I Am Not Convinced The Appointment Of Yet Another Commission Of Inquiry: Human Rights Chief

United Nations High Commissioner for Human Rights Michelle Bachelet today said she was troubled by the recent trend towards moving civilian functions under the Ministry of Defence or retired military officers, and renewed reports of surveillance and harassment of human rights defenders, journalists and victims.

In her oral updates and introduction to country reports of the Secretary-General and the High Commissioner at the UN Human Rights Council’s 43rd Session, Michelle Bachelet said, she also was not convinced with the appointment of yet another Commission of Inquiry to address Sri Lanka’s human rights issues.

High Commissioner said: “I move to our update on Sri Lanka,HRC/43/19, assessing the progress made in implementing Human Rights Council resolution 30/1. I regret that the new Government has announced a very different approach to the commitments previously made in the resolution which risks setting back efforts to advance reconciliation, accountability and human rights.

“The State must work for all its people and the needs of all communities, particularly the minorities, must be acknowledged and addressed. I urge the Government to preserve and build upon the gains which have been made over the last few years. In particular, I encourage the Government to ensure the Office on Missing Persons and the Office of Reparations are provided with political and resource support. The families of missing persons from all communities deserve justice and redress.

“Sri Lanka’s independent institutions, strengthened under the 19th Constitutional Amendment, are a key pillar in its democratic structure. And the space for civil society and independent media should be protected. I am therefore troubled by the recent trend towards moving civilian functions under the Ministry of Defence or retired military officers, and renewed reports of surveillance and harassment of human rights defenders, journalists and victims. The increasing levels of hate speech, and security and policy measures appear to be discriminately and disproportionately directed against minorities, both Tamil and Muslim.

“The fundamental problem remains that Sri Lanka has still not addressed impunity for past violations, nor undertaken the security sector reforms needed to address their drivers and enablers.  Systemic barriers that continue to exist within the criminal justice system remain an impediment to real justice. Domestic processes have consistently failed to deliver accountability in the past and I am not convinced the appointment of yet another Commission of Inquiry will advance this agenda. As a result, victims remain denied justice and Sri Lankans from all communities have no guarantee that past patterns of human rights violations will not recur.

“I urge the Council to remain alert to this situation in terms of prevention and to explore all possible avenues for advancing accountability.”

    Compared to the hypocricy of militant posturing Sinhala Buddhist nationalists and slavish sycophants of the government, whose claims to patriotism are nothing but sanctimonious humbug to fool the masses – true patriots are those who have quietly rendered a lifetime of dedicated service to the nation without fear or favour and with a passion for justice, truth, and integrity in a free and righteous society.. All such true patriots ( including many like myself amongst the ethnic and religious minorities) have reason to be delighted at the excellent reaction of Michelle Bachelet the UNHRC High Comissioner in response to the foolish and arrogant decision by the government to withdraw from the Joint Resolution. One hopes the UNHRC and the international community would for the greater good of the people of Sri Lanka, take serious note of her appeal urging ” the Council to remain alert to this situation in terms of prevention and to explore all possible avenues for advancing accountability”

      Professor, this is no longer a colonial nation. Foreigners do not decide the future of the country. The majority – and not any white or kallathoni minority – are in charge of all major administrative functions. This basic right has been denied to the majority since the Portugese invaded in 1505. The right reverends, kallathonis, and the gang of human rights champions/NGO’s must come to terms with this basic fact. In any case, Sri Lanka has always been liberal, more so than the West, which used gunpowder (invented by the Chinese) to subdue native populations all over the world, killing millions in the name of their Christian god. Sri Lanka has had women’s rights, free education, and no racial discrimination for 2500 years. I don’t think these are in any danger, unless the separatists get their way. And that is rather ironic, don’t you think? When Bachelet’s fellow Europeans ruled the island for 400 odd years, segregation and discrimination were considered normal. There are still many native buggers going around chanting “sir” in exchange for 10 SLR; this is the real tragedy, not terrorists being eradicated on the beach.

    Thank you for calling the Bluff of the GoSL and its statement on Commission of Inquiry. They have their head in the sand of Impunity. Cannot expect anything from those who had Command Responsibility for the Crimes. The Maha Sangah and those majority who voted for GR to be President gave immunity because of their Office. The opposition leaders are in denial also. There will be no justice for the Victims of the Crimes.
    The UNHRC need to seek Universal Jurisdiction and refer Sri Lanka to the ICC. It will not only bring justice but also ensure preventing further violence perpetrated against the Tamils, Muslims and those who defend the Rule of Law.

Yes they are using Tamils to get what they want, but it is up to Tamil leaders to make use of it for the benefit of Tamils. UNHCR has regretted on Sri Lankan withdrawal of joint sponsorship. USA and India are watching the situation. Tamils must put Sri Lanka at loggerhead with other nations and reap the benefit. In 1987, in order to bring Sri Lanka to its knees India used Tamils. It is because JR wisely surrendered that nothing drastic happened to Sri Lanka. Unfortunately that stupid fellow Prabaharan due to his selfishness, instead of putting Sri Lanka and India to fight and get the benefit, he took money from Sri Lanka and fought India, with disastrous consequence to Tamils. What India and USA are demanding is not possible for Sri Lanka to concede, due to which there will be conflict. Both India and USA are not prepared to trust any Sri Lanka government anymore, after previous government let them down on the promise to move away from China. If Tamil leaders act wisely and sincerely, Tamils will get what they are demanding.

    What Dinesh Gunewardena proposed is not a one man Commission to Investigate. All he proposed was a one man Commission to look into the previous commission reports. Why review previous reports? The reports have already been submitted.

    If SL Armed forces have not committed any atrocities why not have an Independent Public Inquiry with 5 Supreme Court Judges on the Bench and with UN as observers. Even if UN is not given observer status at least open the investigation to the local and international media.

    Its also a slap on the face of Senior Politician Dinesh Gunewardena as G L Pieris who is not a Minister and no one in the Government announced this decision of the Govt before Dinesh as Foreign Minister announced it. Shameless Dinesh Gunewardena should have resigned on this alone.

    Sri Lanka will never address impunity for past violations, if anything it will get worse. You have a better chance of stopping the sun from shining than getting the Sri Lankan state to address past violations. So, the UNHCHR needs to either admit that the war criminals have gotten away or establish a international war crimes tribunal to try them. Talking about it or expecting the Sri Lankan state to act is a waste of time.

    Ms Michelle Bachelette i don’t think know much about the misdeeds of the Civil Political Leaders whom she is in love with for their obedience to the UN Human Rights Guardians.

    They ripped out the guts of the Nation under Yahapalana including its Economy and most importantly the National Security and its innocent inhabitants personal Security.

    Santhosams from every Government Deal including Import of Coal . Power Plants, Infrastructure Construction and even Alcohol.

    But the saddest dastardly deed of the Yahapalana Cabinet was the import of 50 odd Turkish Terrorists who were allowed to the country to preach Radicalism in the East .
    And hiding their presence from the own Govt Intelligence Service to help the Muslim Buddies in Kotte for their Political support.

    And decimation of the Military Intelligence Apparatus which protected the Nation with 100% security since Mr Pirahaparan left Lankawe from Nanthikadal.

    And allowing the Muslim terrorists to destroy the three most important Catholic Churches with the destruction of the valuable lives of 300 innocent civilians including Foreign Citizens who had been helping our inhabitants.
    And severely wounding another 500 innocent moms dads, sisters , brothers and children some of whom are still suffering from horrific wounds.

    My be Ms Bachellette would have preferred the same lot in the Government than the new ex Military personnel who are doing a fantastic job to give the Inhabitants security ,specially y with the Easter around the corner.

    The UN commissioner for HR is an important role although the UN is heavily biased in favour of the US (for example) and ignores its blatant HR abuses overseas that are conducted in a far greater magnitude than can ever happen in poor Sri Lanka. However, these institutions are often the only means by which poor, marginalised sections of society can appeal to, when their national justice systems (often corrupt in South Asian countries) fail them. Most such institutions have agendas that are not publicly expressed. However, one must accept that ordinary people in SL cannot get justice when powerful, politically aligned people are their opponents. Therefore, it is in the interests of all on this forum (who I guess are “ordinary” people although perhaps not victims of war crimes etc) to support any initiative that brings criminals to justice. An independent court can always exonerate the innocent, bringing far more credibility to the nation than when actively avoiding scrutiny or investigation.
