Reconciliation Requires Consultation

Since the war ended bloodily on the military battlefield in 2009, Sri Lanka has been subjected to repeated and increasingly intrusive scrutiny by the international community that has rankled successive governments and induced them to react defensively. This year’s UN Human Rights Council session is no different, with fresh emphasis on accountability and reconciliation. Foreign Minister Vijitha Herath will be representing Sri Lanka at the UNHRC’s 60th session that commenced this week. The government will be calling on the international community to give it the space to continue with its programme to advance the rights and wellbeing of all Sri Lankans.

The government takes its mandate for “system change” seriously. This may be why it is so reluctant to consult other stakeholders, whom they probably see as either failures or tainted by the past, and seem to be making their decisions after internal consultations only. This has given the impression of a unilateral and top-down decision-making style. The government’s ideological position is that all citizens are equal and will be treated equally by the state. Resolving the ethnic conflict is among its top three priorities, together with reviving the economy and improving people’s living standards, and putting an end to impunity, corruption and mismanagement of resources.

In the run up to the UNHRC session, President Anura Kumara Dissanayake spent two days in the northern capital of Jaffna. The media showed images of warm interactions he had with the people of the north, including students and families, and he announced several development initiatives. These included new investments in fisheries, infrastructure and higher education. Such projects have the potential to improve livelihoods in a region that has lagged behind for decades. In general, any form of developmental initiative that creates employment and wealth would be welcomed by the people of the north, as it would by people anywhere in the country. Yet, development alone has never been enough to address the core grievances of the Tamil people. Unless development is accompanied by political inclusion and justice, it risks being dismissed as tokenism or worse, as imposition.

Alienated North

The neglect of the north and east in terms of development has long figured in the sense of alienation of the Tamil people from the Sri Lankan state. However, the choice of Mandativu island for the proposed international cricket stadium and of Kachchativu island for tourist development has proved problematic. There may be more suitable sites for a stadium in Jaffna that is nearer to the main highway that connects Jaffna to the rest of the country and with better supporting facilities than Mandativu, which is an island with mangroves and shallow seas with seaweeds that are considered to be ecologically valuable. Kachchativu, being a place of religious worship and very small in size, may not be suitable for tourism promotion. The Catholic Bishop of Jaffna has pointed this out saying that Kachchativu “should remain a place of pilgrimage and prayer, not of commercial tourism.”

The controversy over these projects shows why consultation is critical. For local communities who have endured decades of displacement, militarisation and poverty, the right to decide on the future of their lands and livelihoods is dearly sought. By bypassing consultation, the government appears to be repeating the centralising tendencies of past governments that left Tamils and Muslims feeling excluded from national decision making. This is also the reason why the devolution of power is important, as is the appointment of Tamil and Muslim government officers to high administrative posts in the north and east. It enables people of the area to be their own decision makers rather than those far away and from different backgrounds. The government needs to consult with other stakeholders, and not just its members, before making decisions. This is especially true when decisions made concern the ethnic and religious minorities.

Another important issue that the president’s goodwill mission to Jaffna did not touch in a positive way was the issue of mass graves. There are reports of more and more mass graves being unearthed in the north and east. The evidence that is emerging is that the people who are buried in them died horrific deaths, at least many of them. There is a need for revulsion to be displayed when adults and children are discovered huddled together in death or a person buried in a sitting position. Justice Minister Harshana Nanayakkara visited one of the newly discovered mass graves in the east. However, President Dissanayake appears to have decided against doing the same in the north. The symbolism matters. A visit by the president would have been seen as a gesture of empathy, even if investigations are slow and contested.

Consultations needed

The issue of war crimes in the north is controversial in the south among the Sinhalese majority who tend to see war victory as one of the best things that happened in the country despite its cost. They also tend to see the soldiers who won the war in a positive light with the description of “war heroes,” which makes it challenging for any government, democratically dependent on Sinhalese votes, to address the issue of war crimes. The government’s approach to the issue of mass graves is to provide the necessary financial and human resources to enable the relevant authorities to act independently and continue with the excavations, while ensuring that the evidence that is gathered is not tampered with.

Successive Sri Lankan governments have long argued that an international inquiry would violate sovereignty. Sri Lanka’s response to the UN High Commissioner’s report that called for international action states, “External initiatives will only serve as a hindrance to the ongoing national efforts and serve to polarise the population.”  However, due to their past experience of commissions of inquiry being appointed one after the other, but nothing happening as a result, the Tamil people have little or no faith in domestic mechanisms where it concerns the government dealing with the war-winning military and war crimes. Their ideal is an international inquiry. In the past a hybrid mechanism, the International Independent Group of Eminent Persons (IIGEP), a group of individuals nominated by the international community and the government of Sri Lanka in 2006, also failed in their mission because there was no real desire to involve them in the truth seeking process.

The gap between the two positions remains wide. Unless this gap is bridged, the people of Sri Lanka will remain polarised regardless of what the government says and does. There are also a lot of vested interests in the form of political parties and politicians concerned about their personal futures working as spoilers. The government needs to consult the Tamil people both through their elected representatives and directly. It needs to explain its position to the rest of the people too. Top-down decision making will not be successful in winning sustainable reconciliation. A process of dialogue that is transparent and inclusive can build confidence not only among Tamils and Muslims but also among the rest of the population to overcome the polarization that the government seeks to prevent.

            If God knew man would fail, why did he wait 2000 or more years to redeem himself? Remember his 2nd failure (1st Failure Eve and the apple) was the Genocide of all Humans except Noah and his Family. His 3rd Failure was the destruction of Sodom and Gomorrah after the Flood.
            Does he never learn from his mistakes. So much for the 3 Omnis – Omnipotence, meaning all-powerful; Omniscience, meaning all-knowing; and Omnipresence, meaning present everywhere at once. I think he has failed to demonstrate any of them.

He told them that on the day that they ate of the Tree of Knowledge that they would surely die (a lie). They didn’t die. He cast them out of Paradise (Eden).
        Being all 3 Omnis he must have known this would happen. “Oh, what a tangled web we weave, when first we practice to deceive” Walter Scott”.
        God lied and then punished all Humans until 2000 or so years ago when he became human, crucified himself and then re-assembled as the Trinity.

            Light travels at 299 792 458 m / s. The James Webb Telescope is receiving light from distant Galaxies around 13.5 Billion light years away. The Earth is around 4.5 Billion years old. So light was in existence around 9 Billion years before the Earth came into existence.
            “Genesis 1:14-19 describes God making the sun, moon, and stars on the fourth day”.
            Obviously you cannot see the contradictions. How did light exist before the Sun or the Stars (distant Stars) existed?

    This is not the system change. This is again a change in government. The system should include all communities, not only Sinhalese. The system change includes the consideration of power sharing, not only a unitary government. This government is another Sinhalese government where most of the powerful ministries are held by Sinhalese as in the past. There is not a single Minister from Muslims and there is no Tamils from the North East. So far there is no war crimes investigation or genocide investigation or judicial actions against the past or present.
    Corruption only did not the economic crisis, it can improve economy to save you for time being but it can’t save the country.

      Ajith, if solutions to ethnic issues generate as if a magician pulls a hare out of a hat, then SL would be a different country altogether. I believe many in our non-Sinhala communities have patience, hopes and don’t expect overnight solutions unlike you – quite fortunately, or else we would have seen more bloodbaths than we did!

          Ajith, you didn’t address what my main point was about. That no government anywhere in this world can give 100% solutions to ethnic issues overnight, so NPP is no exception. They have clearly displayed that they are not racist and have already initiated more development work in the N&E within 11 months than any other government have, since the independence. Despite skeptical Sinhalese opinions, NPP has already opened almost all previously closed roads and highways in N&E for its people to use. They have even started giving back lands to its original owners which were occupied the SL Army, again a very contentious issue with the Sinhalese in the south. Don’t forget the core party in NPP is JVP and historically they were one of the most racist parties that denied any rights for Tamils under its previous leaders. If AKD could completely change that ideology and initiate a genuine concern for minorities, then why do you still keep sticking to century’s old hostile guns? Either you don’t know the truth, or don’t want to know the truth or don’t want to accept the truth! Or don’t want to see solutions provided, so that you can keep complaining eternally!! Please assess the present, compare the history and move forward people – a quarter of this century is already gone!!

            What about the next door India? India devolved power and have number of regional state including Tamil Nadu? There are many other governments devolved power to handle ethnic issues. I don’t know what is the truth you are talking about? I am not complaining about NPP but there is nothing wrong about talking about Tamil peoples expectations. You can talk about NPP’s new investments or opening of some closed roads but you are not talking about Thaiyiddy illegal building of BuddhistTemple in peoples land. If we talk about you say it is complaining about NPP but I have a right to express my opinion as you have your opinion. I welcomed NPP compared to others of past governments.       Ajith, ITAK, the SLMC, BBS etc are by their very nature exclusive and racist parties. The minorities should join the SLFP, NPP, UNP etc and work to change any racism from within. You may think that this has been attempted for seven decades without result, but there is no alternative. Racial and Religious parties only widen the divide and make matters worse. Several far thinking Muslim MPs warned about creating divisiveness when the SLMC was formed.

    The fact is that this argument made Sri Lanka to violate sovereignty. what is sovereignty. It says that Sovereignty is the supreme authority a state has to govern itself and its territory, free from external interference. Today Sri Lanka fully depends on external interference. IMF one side, India one side, China one side, USA one side, Debt one side, corruption one side, Under ground groups drug deals one side? For what? To kill Tamils.
    Even now IF AKD thinks that sovereignty will come with just corruption but not killing Tamils or protecting Buddhist terrorism you are wrong.

      You are right on the mark, Rajash. There was trust between the two communities under DS Senanayake. His small cabinet had minority ministers significantly above their demographic weight. Then came SWRD, Sinhala only and 1956, and SJV Chelva and his Arasu friends, already in 1949 Maradana meeting launched the Vision of a Tamil Kingdom, and Tamil homelands. ITAK was a fringe party in 1949 and even in 1952. But 1956 changed everything. The Banda-Chelva pact was broken up, not only by Sinhala-Buddhist extrimists, but also by SJV’s own. The day the BC pact was announced, the ITAK also launched its intense anti-Sri Tar-brush campaigns, distributed toy pistols, printed stamps, civil disobedience in the North, set up Makkal Padai etc. Instead, they should have stopped hostilities for an year and supported SWRD to bring the BC-Pact to fruit. Shanmugathasan (Chinese wing CP boss) had pointed out all these in his History of Ceylon written from prison. Many (Sinhalese and most Tamil) leaders inflamed everything from then on, triggering riots, polarizing the Ethnic divide, and destroying trust. Even after the end of the war, Wigneswaran’s NPC continued the same trend, casting aside Sampanthan and Sumanthiran more moderate voices. .

    According to Christianity, Jesus “sacrificed himself” on the cross for alleged “sins of man”.
    What sacrifice did Jesus make? After the crucifixion Jesus ascended to heaven and basically went home (i.e., heavenly comfort) to his father – i.e., he gained heaven and sacrificed nothing. Normally, if you take over someone’s punishment on his/her behalf a la Sydney Carton, you go to prison instead of him. Jesus did not go to hell after being crucified. The Jesus story confirms that there was no sacrifice – only a bit of political show. When the Messiah comes again, on judgment day, only the chosen FEW will go to heaven, with God’s grace, weather you are David the Good or Hoole the Honourable, sinner or saint, murderer or rapist, Catholic, Anglican or heathen. Meanwhile, the VAST MAJORITY of us, are to perish in hell for eternity. So, this “sacrifice” of Jesus is no help?? Jesus ascended the cross, spent the night like a Zombie in a tomb, and eh voila , his body was not there~!! So the faithful immediately swore that Jesus in his very body must have gone to heaven. Even hard-headed engineer-Prof. Hoole seems to swollow the narrative, hook, line and sinker. If the narrative is true, Jesus merely went to home comfort through the pearly gates – and Christians call that a sacrifice !!!!!!!!!!!!!

      SebastianSR, Sinless Jesus, born of Virgin was crucified. Why? Sin was laid on him by those who flagged him to death. Buried in tomb which could not hold him, His body came out of the burial garments left behind and took back the keys of hell from satan, gave them back to disciples and he ascended to Paradise with some resurrected saints, whose graves opened, when the temple veil tore, earth quaked and rocks split. Mat.27, 51 The Centurian who watched became a missionary later. Jesus will return for those who believe that He took away their sins and forgave them. Sacrifice no doubt.

      Assuming “Jesus” actually existed, he was far better in character than so-called Prophet Muhammed. The modern world is shaped by the morality of Judeo-Christianity, not shariah. That is why people are desperate to flee to Western Europe & North America, not KSA. Unfortunately the rise of Christianity paralleled the decline of Rome, probably the greatest civilization in all of history. Nevertheless, it is Christianity/Christian civilization that prevented Islam from a total conquest of Europe. Had that conquest happened, the world would very different today.

            Ms Susila Karki, a former CJ, became the Prime Minister of the interim government after Z-Genzies# youth unrest turned violent, similar to the scenes that went viral from Sri Lanka in July 2022. But the journey ahead of her is not as easy as one might think, given that she has no political experience in that country, despite the fact that she is said to have fought tirelessly against rampant corruption there.
            Sri Lanka and Nepal are thought to have a Z-genzie population of 0.5 million each. Since the monarchy was abolished in 2007, 14 governments have been elected, but each lasted only a short time. I believe that settling the dust in that country will be more difficult than in Sri Lanka because democratic governance has not been established.

The point is, Jesus never took a slave or woman, while Muhammed (dial 999 ) had 12 wives, ranging in age from 6-40, and many slaves. For context, Muhammed was born 570–576 years after Jesus.

          The modern world is shaped by Judeo-Christian morality and some variation of Roman Law. Muslims may practice Shariah in their own communities, that does not conform to modern values. Much of Islamic doctrine is regressive , that is the reason for today’s geopolitical conflicts.

          Of course, Judeo-Christian morality may overlap with values found in Confucianism, Hinduism, Buddhism, etc. But in most places in the world, if someone commits a crime, there is a judge and jury, not an Imam and rope. This is a Western, not Eastern concept. For readers who are not aware, headchopping, stoning, hanging, amputation… all of these are justified under Shariah, but have no place in the modern world.

            You forget that Jesus said that all the laws of the Old Testament should be obeyed.

            I am against all Capital Punishment as are most Western Countries. However the USA still practices Capital Punishment which includes some of the more Barbaric Methods.

              Nice try, Scott. Muslims give higher precedence to Shariah Law than Western/Roman Law. Of course they try to follow Roman Law while living in the West but (within their own communities) they obey Shariah to the largest extent that remains practical. In London, they try to settle their disputes through Shariah Courts first.

        But look what this Christian civiliazation that spread in the Western world gave it, with Trump at its head. Forces of reason that arose during the englightenment (e.g., Voltaire, Lock and others), the rise of Science, rise of international trade gave the strength to fight the Church (then very powerful and rich, even with armies and spies) and reduce the Church powers to what they are today. Islamic countries even prevented the printing press and more successfully aborted the growth of science and rationality.           Try reading Jim al Khalili’s book “Pathfinders: The Golden Age of Arabic Science” 8th to 13th Centuries.. This gives a good insight into how much of the Greek Science was preserved by and improved upon by Arabs and other Muslim Countries. They were also famous mathematicians that include “Al-Khwarizmi (the father of Algebra), Omar Khayyam (who worked on Cubic equations), and Ibn al-Haytham (known for his contributions to Geometry and Optics. Take for instance the work of Ibn Sahl which is regarded as the first serious Mathematical study of lenses for focusing light. he preceded Snell and Descartes by 650 years.
