Lessons From Geneva

Mission Impossible-Geneva is an inspiring account of developments at the Human Rights Council in Geneva when Dayan Jayatilleka was our Permanent Representative there. It is written by his wife Sanja, which provides for fascinating insights about the manner in which he planned how to overcome the threats from Western nations that seemed designed to stop us eliminating the terrorist threat within Sri Lanka of the LTTE.

The book is essential reading for anyone who believes that Sri Lanka needs a coherent and effective foreign policy if it is to withstand the multiple threats a small country faces. These are exacerbated by our situation, and the developing dynamics in Asia with continuing interference by the United States to preserve what it sees as its rightful hegemony.

Sanja brings to bear keen analytical skills as well as lyrical passion, which makes the book both enjoyable and instructive. She relieves the tension of her account of what happened in May 2009 with a moving account of her and Dayan walking in their garden, ‘discussing the situation…There was a wondrous little pond on the side, which provided the most pleasant surprise when I first came across it, for it was filled with pink lotus flowers in full bloom…it was restful to sit by the pond taking in the tranquility they offered’.

Heaven knows Dayan needed to relax, for this was when the European Union tried to have a Special Session of the Council, obviously to stop our armed forces from dealing with the LTTE while continuing what they had achieved in April, liberating vast numbers of those the LTTE held hostage. Dayan had foreseen this coming, since when he went to Geneva in June 2007 there was already a draft resolution ‘against Sri Lanka, accusing it of War Crimes…tabled in 2006’. He dealt with this expeditiously, and the British ambassador, who had put forward the resolution, told me in December when it was clear he did not have enough support, that Dayan had won. But we would see what would happen later, he said, a warning of the sort the American ambassador told Tamara Kunanayakam when she too first arrived in Geneva and found the Canadians plotting against Sri Lanka at the behest of the Americans.

Kshenuka Seneviratne, Tamara’s predecessor, had known about the plot but failed to inform Colombo and Tamara had to get through direct to the President to get authority to respond. She did, very effectively, but then she too was undermined in Colombo, just as Dayan was.

But Dayan at least managed to survive in authority for the two years needed to ensure that the Sri Lankan forces did the job that has brought such relief to the country. He succeeded through both intellectual capacity and a brilliant understanding of how foreign relations should be conducted. This involved building up both trust and gratitude.

For the latter he needed to keep up a constant flow of information, and I am glad Sanja pays tribute to his excellent IT officer who built up a website that rapidly became the most visited site in Geneva. Sadly this collapsed completely under Dayan’s successor, and the world receives information about Sri Lanka at the whim of the western world as had been the practice before Dayan went to Geneva.

Typical of the manner in which foreign relations were and are conducted was the advice given to the President that he should not face the media. This made no sense in the case of Mahinda Rajapaksa, who can communicate effectively in English, but whose officials frighten him in this regard – as indeed happened recently with the interview by the Indian journalist Padma Rao, which I had to press for several times at her request before he agreed (to what seemed his great satisfaction afterwards).

Similarly the Ministry makes a fetish of not responding to NGOs, even though it is clear that what they say has a tremendous impact. But in Dayan’s time, which proved crucial in winning over votes when we needed them, his strategy was ‘so effective that when various NGOs accosted Ambassadors in the lobby to spread misinformation, they brushed them aside and walked on or were able to counter them themselves’.

What Sanja’s book makes clear then is that the first obstacle Dayan had to overcome was not just the ham-fistedness but also the jealousy of the Foreign Ministry establishment. But she is quite clear about the enthusiasm with which those who worked for Dayan adopted the strategy he proposed, and again it is heartening to read of the skill with which his deputy Ameer Ajwad, now in Singapore, operated.

Secondly Dayan had also to face the unremitting hostility of the West, or rather at that stage, of the British, who led the Europeans – and were joined with greater enthusiasm by the Americans after Hillary Clinton took over their foreign policy. And in this regard Dayan was hampered by the slavishness of the Sri Lankan establishment to the British, as represented most obviously by Kshenuka Seneviratne, who was reported to have complained about Dayan’s strictures on David Miliband (and managed to get her uncle Manik to introduce a nasty critique about him into the ‘Sunday Island’ – which led to a strong rebuke by the daily ‘Island’, which was much more committed then to defeating the Tigers).

The critique made reference to the defeat we suffered in New York, when the usual ham-fistedness of our diplomats resulted in us not being re-elected to the Human Rights Council. Part of this was continuing slavishness to the British as ably highlighted by the British intellectual Kath Noble (so that they defeated Spain for a seat on the Council, at a time when the southern Europeans were much more sympathetic towards us as exemplified by Dayan’s friend the Portuguese Ambassador in Geneva who formally but revealingly kept him abreast of British manoeuvers).

The foreign policy establishment had a champion in the then Minister, Rohitha Bogollagama, who did not let Dayan go to New York, contravening the practice whereby our representative in Geneva attends meetings of the Third Committee in New York. Given the close relations Dayan had established with most countries in the Third World, it is probable that he would have won over enough votes to have us elected, whereas the contempt our established diplomats evinced for our peers obviously had its effect.

Thirdly Dayan had to deal with obvious prejudice against us amongst Western officials at the Office of the Commissioner of Human Rights. The worst and most influential of these was Rory Mungoven, who had adopted a patronizing proconsular role in Sri Lanka when he had been stationed in Colombo and earlier governments had in effect allowed him to dictate with regard to Human Rights issues. In passing I should note that, on his first visit to Sri Lanka when I headed the Peace Secretariat, he rather oilily suggested that the Norwegian-headed Sri Lanka Monitoring Mission was incompetent and should be replaced by the UN (similarly Gareth Evans, during his vulgar lecture supposedly to commemorate Neelan Tiruchelvam but used to promote his Responsibility to Protect concept, had made a pitch for his outfit to take over from the SLMM).

Sanja’s account of how Dayan dealt with Rory’s pretensions is instructive, for his response to the High Commissioner led to ‘a conciliatory letter, regretting that the fax was not more appropriate’. Again I should note that Rory tried, when High Commissioner Louise Arbour visited Sri Lanka, to have her address the press on her own, contrary to her commitment to the Human Rights Minister Mahinda Samarasinghe – which would doubtless have led to problems as had happened when the same had happened with John Holmes, the UN Under-Secretary for Humanitarian Affairs, who had seemed to be highly critical of the government then, whereas the rest of his visit had passed off well.

Sanja’s account of the manoeuverings of the OHCHR with regard to our Universal Periodic Review is also fascinating, and makes clear the prejudices we had to overcome. That Dayan did this so successfully when the West sought to stop our military successes, and to punish us when we eliminated the LTTE on Sri Lankan soil, then forms the bulk of the book, but I believe exploring that adventure requires another article.

I shall conclude this article with mention of another major obstacle Dayan faced, which was the unremitting hostility of Israel. Given the intellectual and strategic lead he had begun providing to the vast majority of the Third World who were opposed to the continuing oppression of the Palestinians, the Israelis were determined to get rid of Dayan, and spared no pains to get their point across to the government. For this purpose the Israeli government whined continuously, a strategy that works as I have seen, for instance with Faiszer Mustapha who strove successfully to convince the President that he was unjustly persecuted.

Sadly that strategy on the part of Israel seems to have worked with the former President too, though there were also other reasons for him finally giving in to pressure and getting rid of Dayan. The letter of the Israeli ambassador which nearly prompted Dayan’s sacking early in 2009 shows clearly how the technique is deployed. But our tragedy is that our officials succumbed to this, and never thought of asking our supposedly good friend why they had also at one stage trained the LTTE.

Had Dayan been removed then, it is not difficult to imagine what would have happened to us later that year, as our forces pushed to take over the last remnants of Tiger territory and the diaspora conducted a vigorous propaganda campaign with both Miliband and Clinton repaying the electoral debts they had contracted. Fortunately, though Palitha Kohona had failed to defend Dayan vigorously, the President resisted pressures at that stage – only to succumb six months later and precipitate the crisis that has beset us internationally since.

      I think Profs in general should be away from 3 RD World politics. They< ycould better help many more PhDers to be added to the country.

    For any reader from within and outside Sri Lanka your article “Mission impossible-Geneva” gives the impression you have now decided to defect back to your last sunken flag ship. Other than showing your intentions how do anybody learn how you intend contributing to bring back some lost dignity to your beloved Country?

    But none of these men have been part of the current issues. They just keep on ciritcising. No whatsoever shame they may have when doing so. In a country whose almost everything have been subjected to abusive acts during the reign of Rajapkshse, but today the current playres to iron out them as rulers have NOT been easy at all. Be it in external issues or interna they the former men have made it worsened.
    These duo – Rajeeva and Dayan were not born yesterday. They had been even VERY CLOSE TO THE lanken Mugabe. But none of them succeded getting former policies changed at least for the benefit of the future of the country.
    Today, against being out of the context, they just point the finger at the rulers.
    I think Mangala has done a great job.
    The country was to be branded and made aware to the world as NO SECOND to Mugabe run Zimbabwe.
    But Mangala et al got almost everything to somewhat cleaner.
    Today at least they have stopped appointments made to FORIEGN ministry the manner MR did earlier.
    Even former rapist, killer or anyone would have been sent out to foregin missions, MR thought it should be the way if they could be saved through impunity. Diplomats have been given some exemptions. That was the target of Megalo Rajapakshe. But that caused to backfire the system.
    Berlin to any other deistnations they had been no properly qualified men or women got appointed.
    So, what talks more about the issue, each and every corners were occupied by pro-rajapakashe men and women. No matter they have nothing in their heads. just to occupy and destroy the country assets.

Time has come for intellectuals like you to get together in order to throw the current lot out and save the motherland and the good traditions being practice more than 2500 years.

      Don’t forget that Our Rajiva joined the current Yahapalanaya mob but found that it is easier to get blood out of a stone than clean up the unholy mess that is our Higher Education System.
      Our Ranil told Our Rajiva not to come back until he finishes reading in full Rab Butler’s Art of the Possible. However, going back to his Peace Secretariat days, Rajiva is still working on his definitive volume of the ‘The Art of Lying’ and (hoping not to get caught).

    In a world of hierarchies bolstered by institutional and economic power, and many individuals fighting battles, some to score points and further their careers, and several others out of genuine humanitarian concern, one could sympathise with Rajiva and Dayan. Their plight owes significantly to Sri Lanka having bankrupted itself in the perception of the world. The expression ‘Canadians plotting against Sri Lanka’ is I think paranoid or mistaken. We in the UTHR(J) have dealt with several westerners whose perception was genuinely humanitarian. We too experienced feelings like those harboured by Dayan and Rajiva when we told representatives of the West, our grave reservations about the 2002 ‘peace process,’ which granted the Tigers virtual licence to kill opponents and conscript children. Often, we were portrayed negatively. No doubt many Tamils felt, and feel, the way Dayan and Rajiva do, when they battled an unyielding Sinhalese establishment that brought this country to the present state.

    Their story is told from the perspective of persons high up in the Sri Lankan establishment, informed about the war by the official hierarchy. To begin, we differ greatly on casualty estimates (my figure, about 100, 000 civilians resident in the Vanni – Palmyra Fallen). Most impartial persons who understood the plight of the civilians in the ‘no-fire’ zones were for the UN stopping the hugely destructive army advance, despite the nature of the LTTE.

    As I have said elsewhere, the LTTE was politically and militarily paralysed by 2000. It was not beyond human ingenuity to find more pacific ways of ending the conflict. The propaganda of war in 2006, backed by a rhetorical upsurge of Sinhalese hyper-patriotism, was ultimately an admission of weakness, storing up troubles for the future.

        We are all under one banner by date, specially living out of the country. You boast of your 30 years or more carrier in ME countries but you sound not to have learnt the basics.
        I am also one who has left the country for my education to Europe. Then I stayed back here for a couple years. There I notice, my thinking is totally different ot many of you guys that come up with hateful contents. Back and forth, .. mama sinhala, mama dhemala mama burgher.. but we are all srilankens or not ?
        This is what they the australians and scandinavians have been trying to teach each of them from the Kindergarten on.
        The model program has been very successful by date.
        Now the westerners go after them and try to learn it. Germany s turks and France s north africans, have been isolated so as the case in UK s Pakiss and other migrants. They have got isolated for various reasons. Most of them migrated to those countries had no basic level of education. I know my cousins moved to UK in 60ties. Many of them just got their OLEVELS completed then. But they started work immediately putting the feet on the west. Now though they ve been far better off but they have not studied degrees. Instead their second generations do well. That is why you would read the name of many migrants on the PUBMED.com today.

    It has been a long time a coming, but now we have it – for the record – an ‘inside’ account of the diplomatic heroics of our national unsung hero Super-Dayan. Notwithstanding the fact that with a smart turn of diplomatic opportunism, DJ secured a ‘win’ before the proverbial faecal matter hit the fan, DJ did indeed achieve a small miracle given the constant ‘breaking of his bat’ from those on our own side. Alas, an innocent bystander cannot but notice that DJ like many others has been used by the Great Liberator and his closest. So, now we have DJ’s inside, at Rs 1000, a steal, and very readable, but when, if ever, will we have the Great Liberators version?

You were fantastic against those BBC, Al Jazeera interviewers giving them a HARD TALK in return. Your English was impeccable and the way you reacted so quickly and logically in meeting those arguments was simply superb. Of course, these will be pearl before swine for those who cannot write 10 words of English without making a dozen mistakes.

    I am sure, there are and will be many comments that are harsh against you regarding this new article by you. But, that is part of the freedom of expression and you and I understand it well. We have to meet such comments with Upeksha (Equanimity) but not with silent servility.

                Spelling mistakes are found in every thesis work even after thorough checks. If that is what it is, why don’t you write in Tamil – a language I am sure you know well? Generally Tamils are clever people, not donkeys like us, though there are obvious exceptions. They do not make mistakes. But they do make big blunders like waging war against a government of donkeys and getting thoroughly defeated. But then, that is not a mistake. Mistakes are repeated but blunders are not. Blunders do not get repeated because the blunderer gets terminated as a result of the blunder. Remember, “Winner takes it all. The loser standing small.” Perhaps, that is not quite appropriate, because in this case the loser is not standing –may be lying down like Prabha licking the boots begging for mercy – but definitely not standing.

          Yes it is zero casualties on the Forces side. Check with the dead Forces list for the period Jan 2008 to May 2009. VP retreated from all land held by LTTE including their stronghold Kilinochchi only to be massacred when they came to surrender in the end as VP believed MR would deliver what he promised. Otherwise there was no battle between the Forces and the LTTE as it was only a Drama of a war for purpose of propaganda only.

                    I never travel through Dubai.There is no need to. There is a daily direct flight to Colombo from where I live. You say, Indians, Pakis and Sri Lankens? Yes, I know what you mean. That is another reason for avoiding Dubai. The Thala Thel smelling lankens.

                    Sometimes you get those Lanken refugees working in Europe going through Dubai. They smell like toilets. They work as public toilet cleaners in the West. I remember, my childhood hero Muniyandi, who used to carry a huge basket full of human waste balanced on his head never spilling a single drop on the ground. Did not VP allow all Tamil civilians numbering around a three hundred thousand to wade across the Nandikadal lagoon to the Forces side?     Dr. Rajiva, most of the commentators commenting here suffer from the BS syndrome. To the uninitiated, I have to mention that BS does not stand for Bull Shit but for Burampi Singho Syndrome, the habit of commenting on something without knowing what the hell one is commenting on. They have these reflex type responses, programmed by their controllers, to everything. It goes like this:

    If the author is Rajiv, attack it. Actually one cannot blame these guys. Going through an article like this written by someone who knows better English than 95% of the living Para Suddas, would be Mission Impossible for the those who comment here. It has 1654 words , 42 sentences and 20 paragraphs excluding the author’s name. (Those who do not trust me may count and see) making up an article that is more like a beautiful symphony.

    It is said that a monkey typing monkey on a key board at normal speed would produce the complete works of William Shakespeare in so many millions of years. Our motley crowd of commentators would probably take up to eternity if they try to reproduce an article like this.

    If you think I am wrong then take up the challenge. We will see. At least we will have some peace from those commentators whose English makes one wince.

    Dear Author and all participants,
    A typical Sri Lankan forum always result in inputs ending up losing even the little dignity the Country is trying to restore. Sri Lankans are found satisfied or even enjoy twisting the truth willfully caring the least for their Country. It is more of finding fault and ridiculing each other than consolidating facts and improving each other and bringing dignity for the Country. Racism is the fundamental curse the Country is suffering from. What chance does the Country has to produce executives who can understand the requirements, stop injustice, corruption, and improve the standard of living which is most vital right now. Remember you need to work towards bringing good sense for your future generation as well.

Over the seven decades of violence, loss of human life and humanity, loss of resources and overall the loss of dignity none of us are not prepared learn the lessons from the impact of racism.     This article is about a book that has been published. but, every has taken to criticize RW or to praise him. Anyway, All Dayan and RW were pro-federal solution, pro-indian etc., at the end of the war. Probably, they trusted diplomats morethan the country’s needs. Becuse of that, most did not trust these two. Generally the govt goes with what people say. I think RW wants to appear in elections, probably. anywa, he he gives less prominence to the book that he was discussing.

    what this book tacitly admits is the influence the Sri Lankan Tamils had in Geneva and in the IC and that without recourse to any diplomatic apparatus that a legitimate government would have at its disposal. The author of the book, Dayan and Rajiv have walked in to the trap of admitting the influence of the Tamils in Geneva and in IC. These idiots basically admit that the Sri Lankan Government have to strategist for over two years to defeat the Sri Lankan Tamil’s influence in Geneva.       Black Money and Western Politicians: Rajash, the most important thing that this book reveals is how large amounts of money can influence the policies of the Western Governments. Governments such as that of Sri Lanka are obviously handicapped in this aspect. They do not have the money to compete with the terrorist groups and even if they had they would not be able to account for such expenditure and consequently there would be a big ha-ho in their countries.

      On the other hand the Tiger terrorists had ship loads of money all earned through criminal activities such as extortion, drug, human and arms trafficking which they put to good use for a very bad purpose. There was no way an ordinary Tamil could ask for accounts. It was all in the hands of VP and KP.

      On the other side the politicians of Norway, England, France and the Clinton foundation and so on were too happy to get loads of this black money in addition to the political support of the refugees in their own constituencies. It was a nice game played by LTTE and Western politicians and Sri Lanka was the victim and it is being played even now. If not for our friends such as the Gulf countries, China, Russia and so on Sri Lanka would have been hung by its balls, as Burampi would like to put it.

      Now there are new ways the corrupt Western politicians can earn money. Why is Germany accepting so many thousands of refugees? For each refugee accepted, these gals and guys get a big cut. Exactly how much I do not know. Perhaps people like Burampi, Darunuwathie, Sam, Samuel and you Rajash can enlighten us about that.

    A number of studies show that toilet workers are highly prone to sexual diseases. It is obvious why.
