Maithri Lambasts Divaina For Inflammatory Journalism, Reiterates His Stand Against Foreign Judges

President Maithripala Sirisena lambasted the Divaina newspaper for misleading the public, while reiterating that he will not allow any foreign judges to be part of any judicial process in the country.

“The Divaina has reported that a war crimes tribunal will be set up in 9 months and foreign judges will be part of this. This is absolutely false. I reject this news completely. They should not mislead the public and create panic among the people,” Sirisena told a gathering at an event held in Peradeniya on Saturday.

He emphasized that the Sri Lankan constitution does not permit foreign judges to sit in any judiciary process, and in order to allow foreign judges to sit in any bench, then the constitution has to be amended. “But, I will not agree with such an amendment,” Sirisena who has been adamant against allowing foreign judges to be part of a judicial process for accountability said.

Sirisena said that the UN has never made any mention of a war crimes tribunal. “I don’t understand why they write like this. The newspaper can at least call us and verify it. That’s basic media ethics,” he added.

Sirisena added that he will steer the country forward based on the advice of the Maha Sangha.

      Sirisena and his government are playing hide seek with the UNHRC, the international community and the people of Sri Lanka.

      They simply think the war crimes accusations and the extensive evidence gathered by the UNHRC reports will be forgotten and go away.

        I never believed in the Hybrid Court. This will help settle one thing. Whether the trial will be held in Sri Lanka or outside of Sri Lanka.

        UNHRC is a body that has to protect their existence which was created after World War 2. Sirisena can say whatever he wants.

        This situation has created 3 divisions within Sri Lanka’s Political environments. UNP, Sirisena’s and Mara’s contingents.

        You know what will happen when you are divided. I rather see Sri Lanka totally bungle the UNHRC resolution altogether.

        This will allow more resolutions from UNHRC.

    Thi sis the reason why we need to introduce code of ethics for the journalists.
    European rich countries would never allow every bit to be discussed with any average. There exist press freedom but to someextent they keep some news items away from the people.
    Example:

    At the time, Supergau disaster broket out in Japan – we perfectly know that radiation threat was much higher than they reported in the news. But wihtin shorter period of time, Japanese were able to control Eurepean press asking them not to spread realiteis.
    Now with all the blood cancer or the related will become aware with the time, as was teh case with Bopal or chenobyl couter disasters, people will have to focus on the realities.
    This is an extreme example, but there are all various news items thatneed to keep away from the general public.. since some fractions in the society, tend to sabotage anything for thei fun and revenge. Like the Joint DONKEY opposition, there are also the kind of alike groups in Europe too, for example when it go with environment protectionists… they are fanatic in some countries, but the press rather supports succeeeding them.

Those abused power have craved it that the average cant see the simple difference between good and bad. So, theytake anything seirious even granted – they simply dont care and join to discuss.         The only time you will see Sangha is when the government seriously start a negotiation process with minorities with a view to settling the conflict.

    Having taken the trouble to go through the video, it is clear that the President criticized the news paper but not a harsh criticism amounting to a lambast. On reading the newspaper it is clear that the headlines do not match the contents. The body of the news indicate that the High Commissioner has given a dead line of 9 months to have a war crimes investigation, the head lines indicate that the event would occur in 9 months and it could immediately work on the body of extremists.

    I have to take note of the fact that if any activity results in a mayhem like that of the July 1983 Pogrom the it is a disaster. We did not vote for this Government throwing out Jarapassa on Jan 8, 2015 for this. In a way, it looks as if Prez. Sirisena too is trying his very best to avoid that in my opinion that is a sensible thing. Unlike last time, where he personalized the issue of appointing Foreign Judges he made it clear that the Constitution does not provide so.

    Prez. Sirisena is a politician. When he says that he would not favour a constitutional amendment permitting foreign judges he jolly well knows what happens if a referendum were to be held afterwards upon his agreeing.Firstly, he would alienate himself with the sitting judges. Secondly the wild public reaction which would be difficult to contain. The Prime Minister, though not vocal like the President on this issue, is fully aware of the gravity of the problem and its implications.

    While safeguarding the order of the country, it is also important to address the concerns of a section of the people who calim that they have been wronged and to have a credible panel to look into what happend and remedy the situation. It is not a bad idea to discuss in the Constitutional Council, though it may not have the mandate to do so, to identify a panel of Sri Lankan Judges who would meet the expectations of credibility, impartiality and integrity in dealing with this issue.

      What made you think that foreign judges hearing international cases is a national betrayal? it is a downright admission of guilt insisting on crooked Sri Lankan judges must hear this sort of case.     Just imagine the fiasco that would have been created if foreign judges were prowling around the country agitating the majority of the people who are Sinhala Buddhists.

    President Sirisena has shown that his loyalty first and foremost is to the motherland and peace.

      I am neither angry or vengeful. I want to only know the truth, which will become part of our history. I want those who are found guilty from the armed forces, LTTE , Para-militaries, polticians and officials , to be forgiven. They were also victims of circumstances our unfortunate history seeded. Our politicians of all hues have to take the blame for the circumstances they seeded and continued to fertilize.

      I have been a victim several times over, but do not hold any ill feelings towards the perpetrators. I am also blind to the ethnicity or religion of others, although I cherish my own identity.

      However, we have to know the truth as citizens, to the extent possible. Rajan Hoole has in excerpts of his book reproduced in CT, outlined how the Justice Sansoni Commission white washed the JR government and the police in the late 1970s. I gave evidence before this Commission as a victim.

      Our judicial system is much worse today and is a degraded institution. It will take decades to recover. We need neutral personalities from countries with functional judicial systems to be a part of the judicial process as at least
      observers.

      Good point, however, it would be a selective agitation.

      There had been many occasions when foreign military personnel was prowling the length and breadth of this island when there were not any agitation by the majority of the people who are Sinhala Buddhists, including the Sangha.

    The Chilcot report shows that there are grounds for UK and US leaders to be prosecuted under International Humanitarian Law. Under these conditions, under the concept of Right to Protect, they cannot accuse the Sri Lankan army of what they did in their own country to defeat terrorists and murderers like your pal Praba. This will be double standards.

    Please wait and see Sir! The so-called international community will back-off. They have greater problems in their own backyards such as the blacks fighting for basic rights.

    Knowing that the US, UK and UNHCR have no teeth to bite, President Sirisena has grabbed the opportunity to save Sri Lanka from their interference. The Chinese have given their re-assurance. May the triple gem bless President Sirisena who is the only leader worthy of governing Sri Lanka and uniting everybody. Forget the past my friend!     Is this an answer to a question raised by somebody, somewhere or New King made it as the main speech he delivered for that occasion? The Paper in his hand tells he had come prepared to criticize the news media. If that is part of the speech that is indicating that New Royal government might having upper hand in its effort of defeating the UNHRC.

    It appears to be they all are taking courage to come out and celebrate the Victory Day in November for the departure of Secretary Kerry. As a respect to Old King, New King stayed out of occupying the Temple Tree House which was vacated by Secretary Kerry by the threat of sending US troops on Old King. That is what Lankawe Media made the Sinhalese to believe. Of cause we do not have any script of the talk that took place on the early morning of the Election Day, January 8th, 2015. But there is some truth; otherwise Old King would not have departed. After winning the LTTE, Old King went to Middle East and came back to stage a flamboyant drama of kissing the land and glorify him. I wonder what will be the equivalent to kissing land in November.

    New King does not appear to have a team like the Joint Comedians who are following the Old King. Still he is spearheading the anti-investigation team within the Yahapalanaya (Government) part of the SLFP. He is out rightly denying this time that there is any call from UNHRC to investigate war crimes. But it was reported even his name was included in that list prepared by OISL. But, those names were removed by delaying tactics of allowing the report to be tabled. It has been many people’s suspicion for some time even there are efforts to have the requirement of investigation also removed. When last time UNHRC High Commissioner, prince Zeid was in Lankawe he promised to Lanka that any internal investigation acceptable for UNHRC members would suffice the resolution requirement (at least that was the one reported in Lankawe media and UN local office did not deny it).

    New King’s outright denial of the investigation might indicate that Mangala probably closer to have the investigation part removed from the resolution one sided. Mangala had fooled the EU to have reinstated the fish export. Now Lankawe has applied for full GSP+. Many members of the Yahapalanaya Royal Government have expressed hopes on that too. UN sponsored IIGEP has submitted report on the level of the lawyers and Judges found in Lankawe before it resigned from its duty. When they are having even a headache, these Lankawe Parliamentarian fly to a Western country, pull off their cloths and prostrate in front of the foreign Specialist Doctors to cut and check them. For More than 40 years, the entire Sinhala nation had combed out all the International governments’ constitutional structure to see which one they can smoothly use to suppress Tamils. Both parties, UNP and SLFP, hired American and other expensive consultants in their last election campaign. Even the simple electric transformer accidents could not be investigated reliably in Lankawe. New King ordered to bring Japan and German Engineers at high cost, in addition to the lost transformers, to investigate the fire . China who built the Norochcholai has complained that its 16 page report on the inferior quality of the CEB electrical Engineers was not used. In reality, Lankawe which does not have Intellectual resources other than the Modayas renamed as Sinhala Intellectuals like Peiris, Dayan, Rajiva. But it is strange and astonishing to the claim that Lanka has legal Expert to conduct courts based on International Laws.

      Sirisena as usual is trying to play double games, just like the way he releases a few hundred acres of land in the north and east with a lot of fanfare and then gets the armed forces and other government departments to put obstacles so that the Tamils will be able to return to this so called released lands. EG Champoor/Sampur is a very good example, where not only the armed forces and Sinhalese led government officials are preventing the Tamils from returning to their homes and agricultural lands but also by the opportunistic Muslims who are using their new found power in the east to try and steal huge chunks of Tamil lands in Champoor.

      Sirisena the Sinhalese establishment and most Sinhalese do not have a conscience but are only very guilt ridden about what they did to the Tamils. Guilt only erodes you and corrodes you, however a conscience tries to correct the injustice done and brings healing. They sadly lack this.

    without putting it diplomatically to the people and the UN that foreign
    judges will not be allowed to sit on judgement of the war crime cases while the govt.initially agreed to abide by UN/UNHCR ruling thatforeign
    judges will preside over these cases and adequate reasons were given for this decision by UN high comm. for Human rights. The President,him
    self took oaths under a senior judge and not under CJ of the time, who was in town, as he did not trust the local judiciary.

    This decision of his, will put the President at log a heads with USA,&
    IC and UN/UNHCR and this is not the time to antagonize UN and IC and get into their bad books, so soon after rebuilding the confidence of IC.by sheer hard work of the new Govt.There is no unanimity among the top rankers in the Govt. FM Mangala, who faces the UN officials very often, feels that he cannot go back on what was discussed and agreed in this matter at the UN,PM Ranil, who has a greater say in Europe,is sitting on the fence, fearing back lash from the IC and only the Pre-
    sident came to this unilateral decision, fearing back lash from the public, which is expected but since the case is in the hands of UNHCR, lodged in the UN ,we have to face the truth as to what ever happened at the war.Finding traces of cluster bombs,used in areas wherecivilians
    were killed,as per some media reports,has made the case even stronger.
    .It is surprising to most of us as to how the President rushed to this conclusion and keep repeating same without discussing as to what would be the consequences of such a decision.
    Suggest that key players ,TNA/Tamils, Diaspora, UNHCR the govt.and Buddhist activists discuss the matter fully and agree to have foreign legal experts as monitors or Observers with certain powers to over rule
    certain decisions if found, flouting the law to favour of some one. The Govt. should do more in reconciliation work in deeds and not in words and faster to bring equality among the major communities so that the Tamils will cool down and agree to a compromise,suitable to both parties and the UN in this issue and close the subject with a happy ending.

    The more the communal forces are allowed to spread hatred against the minorities , the more these communities become stubborn. TNA, since they have good working relationship with the Govt.,should take the initiative to start the dialogue to find a solution as Tamils, the only supressed community, have to move forward to keep pace with the other communities, who made vast progress. TNA and Tamils should also
    know that the present govt. is not responsible for this situation and should cooperate with the govt. to find a solution.

      Ranil is foreseeing a future split. First, beyond whether he is foreseeing or not, the national Goverment was intended to be together only to survive from Secretary Kerry and to there until American State Secretary loose power. He dethorne Old King by showing US troops This is the fear fused together the Solomon West Ridgeway Dias gang and with Stephen Don and Junius Richard gang. So, as departure of Sec.Kerry is initiated, there is no fear of US troops invading any more and no more the Unity Goverment needed. Ranil’s recent speeches suggest he is more than a Sinhala Buddhist. He is willing to become another Ranilnayake Thero. Name Change may be released soon. He is taking the path of Don Stephen, Solomon Dias, Junius Richard… He understand this medicine age old test and real cure the power hunger melady. He came to power after waiting on the step for 20 years. He just can’t lose it.

      Mahendran allowed or assisted a big loot from CB. The proceeds mainly circulated only in the UNP Bazaars. SLFP did not benefit. This was a concern for New King and that is first major rift. So he is out there on the promotion of the evangelical Buddhism. Then there is no other way for Ranil other than matching it. So now there is an intensive Sinhala Buddhism Evangelical Match going in the Land. Ranil is well conscious that New Royal Yahapalanaya government has only 30-40 SLFPyers support but the Old Royal Chitanda Goverment had 65-75 UNPyers. He understands, so, instead of preaching Yahapalanaya, the Chitanta is the best way. That is why he has started to open the Pandora Boxes one after another.

      This will remind to New King that he can not sack Ranil like Chandrika did to him in previous session, so directly engage him on the Evangelical match. This will provide a way out for Ranil from the UNHRC noose too. Foreign Government must accept the verdict of the Sinhala Mahajan, as Sinhala Intellectuals conducts a drama called election. With that, even Secretary Kerry must accept (because he is losing his Chair, at least he has to act like that or confess to American public the failure of his foreign policy towards Lankawe) Lankawe has been rehabilitated from its 70 Years of dictatorship to democracy by his friendly patting on the back of New King and Ranil. By the fear of these new evangelical match, Sampanthar too has flip flopped that there is no need for foreign involvement in investigation. That is what reported in Tamil news as one obtained from Sihala sister system.

      I doubt the need of Gnanasara. Ranil and New King appears to be doing more than him from the comfort of bed of power.

Religious leaders can have their say in social affairs but what do they know about running a country & foreign affairs? Why not consult astrologers as well like the previous regime?     Mr. President, as a devout Buddhist, I worship Lord Buddha, His Teachings and Maha Sangha every day (Morning and evening).

    It is not good to deceive Sinhala-Buddhists in Sri Lanka under various pretexts. However, It is appropriate to mention at this time on this particular subject.

    Having foreign judges represented in our courts of law is not the issue, it is hypothetical at this time. But lack of credibility of our political leadership is the biggest problem.

    My master Lord Buddha once said,

    ‘When the ruler of a country is just and good, the ministers become just and good; when the ministers are just and good, the higher officials become just and good; when the higher officials are just and good, the rank and file become just and good; when the rank and file become just and good, the people become just and good.'(Anguttara Nikaya)

    Mr. President;

    According to the above; if I am to judge you by the performance of your Prime Minister, Other Ministers and high officials, you have a very long way to go be a just ruler.

    Maithripala Sirisena was elected President by the people of Sri Lanka on the 8th January 2015 against all odds, NOT to make the same mistakes that his predecessor did.

    Before the President places the Maha Sangha before the National Interests of our nation he should advice them to change their ways.

    First the BBS and Gnanasara thero has to be asked to behave and respect the saffron robe they are draping around them. As President he has still to utter one word about the behaviour of this despicable monk.

    The Malwatte and Asgiriya chapters and all other upcountry temples affiliated to them have to change the still prevalent caste based ordination process.

    They have to clean up their houses before they could start preaching goodness and humanity to others.

    The President has to take a hard and close look at our Judiciary and the way they are conducting their responsibilities.

    He has the prerogative to appoint a Presidential Commission, even bringing in foreign Judicial experts to conduct an impartial inquiry into the conduct of our Judiciary with the general public given the opportunity to place grievances before it.

    Based on such an inquiry he could justify or otherwise convince the people of Sri Lanka and the International community that all is well or NOT WELL in the dispense of justice in our “Thrice blessed” land.

    The President should know by now that whatever rhetoric that he loudmouths before illiterate peasants will NOT change the perception in the International community that all is NOT WELL in the dispense of Justice in our country.

    Former Chief Justice Sarath N Silva’s heroics, the Magistrate’s bail order in the infamous “Elephant Judge” case and the subsequent High Court ruling, among many other such cases are all not being digested well by the world community.

    Hence the often spoken of “independent mechanism” is a Sword of Damocles hanging over the heads of all right thinking Sri Lankans who voted in confidence to bring President Maithipala Sirisena to the Hot seat that he is occupying today.

    We do not for a moment think that the President has everything cut & dry laid out at his feet but he has to brave the storms and do what is RIGHT for Sri Lanka and ALL Sri Lankans living today in our resplendent island today and those to be born in the future.
