Police Vs Lawyer? (Not Lawyers)

Mount Lavinia Courthouse Incident Was Shocking, shocking, shocking. Lawyer Gunaratne Wanninayake got his day when he was able to remand the Police Constable who asked him to move his vehicle that was parked/moved/obstructed, the place where the Prison bus was going to be parked. Semantics do not matter.

Wanninayake disgraced the entire Legal Fraternity. Not a single Lawyer came to the rescue of the hapless Police Constable. Not a single. Lawyers appear for Murderers, Rapists, Drug Lords, Child Molesters, and even worse offenders. Of course, for a hefty fee. There was none for the Police Constable at the Mt Lavinia Magistrates Court. Shame, Shame.

Let us glean over the facts as we know. Let us assume that the Police Constable did throw a punch (we do not know that), but did the lawyer make a complaint to the Police? Did he go to the Hospital and produce a medical report? No! Did the senior Police Officers who came to the scene act in a manner that was expected of them? Did they throw their brother officer under the Bus? For what gain? Small man Vs big wig? Shame, Shame.. This is the state of our Nation.

Let us assume a scenario. God forbid if that happens. Let us assume that some legal officer’s house is vandalised, broken into (it could be a bigger crime), and the Police Juniors refuse to investigate? The matter will not even come to Court. Huh? Let us assume that a legal officer’s neighbour’s house is burgled. The Police Constables visit the scene of the crime and arrest the culprits, and file action? Fiction, as it may seem, let it not escalate into such. Does the Law yet have a big man, small man bent?

The issue was (even if the Constable threw a punch) a simple misdemeanor. To remand a Police officer without an inquiry is to appease the legal fraternity. A serious lapse in judgement, is to say the least.

Let the Lawyer be held liable too for his offending and crass behaviour. Let good sense, nay, the proper application of law prevail. Why not remand the Lawyer too for a couple of days too, to balance the scale.

After Mangala’s controversial 2017 legislation, which resulted in the nation being labeled as a haven for money laundering, the European Union is about to assess the situation further.

    Hope and Choices for the Future

    Despite these challenges, there remains hope for the optimist. If the mountain does not come to Muhammad, then Muhammad can go to the mountain. People can unite under a leader to clean up the cesspool—much like the doves in the Panchatantra story, who worked together for their freedom. Alternatively, they can resign themselves to a lower standard of living, finding comfort in their predicament, as pigs do in a cesspool. Then, hope for Shevanties and the mothers to twinkle on sky occasionally, so pig can feel purpose for their lives amidst adversity.

    On the path of treasure hunting for Shevanties and mothers to facilitate their life, the Gentlemen Procter and Police must engage in tussles within them, time to time. These interactions are not wasteful, but rather serve as essential components of a dynamic system—similar to competition within a market economy. These engagements within these roles are not superfluous; instead, it acts as a parallel pillar that reinforces overall stability. In the Wildlife Society of the Sinhala Intellectuals, it cannot be surprising the selection of which male has to fertilize the females to ensure for the future strong society, by power competition. The administrations sustain these entities to ensure the continued delivery of protection and law enforcement services (police and proctors). Any imbalance in energy between the proctors and police is, naturally, addressed through the dedication and sacrifices made by Shevanties and mothers. (In the Gane Mulla Vasanta’s murder drama, Shevanti is the de facto lawyer like Playboy Minister and the man smuggled her there is police.)

    When the demand for the contributions of Shevanties and mothers (the cows deliver flesh and milk) surpasses the supply from the sources, the cesspool wallowing pigs, it prompts considerations about resource allocation, i.e. questions of the purpose of pigs wallowing anymore in the pool arise. This is a warp for the regular path of Langkang’s political cosmology. The complexities appeared in Protest 2022, may help explain the transition of government from the UNP-SLFP Union to the NPP, as the former required significant sacrifices from Shevanties to maintain services for the pigs. It is so astonishing to listen, in such an uncertain situation, to the speeches of the playboy minister, Evil Emperor, Lemon Puff Weeraya, Valaiththodam…… all are delivering with only one purpose that has-to-have capture power at any cost to the country. The recent World Bank report raises critical questions regarding the feasibility of promises made and the intentions behind NPP’s policies in contemporary Sri Lanka—a matter worth $110 billion. One thing is sure, unless NPP can clean the drug culture, which is apparently has penetrated very high percentage of Ceylon families, regardless of their status in the society, the pure economic development, even, if possible, is not taking the country anywhere.

    Thanks for the explanation, Suranimala. The print and electronic media have been very circumspect about this incident, probably due to fear of lawyers.
    Lawyers think themselves to be above the Law. They and the doctors should be brought down a peg. It is good that the IGP has assigned a state lawyer for the constable.

        And the paramilitaries, illuminators, washing politician, Hallucination diagnosing doctors, the drug lords who Shepherds the Shevanti class citizens, the 4th floor, the neighbor who always live in peace next to rehabilitated LTTE rebels, those whose heads are bold………..

        Isn’t the Tamil saying goes like, “Thadi Eduthan Ellam Thandaharan!”(The one who hold the stick is the one your official tax collectors). Summit, obey and serve!

      OC, be it a lawyer or a police officer, today’s civil society does not deserve entitled behaviour from those who are supposed to protect the law. This stupid lawyer, being a senior fella, must follow the law of the land and that is what the society and the judiciary expects from lawyers. Instead he runs amok like a malu kade mudalali breaking all legal, moral and ethical rules. Actually what did he display? Our stinking political culture of the last few decades! Acquiring powers of VIP people he hob nobs with, and translating that into an authority he does not hold, to harass a low rank duty officer! If this happened in a decent civil society elsewhere, that would be Wanninayaka’s last day as a lawyer!

    This is more than Police vs. Lawyer — it’s a clash between responsibility and reaction.
    A minor parking dispute escalated only because the lawyer refused to act with reason.
    Baseless claims and harsh language don’t solve problems — they create bigger ones.
    Declaring punishment without due process undermines the law itself. HOw he is telling to interdict without proof. in which law book says it
    If there’s influence or intent behind his behavior, it must be thoroughly examined.
    Let’s not be swayed by noise — only facts, not emotion, should guide justice.

    So, if there is no hospital or police report, one could not have been assaulted?
    If a location is marked as reserved for specific vehicles, it is open to use by anyone who has the right to park in the premises.
    But, if it was common practice to park prison vehicles at a given spot, then there is serious error on the part of the lawyer.
    I do not know what the crass behaviour of the lawyer referred to is.

    The problem would not have arose, if a definite slot has been allocated near the Magistrate’s court like the ones allocated for ambulances near the hospital.
