Kili Maharaja’s Illegal Grab Of State Land Worth Half A Billion Rupees?

Be it Palestine or a prime State land at Colombo Sri Lanka, impossible it should be made to claim ownership for criminals when lands are acquired illegally. Conducting investigations in to the disputed block of land at Bank of Ceylon Mawatha (right opposite WTC), many instances of meticulously planned and illegally occupied State and private lands have come to light and that which resulted in political henchmen and criminals raking in billions in the last 30 years. While I intend exposing famous personalities for obtaining land and property illegally and by using fraudulent documents in the near future, it did come as a surprise when a prominent and supposedly a ‘conscientious’ media empire happened to be involved possibly in one of the biggest illegal land grabs in the recent history of Sri Lanka.

Elusive and highly manipulative, though establishing himself as a successful businessman, it is indeed pathetic of Mr. Kili Maharaja (KM) and his company, Capital Maharaja Organization Limited (CMOL) to ‘move mountains’ in staking a claim for a prime State property at #19, Bank of Ceylon Mawatha, Fort Colombo, and over which I have reasonable grounds to believe that it should be vested back with the Urban Development Authority (UDA) as rightful owners.

Having met with stiff resistance when in search of information on the land in question valued at over Rs. 10,000,000/- per perch, the five million Dollar question is how was it possible for a prime State land to end up in the hands of a politically powerful figure (KM) after it was given to a little-known Sri Jaya Hotels Limited (SJHL) 26 years ago?

UDA_image_01When this matter surfaced a month and half ago when officials from CMOL attempted to fence the property in question, watching news on TV at home, my attention to this matter was drawn only when UDA officials sprang to action within 24 hours in defending CMOL’s right of ownership. In my eyes, this was quite unusual for a lethargic government department in Sri Lanka, especially when the value of the land is about half a billion Rupees. The following describes the turn of events;

1 – Visited the MTV Head Office on March 31, 2015 and met Mr. Shameer Rasoolden who asked me to email him a formal request along with my credentials. Other than my GCE O/L qualifications and not having any other significant paper qualifications as such, I e-mailed him links to my Colombo Telegraph online articles and the links to two interviews I have done with Mr. Sumal Perera of Access International and with DIG Ravi Waidyalankara, Director FCID along with the formal request.

2 – Mr. Chevaan Daniel, the highly respected Group Director of CMOL that he is, responds on April 6, 2015 mentioning his willingness to furnish the following documents but NOT the copy of the deed,

  • The non-vesting certificate issued by the Colombo Municipal Council.
  • The Certificate of Registration of Ownership, issued by the Colombo Municipal Council.

3 – On the same day, I reply e-mail Mr. Daniel requesting answers to the following questions for which I am yet to receive a reply 30 days later,

I. If the land at #19, Bank of Ceylon Mawatha belongs to SJHL as you claim,

a) When did SJHL acquire it?

b) Who was the seller of the property?

c) When did SJHL become a subsidiary of the CMOL?

d) Who were the original directors of SJHL at the time of acquiring the property?

e) What was the nature of business of SJHL at the time of acquiring the Property?

II. If the Property was obtained from the Urban Development Authority (UDA),

a) When was it obtained?

b) On what terms/basis did SJH obtain the property?

c) At what price was the property obtained (if some kind of payment was made that is)?

d) Was the property obtained for a strategic development? If so, can you describe the project in brief?

III. Believing the Property was not developed for over TWO DECADES and assuming UDA under Mr. Gotabaya Rajapaksa (GR) took over the said property and developed it in to what it is today,

a) What was the reason behind SJHL not resisting efforts of the UDA in claiming ownership in the same fashion as was seen a week ago on National Television and that too for well over TWO DECADES?

b) Was there ever an official correspondence with the UDA in this regard since SJHL acquired the Property?

c) How was it possible for UDA to deny the claim of ownership of the Property by CMOL one day last week and for the same officials at UDA to retract the statement the very next day by establishing CMOL as the rightful owner of the Property?
d) Was there an official correspondence between UDA and CMOL soon after the matter surfaced last week? And if so, were there any copies of the Land Deed or any other documentation submitted to UDA in favor of establishing ownership the property?

4 – Having confronted obstructive officials such as the Mr. Dayananda (Director – Lands, UDA) and Mr. Mawilmada who happens to be the new politically appointed Director General at UDA under Yaha Palanaya (Good Governance), I phoned the Chairman of UDA MR. Ranjith Fernando and the following extracts are from the conversation I had with him on April 23, 2015 over the phone and for the concerned to take note,

a) UDA lands are NOT necessarily given for a strategic purpose.

b) When GR led UDA flattened the land, CMOL did not come forward out of fear since GR was ‘riding rough’ at that time. And it is now that CMOL has found the liberty to claim ownership.

c) We (UDA) has gone through the deeds and we (UDA) found that CMOL are the rightful owners.

d) Absence of a basis when the land was given to SJHL.

e) Contradicting the earlier statement, Mr. Fernando says hundreds of lands were given for different purposes or development for hundreds of people. And when questioned about the purpose of giving the Echelon Square land to SJHL, he says it was given IN LIEU ANOTHER LAND.

f) Claims the land in question was NOT a prime one 26 years ago and that it was a NEGLECTED land.

g) Expects me to take his word since he is the Chairman of UDA and mentions of an investigation done in this regard by the UDA on the matter and that which had ascertained the present ownership supposedly.

f) Refuses to show any documents.

5 – Further into investigations, it was revealed that the ownership of this plot of land was ‘transferred’ to SJHL in two phases, in July 1988 and in December 1989. While ownership was supposed to have been ‘transferred’ along with the plan to construct a 10 storied hotel, the original plan seems to have been shelved along the way and CMOL had drawn up plans to construct the Head Office of the Capital Maharaja Organization Limited instead.

Having met the Deputy Minister of Urban Development, Water Supply and Drainage, Mr. Dunesh Gankanda in this regard and who promised to assist me in my investigations, it was indeed regretful to note the existence of the ‘old guard’ loyal to Rajapaksas who seems to be hell-bent on scuttling the good intentions and actions of the Deputy Minister and of the present government.

Interestingly, the file related to the land in question seems to be kept under lock and key and I strongly fear the eventuality of important documents going missing before a possible investigation commences. While I do not doubt for a second the fact that SJHL is the current owner of the land at Echelon Square, my concerns are about,

  • The unanswered questions on the basis on which SJHL acquired it in the first place.
  • The possibility of UDA not been within their legal parameters in 1989 when the land was originally given to SJHL.
  • The absence of an enforcement team to recover such lands if it was indeed given illegally to SJHL or if stipulated conditions (if it ever existed) were not met.
  • Not having any information on the land that was supposed to have been acquired by the UDA and for which the Echelon Square land was supposed to have been given in lieu of it to SJHL.

While I await a response from Mr. Chevaan Daniel for answers to my points of contention, the wannabe investigative writer/activist that I am, I intend pursuing this matter and many others vehemently until rightful ownership is ascertained concerning all and any illegal land grabs that is brought to my attention…. be they state or privately owned.

Ironically, state lands that were given to various people for development projects under previous governments (especially under UNP) seems to be on sale by its owners or not being investigated for non-compliance by the very same government that rode to power on an anti-corruption platform. An example would be lands given to set up garment factories during President Premadasa’s regime and of which most had ceased to exist or declared bankrupt.

In conclusion, I guess reasons behind Members of Parliament from all political parties not wanting to cross swords with media bosses goes without saying now that elections are around the corner.

      Hey guys, I have no idea as to why lanken politicians and their assets cant been screened to the very same manner civilized western states do. I perfectly know in alleged cases, Germans, the English and others would never be backward to fight against corruptions.
      I also understand until the most important AMDs have passed, nothing can be done in the country, and the reason current leaders to stay somewhat away from taking actions against the previous most brtual highly corrupted guys.
      The man who led all high profile corruption was none other than former PREZ Rajapakshe.Even today, he shamelessly shows his face to others THINKING nothing would have ever been revealed about his and his oligarchs high criminal acts had been carried out while being in the office.
      These are secondary but the alleged human crimes had fully been forgotten, be them towards minorities or majority folks, any honest leaders of the day hsould focus on that… then only we can feel secure in this beautiful island of 93 % highly literate nation of the region.

        Did the burning of land registry records in the Colombo Kachcheri and the destruction of the land records have something to do with all the land frauds?
        The burning of the Colombo land registry was done on Gotabaya Jarapassa’s watch..

        1. How much of stolen land and property do the Rajapaksas have?

        2. Who owns the recently built PALACE opposite the Colombo Museum on Sir Marcus Fernando Mawatha? That land formally housed a colonial mansion and was home of the Australian High Commission and was sold when when the Aussi HC moved to new premises at Gregory’s Road – to a Rajapaksa or stooge.
        Did Dhammika Perera acquire it for Namal Jarapassa?
        There needs to be an inquiry into this property and its current owners TAXES..

          Rajapass only followed the destruction of records of the Dutch merchants which gave way to sinhalayas and Muslims of Portuguese transport from east and west of south India.

    This is what has happened all over the island, involving State and private lands. The State has been the victim and the perpetrator as well. Crooks and frauds in society have either taken the cue from the State and the State has adopted the tactics of the criminals, to defraud the people as a collective and as individuals. In the north and east, what was the norm of the LTTE ‘ defacto’ government and its cohorts, has been continued during the war and subsequently by the State, crooked politicians and individual fraudsters.

    The employees in the land registry and even the courts have been part of this fraud. Documents in the land registries have been tampered with or destroyed. Documents deposited in the courts have gone missing. Many lives have been taken and much violence has been perpetrated to achieve illegal and immoral objectives.

    I know of an instance and am in possession of a transfer deed, where land was illegally sold on the basis that it was in the possession and care of the seller who had illegally fenced the land during the war in Jaffna. The legal owner is domicile abroad. A land belonging to the mother of a friend of mine in Navalar road, Jaffna, which was never legally sold by the late owner, had been illegally acquired and thereafter sold twice! The legal fraternity plays a sinister role in such rackets.

    The documents in the land registry should be secured and computerised. Action must be taken to stop such rackets and crime immediately, while setting up a mechanism to redress past wrong doing.

    Urgent action on a national scale is required immediately.

    By the way, I watched your interview with Sumal Perera, where he said that Gotabaya was the most honest man he knew. Either the guy is the most gullible man around (which I doubt) or an incorrigible liar. What do you think?

    If the land belongs to the state, no one has the right to claim ownership. We know the company in question have a track record of bulldozing people using their media. They have conveniently planted their favourites in different parties to ensure their support for whatever mischief they may do. Now, the elections are nearing again they will try their tricks with different political parties. Understand they are trying to an approach to our President Maithree. During past few years they canvassed against Ranil because he did not accede to their bulldozing.

    1.who gave it to this hotel and the terms and conditions under which it was given?
    2.Is the deed still in the name of this hotel?
    3.Who are the proprietors of this hotel.

    Someone must go and make a complaint to the bribery commission about this.yahapalanaya can’t be choosy about the people who have plundered.

    At Least Maharaja bought it from Jaya Hotels.

    It seems a legit transfer.

    But the sad part is Mr Afzal who by his own admission a close buddy of our lovely FM, wouldn’t or couldn’t write articles about the Hon Minister Baththudeen, who has a long history of acquiring Crown Land by force.

    He has even built a decent Hamlet in the National Park in Wilpattu .

    Probably the Hon Minister has plans to protect the Wild Boar from our Dalits in the near by villages who go for a Protein hit.

    It has even Garden Lights powered by e Electricity from Noroncholi.

    Mr Baththudeen also has forcibly taken land from the Dalits in Mannar to settle his own people there.

    And also settled his people in a historical place called Kuragala, which is a sacred site of the Buddhists, according to my Elders.

    Why Afzal is going after Killi, when Baththudeen is so blatantly serving Yahapalanay to even poor Tamils.let alone poor Sinhalese.

    Remember the infamous Water’s edge case where the supreme court heard a FR petition against CBK?

    J. C. Weliamuna actually appeared on behalf of the petitioners in this case !!

    No action was taken against her for transferring port authority land to private hands despite a supreme court ruling.
    Not a good sign for action against MR?

    So this is nothing new, land is not being produced anymore and with 21+ million people we will only see this more and more !

    Your intervention is to be lauded as that of a ‘concerned citizen’. To all appearances Killer Maharaja has appropriated the land without just cause.

    I like to know whether you have any ideas as to how Killer’s right to the land can be challenged in the court of law with a view to handing over title to the rightful owner, GoSL

    Should such legal efforts fail, would political, social, and the unjust circumstances preceding Killer’s acquisition suffice to justify acquiring the land by the GoSL under existing land acquisition legislation?

      Navin, in response, I would like to suggest that Mr Nagananda Kodituwakku who famously filed a case in the SC against MR being eligible to contest on 08Jan and later withdrew it on sound advice, be requested to take this matter forward with the courts. He is a fearless crusader for justice, and may rise to the occasion. More people like him will convince other members of the legal fraternity to get off their soft arses and do their bit to bring good governance to our thrice blessed land.

    Publish the secret agreement that you have with MR promising him to campaign in Sirisa and other channels that you own on the undertaking to get 5 appointed MPs posts in the next Parliament .What is the grudge you have with Ranil ? Is it because he is honest and will not tolerate any corruption .I remember in 1983 when you were called by JR and complained that you supported Mathew and JR went to the extent that you supported the guy who was responsible in burning your house down Coniston Place, Colombo 7..Shame on you Killi!!!

    They benefited from Premadasa during his presidency. They also kept a slice of money overseas by their involvement from trade. They should not be allowed to get away because they can bribe people to lobby their interest and manipulate publicity.

    OPEN LETTER TO THE COLOMBO TELEGRAPH

    I write to request you retract your article published on 7th May 2015 titled “Killi Maharaja’s Illegal Grab of State Land ” because it is factually baseless, lacking in sources and unnecessarily defamatory.

    If Colombo Telegraph is committed to the freedom of speech online, for the best interests of this country, then it should have more responsibility in journalism, because that is what this country deserves.

    I refer to the following as examples of poor content management:

    1. The journalist attacking one of Sri Lanka’s leading business institutions and its Chairman, refers to himself as “ the wannabe investigative writer/activist that I am” and admits to no qualifications and marginal experience.
    2. The writer does not use the correct name – first name or surname – of the Chairman and therefore even the headline is factually incorrect. Even the abbreviated company moniker he uses is wrong, the Group is known as TCMOL.
    3. The writer cites ZERO sources that support his accusations or line of questioning. In fact, he only names sources that have informed him he is incorrect in his baseless assumptions.

    The danger of publishing unsubstantiated articles online is that it offers a biased view to a larger readership; that assumes there must be some truth to it. Inflammatory terms such as ‘land grab’ conjure memories of genuine land grab controversies by authorities in this country and that alone is enough to create at best, unjustifiable hostility. The reporting is unbalanced and does not consider the following:

    1. Public records: The Land Registry contains a history of Title Deeds, yet the writer has not referred to public information that will establish who owns/owned the land and when. For example, what if said Registry showed that in fact the land belonged legitimately to TCMOL and it was “grabbed” from them by the usual “land grabbers” to make a nice pavement at the Dutch Hospital? I don’t know if this is true, but it sounds more realistic than the hypothetical wrongs suggested.
    2. In calling the Chairman of TCMOL “pathetic”, did the journalist even skim over the history of TCMOL, its Chairman and their relationships with successive governments of Sri Lanka? For example, is it not true that TCMOL use their TV and FM stations nationally and even transmit internationally to promote this country and showcase its artists, signing several to recording labels such as Sony Music? And whilst doing so, that Channel 1 and Sirasa dedicate themselves to exposing corruption and fighting for the rights of the Sri Lankan people? That in the process of doing so, their offices have been attacked numerous times, with the lives of both the Chairman and key journalists threatened repeatedly during and before the Rajapakse regime?
    3. While using the Internet as a platform to expose corruption as Colombo Telegraph do, did you consider that TCMOL instead have used terrestrial media and have journalists on the ground, risking their lives?
    4. Did the writer elude to the contribution TCMOL have made to this country in terms of power & energy, manufacturing and many diversified interests that employ thousands, while facilitating billions in investment into this country and creating jobs?
    5. Why is there no mention that when disaster strikes this country (tsunami, landslides, flooding), that it is TCMOL that launches a massive aid operation? Where did you go to drop off aid for survivors? Many people went to TCMOL. Could it be because Sri Lankans trust Maharaja’s to take emergency aid where it is needed?

    Why would Colombo Telegraph not ask for a fact check before allowing a journalist with no credibility (a self-admitted novice) to have space on your website and social media, representing YOUR news? TCMOL fights for media freedom and you publish baseless assumptions without ANY proof of wrongdoing and even a single credible source?

    I could go on at length, after all, all this information I have shared is available online, via Google, Wikipedia and numerous websites including TCMOLs.

    One last thing. While your ‘journalist’ has now gone on the record on YOUR Facebook wall stating that “summons will be issued” (source?) and that he would expose corruption “Unlike the cowardice of TCMOL who stood silent in fear of GR and MR”…” he should perhaps consider this about the people he named at Maharaja’s:

    In 2009, after MBC (Maharaja Broadcasting Corporation) was attacked and burned by unidentified gunmen, Chevaan Daniel was interviewed on CNN about the incident. Soon after, Sri Lanka’s former Defense Secretary, Gotabhaya Rajapaksa labelled him a terrorist and ordered his arrest. Mr. Daniel was forced to make a dangerous exit out of Sri Lanka but returned within a week, refusing to remain a fugitive. He was famously ‘hauled out’ of Temple Trees for standing his ground against then President, Mahinda Rajapaksa when warned not to criticize the government (Wikipedia and CNN will confirm this, if you were not around at the time).

    I hope, Colombo Telegraph, you will now do the research (as I just did) and see there is no merit to this kind of journalism. It would be nice if you could apologise to these good people for this embarrassing piece of supposed news.

    Can someone explain on what basis the ownership is being questioned if UDA and CMC can confirm that CMOL is the owner?

      UDA and the CMC can SAY what they want…. I am only questioning the basis on which SRI JAYA HOTEL obtained it in the FIRST place from UDA. And to disclose the original terms/MOU in this regard. Since it was not forthcoming from no quarters, I believe my assumptions are justified.

Therefore the govt should nullify such land transactions. Killi Mahendran has no ownership of this property to his Company until the property was transferred fraudulently. Even earlier under Mrs. B, prime property in Colombo has been alienated to party supporters and house boys as JPIU Piyadasa. UK Edmund acquired Mount Lavinia Hotel with the help of People’s Bank funding. For that matter ‘Tintagle’ mortgaged to Bank of Ceylon for Rs. nine hundred thousand by SWRD in ’56, was redeemed after the People’s Bank was set up in 1961 by the SLFP under Mrs.B.
