Police Killings Continues: 17 Year Old Boy Died In His Brother’s Arms

A 17-year-old boy died at the remand prison due to severe injuries he suffered by the police assault, the Asian Human Rights Commission reports.

P.H. Sadun Malinga, from Atturukudua, Megahakiula, was arrested with his brother and brutally assaulted by a group of policemen from the Kandaketiya police without any reason. He died at the remand prison due to the severe injuries he suffered by the assault. He died in his brother’s arms. Now the brother who is still in remand prison is suffering from mental stress and is in need of immediate treatment. However, he is unable to get such treatment as the police, after severely beating them, made false allegations and filed a case before the Magistrate’s Court of Badulla where they were remanded.

The Asian Human Rights Commission (AHRC) is urging civil society organisations and individuals to intervene urgently to stop this travesty of justice. The police who have committed a murder are enjoying their freedom while the brother of the victim is being held in prison on false charges made by the murderers.

A short summary of the case is as follows:

On May 7, 2014, Sadun Mallinga with his brother, P.H. Kashun Nirage Maduwa and a cousin went to see a three-wheeler which was to be sold. On the way they were caught by a group of ten policemen which included Sub Inspector (SI) R.M.P. Somaratne. They were assaulted upon arrest and thereafter taken to the police station where the assault continued. While Sadun Mallinga was complaining about the severe pain he was suffering and requesting medical treatment the police kept them in a cell. The next day at around 2:30 pm when the parents arrived at the police station they found Sadun Mallinga crying out loudly in pain. The boy told the parents that SI Somaratne and several other officers had assaulted him and that he had severe chest pains. His mother immediately made a request to the police officers to take her son to a hospital. However, the police officers told her that no senior officer was present at that time and that they should come back the next day.

The parents returned the following day and found their son lying on the floor and complaining about chest pains. The parents again pleaded with the police to send their child to a hospital. However, the police refused using foul language and told the parents that their sons would be produced in the Magistrate’s Court of Badulla. The parents went to the court but the boys were not produced. On telephoning the police station they found that the boys had been taken to the court at Passara.

The parents then went to the Passara Police Station and sought the help of two lawyers and requested them also to inform the court that Sadun Mallinga had been severely assaulted by the police. The boy and the other accused were produced in court only at around 3 pm and as the official work of the court was finished the case was taken up at the Magistrate’s Chambers. The police wanted the Magistrate to remand the accused until May 21. The lawyers who appeared for the suspects informed the Magistrate that Sadun Mallinga had been severely assaulted and needed medical treatment. Besides this, Sadun Mallinga himself told the Magistrate that he had been assaulted by the police. However, the lady magistrate did not make any order regarding medical treatment and ordered the suspects remanded until May 21.

Accordingly the suspects were then taken into remand and the parents informed some of the prison officers that their son had been assaulted and needed medical treatment. However, the prison authorities did not take any steps to refer him even to the prison hospital.

On morning of May 9, Sadun Mallinga died as his brother was holding him in his arms. The following day the boy’s body was subjected to a post mortem where the Judicial Medical Officer concluded that the reason for his death was internal bleeding caused by the assault.

The AHRC draws the attention of the civil society in Sri Lanka that the police officers, the lady magistrate and the prison officers are all responsible for the death of Sadun Mallinga. We wish especially to emphasise the responsibility of the lady magistrate who failed to take action even after lawyers and the suspect himself made requests for medical treatment. She should be held responsible together with the police and the prison officers for his death.

The scandalous situation is that while all these culprits to a murder remain scot free the family of the deceased child is further tormented due to the orders of the Magistrate to keep the other family members in remand. The family is aware that Sadun Mallinga’s brother in whose arms he died is in severe mental distress and the family is afraid that he may suffer a complete breakdown but they are unable to do anything as he is being kept in remand on court orders.

The AHRC wishes to draw the attention of the civil society of Sri Lanka that this is a case that deserves their immediate attention in order to avoid the continuing consequences of a grave travesty of justice.

    My heart cries fir these boys. I went through the similar pain nearly 31years ago. I cant imagine it is still happening in the police custody. When will this country change. If it is a politico the magistrate will send them to National hospital as soon as he is attested. Sometime I wonder is there a God.

          How do we know whether MR regime has made secret amds permitting those police to go for beating ?

          In this island there are lot more things happened today that nobody would have any reason. Only Rajapakse familiy (siblings and offsprings) are well aware of them. From recent examples:

          a) Rathupaswala protesters were gunned down, injuring many, by deploying army force – srilanken consistitution would not stipulate forces to be sent to the protest masses

          b) How come some citizens of the country – just because of them being underground men working for thuggish activities for MR family to be away from being arrested even if they publicly, provably attacked UNP MPs on their fact finding mission paid lately to Hambantota

          c) How come Duminda to be away from the investigations- even if Hirunika and co. provably resounds that three are enough evidence (prima facies level) at hand to convict Duminda as the murderer of Baratha murder

          d) This list can go like this.. please add you guys that respect JUSTICE and DIgnified life

        A young sport teacher, a father of two little kids, found dead in Bambalapitiya yesterday was a mistery according to his own family.

        Where is the minister of justice hidden ?
        May be at least to this day, he should raise the question what he has been able to do within the capacity of minister of justice to this nation. All dept whose authorities should have been under ministry of justice have been aquired by president (using his excutive powers) is said to be the reason Hakeem to stay dead silent even if his own children and family is brutally attacked in today ´s context.

        All in all, people, you guys need to listen to your conscience rather than stay dead anmials at this highly critical juncture of lanken politics should be clear to them. hope the best at least in the days to come.

      This is real Mahinda Chinthanaya… even if the war against LTTErs war over, in no war situation, we only hear about varied kind of killings.

      There should be something very fundemental wrong with the ruling bunch of thieves being unable to protect their own citizentry. Justice and dignified life have been new words to the people.

      I bet that the thugs attacked UNP MP in public eye have not yet been arrested or remanded… but this kind of innocient poor young ones are treated as if they are the all last of the society.

      Why these young chaps to become criminals have lot do with the society in which drug trafficking and all other abuses are being promoted by govt goons. Man in power should finally pay his wholehearted efforts regarding the protection of the human rights of the people. That should come above everything.

    The lady magistrate should be stripped of her position and made to answer charges. This is Kamalesh Sharma’s version of “encouraging” SL to behave. I truly feel sorry for the person who died in such horrible circumstances. If there are allegations against him, the law must take its course. Instead, this too often nonsense continue to happen. How on earth this magistrate sit with any conscience in her chair? Anyway, this is the land of the Rajapakses and anything can happen. After all, a holidaying foreign couple paid a heavy price when her man was brutally murdered and she suffered an agonising gang rape. How of many of the stupid theros condemned that?

    What a terrible tragedy!! I shudder to think about what the parents and the brother are going through right now.
    The cruelty of the police and the magistrate is unbelievable and I’m sure they will show no remorse either.
    It is as if us Sri Lankans have become numb.
    Thousands of innocent people killed in the last phase of war –
    Tamils say over 100,000;
    UN says around 40,000;
    and the GOSL says around 9,000.
    Question is, is it OK to say 9,000 deaths is acceptable?
    Is one death acceptable?
    I really cannot understand this blood thirst in our society.
    Its not the police that’s acting this, its our society that is permitting the police to act like this.

    Collectively the whole judiciary system and Police has only one objective that is to sever the master and his planners. The regime requires the Police force to do their dirty work, in return judiciary has been advised to be lenient on their adventures.

    So many people has been killed extrajudicial by Police not even cases were filed against them. Any one laying a hand on police are destined to be killed. There were several murders of suspects arrested for murdering police who were shot dead for various reasons. What we don’t know is whether they are really the culprits or some innocent man paying the price for a personal grudge or being in the wrong place at the wrong time.

    This young boy of 17 years of age, is also a victim of the system which we have created. The police has assumed immense power to do as they please, the judge did not see it fit to send the boy for a medical checkup.
    Wasn’t there a single policemen in the 2 station with some heart ?
    How did they become so cruel ?

    The life of ordinary citizen has no value, no one bothers to stand up for the ordinary man.

    We are all assuming it’s not a problem as long as it’s not me. I don’t think it will remain like that for long. The regime is gearing up for battle with masses, there is no way they can stay outside the power. Their survival is linked to them hanging on to power by hook or by crook.
    Remember DIG Vass G. guy is in a private hospital now, before long he will be out. What happen to the biggest heroin bust ? This regime only needs crooks,cronies and thugs.

    It does not give two hoots about citizens.

    This has become a brutal police state. What a sad story. These poor parents have to suffer the consequences of police brutality, and a government that does not care for justice. There is no need for Sri Lankans to wonder why human rights groups are demanding answers to the absues going on in our country.
    No one is speaking for us, the people. The criminals who call themselves police officers should be interdicted, and severely punished for behaving like thugs themselves.

    Even in Wahhabi judgement, before throwing stones to death, there will a inquiry. How come that monster walking in the shape of a woman refused it to this child? I do not have a doubt what the government in place there now. But let me ask a question; this woman did not have that much authority tell the police to refer the child to a doctor when it complained chess pain?

      This is a back licking country. The magistrate lick the police fellows behind while the police lick the magistrates behind. Finally all of them lick Rajapakse’s arse hole. This is the present culture in the south. This issue will now be cleverly stymied and very aggressively removed from activity by the bitch magistrate and police bastards because this boy and family do not have the benevolence of being “Khuram” with “British” support to obtain justice. It will end up like the countless cases like Katunayake, Rathupaswala etc with all culprits and murderers living to continue the same crimes on another day. In one way, we Sinhalese deserve this for being complacent while the Tamils were harassed, maimed and murdered the past 30 years. Our racist tendencies did not allow us standup and decry the injustice happening in front of our very eyes, because “these are para demalu and they deserve it” was our comfortable justification. Even just last week, we saw the government refusing to allow Tamil families in the north to hold remembrance ceremonies for their dead, while we Sinhalese had a hoity toity ceremony and show of arrogance and victory in the south. This behavior is institutionalized. Even if we were to get rid of Rajapakse and all his hench-aiyas (who are the main culprits for this status) yet the inhumanity amongst majority Sinhalese will remain.

    However, I feel very jubilant about these police attacks, killings and all that committed in the masses! In fact I want more of this things to happen. After all who created these creatures? Who gave wholesale votes to uneducated, uncultured bastard Rajapakshas to create a police and a country like this? This country and the terrible things that are happening are the creations of its grass eating dick heads who, election after election, one suffering after another, one deception after another by the Rajapakshas, still gave their vote to them.       This is after the 3RD UN resolution reiterated MR to take every action in the line of improving human rights.

    In sri lanka,impunity reigns,for all actions of flawed law enforcement,and flawed justice enforcement.
    Assaults and extrajudicial killings are now the norm,and the judiciary appear not bothered about enforcing justice.
    In other countries professing democracy,such an assault resulting in death,and the nonchalant attitude of the magistrate would have resulted in immediate interdiction of policemen concerned,and the magistrate.
    The minister concerned would have been forced to resign his portfolio.

    Successive lankan regimes have made use of police during political rallies,elections,civil disturbances and even protests by unarmed citizens,to buutally suppress citizens.

    Now the government is unable to discipline the same police it has used against citizens, for political survival.
    Deaths of citizens in custody of police and prisons have become common.
    The minor judiciary appear fearful of refusing demands of such police to hold apparently innocent citizens in custody – all the while conscious of the human rights violations by them, which are common.

    The ‘police cum military state’ has been entrenched,and thrives,courtesy of the state.

    It is very likely that this very family voted for the MR govt. like the Rathupaswela dead. What a way of repaying the poor, who voted this Corrupt Murderous MR govt. The poor masses have no escape from the ruthless Police and the equally ruthless Armed forces. The whole country witnessed how the University students were mercilessly assaulted for peacefully demonstrating the other day. Who are these students? Are they the offspring of the Politicians or that of the society, that includes the Police and the Forces? Are these Buggers in uniform so naive to kill their own in order to protect the Politicians and their families? The sooner they wake up the better before they become the target.

    This is standard procedure for the Police, who are in a class of their own when it comes to torture. I can remember female JVP suspects in 1971 pleading to be handed over to the army rather than the police. A bullet through the head was better than torture.

    This is what happened to a Sinhala boy. Suppose he was a Tamil. Not even AHRC would be aware.

    I received an email from a pal in Sri lanka ,according to her ,the BBS monk has said in a private meeting among his devotees ,that they must understand the essence of thakedivada the new form of progressive Sinhala only Theravada practiced only in Sri Lanka and Burma , and that is all this is karma and actually both the Police and the boy who suffered and died are both special people , as for the boy in his previous life he had done the same thing to the police as the police who were involved in beating him up were poor farmers and the boy was a king he had ordered his soldiers to beat the policemen up and kill them , so it is karma ,and now the Boy will reach nirvana or he would have been born as a cattle to be slaughtered (OMG) ,and next life because of this noble act of the policeman they will be born again as human to become monks and lead the people to protect their cult by inciting violence against other faiths which is a must in their new progressive Theravada (thakadivada singala,burma) infact this was encouraged and directed by BBS, like what they did at rathupas

    Well people you may not understand the depth of this all ,what matters to us is what we believe ,according to us everything is karma and no one is guilty ,it is karma taking its course ,the boy was destined to die this way and the police was destined to act this way , and besides the boy who died was a Sinhalese Buddhist and he had sinned and done terrible things in his previous life, so he deserves what he got and the Poor Police officers should not be held responsible they are innocent ,it is karma that prompted them to behave this way .

    According to news this man is the handy-man of Lanza’a and Basil’s. He might have killed scores of innocent before. It is nothing but retribution. But this is not the way he should have been disposed. It is said if a society cannot protect the worst of it’s criminal, then that society can never protect the best of it’s citizen either. There has to be Law and Order to look after the society and not allow individuals to dispense Justice according to their whims and fancies.

      Why is that entire opposition (not only UNP but JVP and all other parties) stayed silent at the time, INCUMBENT MEGALOMANIACT took over the neethipathi Unit to be funtioned fully under him. It is said this had never been the case for the last 100 years. So permitting this kind of brutal acts to get easily passed by the bugger, why the opposition and lanken justice loving/respecting people allowed it to happen is my question of the day.

      If one would raise the question why minister of justice seems to have no power in current regime is answered with president has taken over his authority not allowing him to function independently…. given that, the greater failure lies there as every one feel it…

    Savages. That’s the only word I can use to describe the SL police force. Terrible brutality is widespread in police stations all over the country and nobody cares. Impunity has led to more and more incidents of this kind.

    A policeman was killed and a high level press coinference was held today but no government official, minister, the IGP or even the the defenders of human rights in Sri lanka have said a word about this brutal assault and murder of a kid by the police.

    The country under the Rajapaksa rule has gone to the dogs. The sooner this demon is disposed of the better for the people.

    In a culture of impunity nurtured and used by the Rajapaksas for their advantage it is pathetic that such killings of innocent youngsters should happen. The question is whether this crime would be investigated and the criminals brought to justice. The answer is NO. However the parents and the near relatives of this youngster can never be compensated.
