Implement The UNHRC Resolution: GTF Tells Sri Lanka And IC

The Global Tamil Forum (GTF) has called on Sri Lanka and the International Community (IC) to ensure the UNHRC Resolution is fully implemented in a faithful and timely manner.

Issuing a statement today the GTF said: “The Global Tamil Forum cautiously welcomes the unanimous adoption of the resolution ‘Promoting reconciliation, accountability and human rights in Sri Lanka’ (34/L.1) at the UN Human Rights Council (UNHRC). This resolution, in effect, reaffirms the full implementation of the Resolution 30/1 of 2015. The fact that the resolution was sponsored by forty seven countries and twenty seven countries spoke at the Interactive Dialogue on Sri Lanka is reflective of the strong commitment of the international community to peace, accountability, justice and reconciliation for all the peoples of Sri Lanka. We are grateful to every one of these countries, in particular to the main sponsors Unites States, United Kingdom, Montenegro and the Former Yugoslav Republic of Macedonia and all other countries that worked admirably and consistently in the background to make this outcome possible.”

The Tamil diaspora organisation said: “The tone set by the High Commissioner Zeid’s report as well as the statements from several country representatives is unmistakable. Sri Lanka has made some notable progress but, despite these efforts much more work remains to be done. A common thread underpinning most of the country statements was that a comprehensive, time-bound implementation strategy was urgently needed, and that only full implementation of Resolution 30/1 would advance peace, human rights, accountability and reconciliation.

“GTF is pleased that Sri Lanka once again co-sponsored the resolution and reiterated to the Council that the Government was ‘determined to stay the course.’ But, for the victims of Sri Lanka’s brutal war, words alone cannot provide relief, and time is long-past for credible actions and concrete outcomes. For the Tamil community, and particularly for the victims, their confidence that Sri Lanka would faithfully honour its international commitments, and that they would receive justice in a reasonable time-frame is fast eroding. It is not just the worryingly slow progress, but more importantly the conflicting narratives from the leaders of the country that dash their hopes. Widespread calls from the Tamil community that no extension be given to Sri Lanka needs to be understood in this context.

“GTF strongly feels that Sri Lanka’s top leadership along with the government has to transform its contradictory narrative on accountability to a consistent one, which is neither apologetic nor defensive but principled and forceful that articulates genuine accounting as a fundamental prerequisite to overcome the country’s dreadful past. The government needs to redouble its efforts among the Sinhala people by accurately conveying the beneficial role international community could play in promoting accountability and genuine reconciliation, and that accountability measures will only aim to identify elements responsible for serious crimes, rather than targeting any institution as a whole.

“GTF also calls on the government to wholeheartedly embrace the report of the Consultation Task Force and formulate a comprehensive strategy, with a time-line and detailed benchmarks, to address all aspects of the transitional justice mechanism identified in Resolution 30/1. Our considered view is that this should incorporate confidence-building measures that include immediate land and prisoner release and urgent actions on missing persons, and a credible judicial mechanism that should include a special counsel, foreign judges and defence lawyers, and authorised prosecutors and investigators.

“The unfortunate fact is that the victims and their families from the Tamil community historically have very little faith in the government, and any belief that justice is possible is entirely due to the assurance of international involvement. Several resolutions passed at the UNHRC and the key roles played by major international powers have undoubtedly helped build their trust in the impartiality of the UNHRC processes, and has been very important in preventing them from descend into a state of despair. Therefore, it is in the interest, not just of the Tamil community but of all communities, that such trust in the international system is strengthened through the concerted actions of the international community by ensuring that Sri Lanka faithfully meets all its commitments.

“To quote High Commissioner Zeid, ‘This critical opportunity in Sri Lankan history cannot be missed. I urge the government and people of Sri Lanka to prioritize justice alongside reconciliation to ensure that the horrors of the past are firmly dealt with, never to recur.’ GTF calls on the Government of Sri Lanka to do just that by publicising and acting on a comprehensive reform and transitional justice plan, and the international community to ensure that the set path towards transitional justice remains on track.

“On our part, the GTF would like to reaffirm its commitment to assist such a process that will lead to true accountability and a sense of closure to the trauma experienced by the surviving victims from all communities.”

    GTF may make believe that IC pays heed to their chorus. That is baloney.

    No noise made by GTF or any other diasporic entity can halt the march of the governments of Sri Lanka. In fact, the Government of SL is taking advantage of such noises to get IC on their side.

    IC does not work to GTF’s time-table. If GTF wants Tamils to believe that their voice is heard by IC, they are deceiving the Tamils.

    TNA is the only entity to which IC lends any hearing. And, TNA is under plain instructions not to upset the apple cart!

          Big projects like port city would not take place in the North or in the East with the help of the West or India. Yet Tamil leaders support the West and India. We need a strong leader to send a clear message to Tamil leaders that “one country one policy.” The government must make sure that whoever fails to follow “one country one policy” must pay a huge price, including imprisonment. Singapore has Tamils, but India can’t use Singapore Tamils to divide Singapore, because Singapore leaders won’t allow that to happen. Singapore doesn’t depend on Malaysia’s mercy. Therefore, Sri Lanka shouldn’t depend on India’s mercy. India has its own time and way to become successful, let it be. It doesn’t mean Sri Lanka must go with the India’s timing to become successful. According to Transparency International India is the most corrupted country in the world. India has the largest young population, but it couldn’t get a gold medal during the last two Olympic Games. When China was expanding its manufacturing sector, India was too busy in creating terrorism in Sri Lanka. I believe that India has issues, so does Pakistan. Therefore, we must move towards ASEAN countries.

    In fact Dr Ranil’s partner categorically rejected what Suren Surendrans demands lock stock and barrel.

    The Partner Bodhi said no Ranawirus will be prosecuted ever, as long as he is in charge.

    Wonder whether Sambandan or any of his Vellala clan were in the Maradana Temple along with Kabir and his Muslims.

    Sri Lanka is obliged to implement the UNHRC resolution in full, including war crimes trial by a hybrid court of Sri Lankan and foreign judges recommended by UN.
    This has been the position since Sri Lanka co-sponsored the resolution originally in 2015.

    Since there had been war crimes committed only by the LTTE, according to the former and present regimes, there should be no objections.

    It looks like Tamil politicians and activists have got lost in the wilderness after the political changes that took place in USA, UK and Tamil Nadu.

    During Obama Administration, Sri Lanka was like another State in USA. All kind of guys came one after the other. They landed in Sri Lanka and next day they were sitting with Tamil politicians in Jaffna. With Obama gone those stooges have disappeared. Tamil politicians and Diaspora had high hopes of Silly Billy Hilary. Diaspora poured lot of money to Hilary’s campaign fund thinking that they can have her in their pockets when she became the President. That hope also dashed out. I heard that one Tamil politician cracked 1000 coconuts in a Kovil in Jaffna and prayed to make Hilary the President. That God, at least for the time being was sympathetic to Sinhalese and gave the chance to Trump. If Hilary became the President, Sri Lanka would have been in real trouble.

    In UK, David Cameron was licking the ass of Tamils to get their votes. He once visited Sri Lanka and behaved as if this country is still a British colony. Thank goodness, he had to leave politics because of Brexit. That change is also an unfavorable thing for Tamils. Theresa May is bogged down with Brexit.

    In Tamil Nadu, Amma is gone. It will take some time to know how things will shape up in TN.

    At UNHRC, things are not the same as during Obama Administration. Samantha Power is no more there to bark at Sri Lanka. Have to wait and see what would be Trump Administration’s stand point on Sri Lanka.

    China has given a warning to India to stay off from Sri Lanka and Nepal.

    With these changes things are not that rosy as they used to be. International community is slowly becoming deaf. So the guys in GTF and Tamil Diaspora have to shout louder and louder.

      Members of Global Tamil Forum posses foreign citizenship. According to Sri Lankan constitution, foreign citizens cannot be extradited to Sri Lanka for them to be tried for war crimes.

      This is parallel to your opinion that foreign judges cannot serve in Sri Lankan war crime probe unless they pass Sri Lankan bar exam.

      If foreign judges serving in war crime probe is against the constitution, how extradition of foreign citizens for war crimes probe in sri lanka is consistent with the constitution?

        Extradition happens according to prior established agreements between countries. Some countries have such agreements and they exchange such criminals. What I say is if the west is so hell bent on wiping out terrorism they should extradite such criminals to SL whether they have a extradition agreement with SL or not.

        Foreign judges/lawyers practising in SL is decided by the professional body of lawyers. They require certain criteria to be fulfilled prior to a license to practice.

          You agree that foreign lawyers/ judges must pass “certain criteria to be fulfilled prior to a license to practice.” Similarly, certain criteria (such as signing an extradition treaties) should be fulfilled prior to extradition of any terrorists.

          PS – I am not saying that I disagree with your opinion, but certainly I disagree with your double standard logic.

            I have clearly stated in my post that the West (champions of anti-terrorism) should extradite terrorists whether they have an exchange treaty or not.

            Practicing law, medicine, dentistry etc. are different. Additionally, where UNHRC is concerned SL did not request a tribunal inside the country. If SL requested, SL first has to issue temporary law licence for foreigners to participate.

              1) You are asking, ‘champion of anti terrorist’ to extradite terrorists even if they do not have prior extradition treaty. If people are extradited ‘against the will’ without proper judicial mechanism (extradition treaty), why is not ok to include foreign judges against the Sri Lankan government without proper judicial mechanism (license to practice law. I am merely pointing out the double standard in application of logic to your conjecture.

              2) You are expecting ‘terrorists’ who are foreigners to be extradited to Sri lanka, without an extradition treaty, even though they are NOT considered terrorist in the foreign countries. Just think about it for a sec. This not any different than, somebody is asking the BBS terrorists to be extradited to a foreign country, without an extraction treaty, even though BBS is not classified as terrorists in Sri Lanka.

              I sincerely hope you could understand your application of double standard burden of proof.

    Whether offenders are punished or not, the lives of victims need to be restored to pre-war dignity and security.
    Not a fraction of the effort that the NPC spends on passing its countless resolutions pleading with the International Community is spent on rehabilitation of the war victims.

    It is government responsibility. The duty of the Tamil leaders is to urge the government to do its duty.

      What’s wrong with debating war crimes?

      For the victims’ family everyday is a sad day for them. Everyday they remember the victims. There is an existential need for them to keep hope alive, keep the campaign going. The debate must go on, we have a responsibility towards the victims. They should be served justice.

      If you cannot bear the debate please feel free to ignore those who continue keep the debate alive.

      You may have forgotten the fact that the NPC elections were held on 21 September 2013. The council (North East) was directly run by the state from 1990 to 2008. North was under the control of war criminals from 1990 to 2013. Why haven’t the war criminals cared about the plight of victims of war from 1990 to 2013?

      Why haven’t you cared tuppence about the victims? As far as you are concerned there have been no civilian victims but the victim has always been the state and its rulers since 1948.

    UNHRC is a farce, the GTF is a farce, the TNA is a farce, only the people are for real and are being used by all those forces. The GTF which is aligning with the Sri Lankan government at present knows very well that nothing is going to happen as far as the UNHRC resolution is concerned. When the time is dragged on in implementing the resolution, it is certain that nothing will be done. 10 years since the war ended, is too long a period to implement the resolution.Hence it is a wastage of time and energy on harping on reconciliation, human rights and so on.
    I would advice THE GTF to concentrate on something more beneficial to the Tamil community.
