an asset for successful completion of the investigation.

    His asking for the release of the ltte terror suspects is because he wants them out of prison and out of the country before the investigations start. We are told so many people were killed by the army we are sure these people will be in a better position to give evidence than anyone else. They have been inside for almost 5 years so now they should be kept there for a few more months so they may be able to provide some information of what actually happened (even though some of it may be lies and their imagination)or what the diaspora wants them to say.

    The government’s honesty of purpose in pursuing reconciliation could be judged by how they handle this issue. We won’t have to wait long for that.
    What is the meaning of detaining persons for years without framing charges? Are they still looking for evidence? Or trying to cook what was obtained as ‘confession’ through torture to look realistic evidence?

    The same time grant full pardon to all Military and police officers Politicians and other convicts ,because Sri Lanka never had a true and unbiased judicial System , so pardon everyone and then bring in new laws and punish anyone who breaks it severely after the date instituted .

    If you bring laws and try to punish people of today ,you will also have to bring back to life the once who got away and now a skeleton in the grave.

    You can punish a selected few neither no one has the right to pardon a selected lot ,what is fair and right for the Tamils is also good for the rest of the Citizens of the Country.

    Politicians and their henchmen must also stop taking advantages of Religion and its traditions to gain Political mileage ,please stop also using the poor and the less educated and less informed as milking cows ..

    Tamils were defeated because big countries wanted to defeat us- it is no point in fighting now against the will of big countries instead we can get a good political solution with the help of them. Tamils have many important tasks at the moment. Urgently we have to save our beautiful country from becoming desert by destroying trees digging sand and allow sea water into the country, save soil from poisoning. We have to replant trees in all cleared area. It might take many years, but we have to reclaim all stolen land from robbers. To do all these vital tasks, we need a solid political solution. We want Sambanthar, Sumanthiran, Vikneswaran & Gajenthirakuman etc to stop pulling in different direction, work together to achieve a good political solution with the help of UK, US and India – we can’t achieve anything without the help of big countries. They all willing to help us – only crying baby get milk, so we all get together and cry.

      Senthil, can you give me the reference of a “political solution” generated by any political maestro which purports to satisfy political aspirations of at least 90% of Tamil speaking people irrespective of their religion or the date of arrival?

      What you have in your mind is this “holiday resort” model in NE for Hindu and Christian Tamil spakers who are less than -50% of the total Tamilspeaking population(less than 10% of the total population )? What is bad for -50% is good for +50% ?. An argument very difficult to digest mr Senthil.

      Shall we look at it this way. There has not been a solution for 67 long years, as many bemoan, BECAUSE there is no conceivable solution.

No 48 of 1979, Regulations made under the Public Security Ordinance or any other written law which makes express provision in respect of the release on bail of persons accused or suspected of having committed, or convicted of, offences under such other written law
    (2) Where there is a reference in any written law to a provision of the Criminal Procedure Code Act, No 15 of 1979 relating to bail, such reference shall be deemed, with effect from the date of commencement of this Act, to be a reference to the corresponding provision in this Act

    Prisnors who are even inderectly responsible for murder have to be rehabilitated. Sinhala who are accused of crimes need to be rehabilated. An exchange is possible. Many are psychotic after being under tension. Thay depended on drugs and rape to kep on mania during the rebelion. They did many heroic deeds.
