MPLRAG Issues Four Guiding Principles For MMDA Reforms; Demands A Place For Muslim Women In The Process

The Muslim Personal Law Reforms Action Group (MPLRAG) has spelt out four guiding principles for the state to ensure when carrying out the reforms for the Sri Lankan Muslim Marriage and Divorce Act (MMDA) of 1951, while reiterating the State’s responsibility to ensure ‘equality, justice and non-discrimination.’

The guiding principles for the reforms covered; the State’s responsibility to ensure Equality, Justice and Non‐Discrimination; Women as key stakeholders in reform, Respect for the heterogeneous character of Muslim community and diversity of opinion; and Recognition of the dynamism of Islamic Jurisprudence.

In a statement issued today, the group said that the Sri Lankan state has a role and the responsibility to ensure all its citizens are treated equally and without discrimination. “Equality before the law and equal treatment under the law is a fundamental right. The MMDA and the Quazi court system is a special law and cannot be utilized to deny any Muslim citizen of Sri Lanka his/her fundamental rights and protections under the Constitution. If this is permitted some Muslim citizens will effectively be rendered second-class citizens,” the statement said.

The MPLRAG pointed out that the Muslim women have been the most affected by the MMDA and Quazi court system and the mandate for reform is principally derived from their call for changes to MMDA. “Therefore women’s experiences of the law and its implementation procedure and their just expectations must inform and shape the reform agenda. In the current reform initiatives which are underway, Muslim women must have a place at the table. Their voices and demands should be heard and engaged with as the key constituency that is most affected,” the statement said.

      Based on medical evidence, Word Health Organisation has announced that circumcision should be considered as a routine practice for people around the word to tackle HIV. The studies have shown circumcision reduces the rate of HIV infection.

      Saree wearing Buddhists monks who sleep around with fellow monks and have sex with minors are infested with HIV. These monks should be first circumcised to control the HIV transmission within our mother Lanka.

        Son’y you think. exercise, exposure to sunlight, the skin, etc should be considered good practice for healthy living?

              As I said repeatedly I didn’t say anything about Muslim. My post is nothing to do with Muslims. All I said was circumcission was medically indicated by World Health Organisation to tackle HIV. I provided the link to substantiate my claim. Why are you,once again twisting my conversation to Muslim ??? Not everybody does circumcision are Muslims and Jews. In some parts of US and Canada it is a standard practise to circumcise boys. But this practise has stopped in Canada.

                Where in the Quran does it say, Muslims must circumcise? The Old Testament required Jews to circumcise, and this came AFTER they left Egypt.

                Apparently , it was practiced by Egyptians, as they believed that it has some medical benefits.

                However, many are of opinion that it was for religious reasons.

      Have you read the full four page report by clicking on the “here”.

      Yes, I too, would like to have one law for everyone, but that may have to evolve slowly. What has been suggested brings MMDA much closer to the “normal” laws than I ever thought possible.

      Don’t provoke Muslims unnecessarily . . . by talking about pork, or circumcision. Please look this up on the Internet yourself: about 50 years ago well over half of white American boys were circumcised because it was thought to be healthy. Those figures have now fallen.

      What the hell does it matter to us? Also, I won’t be surprised to learn that there are many boys in Muslim families who have not been circumcised at all. Hasn’t the unnecessary war that we fought taught you to let sleeping dogs lie. Oh, and Muslims are rather averse to dogs, so it may be I ought to have avoided that particular idiom in this place.

      However, once they’ve assessed where I stand on issues, I don’t think that they will strongly object.

        The Messenger of Allaah, sallallaahu alayhi wa sallam, said,

        “O Allaah bestow your blessings on our Shaam. O Allaah bestow your blessings on our Yemen.” The people said, “O Messenger of Allaah, and our Najd.” I think the third time the Prophet, sallallaahu alayhi wa sallam, said, “There (in Najd) will occur earthquakes, trials and tribulations, and from their appears the Horn of Satan.”

        This hadeeth has some controversy surrounding it due to obvious sectarian reasons. A hadeeth which has been (deliberately) misunderstood by certain groups of people in order that they may spread their misguidance and deceive ignorant Muslims.
        Amongst the scholars that are mentioned who referred this hadeeth to Iraaq were: al-Khattaabee, al-Kirmaanee, al-Aynee, an-Nawawee,ibn Hajr and others. The reasons behind this are numerous and clear:

        At the time of the Prophet, sallaahu alayhis wa sallaam, there were 13 places known as Najd [according to ‘Najd Qarnu ash-Shaytaan’] depending on where one was. This because Najd linguistically means a raised/elevated land. Therefore the Arabs referred to lands that were elevated with respect to them as Najd.

        One of the most commonly referred to areas at that time as Najd was Iraaq.

        The variations in wording of the Hadeeth of Najd leaves no doubt whatsoever as to what it refers to. I will refer to only one for brevity’s sake

        The hadeeth of ibn Umar Reported by Abu Nu’aym in al-Hilya (6/133),

        “O Allaah bestow your blessings on our Madeenah, and bestow your blessings on our Mecca, and bestow your blessings on our Shaam, and bestow your blessings on our Yemen, and bestow your blessings in our measuring (fee saa’inaa wa muddinaa).” A person said, ” O Messenger of Allaah and in our Iraaq” and so he turned away from him and said, “there will occur earthquakes, trials and tribulations and there will appear the horn of Satan.”

      When we had a son in 1989 in California, we were told he would be routinely circumcised because it was deemed to keep the relevant part clean and healthy. We were told to tell the doctor not to do it and we did so. Otherwise he would have been circumcised.

      Circumcision reduces the chance of penile cancer by a factor of 3. It reduces the risk of urinary infection. It provides the definitive treatment for phimosis and recurrent balanitis (http://jme.bmj.com/content/30/3/238)

    I’ve skimmed through the full (4 page) document as well.

    This is amazing! Now we non-Muslims can mind our own business knowing that the law (at least) doesn’t allow Muslim women to be ill-treated. If we are to consider the State of Sri Lanka to be a united entity then it must be possible for us to claim that the laws of the land are fair by everybody.

    There were three excellent articles by Muslim women in December 2016. This was one:

    A great victory for them. Readers wanting to go in to those posts ought to look at archives for Dec. 2016. Search at the top of the home page, go to the last, and then work backwards to about page 6. This post has been on the 9th of Dec. 2016.

    Great work also by Colombo Telegraph and the editor, Mr Uvindu Kurukulasuriya.

    Now, for Allah’s sake don’t let this get mixed up with issues like LGBTQ etc. Personally I have no objection to issues like that being liberalised, but those issues must be considered less acute than this one dealing with Muslim women.

    It will be good for us non-Muslims not to interfere from this point on, provided this all goes through. What I’m hoping is that this new law will make all Muslims more sociable, and that it will also bring down the birth rate – which is something that seemed to trouble many Sinhalese (not me, particularly). Or, perhaps, such statistics allowed the likes of Gnanasara to create mischief.

    Once more, congratulations to the females of the species on what seems like a great victory. Ultimately, let’s hope that it makes the men also more relaxed, open and happy.

    What no comments yet on what seems to be a great victory for for Muslim women activists? I clicked on “here” and read it all – about 4 pages of very concrete

    I posted one about five hours ago congratulating Sabra Zahid and Shreen Saroor. Their articles in December 2016 undoubtedly allowed this to come about. Perhaps my comment was too long.

      The problem is the Muslim women are trying to mimic non Muslim women. Most of the divine laws of Islam are now being proved to be scientifically gospel. Why the hell can’t these women just leave Islam if they want to change divine laws. In any case, they have no Islam in them

        When I comment on something that has been written by a person whom I know nothing of, I try to be more polite, but your response is so predictable, so dogmatic, that I’ve been dismissive of what you say.

        Please try to think of these persons as people first, (that’s how they entered the world, then Muslims. I know that Muslims in particular find it difficult to adjust, but you will have to. It may be that reading my response will harden your stance.

        The problem really is that you are so convinced that God is on your side. You ask, why these women can’t leave Islam. When? Now that a few of them have been brought up to be thinking adults. Those are the fortunate ones. The others are have had their minds brainwashed from birth, and will never develop independence.

          Now to voice the concerns of many Non-Muslims.

          There is this fear that Muslims will all band together and try to swamp all other cultures and have only Islam prevailing throughout the world. I myself feel that with greater education and the empowerment of women, it will not be possible for such an agenda to be carried through.

        Have the courage to trust people more. Your response is similar to that of “Muslim Man” above. I’ve tried to be less offensive, because those excellent recommendations are not the end of the story. Those ladies will have to persuade you to accept them. It won’t be easy.

        As I said in the very first comment I made here, the last thing that we want to do is to interfere in your personal affairs. Yes, men in every society try to “safeguard’ their women. Do so, but you are now being challenged to think differently. Yes, these suggested changes are drastic.

      When I saw this article five days ago, I misread it. I imagined that these recommendations were going to a legal draftsman (in the Attorney General’s Office, are they?) for a new MMDA to be enacted by Parliament. Now I realise that these are the recommendations of a group of liberal Muslim activists, and that we have a long way to go before these are accepted by the entirety of the Sri Lankan Muslim community.

      So, there’s a lot of work still to be done, and I wish these persons who are striving to better the lot of Muslim women the very best. I can also see that if Non-Muslims are too vocal it may get counter-productive. We men certainly have no business messing about with women who are destined to be the faithful wives of Muslim men!

      Our concern has to be limited to this: human beings everywhere ought to enjoy basic human rights. Within our own country, which is still 90% non-Muslim, I think that we can, and must ensure that the group of persons worst discriminated against (i.e. Muslim women) have their rights. In predominantly Muslim countries, it is unfortunate that “infidels” have almost no rights! However, that does not mean that we should try to impose narrowly “Sinhala-Buddhist” values on Sri Lankan Muslims. The day that a “Sri Lankan” identity transcends a “Sinhalese identity”, and we accept that this country belongs to all its citizens, we will be able to insist on certain common laws.

    All the best to these ladies in this group for articulating so succinctly their demands and hope these will be granted by the State and other actors in charge.
    Some weeks ago it was reported that the committee appointed by justice marsoof will release their report soon but it looks like that is not the case.

    Hope the state accedes to the women’s demands and not let the ulamas Retain these barbaric practices. These barbaric laws must go and this group of women have done a good job. It is unfortunate that the ulamas are given such prominence and no Muslim leadership to counter them. Mplrag has a long way to go and I wish them all success.

      Yes, let’s hope that these progressive reforms go through.

      I’ve already made two responses which may be considered to be rude and interfering by the Muslim men whom I ticked off. It may be that I’ve done a dis-service to these courageous women. It may be that we have to work out how to respond to these men who feel threatened.

      We can’t force these things on this community. They must realise that these recommendations are healthy. Few of us have much respect for Muslim politicians; but it won’t be healthy for us to get non-Muslim Members of Parliament (well, we hate the entire breed in one sense), to force this legislation on this particular community.

      I don’t think that even this response of mine is satisfactory. I hope that a few intelligent Muslim men will start advising us – and soon. Those reading on this site tend to be fairly liberal; one has to expect stronger reactions in other fora.

      Let’s see how this evolves.
