International HR Law Experts Refer Sri Lanka To ICC, If It Continues To Act In Bad Faith

Within hours after Foreign Minister Mangala Samaraweera’s address to the UN Human Rights Council, a group of well renowned international Law experts have recommended Sri Lanka be referred to the International Criminal Court (ICC).

“If Sri Lanka continues in bad faith and/or fail to take significant steps towards implementing the word and spirit of the UN Human Rights Council Resolution 30/1, including establishing a hybrid war crimes court with the participation of international judges and prosecutors.” members of the group Monitoring and Accountability Panel (MAP) said in a Press Conference held in Geneva.

The group Monitoring and Accountability Panel (MAP), was established to monitor Sri Lanka’s compliance to the UN Human Rights Council Resolution 30/1, which Sri Lanka itself co-sponsored.

Based on the documented events of the last twelve months, the MAP has come to the following conclusions:

1) The Government of Sri Lanka is not acting in good faith with respect to its commitments under the UN Human Rights Council Resolution 30/1;

2) Human Rights violations and abuses amounting to crimes under international law continue to be committed in Sri Lanka with impunity;

3) Key reforms to the country’s justice and security sectors have failed to materialize; and

4) The initial reaction of the Government of Sri Lanka to the Final Report of the Consultation Task Force on Reconciliation (CTF) appointed by the Sri Lankan Government itself amounts to a cynical and reckless repudiation of the stated aspirations of Sri Lanka’s citizens.         “The United States first imposed sanctions on Sudan in 1997, including a trade embargo and blocking the government’s assets, for human rights violations and terrorism concerns. The United States layered on more sanctions in 2006 for what it said was complicity in the violence in Sudan’s Darfur region.”

      There was a time Tamils were representing the majority Sinhalese under the British rule. This had been done to divide Sinhalese and Tamil. The British rulers gave wrong ideas to Tamils. This is the reason Tamils never went for a solution, even though they had opportunities to find a solution since the independence.

Tamils are still under the firm grip of foreign powers which transformed young Tamils as ruthless terrorists in the world.

      Tamils won’t go anywhere by avoiding smart Tamils; they will continue to go backward. Tamils have achieved nothing by conducting the Asia’s longest brutal civil war for three decades with the help of the foreign powers. The West has been using Sri Lankan Tamils to get a foothold in Sri Lanka to dominate the Indian Ocean. Tamil leaders don’t learn, but blindly follow the foreign powers.

        The British never favoured the Tamils, if they did the Tamils will not be in this position, they only used the industriousness and the hard work of the Tamils for their benefit, as most Sinhalese were lazy and did not want to better themselves. They were content with their easy way of life and did not want higher education. In fact it was the opposite, the British favoured the Sinhalese, this is why unlike the Portuguese and the Dutch after them, who ruled the Tamil areas as a separate colony, they merged the Tamil areas with the Sinhalese south and only gave importance to the Sinhalese areas to the detriment of the Tamil areas. Most of the Christian schools in the north were opened by American missionaries and not the British. The British also opened many higher education institutes in the Sinhalese south and also universities which were not opened in the Tamil areas. Unlike the northern Tamils, only the Sinhalese elite made use of this, the peasants were very content with farming and fishing. They( the British) also had to compensate the Tamils for the loss of their sovereignty, as it is because of the British the ancient Eelam Tamil nation who were 100% majority in their own land became a minority in the island and are now even fast becoming a minority in their own land too. It has already happened in the east. The Sinhalese curry favoured the British by wining dining and giving their women and at times their men to them. Tamils never stooped to this. This is why the British handed the entire island to the Sinhalese racists in 1948, when they left. They did not have the right to do it. They should have handed the Tamils their land back or created a federal setup. They did neither. Asking the opinion of a few highly Sinhalised Colombo 7 Tamils will not do, as these people have never represented the Tamils and still do not. Yet these Sinhalese racists have the audacity to state the British favoured the Tamils. Jaffna Tamil civil servants were highly noted for their efficiency hard work and dignity not only in Ceylon but where ever they went in Malaysia Singapore India. You mean to state the British favoured them there too?

        HE,The President of Sri Lanka Democratic Socialist Republic of Sri Lanka, Maithripala Srisena opted to write, and did write to Donald Trump as soon as he was elected as the President of USA, to mitigate the UN Human Rights Commission’s Resolution which Government of Sri Lanka itself co-sponsored; rather than exploring the possibilities within the same Resolution to promote concrete measures towards a true reconciliation and to accommodate the Minorities of all respect as equal citizen of the State Sri Lanka, whom very much contributed to he becoming a Head of the State, that has been awfully guided by narrow minded one race domination at all cost.
        What is the Glory found in writing to US President, against the initial mechanism that the Government itself cosponsored towards the State’s Responsibility towards its own people?

    releasing the private lands seized by the military,

    stopping the hotel businesses and farming of private lands by the military,

    stopping the military from illegally building Buddhist shrines in private lands,

    prosecuting or releasing the suspects from detentions and

    employing translators to the government offices including police stations.

        It is criminal to kill journalists, dissidents and innocent citizens even if they are Tamils or Muslims. You must get that into your head first. They must be investigated and brought to book even if they are from the military or Rajapakse family, that’s how it should be. Otherwise you might be abducted and killed one day.

        Running hotels and farming seized lands have nothing to do with security, if you do not know about it already.

        UNHRC will do its job and we, Sri Lankans, have no part in it. It’s decided by the member countries, if you think we , in any way influenced those countries you give more credit and importance to Tamils that they deserve.

        Leaders of Tamils, TNA, are whole heartedly cooperating with the government.

    The judiciary appears to “toe the line”, rather than deliver justice.
    The Minister of Justice supports injustice to arbitrarily arrested citizens, and justice to robed foul mouthed rogues.
    Meanwhile the MPs are kept from speaking the truth, by financial inducements.
    MAP speaks the truth.

    Poor Mangala ” Samayang” Samare as Dr Dyan put it, must have done a course in Elocution,amidst all his other heavy lifting on behalf of the Diaspora, to do these kick ass speeches in English.

    This came soon after the one he did in our Yahapalana Parliament, in tandem with the Vellala Party Leader Sambandan.

    The ICC and these so called Experts should at least acknowledge the proficient manner Mangala Samang delivers these pleas on behalf of the Diaspora in English.

    How many other Foreign Ministers of the countries which these Experts gunning for can speak English.

    Please give the Yahapalanya a break.

    Specially now that his boss Dr Ranil has spat out a bit about his new Batalanda Constitution.

    Pity Batalanda made his speech after Samare appeared in front of the Bedouin Prince with his offerings.

    And Dr Batalanda made the speech in a Temple somewhere and delivered it in Sudda Sinhala. with the promise it will be called a Gamaya (Rural) Government.

    But with special Powers of Land and Police to not only Vellalas but Wahabis as well.

    Dr Rajitha should email a scanned copy ASAP to the ICC . Before these experts get there.

    But make sure it is translated and properly dated , unlike that Gazette which was issued to the Diaspora Mahendran before he fixed the Yahapalana Sovereign Bonds.

    Now that Sri Lank has been referred to the ICC by this self appointed MAP, Sri Lanka should halt all reconciliation efforts and nullify any previous resolutions they agreed for.
    UN should explain to SL under who’s authority this group is acting the way they do. Until then their should be no interaction with the UN.

      You may be right when you say “no history or architecture or evidence”.

      Every bit of history, architecture, ….. of those Tamils have been now converted to Sinhala/Buddhist history, archetecture, etc.

      Those Kallthonie Tamils now call themselves Sinhala/Buddhists and converted to Sinhala/Buddhism.

    UNHRC is taking a “U” Turn in 2017. It is going back to May 2009.
    There is an Internal Investigation of UN, is blaming UN for its failure to protect Tamils in 2009. OSIL report recommended an UNHRC initiated International Investigation rather than the resolution 30/1’s internal investigation. As all predicted, Lankawe has cheated on its promise, not abruptly, but word by word throughout the last 15 months period. It started with interpreting Foreign and Commonwealth as Lankawe criminal-national living in foreign lands. But the latest heard from Janathipathi Mahatha was applying pressure on Trump’s administration to repeal the resolution. Like China’s loan arms against Tamils, China’s loans to Lands are the weapon against Trump administration to pressure it. Now Lankawe is asking 2 year period to polish its weapon of China and throw it on Trump’s administration to bring it down. EU and USA are out there on a Sahadevan job. So they want to bring a new resolution to allow rollback Lankave is asking for.
    The EU and USA are trying to differentiate “Yahapalanaya- Joint Comedy Club” from “SLFP-UNP” combination. So they like to show the earlier one is better than the latter one. They have no idea the Octopus shaped Ceylon evolves and changes shapes as per the need. The current shape is Yahapalanaya- Comedy Club. That is it. So they are not going to use the additional time they are asking for. In 2009 Canada brought a resolution against Lankawe. Lankawe used Sonia and Middle East to turn it in favor by self-sponsored resolution. By allowing Yahapalanaya – Joint Comedy Club duo the additional time, UNHRC is not doing anything different from it did in May, 2009 to the SLFP-UNP duo.

    ICC is a joke. It is not a mandatory body. When a person is born in a country the law is NOT optional! It is MANDATORY! In terms of the ICC, there are only 60 ratifications (139 signatories). Sri Lanka along with USA, Israel, India and many others are not signatories. USA withdrew under George W. Bush and he even threatened to invade if any country (including Netherlands) if they held Americans personnel under ICC warrant. SL and USA actually have a direct defense agreement disregarding/rejecting any ICC warrants. Ironically it was RW who signed this in 2003 at the US DoD. RW had a chance to sign and ratify the Rome statue in 2003 but he said “F— NO”!

    The other joke is the implementation of the ICC. It seems only the poorer countries especially in Africa are a target of the ICC.     And, last Sri Lanka is NOT party to the Rome statutes. The ICC has no jurisdiction. One clear way to get the ICC to prosecute SL leadership is via the UN security council.     Simply put, any LAW should be applicable to everyone and NOT a select few. Law has to be mandatory and not optional. I call the ICC a joke because it is not a mandatory body. Ideally all countries should automatically fall under ICC jurisdiction. If SL fell under ICC jurisdiction the MR regime could not just do what they wanted during the war.

    The Monitoring Accountability Panel – or “MAP” – started its work on 1st December 2015.
    Isnt this monitoring panel just a Anti Srilankan group set up by the diaspora Eelamists?
    I dont think it an official UN panel.

      I live in Dehiwala which is very close to Wellawatta. All the Tamils I know and see everyday are very well dressed. Especially the ladies. In-contrast the Sinhala women seem to have a major shortage of clothes because their skirts are getting shorter and shorter.

      Why did the Afrikaners agree and successfully conducted impartial war crimes investigation through Truth and Reconciliation Commission?

      You got lot to catch up with goings and comings in South Africa, at least you have a 20 year information gap. It is sad you are still stuck with Mahawamsa, Sinhala Only Language Policies, Appey Aanduawa, ….?

    Major problem Tamils facing in UNHRC in 2017 is not Lankawe has successfully dodged the resolution, which the Yahapalanaya cosigned, but it is America’s non full engagement in the problem.

    From last November, Lankawe has planned staged this resolution defying drama. Obama’s administration, especially Ex. State Secretary John Kerry did not have the basic understanding of the Lankawe politics. Lankawe is a democratic country where dictators are elected by reasonably valid election only to ensure the Sinhala Chauvinism will seated on the throne. There, to please Muslim Politicians and oppress Muslim Women, an act called MMDA, worse than oppressive Sharia has been passed only to keep Sinhala – Tamil communal tension would be burning in the oven.
    With her limited ability to analyses and evaluate Lankawe’s political matters, earlier Ex-State Secretary Condoleezza Rice, threw the might of America behind Kathirgamar and Mangala. After the war victory, underneath the American’s feet, GOSL and China pulled the carpet. Net result was America thrown out most part of Indian Ocean. But, a very talented, Ambassador Robert Blake, realized the mistake and redrew the path to recovery. It is in these circumstances John Kerry, advised by Boston Sinhala Intellectuals, plunged the ship again.

    Secretary Kerry compared the war heroes, the Old Royals, to Myanmar military Government, whom the people hated. Old King had come to power with overwhelming majority in a democratic election, but the Myanmar Military was running the government virtually without any real election. Because of this perceived mirage similarities, he used a similar fix to Lankawe and Myanmar, the power change.

    Faces may change, but there cannot be any power change in Lankawe. It is the Sinhala Chauvinism only rules the country. New King came to power by promising “No Leader, No Commander, No Soldier prosecuted.” Still Tamils voted for him.

    A coup was suspected even long before the election. Secretary Kerry ensured power change over by ousting Old King out of Temple Tree House on the night of the election loss. 19th Amendment came though not in the first 100 days. But this amendment did not grant any new relief for Tamil, but a new broken -“100 days solution”-promise. The explanation was UNP_SLFP division. Again by the illusion of Aappa Diplomacy lies, for this problem, America helped to forge a National Unity government for two years. The expectation of this was the Unity government will draw new constitution, permanently ensuring all nationalities rights and other concerns. Continuing on his this surface level success, he got the Yahapalanaya to agree internally investigate the war crime, with foreign help. In May 2016 he went to Lankawe. Unlike PM David Cameron or Modi, he avoided going to North or East to show that he would be balanced on the both side of aisles. Stayed in Colombo, Further he promised to GOSL to stay with Yahapalanaya on all of these ambitious endeavors. We don’t know what he promised to Yahapalanaya, but for guess, it could be money, mechanisms to manage and military, if in case of an internal coup to over throw the Yahapalanaya opposing its objects.
    With all these good faith promises, Ex. State Secretary Kerry thought that Lankawe’s Sinhala chauvinist government will come out of its cocoon, fix the race relations, come up and flourish in market economy and will become a loyal partner to America like, Japan, Korea…. But, by the Last UN sitting in New York, he had come to know, the new government didn’t simple change its Sinhala Chauvinism, instead, in a challenging way or even as a threat to Secretary Kerry, it increased its involvement with China.

    That time, he blamed a faction of SLFP sabotaging the progress. But, in reality, it was not a faction of SLFP, it was the Original SLFP, but lost the name only for legal wrangling. But the new name “Joint Comedy Club” does not change the nature or facts. The catalyst opposition was present to keep the GOSL simmer continuously Sinhala Chauvinism. Further, irrelevant of what he said, Secretary Kerry had learned from his mistake. He learned that Lankawe is not armed like China or Russia, where a balanced negotiation always necessary; not an underdeveloped African country, where a simple military intervention can fix. He understood that the American Diplomats are not really equipped to counter the Lankawe’s unique, powerful, Appa Diplomacy.

    This where American involvement, whether it is balanced or even in favor to GOSL like in the time of previous Secretary Condoleezza Rice, is very important for Tamils. America may show interest in UNCHR/UNHRC one time, or ignore it another time. But staying engaged in the Lankawe matters and learning about the notorious Aappa diplomacy is important. If America learned enough about the Aappa diplomacy only when it shows renewed interest in UNHRC, it can influence a meaningful solution for Tamils. It will be serious mistake from Tamils part if they keep saying that Trump’s administration is not interest in UNHRC. We saw the difference in the actions of the three secretaries, Condoleezza Rice, Hillary Clinton and John Kerry. Certainly America has been improving the techniques to deal with Aappa Diplomacy, progressively. This is the lesson Trump’s administration also has to go through. Even if this administration shows no interest in UNHRC in its all term, but if it keep engaged with Lankawe and Tamils problem, any new administration comes with interest in UNHRC will use it.

    Mr.Malik, In the case of countries or Individuals from countries which are not signatories to the Rome Statute which established the ICC the procedure is for the UNSecurity Council to refer to the ICC. UNHRC could recommend such cases to the General Assembly who could refer the matter to the Security Council and if deemed fit they will refer it to the ICC. There is precedent in this way
    By the way some of the Lawyers in the Panel are those who appear before the ICC.
