Prosecute Prez & PM Before Minions

The Attorney General (AG) has reportedly instructed the Criminal Investigation Department (CID) to commence a criminal investigation against Hemasiri Fernando, the former Defense Secretary (DefSec) and Pujith Jayasundara, the former Police Chief (IGP). The primary objective is to ascertain reasons for ignoring advance intelligence warnings of the Easter Sunday bombings by ISIS backed Sri Lankan jihadist group National Thowheeth Jama’ath. 

Two interim reports by the three-member committee headed by a sitting Supreme Court judge is believed to contain strong strictures against the two bureaucrats.

The cost in human life resulting from the six suicide bombings and two secondary explosions amounted to over 250 dead and more than 500 injured. The anti-Muslim riots which erupted nearly three weeks later took the life of one innocent Muslim trader. The material cost of the bombings and riots amount to millions of dollars. The impact on the economy of explosions and riots run into billions of dollars.   

There is no argument against investigating the former DefSec and IGP for failing to act on advance intelligence reports and keeping their political masters (if that is true) in the dark.  

But there are more significant issues involved.  

The political and administrative leadership provided by former President Mahinda Rajapaksa and former DefSec Gotabaya Rajapaksa to the armed forces to defeat LTTE terrorism is a given. A significant contributing factor was the appointment of Sarath Fonseka, Wasantha Karannagoda and Roshan Goonatileke as commanders of the Army, Navy and Air Force, officers eminently suited for their roles. 

However, the same cannot be said of many other appointees of the Rajapaksa administration.

Commencing January 9, 2015, the country’s governance underwent a paradigm shift. The nation moved from a stable structure of executive power flowing from the Executive President to a disjointed structure of power sharing between the President and Prime Minister, two individuals as diverse as chalk and cheese in their thinking. 

The position of DefSec, along with Secretaries to the Treasury, Foreign Affairs, the Economy and Foreign Investments are critical in any country. Such posts should be preferably handled by professional careerists (there can be merit-based exceptions) with a proven track record rather than political lackeys. Even in the case of career administrative officers, experience gained as provincial administrators does not necessarily equip them with the knowledge base and expertise required for appointment as Secretaries to Defense, Treasury, Foreign Affairs, etc.            

By no means can the President escape responsibility for his handpicked DefSec. Ministry Secretaries is no doubt the President’s prerogative. That said, that prerogative need be used wisely with the nation’s best interest at heart. 

In the past, officers of the caliber of N Q Dias have held the post of Permanent Secretary for Defense & External Affairs (the combination of Defense and Foreign Affairs). A member of the old Ceylon Civil Service, he in 1963 foresaw Tamil militants taking up arms against the state with Indian assistance. A chain of garrisons in the North was his counter strategy (refer ‘Exorcising the past and holding the vision’ by Neville Jayaweera – page 79). Visionaries of the likes of NQ Dias were giants who walked tall compared to some of the pigmies who have occupied the DefSec position since 1977, some military men included.

In January 2019, the former DefSec, after his appointment claimed he had, at last, got his dream job. During a public gathering, he stated, “Minimaruvo’ (murderers) cannot become ‘Ranaviruvo’ (war heroes).” He continued, “Everyone who joins the Army does not become a war hero. To become a war hero, a soldier has to earn a medal, and their accomplishments should be announced by way of a gazette. As of now, there are only 39,000 war heroes in Sri Lanka.” 

It was an inhuman and insensitive remark unworthy of the administrative head of the armed forces. Seasoned bureaucrats do not speak in that manner. Only political hacks do so. The Head of State would have been placed in an awkward position in case our men in uniform and kith and kin of soldiers who gave life and limb without the benefit of a medal taken exception to this statement. It could also have had unwanted political ramifications.   

The President’s failure to realize his appointee’s unsuitability to the position and dismiss him forthwith amounts to criminal negligence and incompetence. Nature course corrected the President’s shortcoming in April, albeit at a substantial human and material cost.

The Prime Minister cannot escape his share of responsibility on the pretext of not being invited to the National Security Council (NSC) since December 16. In June 2016, he required no invitation before storming into President Sirisena’s office. He demanded the appointment of a new Governor for the Central Bank be left to him as the institution came under his purview.  

For his own devious reasons, the Prime Minister failed to inform the country and parliament of his exclusion from NSC meetings. 

Constitutionally, the Prime Minister is the second most powerful person in the country after the President and should be an integral member of the NSC. However, the problem is when the Prime Minister is Ranil Wickremasinghe. He disqualified himself many years ago. 

The UNP won the December 2001 Parliamentary Election paving the way for Ranil Wickremasinghe to form a new government. On January 2, 2002, an over-enthusiastic Superintendent of Police raided a house in Millennium City in Athurugiriya. Among the five arrested were five soldiers including Captain Shahul Hameed Nilam, Commanding Officer of the Long-Range Reconnaissance Patrol (LRRP). Also taken into custody was a host of military equipment and LTTE uniforms. 

UNP Chairman Charitha Ratwatte (currently Finance Advisor to PM Wickremesinghe) and Deputy Chairman Daya Pelpola (now Ambassador to Italy) announced it was a hideout for assassins planning to assassinate high-level government leaders including Wickremasinghe. It was subsequently proved to be erroneous.  

In reality, it was a secret hideout of the LRRP unit of the Army tasked with the assassination of senior LTTE operatives. Despite a personal assurance from the then Army Commander Lionel Balagalla of the true nature of the LRRP and scope of its duties,  those arrested were kept in custody for days, photographed and fingerprinted. Their identities, along with mission objectives, were leaked and published in the local papers. Tilak Marapana, the Defense Minister at the time and then Interior Minister John Amaratunga did nothing to prevent the debacle.  As a result, 24 intelligence operatives and civilian informants were either assassinated or abducted and killed by LTTE. Captain Nilam was posted to the Sri Lankan embassy in Indonesia after which he and his family disappeared. In 2004, Lieutenant Colonel Tuan Nizam Muthaliff, Captain Nilam’s deputy in 2001 was shot dead in Polhengoda by LTTE operatives while on his way to work. 

LTTE Supremo Prabhakaran undertook a coordinated campaign to eliminate members of LRRP and informants. 

Ranil Wickremasinghe and his government did nothing on the basis it would jeopardize the ceasefire.  

Some reports termed the government’s inaction a ‘total betrayal and absolute treachery to the nation.’

Can a person responsible for such a betrayal and treachery be permitted to sit in the NSC ever again?

Field Marshal Sarath Fonseka, in the aftermath of the Easter Sunday carnage, stated he did not become a Field Marshal selling gram in the Gall Face. 

Similarly, Sri Lankan born Dr. Rohan Gunaratna (RG), eminent expert on terrorism and Professor of Security Studies at the S.Rajaratnam Center for International Studies in Singapore did not attain his reputation selling noodle soup in Singaporean food courts.

Addressing a mixed gathering of educators and religious personalities at ‘Sri Lanka at Crossroads’ program sponsored by Gateway College, RG did not mince his words.  He stated, the present leadership, once in power, sent the military back to barracks resulting in the loss of the interaction between the military and ordinary people of the nation. Calling it a “fatal mistake,” he attributed it to the leadership’s desire to please the international community and minority political parties such as TNA.  He also referred to the transfer overseas of a very senior Muslim military officer with the “deepest expertise” of chief Easter Sunday bomber Zaharan’s group besides the arrest or fingerprinting and photographing of 500 military intelligence officers. RG further claimed, the 5,000 strong military intelligence corps was rendered impotent and demobilized.  He opined, “It is a crime to have intelligence and not act on it. Easter Sunday attacks were not a failure of intelligence, it’s an operation failure. A failure to act because politicians played with national security and the security was compromised.”  

RG’s verdict is the most damning yet on the traitorous conduct, criminal negligence and sheer incompetence of the Sirisena, Wickremasinghe, and Samaraweera triumvirate.

In such a backdrop, the prosecution of former SecDef and IGP is a secondary priority. 

The greater need is to hold the trio of politicians accountable and prosecute them using the full force of the law.

Capital punishment would be too lenient a sentence.

    The title of the article should be “Prosecute President, PM and the Opposition leader”. They are not fit if the country to become not only safe and secure but also peaceful, unity and prosperous. Author highlighted the cost of the bombing blast but he failed to point out the cost of the political coup to the country. The cost of the 1958 riots, followed by the 1977, 1983 riots unamaiginable and each and every citizen still have to pay the price of the brutal Sinhala Fundamentalist Policy. So far there is no change in the above policy. As long as no change in the policy the country and people have to suffer forever.

    I suggest after reading Mr Jayaweera’s citing “terrorism expert” Rohan Gunaratna in support of claims about the harrassment, arrests, finger-printing, etc., of military intelligence, that readers look at “Rohan Gunaratna Debunked? in today’s Sunday Observer.

    This is by no means to say I am not appalled by the behaviour of those with power and responsibility which has culminated in a truly horrendous situation.

      Rohan Gunaratne is nothing but a charlatan who is claiming to be an expert. Even a Chinese selling noodle soup in Singapore food court is more knowledgeable about terrorism than this pretender. Mahinda and Gotabhaya want to come to power by hook or by crook and are behind this killings of innocent Christians and foreigners. They have contacts with Muslim terrorists as well as politicians, and had actively promoted them to commit atrocities on Tamils. Even the present government turned a blind eye to these as long as they were confined in harassing Tamils. Since these terror groups were active in east, they believed that bombings will be in churches and tourist resorts in eastern province, but terrorists had different ideas and bombed Colombo resulting in deaths of Sinhala Christians and blow to the economy. Even now they have not said anything to condemn these acts. Sirisena also knew about it as he wanted to use it to extend his tenure illegally citing security reasons. The claim by Ranil that he was not informed about it, casts some doubt as he too wanted it to defuse the pressure on the government from UNHCR on accountability and rights issues of Tamils. If he dodges these in the future, then it is clear that he is also a part of the game.

    Rajeewa why have you left out Mahinda and Gotabhaya in the list of persons to be prosecuted. It is now known that during Mahinda’s regime funds from defense ministry was paid out to Muslim groups like NTJ to harass Tamils in eastern province. They also nurtured politicians like Hisbullah and Badurdeen to commit atrocities on Tamils. This government turned a blind eye to all activities of these terror groups as long as they are confined to Tamil areas. Top Sinhala politicians both in government and opposition knew about these bombing, but wanted it to happen so long as those who dies were Tamils and Sinhala Christians. They all had their own agenda to utilize this tragedy for their own benefit.So no point in pointing fingers at those whom you don not like and covering up those whom you are going behind.

    I think people are getting organized to bypass the Parliament and help the country. I think that is the way if NGOs, International community…….. are kept away. Cardinal Was very conciliatory, but Vatican tried to fish in troubled waters. One Messenger came and talked to Ranil. That is typical Jesuits. that is one hurdle Buddhists face. I hope you understand that. They have that behaviour all over the world and Christians do that to Catholics. We observe it.

    I do not wish to deal with the past, and especially after the the 2015 January 8th. We observed and SAW what happened and how the politics of the country were been “Twisted” and “Warped” to suit and accommodate depending on the “DEALS” that were entered into among those who took over power and who were deposed of the power. Even with the “SACRIFICE” of 250 innocent lives, including those of Foreign Lives and hundreds of others who are still receiving medical attention, the “Politicians” and most importantly the PEOPLE have not being able to make a “SOUND JUDGEMENT” as to on whom the “RESPONSIBILITY” and the “ACCOUNTABILITY” must be laid. The role of “CLOWN” played by PHU Leader Gammanpila and another “COURT JESTER” role played by Weerawanse have taken upon themselves to represent “JO” and presented a “NCM” against one Cabinet Minister, viz Rishard Baduideen , misleading the whole country and the people by placing the entire calamity of April 21st on him. As the writer very correctly points out, it is the Government and State headed by both the President and the PM are the main parties to be “ACCUSED” other than those who actually committed the massacre. Of course, there is the “PROPER” “NCM” presented by the JVP; but I doubt what “WEIGHT” and “IMPORTANCE” it would receive in the presence of the NCM of the JO. If at all that Minister Rishard Baduideen must be made an “Accused” of an “Associate” among already many who have been investigated and taken into custody. CID has already summoned him to record an statement and that is the correct way to deal with him. Now in the presence of a “FIRST” NCM (which I believe to be a another “DEAL) the PEOPLE must VOICE to take up the “SECOND” NCM presented by the JVP in Parliament , debate and vote on it. Will it happen?

    The author is absolutely spot on. The Buck has to stop with the President and the PM. Leadership is not about delegating and then looking the other side when information is provided to them. According to Field Marshal Fonseka, information had been provided to the Security Council at least 15 times. Nothing was done. How could a country be run by leaders like the President and the PM? They have blood on their hands and they are accountable, and they should not be allowed to strut about as if they bear no responsibility. As to why the people have not gone to the streets is beyond belief. As to why the civil society that helped to oust the previous administration has gone deaf and blind and impotent is also beyond belief. The only conclusion one can draw is that they were paid to do what they did and now no one is paying them, therefore they are silent.

    Specially Sirisena must be Prosecuted for this tragedy.
    Sirisena is a prime suspect and responsible man for this crime.

    He must be brought to justice and in incarcerated for life.
    Sirisena is not a suitable for the presidency.

But so were the words of personalities like Anagarika Dharmapala and Rev. Migettuwatte Gunananda who are considered as heroes by those who love this country.

    Why, Mr Jayaweera, did you include Mangala Samaraweera for something more than capital punishment? You havent made a case anywhere in this article for including him in the triumvirate.

    I see the Prez is off on yet another trip this week — to Modi’s swearing-in. Has he got itchy feet or something? The man should see a doctor. Why doesnt he just go on unpaid leave until his term is up? Take the PM with him. The 2 can fight it out where they can bring no more harm to this benighted country.

    I see there’s an ad in the Island (p.7) calling for a people’s movement — a desperate cry from a desperate country — with criteria for a presidential candidate. Only a miracle will turn up someone who fills the bill. Many of us are still reeling from our shattered, foolish hopes of Jan 2015. Will we even vote again?

    It is likely that sirisena got funding from saharan via hisbula for his 2015 election. That’s why this pakaya put the CID chief behind bar by a false allegation about assassination plot which stands disproved now this pakaya needs to be convicted. The evidence of false accusations and preventing the arrest of saharan are very clear

    I appreciate all who commented on this article agreeing that the President and PM representing the Government and the State must be “Prosecuted” for the “Massacre” of 21st April. But “WHERE” and “HOW” the public opinion is “DIVERTED” by the print media and the “Journalists” is clearly shown today by the “Sunday Island”. It published an article written by Mr. C.A.Premachandra under the title “Yahapalanaya Govt. Divided by JO , United by JVP”. In summery, it presents the opinion that the NCM against the Minister Rishard Baduideen by JO would have “Down” the Govt, as against the NCM by JVP would “UNITE” the Government. This writer enumerates 10 allegations contained in the NCM by JO; all of which, in my opinion are very much and MUST be placed before the CID for a complete investigation that would very clearly lead to the “ARREST” of the individual Minister. Why that course of action was not taken by JO is very RELEVANT and QUESTIONABLE. In contrast to that NCM, the JVP’s NCM makes a very DIRECT ACCUSATION on the Government and it’s Law Enforcement Machinery for utter Negligence, Failures, Disregard and the Willful Avoidance to act in a timely manner, “SINCE 2014”, to AVOID the Disaster. Shouldn’t this be the very RELEVANT PUBLIC OPINION that must be mustered to punish their (Peoples’) own Government that “AVOIDED” and “SHIRKED” the RESPONSIBILITY cast on it? Where this “Print Media” (in this case the Island) and its’ writer Chandraprema are trying to DIRECT the attention ( On an individual or entire Government). It is time for the PEOPLE to make a NOTE on these DUBIOUS attempts and study facts in detail and make INDEPENDENT and FREE choices. This writer (Mr. Chandraprema) must also be reminded of the growing PUBLIC OPINION against all the 225 “Comfortably” accommodated in that “Safe House” located at Diyawnnawa. That has not so far excluded JVP ; but that NCM of JVP is the RELEVANT SUBJECT MATTER for the People and not the JVP. The readers of this forum are requested to read that article by C.A.Chandraprema published on Sunday “Island” paper.

    Today the Police reported that they received two complaints against the Minister Rishard Baduideen and the Governor Hisbulla. This is what was waiting for and must have been done by JO. Now JO must place all the 10 allegations contained in their NCM with the CID who are to investigate the two complaints. I hope Gammanpila & Weerawanse will direct their attention in the the PROPER Manner to get these two culprits rounded up and put behind bars, without allowing them to ESCAPE through a “NCM”. For the attention of Mr. C.A.Chandraprema of “Island” news paper.

On May 6th I asked him a simple question which he has not answered yet.Is he a Rajapaksas PROXY ?????. without answering he countered by accusing me of hatred to Rajapaksas .(a familiar move by all proxies in Lanka) I clarified that I do not have any hatred to anyone except for HYPOCRITES. Until and unless he clears this with a simple answer, (yes or no)there is no credibility in what this hypocrite writes.Also I will again like to remind readers of CT, this guy is the only one after post Easter , within a week came with an article title blaming the whole Muslim community ( along with state)for the carnage. Following communal riots, after achieving the results he wanted, now he decided to drop the community and continue to blaming the state. Rajeewa the commission reports found not just Hemasiri and Pujitha but intelligence director and all heads of police and security accountable,(unless you are privy of infor which none of us ) get your facts right before write.

    After MS next should be Rajapaksas who are accountable. They knew few of the perpetrators well, who were on Gothabayas pay list, Rajapaksas created a fertile land for ISIS by targeting Muslims after war. Rajapaksas created BBS and Ganasara with this in mind. Rajapaksas past history is peppered with engineering such hatred and violence between communities for political gains. Rajapaksas personally are charged with political killings, murdering and disappearing of journalist who dissent, GR personally threatening journalist over the phone and ordered releasing an abducted journalist, There are on going civil and criminal cases against GR who just officially announced his presidential candidacy, the list goes on and on. How come Rajeewa just ignored even mentioning these facts, in his fake reach for justice. Blaming RW for not disclosing is like , a couple who recently got married where one partner is a rogue with intentions of cheating is intentionally not providing anything(including physical relationship), where author demanding victim to go in public and disclose all her/his grievances.       Mr. Dharmakeerthi, something I noticed about our Prof Gunaratne, is that in all his presentations, he picks information provided in the daily press in SL.The Daily press reports what had been given to them by the Govt .However many of the claims by the govt adducing mischief to parties antaghoniztic to it does not stand the test of scrutiny.

      I will not consider statements by Gunaratne as being serious.

We only know one , commission nominated by MS, which is not yet fully disclosed to public. Please give at least the name of the reports to support your writing. Hope it not your own or RG reports.
