Obligations In 2015 Co-Sponsored UNHRC Resolution Must Be Fully Fulfilled: TNA

All Sri Lanka’s obligations in terms of UN Human Rights Council Resolution 30/1 of 1st October 2015, co-sponsored by the Sri Lankan Government, must be fully implemented, says the Tamil National Alliance.

The decision was arrived at following a meeting of TNA Members of Parliament and Provincial Council Members held in Vavuniya today (11th March 2017).

Issuing a statement last night the TNA said: “These obligations must be fulfilled under strict conditions, under the monitoring of an office of the UN High Commissioner for Human rights, which must be established in Sri Lanka.

“The UN Human Rights Council must ensure that, in the event that the Sri Lankan Government fails to fulfill the abovementioned obligations by way of an appropriate mechanism, victims will receive the intended benefits of the fulfillment of such obligations, by way of international mechanisms.

“Hon. MP Nadesu Sivasakthi stated that the EPRLF did not agree to the abovementioned decisions.”

    “victims will receive the intended benefits of the fulfillment of such obligations” Can someone explain what these benefits are? It would be beneficial to know that there are so many from all walks of life, all races, religions and all parts of the country who have been victims of state sponsored violence. They are entitled too.

      Do you object to victims being registered, losses recognized, confessions sought or made, perpetrators identified, perpetrators prepared to accept guilt and accepted appologies for their part in the crime, begged pardon, pardon being granted to the perpetrators, victims being adequately compensated, ……………. then moving on?

      You are too primitive to be go through such a process.

      It is Srilanka responsible war crimes committed by its rulers, military, paramilitary and including LTTE. Srilanka rulers are responsible for violation of human rights, creating ethnic cleansing policies and the breakdown of the rule of law and massacre of both Tamil and Sinhala people.

    Tamil political Road Map by division of Sri lanaka.

    TAN is not national political Party, it is Tamil-national- chauvinist politics of country, who want only Tamil speaking in North.

    Such party is similar to ISIL of politics of Islam fundamentalism of Terrorism .

    TNA is more or less proxy forces of LTTE Parliamentary arm.

    It Is not independent political out-fit of TNA that is belongs Tamil Diasporas of LTTE ideologies.

    TNA politics is not that politics of democracy party.

          Did TNA justify/encourage/support/incite terrorism in their speeches in parliament? If they did please cite the relevant Hazards.

          You will do well to remember public racists Cyril Mathew’s speeches in the parliament, inciting violence against innocent civilians who were the citizens of this island.

      This investigation process was agreed by Old King to UN SC Ban ki Moon. But when Ban-Ki-Moon left it with UNHRC, Thero De Silva and other Old Royal crooks cheated UNHRC for 6 years.

      The truth is, last two year Yahapalanaya, who get the American help to come to power, has so far successfully prepared itself for American presidential election, Lankawe Local Government election, EU’s GSP+, India’s ETCA, Hangbangtota sales to China, Colombo Pong Cing sales China, but nothing on Resolution 30/1 or Constitutional amendment. Who knows what is going to be next agenda of Yahapalanaya and for what political agenda it is getting ready?

      Constitutional change and war crime investigation are two mutually exclusive matters. TNA lawyers lack legal sense, so they are cooking up these into one and that is why they approved the extension.

      Can one of them explain what the extension can do than the direct referral to UN SC cannot do? The extension is, if not associated with any hidden political agenda agenda, only to allow time for Sinhala Buddhist Goverment to set up the legal framework to investigation and investigate the war crime. When the Sinhala Buddhist government set up a special court and, if the Sinhala Buddhist government is not guilty then the Sinhala Buddhist will be free to go. This can be well promised by UN-UNHRC to Yahapalanaya, instead of UNHRC buys the guarantee of Lankawe in ensuring a sincere justice for Tamils through the local system. But the Sinhala Buddhist government is not setting up the court for whatsoever the reason is. Why the TNA thinking that the UN-UNHRC should not jump in and set up a system with the necessary amendments to the law body text and finish all the peripheral jobs? If Lankawe is ready at that time, UN-UNHRC can hand over the rest of the work to Lankawe. If Lankawe, even at that time, is not ready then UN -UHRC mechanism should go ahead can completly the investigation. Why should everything be postponed until Lanka’s timetable?

    It was Srilanka who co-sponsored the Motion. It is highly irresponsible to do a U-turn after two years to renege what was promised.

    It is morally unacceptable the irresponsible conduct by any one.

      I wonder who is the biog boss who agreed to co-sponsor, is it Prez MY3, Premier RW or FM Mangy on his own or as advised by foreign service Mandarins. We need to get to the bottom of this. It gives the impresssion to the world at large that Sri Lanka talks first and thinks later.

        It was none other than that historical traitor of the country Mahind Rajapaksha. That blood bastard, on the very first 9th date after the was over, brought down Bank Ki Moon and promised him the moon! From that day on UN is after SL demanding honouring the promised Rajapaksha made to the Ban. This is the very reason why Pirabaharan chose to support MARA in the presidential election instead of RW. He knew very well that Rajapaksha will one day betray the country and give it on a plate to them! It is this Gordian knot that Ranil Wickramasinghe has had to solve today. Rajapakshas have bequeathed the country several Gordian knots: that of economy and debt trap, HR violations and international pressure, total collapse of governances and public administration, system breakdown, education training and skilled worker shortage, the problem of anarchy in every aspect of the country whether it be the health sector, environmental sector, administration sector or civilian responsibility, awareness, perception or conductor aspect.

    People voted Jarapakshe out and voted this government in not to take us deeper down the same abyss.

    We as Srilankans have to hide our faces in shame because we have become a pain in the neck to the whole world. Ever so often, IMF, UN, EU, British, American you name it and you have it, delegations are in Srilanka trying to untangle Srilankas very own problems, in spite of costing an arm and a leg for the country to maintain such a bunch of brilliant fellows in our august Parliament.

    In 1948 at the time of transfer of power from Britain to Srilanka, Srilanka was a model for the rest of the world to follow. And, Singapore did faithfully follow that model and today She is a model by Herself and in Her own right.

    It is high time to get the Srilanbkan Al Capones, Pablo Escobars to strip them of their Sinhala Buddhist shrouds to reveal their real selves.

    I like to quote here the Jaffna Daily “Valampurii “example from Panchali Sabatham for TNA’s Vavuniya meeting. “The princess’s clothes were mostly peeled off. Thuchathanan was dragging on her hair into the Royal Court in session. She was reeling behind him crying out for help from the learned Gentry were seated in that court of King Duryodhana”. Not one of them stood up and told to the King “Duryodhana these actions are beyond this court’s commission ot it can take. We can’t just sit and watch this. You better stop at this stage”. Thus Valampuri accused no one in the Vavuniya meeting of TNA stood up and talked for the Tamils.

    TNA should not have done this way.

    They should have asked UNHRC to follow simultaneous action. Lankawe has purposefully let the date pass. It publicly appealed President Trump to invalidate the resolution 30/1. In that circumstances UNHRC gains the authority, by virtue of Old King releasing a statement through Ex-UN SG Ban Ki Moon to take responsibility and accountability of the war crimes and the co signing on the resolution 30/1 to investigate it with Foreign and Commonwealth Lawyers and Judges, to proceed to the next stage. Of cause, if in its evaluation, it finds to be reasonable, it can still allow Lankawe to go ahead and try to implement the resolution. So, there is no need to put a halt on one waiting for exhaustion of the other. They both can be done at the same time.

    UNHRC has no expertise in war crime investigation. It has not consulted ICC on this matter for its opinion of dragging this forever. ICC is the one has the experience on this matter. UNHRC has promised to Lankawe to assist in technical expertise. The laws or acts need to be passed on this matter at Lankawe parliament is ICC’s area. Lankawe may or may not be party to ICC. Still UNHRC, directly or indirectly through UN SC, officially requesting ICC to offer its expertise on Lankawe in this matter is not violation of any process.

    Then, if Lankawe is not willing to go further and investigate or the case, in nature, for ICC’s opinion, beyond for just offering technical assistance, ICC’s president can always take over it without UNSC recommending it. This is a process available for any UN member without any violent imposition over its sovereignty.

    I am not sure why TNA members were not willing to suggest or consider any alternatives.

    It is my wish the Sri Lankan government do the right thing by implementing the operative paragraphs of Resolution 30/1 without prevarication. To the country’s progress we all should turn our attention to the development of the economy. As a prelude, we must solve the national question once and for all amicably among all the three major communities. Once ethnic peace is established, promoting economy will prove easy. Right now there are street/sit in demonstrations by IDPs at various parts in the North. Some people are fasting till death. President Sirisena has not kept his promise given in December 2015 to hand over the lands within 6 months to the rightful owners. Naturally the people’s patience is coming to an end. Instead of winning the hearts and minds of the Tamil people, the government is doing the opposite. President Sirisena says he will not allow foreign judges, prosecutors to participate in the investigation. His reason is the Sri Lanka judiciary under Yahapalanaya is not the same as under Mahinda Rajapaksa. Rajapaksa appointed a pliable and backboneless Chief Justice who will give verdicts the way he pleases. But the verdict in the Kumarapuram tried before a Sinhala speaking jury proves the opposite. All the accused were acquitted. So the insistence by President that he will not allow foreign judges and prosecutors is simply ridiculous.
