Nawaz To Succeed Livera As AG. Will Jayawardena Replace Jayasuriya As CJ?

With the Supreme Court saying ‘yes’ to most of the clauses of the 20th Amendment, Aluthkade rumor mills have already begun churning out various scenarios about the future.

Although Attorney General Dappula De Livera played his part in the 20th Amendment case and saved many clauses from being subjected to a Referendum, it is no secret that the Rajapaksas do not like him. This dislike, quite apart for their dislike of his mannerisms and demeanor, goes back to the days of the previous Rajapaksa regime when he used to address Secretary to the Ministry of Defence Gotabaya Rajapaksa as “Mr. Secretary” when other senior government officials were virtually prostrating at his feet.

Next year, Livera is due to retire. Even under the 20th Amendment, he will not get an extension form the Rajapaksas. His deputy, Solicitor General Dilrukshi Dias Wickramasinghe is under interdiction and in any case the Rajapaksas hate her. Next are Sanjaya Rajaratnam who is already being side-lined and Sarath Jayamanne who is also due to retire soon,

The buzz in Aluthkade is that the man to watch is Dileep Nawaz, President of the Court of Appeal who has always served the Rajapaksas well. Nawaz is an acolyte of Mohan Pieris. It was Pieris who saved him from dismissal. He appeared for Nawaz at the disciplinary inquiry where the latter was charged for several misdemeanors. The inquiry was conducted by a retired public servant and was all fixed. Several senior officers of the AG’s department had egg on their faces when they were disbelieved. They include a present very senior judicial officer who gave evidence against Nawaz. Nawaz is ever grateful to Pieris for this.

It was Pieris who got Nawaz appointed to the Court of Appeal over the heads of senior officers who wished to be appointed to the Court of Appeal. In the Court of Appeal, Nawaz had delivered more than one hundred judgements without writing them! Court of Appeal Presidents Preeti Padman Surasena and Yasantha Kodagoda did not permit him to sit on the Bench but required him to work in his chambers and write the outstanding judgements. Nawaz has not hidden his displeasure to Surasena and Kodagoda for this.

After Gotabaya Rajapakse became President, he nominated Nawaz to the Court of Appeal and is said to have assured him that he will be re-nominated and re-nominated until the Constitutional Council approves him. Nawaz had little difficulty in getting approval as Sajith Premadasa did not wish to antagonize the Muslim community by objecting.

The Rajapaksas cannot have a better AG than Nawaz. “Nawaz will perform even better than Mohan Pieris,” senior lawyers predict.

What about the Chief Justiceship? There the man-in-waiting is Justice Priyantha Jayawardena, Basil Rajapaksa’s former lawyer, who apparently have gone further than the other judges to determine that not a single Article in the 20th Amendment requires a Referendum.

Like Livera, CJ Jayantha Jayasuriya is also not liked by the Rajapaksas. It is no secret that the UNP leaders preferred Jayasuriya when Chief Justice Nalin Perera retired. Speaker Karu Jayasuriya in fact campaigned for him.

Aluthkade gossip is that the Rajapaksas would like to see the back of Jayantha Jayasuriya soon. “The Rajapaksas have their own ways. Remember how they gagged Sarath N Silva after he gave a few judgements against them? After Sarath N Silva struck down the fuel price increase, someone paid a not-so-friendly visit to his house and that was the end of his bravado” a pro-Rajapaksa lawyer who hates Sarath N Silva said. “Aluthkade will see interesting changes,” he confidently said. (By Ranmal Weerasekera)

    Sri Lanka is a country where gossip and speculation finally becomes Gospel truth. One recent instance is the speculation that a Navy man would be the Foreign Secretary. Bingo! It became true. The author highlights that some characters are not liked by the Rajapaksa’s and for that reason justice will no be done to them. Is it the Rajapaksa’s only? Had Sajith got elected with a thumping majority of telephonists in the parliament, wouldn’t it be the same? When will Sri Lanka realize the need to have a President directly elected by the People but does not belong to a political party, leaving party politics to Parliament. The big man would spear-head only what is truly national in character and serve as a check on the bravados of the politician. He steps in directly in cases of importance and emergency and operates on the sidelines in other instances. Then even if you give a hell of a lot of power to that guy it has no real impact in terms of abuse and the need to have quite a lot of “independent commissions” do not exist.

      You have articulated it as no others. My heartfelt thanks go to you. But we perfectly know that this has been the culture in this god punished country. They repeat about their pride -being 2500 year old heritage, in the same time, they behave like all the last high criminals, with the direct backing of THE MASSES (who are punnakku drinkers).
      Not the qualifications but backlicking and selfish nature has become the best qualifications for public sector jobs today. Not a week ago, we were compelled to read that Dr Jayaruwan Bandara to be removed from his position as ” Director of MRI” – according to the news came up on the unreasonable dissmissal – what became clear was, PM was not aware the sacking, minister of health APAWITHARA WANNIHAMI had no clue either, but it happened. His self respect, was deminished within few hours. I dont think srilanka manage CONTAINMENT of COVID virus as they self-proclamied it louder to the locals, however, the role of former MRI head was not overlooked by many. I thought the kind of men should be the heads regardless of them being backlickers of high criminal POHOTTUWA party.

      Thanks for your posts encouraging me. I truly believe, you are a genuine person. I read your posts somewhere else. Hope you are keeping well. AYOUBOAN= Live long game iskolemahaththayo… if I travelled back home, I would have invited for a tea somewhere in Colombo… next time, I dont want to miss that.. but when ? very likely after a vaccine is marketed in Feb 2021 or little bit later. I usually travel back home 2-3 times a year.

      Do you think you achieved a smidgen of progress even if you yourself sometimes made diehard effort to change anything in that MISERABLE world ? I know how you and I supported that NK, who was later marginalized not even being able to get the nominations.
      I think if you joined your daughter in Malaysia, you could deliver lot more services to the world, where they hire retired school teachers today ( age is secondary)as their teachers, on a better remuneration package. I know some europeans work in Singapore and Malaysia as school teachers. Most of them are reitred ones. They think it is better to expand their cultural interests. I have been to Malaysia (KL) and Singapore several times in my life.

    Are we in a position to name someone who got elevated to a higher position
    in public service purely based on fine quality or worth in our country ? Such
    personalities are rare because political pressure is on every single individual
    in the country ! Maybe some of us don’t feel it because we go with the flow
    for our safety which translate our default cowardice that has something to do
    with selfishness . In some cases our leaders are very strict on their subordinates
    due to lack of trust and that too has a reason but trying to dictate everything to
    everybody is not the solution for all this evils because dictating at the and leads
    to Dictatorship that leads to superior evils !

    Get rid of the Parliament and the Judiciary and let HEP rule with the clear mandate handed down to him by the people. There would be only one person for the people to watch. Now there is no way of telling whether we are going or coming. There are too many cooks and the lunch or dinner never get done. (Not sure; it should be cooks or crooks.)

                I wish to quit from this forum. First thing we learn as we enter adulthood is to respect the privacy of others. It does not seem SM has learnt that lesson yet. This is a public forum and giving air to private issues is certainly not on. SM sounded very concerned about my situation and mentioned the name of NK requesting details. With high regards for the man and thinking that only some good will come out of it I did oblige. He either did not read it or did not understand what is written. I was surprised when he took off on a tangent, and missing out on the main issue. He should know it is illegal to use/abuse information erroneously delivered or received on confidential basis. I do appreciate your concern.

Not for nothing they were named after ” alleged criminals”: Needless to say, they spent more time in courts and lawyer s rooms during the last few years for all the high crimes they committed during their tenures. However, srilanken lawyers and judges or anyone are not coming from foreign coutnries. Lawyers are teh worst among the highly corrupted srilanka. That Dolawatta, a man from Malgawattha area would defend even the most notorious criminal if the bugger would have been paid for that. Consequence is he ended up being a parliamentarian.

                Some of the Rajapakshes have studied the systems in the developed societes, being able to continue their exile periods in the US and Europe. But Basil or the like are yet today – world champions at LOOTING of the tax payers funds. Do we have any leaders in entire SOUTH ASIAN region, the kind of multi criminals born to a single family ? But people voted for him being misled by MEDIA mafia.

I am just a traveller to srilanka, who visits the country 2-3 times a year: However, I have been very close to srilanken news though me being permamently away from the country.
          Almost everything is upside down in that island today, just because PEOPLE – I mean the average mind set is misled by Rajapakshes and their media networks.

            I am certainly not an idiot of same level as SM. Just within the first 100 days after the defeat of MR, they looted the Central Bank throwing back rotten eggs on the faces of their very voters. Penthouse Ravi went back to Temple Trees without even a loin cloth to cover his nudity. Their leaders grabbed lands declared as National Heritage sites, etc., etc., It is very difficult for any moderate mind to decide on who are bigger crooks and who are lesser crooks. It has to be solved by tossing a coin perhaps one which has the same on both sides.

            Instead of perching safely high up on a tree you should come down to the very earth and fight instead of barking at the Moon from high up on the tree.

    Justice Minister is Ali Sabre. AG is Nawaz. It looks like Royals are going to tap Hakeem for CJ. Lot of Sinhala Intellectuals in the public Service, Media Industry, NGOs are going cover the buttocks with both hands and will be counting one, two three……….. once the Rapist Army’s Thirukai Waals start to swing left and right.

    Those Sinhala Intellectual species will be thanking the 7M Sinhala Buddhist Modayas; let us too join in the hooray for the long awaited dream comes true.

    Over time, in little bits and pieces we have allowed the elected to break down the safeguards built into the system of government.
    It was JRJ who started the rot by appointing Ananda Tissa de Alwis as a Permanent Secretary from the private sector in 1966, when earlier it was a Civil Servant, one of a band who entered the Civil Service having had a First Class (or Upper 2nd – not sure there) degree from a University and having faced a stiff interview, They did not involve themselves in politics and took an oath to service whichever government. Further there were only a limited number in that cadre and each year vacancies were filled in due retirement or incapacity or death only. Varies each year – No more no less.
    Then Felix B with help from Sirima and Colvin abolished the Civil Service in 1972 and brought in the Administrative Service, and along came deterioration and finally now is, a hotch potch of appointees at the will of the powers that be – subservient lackeys ready to rush and even open car doors for the boss. Ministries and Secretaries proliferated.
    Similarly there was in the past, an established order ( by tradition) of the next in line in the Judiciary rising to the higher posts, they did not play politics but acted truly according to law and had a conscience.

If you were heading out on a journey by sea, asks Socrates, who would you ideally want deciding who was in charge of the vessel? Just anyone or people educated in the rules and demands of seafaring? The latter of course, says Adeimantus, so why then, responds Socrates, do we keep thinking that ANY OLD PERSON SHOULD BE FIT TO JUDGE who should be a ruler of a country?
        Is Universal Suffrage the REASON for this fiasco?

              But NGR prior to his election, he assured, that noone from familiy circles would be given any appointements as was the case under MR… remember ?

        I would say, not only Sinhala psysche – but if you consider other communities – many have in their own way contributed in quite some measure by not thinking as Sri Lankans and trying to get what they can of the pie..

    Shocking at first. Then the quick realization it’s business as usual in the GOSL, the dirty business of politics that is.

    Has there been anyone else more audacious than the Rajapaksa brothers, particularly Prez Gotabaya, to be so defiant and so openly self serving as already proven time and again?

    The voters flocked to give Gotabaya this mandate and hailed him as the best thing ever happened to Sri Lanka. Now much of the same voters are shocked that Gotabaya is carrying on as was expected and predicted. They excuse themselves that they didn’t know that the hate mongering, corrupt, war criminal they elected would be a self serving authoritarian.

        Laying low and keeping up with the CT articles.

        Yet another audacious and defiant move… appointing Yoshitha Rajapaksa as PM MR’s sec. It’s concerning that they aren’t the least bit concerned that it will be of serious concern to the voters. Family oligarchy in the making, going all out for win or lose.

        It’s not shocking but still very disheartening when innocent lives of those who were hurdle to the Rajapaksa success were taken out ruthlessly, the majority of the citizens just didn’t care about justice for the victims; if they had, they would not have gifted the Rajapaksas with such overwhelming electoral success.

    Some interesting news from Lanka. 1) when there is Covid breakout reported from south to north and west to east, minister Pavithra claims “somehow they all are connected to garment factory cluster”. These are people who work 24/7 and often dose not leave their quarters . 2) When govt, media and social media were targeting,scapegoating and throwing mud at the poor lady worker, the reports indicate more than 100 workers were already infected and working their to prior to she becoming positive. 3) The chief of commando force , India told media ” India’s counter terrorist force / NSG trained personals who currently provide personal security to MR”. When MR can win over LTTE single-handedly , why he needs India,s services for his own safety ??? Is this like Rajapaksas getting their medical treatment abroad and recommend indigenous “Jeewayu prathijeewaka” for public to keep Covid away. 4) Yoshitha appointed as chief of staff to PM. Just calculate the public expense on Rajapaksas family members alone including their , travel, security, perks, salaries —-etc, when we have less than 150 critical beds available , for newly Covid detected patients and govt getting monthly loans to keep country running. 5) Now please tell me “what is the chance of reviving Srilankan which is declared bankrupt” and govt treasuries/bond recently declared “JUNK”.
