Is Ex-CID Director Shani Abeysekera’s Continued Remand An Attempt To Being Killed Systematically?

The killing referred here is not of criminals or suspects in police custody. The killing this time is of police officers which takes a form of political victimization of police officers for duty done! This fact does not deter or agitate the new killing brigade dealing with Shani Abeysekera (SA), lately of the CID. It does not matter to the new executing brigade that SA has been highly commended by the government for good work done! For it is the very good work SA has done that has brought on his misfortune – the wrath of present government leaders. The B report holds out the work SA has done. These reports of SA have been endorsed by the AG and others. No political victimization is however visited on the AG. Only SA has been singled out to be remanded, not the others in that process. It is just too much for Justice Minister Ali Sabry to enter the fray. He will dance to the others. Minister Ali Sabry’s tune will rhyme with those of the hierarchy. 

For whatever intents and purposes, holding SA in remand custody is a patently punitive action, whereas the law does not provide the process of remand for punishment. Remanding a suspect is only with a view to assist the investigation by preventing him interfering with witnesses or from leaving the country. Minister of Justice Ali Sabry knows this only too well. Can anyone with any stretch of imagination say that SA can influence witnesses whilst all the king’s men and the entire king’s horses are there to protect them? 

The Minister Sabry can play on his own flute since the whole criminal justice process runs on a discordant note. It is surely unnecessary to recount the dysfunction of the criminal justice system once police investigations are handed over to them for further action. The cacophony in the criminal justice system sounds reverberating. The malperformance of the system and the failure of the justice administration and its malfunction have brought on a gold mine for those who would dig into it. The fact is that all the inadequacies in the criminal justice process are remunerative at the base, with laws delay and the lot. It is a muddy swamp. The water is so shallow that the fish can be caught just by hand. 

There is much to do in the Justice Ministry to clear the mud. Shani Abeysekera has apparently been remanded for allegedly fabricating evidence against DIG Vaas Gunawardena by falsely introducing guns to the latter. This item of fabricated evidence had not figured in the original reports to court and to the AG. DIG Vaas Gunawardena was convicted after trial, after witnesses testified under oath, after witnesses were cross-examined. That position has been so for over two years with the AG. No indictment has been filed by the AG through these two years, or other reports made to court. This piece of alleged fabrication of evidence has transpired only after two years. And today SA is remanded for this alleged fabrication of evidence. Is there not a serious dereliction of duty on the part of the AG? Should not the Minister of Justice Ali Sabry check this?   

Minister Sabry, strangely, shrewdly and dubiously, at this point of time changed turf, from justice to police, and wanted a lawyers’ brigade for the Police – a diverting ploy. The brigade idea is an age-old trick. We have heard of the Purple brigade and some other names. They all had a sinister purpose. They soon died out as they got exposed. Is Minister Al Sabry innocent of this? No, he is not; but he keeps fishing. The lawyers brigade to the Police can also be a Machiavellian ploy of sending ‘colonies’ clearly for infiltration into the Police, – see ‘The Prince’ chapter iii pg 9 para 2. (Niccolo Machiavelli was a political philosopher, diplomat and writer- ‘The Prince’ was written in 1513) This again is an age-old game.  Minister Weerasekera is in charge of the Police. Is he non-functional that Minister Ali Sabry is intruding into the Police leaving his own area of Justice blatantly neglected? Such intrusion cannot be for good reasons. Was Minister Sabri acting on his own in his endeavor to infiltrate the police with a lawyers’ brigade? Or was he voicing the thinking at the top? Due to a spate of protests, especially from the police, this was given up.

Karl Marx said of some, ‘Their religion is money’.  Is it not the same problem of money that besets our criminal justice process here, money running through the veins of the process? The specific issue here is the continued remand of SA. Is money running this issue too? For today, we hear of a mantra nidhos nidhas echoing through the halls of justice. Do we not? Can Minister Ali Sabry hear this? And, so, the mantra is chanted, many high-level cases are disposed of by next morning. Theft of mangoes can wait. Oath of office too has evaporated with the money. No oath intoned with religious fervor, from high to low, has served its purpose, in Parliament, and in the Executive. Minister Sabry is well aware of this. Court cases drag on and on. The doctrine of separation of powers helps the crawl. So, the chant goes nidhos nidhas which brings in the money return. This is in the process. 

In the executive sphere Minister Sabry now wants to sing the same hymn nidhos nidhas to the prisoners in the prison. This expediency can be appreciated since the law does not help. This idea is also in recognition that the law itself and its process are ineffective; much waste of time. The public know this well. But the problem confronting Minister Sabry is the case of SA. This case too drags on. But Minster Sabry will not intervene as he has done with the other cases. This he will not dare to do just to save his own skin.   And where is the BASL in all this? The BASL webinars are conveniently elsewhere.  

 What then is left? A little prose and poetry!

Whence all but he had fled

At mention of his tormentors’ name 

Intimidation being name of the game.

Rights activist for Shani fight

Retirees join seeing his plight.

World interest his cause has earned 

Victimization they have spurned.

When all is said and done

Shani will have surely won.

Then a chorus all will sing:

“Shani’s a role-model to the brim”.

    With a heavy heart I have to accept that the entire country is CORRUPT FROM TOP TO BOTTOM, including the Judiciary and the members of the Parliament. Justice is a joke in Sri Lanka. Even the Maha Sanga and Catholic Church Cardinal have become politicians and have their own agenda of supporting one or another political party. Buddhist monks are acting in a manner that is worst than the acts of third grade MPs in Parliament.

    In any country the most important thing is an IMPARTIAL JUDICIARY.

    Where is this country heading?

      I too have been made a destitute by the guardians of the corrupt to the core judiciary of Srilaka. The financial ruin which has been inflicted upon us by the corrupt judicial officers by coalescing with the criminal mafia yielding to kickbacks from them to turn justice upside down is really diabolical. The faith and trust I placed with the judiciary for their honesty and integrity turned out to be a foolish act like holding a deadly snake by the tail. No one in authority wants to hear my case because the powerful judicial mafia is behind it pervading mortal fear in spite of assurances given by HE president.

      Mr. Seneviratne, thanks for keeping Shani’s case in the spotlight. I read that his family lives in a 550 sq. ft. house. A corrupt cop would own a palace. How is Shani financing his defense? Could we start a fund? I’ll be happy to contribute.

    People with some sanity will have to agree with you. But the million dollar question is how many among 22 mio we can consider as work with some sanity ? Today not only most respect CID officer Shani Abeysekara, but also Ranjan Ramanayake, who fought against the continuous injustices in the society, is jailed for 4 years. Iroanically, those who looted the state through AVANGARDE and several other projects, stay scot free. Most of them in Rajapkashes family and their kith and kin get released by FOOLING the JUDGES and Lawyers. We should all stand by RANJANA having said, this country is filled with JUDGES that are highly biased. I have no doubt, over 95% of them are highly biased.

This Commission was appointed to examine “Political Victimization” of Public Servants, Armed Forces Personnel, including Police Officers during the period Jan. 8, 2015, to Nov. 16, 2019. Pl. note the “Members” of the Commission (1) Rtd. SC Judge Upali Abeyratne (2) Rt. Appeal Court Judge Daya Chandraratne (3) Rt. IGP Chandra Fernando. In the “Recommendations,” there are “TWO” “Persons” to be “Discharged” from the cases filed against them. They are (1) Udaya Gammanpila (2) Rt. Major Senadhipathy. The case against Udaya Gammanpila has been filed by an Australian Lady for “Fraudelenly” altering a Power of Attorney and disposing of assets of a commercial establishment. The case against Senadhipathi is in the capacity of a CEO of a “Private Co.”. How have these TWO become “PUBLIC SERVANTS”? That, without going any further explicitly display the “CAPABILITIES” of these “THREE” “Commissioners”. They are “RETIRED JUDGES & an IGP”. No wonder our Country has been named “MIRACLE OF ASIA”. With these “TYPES” of Judiciary and Law Enforcement personnel, can we expect any type of “JUSTICE” to anyone in the country? The best “JOKE” in the “Recommendation” was to “PROSECUTE” the “Complainants”.

    A decent cop goes to jail while a mass murdering thief and army deserter becomes the president. Shani should have run away when he had the chance. If these killers can put Fonseka in jail, they can do this to anyone.

    For ruling Regime, SA is an enemy like Lasantha. So what happened to Lasantha can happen to him as well. Before they used white vans to do that but now 69 million including the supreme court has given legal status to that.

          This was revealed at the Presidential Commission of Inquiry into Political Victimization. I heard the conversation that took place between the Judges and the person who gave evidence in TV but I cannot remember the name of the person. The report has been submitted to the President. If they make it available to the public, you might be able to find out who made that statement.

        Now come out and let us know which Ranawiruwa Shani put in jail. Let me guess none! Shani was director of the CID. He obtained execution convictions in the Vass Gunawardene(A DIG) case. He successfully extradited to Sri Lanka Makadure Madush and Udayanga Weeratunga. Investigated the disapearance of Prgeeth, the murder of Lasantha, the Assault of upali Tennekoon. He was summarilly demoted without explanation days after Gotler became president. When one of his colleagues Nishantha Silva sought refuge of the Swiss embassy and fled to Switzerland he was suspected of being in touch with a lady who worked at the Swiss embassy. This lady was abducted and questioned by unidentified government thugs regarding the granting of political asylum to Nishantha Silva.

          Continuing on,
          Shani was extracting very high level intelligence regarding the drug mafia when he was unceremoniously demoted and removed from the investigation. Makadure Madush knew his fate was sealed when this happened. Sure enough he was killed after being transferred to Gotlers thug division of the police that same out fit that kidnapped the Swiss embassy employee. Three thug division members were sent to court to tell the court that there was no evidence in the Udayaga Weeratunga case. This was a bold face lie. But with the investigator in jail who was going to speak up. Two difficult cases where help from Interpol had to be abtained and extradition were successfully spearheaded by Shani ended up with one suspect being murdered by law enforcement and the other suspect being set free on bogus claims of no evidence. That is the truth.

            The desire for revenge is written large in this saga. Abducting the Swiss embassy employee is nothing but an act of shear anger and the need to take revenge first on the honest instigating officer Nishantha Silva and then when he slipped thru Gotler’s fingers he turned his wrath on a poor embassy employee who would have handled Nishantha’s Asylum case. Eventually a nice little plot was hatched not only to put Shani and his colleague in jail but also to try and declare a mis-trial in the Vaas Gunawardene case and get a convicted murdere on death row released. In the case of Shani I think the writing is on the wall. He stays locked up on flimsy charges until he dies. So what is the so called opposition doing about this case. If this was done to an honest officer of the CID during the Yahapalana government all hell would have broken out. But where is the SJB, JVP etc.?? Kate Pittu??

    Gonja probably was unaware that he was used by a group to:
    1. Discredit the Judiciary in Sri Lanka to convince the International Community that Judges in Sri Lanka cannot be trusted and hence recruiting foreign Judges is a must; and
    2. Discredit Buddhist Monks and paint the image that they are against giving any concessions to minorities.

    Four years is not enough for a traitor who tarnished the image of Sri Lanka.

    How can Minister of Justice Ali Sabri and Attorney General Dappula de Livera be so corrupt and unprincipled? The mind boggles that high level guardians of the law can behave in this manner. It is the most egregious case of the fence itself devouring the crops.
