Once Again Sri Lanka Cheats The International Community

Over the last year, the Democratic Socialist Republic of Sri Lanka, formerly Ceylon has become an international playground for China, Japan, India, Pakistan, Iran, Russia, USA, UK and EU countries. Except for two or three, all the others supported regime change and now they are competing to have their share of gain.

Some are progressing well! Unfortunately, neighbouring India, accused by the former President as being a country in favour of regime change, has not received its reasonable dividend. India is not happy about the recent developments in Sri Lanka. Regarding the ethnic conflict, they took a very lenient path but that trick didn’t work with the new government. The new government prefers to deal equally with China and India.

For various reasons, no government in power in Sri Lanka will exclude China. In other words, there are many reasons for Sri Lanka to be watchful of India. Even though Indian decision-makers know this well, they play a silent diplomacy.

On the other hand, the USA, UK and EU countries are doing well with the new regime. Whether economically or on human rights, it is all based on politics. It is a question of how much Sri Lanka is willing to offer those countries. Some say India is looking for a giant share in Sri Lanka.

Zeid Ra’ad Al Hussein called on President SirisenaIn Sri Lanka, the ethnic conflict has existed since independence in 1948. But Tamil political grievances never reached the international community until 1983. Even though there were many Sinhala riots against the Tamils (1956, 1958, 1977, 1981 and 1983), it was only after July 1983, the international community began to be aware of the longstanding communal blood-bath in Sri Lanka.

No country except Britain was aware of the failure of the Banda-Chelva pact in 1956 and the Dudly-Chelva pact in 1965.

SWRD Bandaranayake (Banda) father of ex-President Chandrika Kumaratunga, who belongs to the Sri Lanka Freedom Party – SLFP was Prime Minister in 1957 and Dudley Senanayake (Dudly) of the United National Party – UNP was Prime Minister in 1965. They both signed agreements in 1956 and 1965 respectively, with then Tamil leader S.J.V. Chelvanayagam (Chelva). These agreements were based on a quasi-federal system, devolving certain powers to the North and East.

Unfortunately both agreements were unilaterally abrogated by both Prime Ministers, due to opposition from political parties and Buddhist clergy in the South.

Indo-Lanka accord

Since the failure of these two agreements, many other pacts were also signed on various issues, between different leaders. Each agreement ended up in broken promises. A good example is the Indo-Lanka accord, which was signed in 1987 between India and Sri Lanka. This accord laid the foundation for the 13th amendment and led to the creation of the Provincial Councils. Now, almost three decades have passed and the full implementation of this accord is still in a dilemma. Like other agreements, the Indo-Lanka accord was also set aside by the Sri Lankan rulers. Each government invented excuses for non-implementation of the 13th amendment.

Last May, in an article about the 19th amendment, – “The 19A For the South & ‘Zero’ For the North & East“, I wrote the following:

“The 13th amendment is already part of the constitution, so why is the present government delaying full implementation of it? No vote is needed for implementation. Why all of a sudden, is the daughter of the late SWRD Bandaranaike talking about federalism? Will she pass this bill in Parliament with huge support like the 19th amendment? If there is a bill on the federal system in Sri Lanka, it will raise many questions in the present situation in Sri Lanka. Would it be supported by MPs in the South? Would such a federal system merge the North and East?”

According to what is reported in the local and international media, there has been no indication of any positive gestures at all either on reconciliation or on accountability. Whatever the government does presently is purely for the consumption of the international community.

Sri Lanka was a co-sponsor to the resolution unanimously passed in the last 30th session of the UN Human Rights Council – UN HRC. Despite being one of the co-sponsors of this resolution, Sri Lanka has set it aside and is trying to implement something of their own. This is being done with the help of some members of civil society in the South.

On accountability, the difference between the earlier regime and the present one is that the present government is being helped by some dodgy members of the civil society in the South. Do these people understand the sufferings of the victims or are they doing everything for their own glorification? We have our reservations on some civil society members in the South.

Chandrika’s commitment

With the present government, there are some people who appear to be serious about finding a political solution. Will it be a durable one? People like President Chandrika Kumaratunga have their personal reasons. Her seriousness came only after her daughter married a Tamil.

In Sri Lanka, there are only two ruling Sinhala parties – the UNP and the SLFP. Both always say that it is difficult to find a political solution without the help of the other. But since independence, on at least three occasions, both parties had their two-third majority in parliament. The Executive President was also from their party. Did they make use of these opportunities to settle the ethnic issue? No

So now, both together will end up in a worse scenario. Take the current President and some Ministers from the SLFP. These people were with the last regime which had its two-third majority in parliament and a powerful executive president. With all these, did they make any attempt to solve the ethnic issue? No.

Who is fooling whom, then? Only those who do not know the attitude and approach of the Sri Lankan rulers can believe all these hypocrisies.

Take a note of what is being said by the President and the Cabinet spokesperson regarding the last UN HRC resolution. With their shameless ‘U turn’ regarding the resolution, they are courageously getting ready in another few days to face the 47 members in the UN HRC.

It did not surprise us when the President openly rejected the resolution and the Cabinet spokesperson took a negative approach to it. But the smart Prime Minister and the Foreign Minister are in the soup. The Prime Minister is telling an utter lie when he says that the President has not ruled out foreign Judges and lawyers being involved in the process. The Foreign Minister is playing hide and seek with the media. He is scared of saying anything about the resolution.

Sri Lanka co-sponsored rejected resolution

Last September, when the first draft of the resolution came up for discussion in Geneva, the Sri Lankan representative and his aides rejected the resolution totally, wanting a new draft. This was witnessed by diplomats, UN Staff and Human rights activists.

But only two days later, they agreed to the same text rejected initially and Sri Lanka became one of the co-sponsors of the resolution. This alarmed us. We understood that some dodgy game was going on. Now one by one, everything is coming out.

Successive Sri Lanka governments have ample experience in fooling and taking Tamils for a ride. Now they have developed new strategies attempting to fool the international community. We wish them good luck.

For the victims in Sri Lanka, it is now the international community which is answerable – neither the Sri Lankan government nor the dodgy members of civil society in the South.

Below I would like to quote from an article by Dayan Jayatileka, one time Sri Lankan UN Geneva representative regarding consequences of implementation of the last resolution in Sri Lanka:

“As Iran proved in 1979, Emergency rule, aircraft carriers, Police and the paramilitary STF cannot hold the line on the ground, up close and personal, against monks, a majoritarian mass movement and a resentful military. Implementing Geneva will shrink the middle-ground, generate polarization, social rancor and radicalization, trigger civic conflict and a Hartal ’53-type uprising and culminate in a bloodbath.” (Thank you, excerpt)

Hope the international community will make a note of this.

What would be said in the UN HRC

In the forthcoming 31st session of the UN HRC, there is no special agenda on Sri Lanka, but of course there will be many statements concerning Sri Lanka.

As usual either the Sri Lankan Foreign Minister or his mouth-piece or even Sarath Fonseka, ex-Commander of Sri Lankan army may attend the session, to tell their stories.

Certainly they will talk about a number of visits by dignitaries including the UN High Commissioner for Human Rights, Zeid Ra’ad Al Hussein and the UN Working Group on Enforced Disappearances or Involuntary Disappearances – UN WGEID.

Now-a-days, Sri Lankan is using children to welcome the dignitaries with bouquets of flowers and then they take them in a procession with Kandyan dancers. We hope the dignitaries will not be taken in by all this hypocritical welcome.

Even though the visiting UN High Commissioner for Human Rights Zeid Ra’ad Al Hussein has adeptly covered most of the subjects that the Sri Lanka delegation would be waiting to inform the UN HRC, they will still repeat these. They will say that the President has pardoned the person who tried to assassinate him; on Independence Day the national anthem was sung in Tamil; there is some progress in the investigation of disappeared Journalist Prageeth Eknaligoda, assassination of Parliamentarians Joseph Pararajasingham, Ravi Raj and a few others. Also they will say that many Tamil detainees were released and some civilian lands have been handed back to the public.

What would not be said in the UN HRC

But what they will not say is precisely when the person who was accused of attempting to assassinate the President was arrested, when the case was filed, when he was sentenced, etc. In fact, he was arrested in 2006 and his case was concluded in July last year, sentencing him to ten years in prison, now completed. In such a situation, is the Presidential pardon necessary for this prisoner? Yes, of course. Otherwise various other bogus charges could be made against him. The assassination attempt on the President is another story…..

Will the Sri Lanka delegation inform the UN HRC that the Prime Minister Ranil Wickremesinghe has already declared that the people who ‘disappeared’ are dead. I wonder why the Prime Minister did not tell this to the UN WGEID, when they visited in November last year.

They will not inform the UN HRC that during the time when the UN WGEID was in the island, they visited the Navy Base in Trincomalee and the underground cells used in the past to secretly detain and torture people.

They will not disclose the history of the Tamil national anthem in Sri Lanka. Many decades ago, singing the national anthem in Tamil was arbitrarily stopped (see annexe) without any gazette notification. One of the reasons was that Chandrika Kumaratunga’s Father, Prime Minister SWRD Bandaranayake proclaimed the “Sinhala Only Act” on 14 June 1956, making the Sinhala language the only official language of country. This was also the cause of stopping the national anthem being sung in Tamil. Now, all those Sri Lanka’s finest thinkers and analysts are fooling the international community.

This is to say that singing the national anthem in Tamil is rectification for what was arbitrarily prevented in the past.

Also they will not inform the Council that from the President to Ministers, all are against the resolution unanimously passed in the 30th session.

The pathetic path of accountability in Sri Lanka is not understood by the international community.

During the war, Sinhala soldiers killed, raped, tortured and ‘disappeared’ Tamils. The general attitude over a very long period is that there is no need for investigations or inquiries because the victims were Tamils. Sixty-six years of Sri Lanka’s history and the message of the Sinhala dominated governments, have not been properly understood by the international community.

One of the reasons is that any diplomat or government of a democratic country never lasts for more than five years. Then the new administrators and diplomats come into action and once again start from scratch. During that period, Sri Lanka has also another new set of government representatives, MPs, administrators and diplomats. It is true that they have their civil servants, who understand the situation, but they are powerless. This is how the situation goes on for many decades without anything being achieved fruitfully by the international community.

‘Clutches’ of the LTTE & Gotabaya

On the other hand, a ‘mushroom’ group of Tamil diaspora is playing a double game on reconciliation and accountability. Some of them were wined and dined by the President and some Ministers. Therefore, now they are reluctant to tell the truth and convey the realities in Sri Lanka. In Tamil there is a Tamil proverb: “Nakkundar navellanthar” (Those who are wined and dined lose their tongue and policy). No wonder they were passers-by in the Tamil political struggle.

During the war and as soon as the war ended in May 2009, then Defence Secretary Gotabaya Rajapaksa, and the government of Sri Lanka claimed that they rescued the people from the clutches of the LTTE.

After nearly six years, former Defence Secretary ‘lets the cat out of the bag’.

Gotabhaya Rajapaksa said the following in an interview on 7 February 2016 :

Q. Don’t you think that the people denounce the Rajapaksa rule and defeated you?

A: What matters is that how they changed the thinking of the people. Analyze the Northern Province which voted against Rajapaksa. It was not surprising that the defeat of Tamil Tigers strongly impacted the people who were brainwashed by Prabhakaran. This is because he was their hero.

Q.Then why are the Tamils angry with the Rajapaksa Government?

A: Because we wiped out the LTTE and Prabhakran is no more.

This is a typical example to show how he or the current government in Sri Lanka will continue to fool the international community.

Many in the South voted for Rajapaksa. The International community has to consider that the regime change happened only due to Tamil votes including Muslims in the North and East and up-country Tamils. Therefore the International Community is obliged to look into their grievances.

Wake up International Community, act now!

    You underestimate Chandrika Kumaratunga’s concern to find a solution to the national problem. It has nothing to do with her daughter’s marriage. Her daughter is not married to a Tamil but to an Englishman.

      Yes, Sri Lanka will cheat, but the degree of cheating is minor compared to the other big cheaters, including India in Kashmir.

      Kashmir India?

      Why not start a List of Cheaters in the international Community, and rank them based on Damage.

          During my recent visit to the Northern Province I witnessed that Army camps are still existing in Govt. schools and Religious worship places. I saw Army personnel’s carrying automatic rifles in the village areas and in patrol duties. Accordingly Northern Province is an occupied area under Military rule and the recently appointed Sinhalese speaking Governor will be in charge of this Military Junta of the Sinhalese Army.
          De-Militarisation of the North & East will be a dream for the Tamils.

      These Kiruba, BTF, TNG, GTF, TYO etc., etc., wanted Mahinda back in the Presidential elections. They campaigned for his victory to extend their own agenda further with his reelection.

      Tamil people back home said no. It is not only defeat for these trouble making rascals but also for their patron saint Mahinda Rajapakse.

      These buggers are duplicitous, thus trying to cheat the whole world. They are equivalent to the cheap BBS.

      What Rajapakse regime committed is unacceptable under international law, as it was war crimes, denial of human rights and other democratic values. MR regime put Sarath Fonseka too behind bars and responsible for several disappearances of Sinhalese, Tamils and Muslims as well.
      Now its pay back time that is approaching..!

    The citizenship status of tamils as ‘second class’ exists even now, exemplified by the recent assault of tamil fishermen without any provocation, by the navy.

    The government does not want international judges to probe the behaviour of the armed forces for fear of excesses by them being exposed – this is the only reason why the government has second thoughts about a ‘hybrid court’ which the government itself proposed as part of the resolution passed by the UNHRC.

    The International community is not going to do anything but they are interested in something else, the Tamil leaders cannot do and do not want to do anything. At present there is no vibrant and honest Tamil leader to take the Tamil people forward. The present criteria is the Tamil people facing at the moment is the land, the youths in prison and the answer for those who surrendered to the army. The land is very important because the extent of land held by the military in Vali North and other places are very vast areas where one day the government is going to colonise with Sinhalese people ultimately the Tamils in the north will not be in the majority. The colonised areas will be renamed in Sinhalese.
    Mr.Sambantan Trio are now working with the government and they are not interested in the people. The Sinhala leaders have a hidden agenda. The Tamils are facing a similar situation since the British left.
    It is planned to connect Colombo and the North by a Highway from Dambulla through Pollanaruwa, Kanathalai, Trincomalee, Mullaitvu and twowards North. It is also planned through the extension of the Highway through Pollanaruwa and Trincomalee, about 10 million Sinhalese are expected to be colonised in Trincomalee and surrounding areas.
    Since 1983 Sinhalese colonisation was introduced at the areas connected between Trincomalee and Mullaitvu. The District of “Manalaru” consisiting of 42 villages were colonised and renamed as “Velioya”. 13,288 Tamils were displaced from this region. The village “Parvathi” was renamed as “Pathaviya”; “Pattipalai” river was changed into “Galoya”;”Muthalikulam” changed into “moraveva”.The District of Manalaru, Thennamaravadi are now administered under Anuradhapura District.
    Vali North consisting 10 villages along the northern coast and interior will be colonised by the Sinhalese and renamed into Sinhalese.
    Will our hypocritical Tamil leaders be awaken to see the disaster the Tamils are going to face.

      What is your opinion on this
      “There existed three kingdoms in Sri Lanka prior to the English captured this country. The English left the country after independence, handing over the kingdom of the Tamils also to the Sinhalese. We are asking for a Kingdom that was ours earlier. We wish live in a single country under federal Solution, said Era Sampanthan, TNA leader and the Leader of the Opposition in an interview granted to Sinhala Weekly ” Divayina”.

      This country was isolated from the International Community for the last ten years. Sri Lanka had gained again its prestige under the assurance that a fair investigation will be made on War Crimes and violation of Human Rights. This prestige could be maintained only if fair investigation acceptable to all is being held.

      There is no doubt in that we all are Sri Lankans. But we are unique in a racial sense. That is why we need a Regional Autonomy. There is nothing wrong in granting similar powers to Sinhala Regions. We still want to live with the Sinhala People, he said.”

        I do not have any faith or trust in Sambanthan’s words.” His words are always ambiguous and not true to what he says. “We are asking for the kingdom that was once ours” What a stupid talk is that. Was he asking Eelam and the Sinhalese are going to hand it over to him. The Sinhalese are not going to give even the federal form of power sharing Mr.Chelvanayagam was once asking for. It will be a procrastinating of time and the Tamils are not going to get anything nearer to what they asked for. The Vaddukodai resolution was as a result of the repeated refusal of the Sinhala hardliners refusing to accept the federal form of government. The moderate Sinhalese to stay in power acknowledges the hard-line concept and the Tamils are destined to be subjugated for ever.

        I would also like to add to my comments that the Present government is showing the International community that they are progressing in appeasing the Tamils for reconciliation, In fact the government id doing nothing towards the Tamils. The irony is when Mr.Sambanthan and Sumanthiran is participating with the Government the International community is satisfied that the present government is doing something towards reconciliation. Singing the national anthem in Tamil at the latter stage of the ceremony is step forward, most people think. It has not done anything to alleviate the sufferings of the Tamils. Very recently Mr.Sumathiran commented when asked by the media, that he trusts Foreign Minister Samaraweera. If he fails will Sumanthiran comit suicide.

    Other than Port City Agreement, Lankawe never – ever kept its agreements. The tail wagging did not work with China, because simply the one runs through the Chinese computers are not blood, but electricity. It cannot be transfused unlike it is very successful in doing it to Sutu SinhaLE.

    The white tigers that fight for the justice and humanity are, when they come to Lankawe, always have been transfused with the crook blood SinhaLE. This has been the case from Soulbury. When Ramanathan went to Britain, he was correct for the British Parliament. But when Soulbury visited to Lankawe, Ramanathan, Arunachalam, G.G., SJV… all were wrong. When Sec. Kerry was in America he warned Old King with US troops. But after visiting Lankawe, and had his blood transfused to SinhaLE, he had the war criminals named removed from the OSIL report.

    Last March, we pointed to TNA that their mistake of supporting a war criminal CC has virtually stalled again the IC inquiry. But Sampanthar and Sumanthiran fooled the Tamils saying the inquiry was over only the verdict was waiting to come and it will be released in September. In September, we pointed again, the Wildlife Sactury Lankawe’ SinhaLE and IC Suthu SinhaLE cheating again with the “Foreign Judges and lawyers” word changing dupe. Again Colombo Tamil Sumanthiran said “Foreign” means IC. Now, after had his blood transfused to SinhaLE, UNHRC High Commissioner Prince Zeid has said there is no need to even Foreign Judges and Layers. Amazingly the blood transfused Sutha SinaLEs are outperforming the SinhaLE in swallowing their own words and duping the international Community.

    After visiting of the Middle East Suthu SinhaLE UNHRC High Commissioner, Prince Zeid, the count of the “Pandavas” has been written on piece of paper with a pencil “ONE”. Coming June will be mirroring the June 2009, when Dayan De Silva shined to get a applause to Old King for having wiped out the tigers with Zero casualty. In 2017 UNHRC sitting, Lankawe will be back on its business of SinhaLE. That. The “ONE,” on the paper will be erased and Pandavas will be “ZERO” in count.

    On the matters of Lankawe, FM Krishna, Ambassador Blake, State Secretary Kerry, UNSG Ban-ki-moon and UNHRC High Commissioner has been showing off the transfused SinhaLE blood. After the crook blood transfusion, they shamelessly denied the promises and refuse to keep to it. Ranil Blocked the ICC. He went to New York as an opposition party leader to have the UN report be scrapped off. He was not success in the last one. Ranil is a different man. He did lose 20 elections and at the end fooled the TNA, got the votes and have captured the power. Like that he biting his lips, took the humiliating loss in New York. But he had promised in the election the SinhaLE people he has saved the rapist army two times and he will do it again. He promised in the last election that no leader, no Commander and not any Private Soldiers will be prosecuted. He has kept the promise. There will be no inquiry what so ever by foreign judges and lawyers. This is what the newly SinhaLE blood transfused UNHRC High Commissioner Prince Zeid has said to Tamils. New, within 6 months, second time has claimed he have saved the Old King from UN Electric Chair. It is in fact, nothing but he saved himself from the UN Electric chair.

    Sumanthiran worked hard to defeat the IC inquiry for the government. He argued there is nowhere any accusation of government conducting Genocide war, but only LTTE did ethnic cleansing the Muslims. He argued with Ananthi on the UNHRC floor. He has reaped his reward too. Because before the next election unavoidable there will be two TNAs. He will be leading his sector. Here of the inadvertent looser is America too. Secretary Kerry has cut his Golden goose to take the last egg. Here after Tamils will never believe TNA words and vote for a Ranil controlled candidates.

    But, As we said at the start, the SinhaLE transfusion technique did not work with Port City contract. The lost Sovereignty by that is promise is a kept promise.     An open challenge for S. V. Kirubaharan and the likes:

    Hypothetically, let us say there is an international judicial inquiry and that they will hear all excesses in, say, since Year 2000.

    Do you, or any Tamil / human rights groups for that matter, have convincing proof to demonstrate beyond any reasonable doubt to establish punishable human right violations against Tamils, individually or collectively?

    This is not about circumstantial evidences, but clear documentation that is acceptable for a court of law.

    Everybody is running up and down, pretending that they are the defenders of human rights, but hardly any of those has documented those atrocities to fit the expectations of legal system. This is not about general questions like ‘what happened to the people who were handed over’ or ‘we saw the pictures’. I am aware of some of the ‘western entities’, who spent a lot of quality time towards this.

    I am still in doubt about any systematic documentation by ANY Tamil groups to assist this inquiry in a legally acceptable format.

    If you don’t have trust in Sambanthan and the Sinhalese are not going to accede to federalism what do you suggest to secure the rights of the Thamils? You want them to take up to arms again? If you are a Diaspora Thamil are you prepared go back to Sri Lanka along with your sons and daughters to fight an armed struggle? As I have already said talk is cheap. The ethnic conflict between the Sinhalese and the Thamils has been internationalised thanks to Sampanthan. The onus to implement UNHRC Resolution passed on October 01, 2015 is with the Sri Lankan government and the 47 countries which voted for the resolution. Sri Lankan government cannot simply wriggle out of the situation. If it does there are consequences.
