Resolve National Question With President’s Support

The social media got a boost like no other during the past seven weeks of political crisis that enveloped the country. On October 26 itself no sooner was former President Mahinda Rajapaksa sworn in as prime minister the stormtroopers of his political alliance entered state media organisations and took control. Thereafter they began to give only pro-government news and views to the nation. Most of the privately-owned media also succumbed voluntarily to the menace of the new dispensation and to the unlimited patronage they could potentially offer those who fell in line. Consequently, dissenting opinion had to take to the alternative media of websites, facebook and twitter to get the other side of the matter. Those who wished to get news and analysis that was not pro-government also had to follow suit and go to the social media.

One of the many videos circulating on social media is that of Prime Minister Ranil Wickremesinghe where, in a brief video clip he can be seen saying, “Politics is more than chess. It is team work like cricket. You must have stamina for a marathon. It is also a hard game like rugger. And it is a blood sport like boxing.” This is a statement that few other politicians in Sri Lanka’s political firmament would make. To them politics would be about patronage, thuggery and somehow or other getting more votes into the ballot box. They would know of no other politics. The present political situation in the country is one in which politics needs to be conducted tactically, strategically and with the interests of all in mind. Every piece on the political chessboard matters, most of all the king.

To most politicians the next few months will be seen as a time in which different political parties will jockey for power, individual and collective alliances will be forged and elections that will yield a new composition of parliament will be held. After he reappointed Prime Minister Wickremesinghe, President Maithripala Sirisena said that most people thought that a fresh election was the best solution. But a more visionary politician could make the next twenty months that are available till general elections fall due in August 2020 the most decisive in Sri Lanka’s post-independence history. It is the last available time period for the UNP and SLFP that worked together for the first time in history to continue to work together. It is through their collaboration that the most vexed and intractable of the country’s problems, its ethnic conflict that gave rise to nearly three decades of terror and war, might be resolved.

Presidential Power 

In 2015 when President Maithripala Sirisena won the presidential election and Prime Minister Wickremesinghe’s party emerged as the single largest party in parliament, and they formed the National Unity Government, their partnership was a promise of great things to come. The most hopeful of these was a solution to the national question. This is a problem with enormous historical baggage and emotional undertones that has eluded answer because the party in opposition has invariably used it to attack the party in government. But in 2015 the two main parties were to be in alliance for five years to come and so the hope arose that together they would do what others had tried on their own to solve but failed. The names of those legendary leaders who tried on their own and failed include SWRD Bandaranaike, Dudley Senanayake, JR Jayewardene and Chandrika Kumaratunga.

However, the hope of a solution to the national question that had bipartisan support seemed to have ended on October 26, 2018 when the president plunged the country into political crisis by withdrawing his party from the National Unity Government and arbitrarily sacking Prime Minister Wickremesinghe. It will be difficult for those who supported the National Unity Government to forgive President Sirisena for his dramatic intervention that toppled the government. They would be confirmed in their opposition especially so after the Supreme Court ruled that his act of dissolving parliament was unconstitutional and therefore illegal. His most recent act of reappointing Prime Minister Wickremesinghe would have alienated the other half of the population. It is verily a dream that President Sirisena can be part of a solution today.

On the other hand, President Sirisena’s actions over the past seven weeks, and their acceptance by wide swarths of the population, are a testament to the power of the presidency and to the belief of people in the legitimacy of the president’s actions. Presidential elections are not due for another year. This is a considerable period of time in which the president’s power can be made use to achieve positive results that are in accord with national problem solving. It would be better for the government to work together with the president than in opposition to him or while waging a cold war against him. There are unfinished tasks from the pledges of 2015 that need to be delivered on. These are in good governance, economic development and most of all in national reconciliation.

President’s Support 

The most important of the unfulfilled promises to be delivered on is to find a just and lasting solution to the national question. In summary this is about ensuring that decisionmaking power is shared fairly between the ethnic majority and minority communities. The door to the solution will remain open as long as the major political parties are willing to work together to find the solution. Prime Minister Wickremsinghe made it clear during the political crisis that providing a political solution and enshrining it in constitutional law is a priority for him. The TNA votes in parliament during the crisis provided the majority needed to show President Sirisena that Mr Wickremesinghe was entitled to be appointed as prime minister.

The TNA leadership has been criticized for being more concerned about the prime minister than about the Tamil people. But their contribution to the preservation of democracy goes beyond the personal. TNA leader R Sampanthan’s speeches in parliament were about the importance of the constitution and the Rule of Law to the country as a whole and to minorities in particular. They were words and sentiments that need to be heard and heeded by the nation.

During the next year the government needs to address the national question and provide a constitutional solution to it. This would require a 2/3 majority in parliament and approval by the people at a referendum. The support of President Sirisena would be necessary for both these mileposts to be a reality. The president has the clear support of at least 20 MPs in parliament and possibly even more if he were to become a partner with the government. It is reported that these 20 MPs would like to join the government headed by Prime Minister Wickremesinghe and President Sirisena has not objected to this. The president’s support for the constitutional reforms would also help to reassure the general population that these reforms are in the national interest- and that they are about doing justice to the ethnic minorities and are not about dividing the country or giving in to foreign interests as stated by the opposition, including former president Mahinda Rajapaksa.

President Sirisena needs to be appreciated as a political leader who is responsible enough not to wish to break the democratic system by defying the law and democratic conventions. He heeded the verdicts of the judiciary and appointed Prime Minister Wickremesinghe although he had repeatedly said he would not appoint him. He swallowed his pride for the sake of the country. Although he is commander-in-chief of the armed forces, he did not order them to suppress his political opponents. He did not declare a state of emergency which would have given him additional powers. Instead he ensured that freedom from fear prevailed even as the country lurched from one political crisis to the other. It is reported that President Sirisena has agreed that the SLFP he leads will form an alliance with the SLPP headed by former president Rajapaksa to contest future elections together. Therefore, it can be seen that the president is also a potential bridge between the government and the opposition.

    I read only the title.
    In view of the existing distribution of Tamils ( all Tamil speaking people irrespective of their religion, caste or the date of arrival) across the island THERE IS NO CONCEIVABLE SOLUTION TO THE TAMIL ETHNIC PROBLEM. No one has ever presented a sketch of a solution which encompasses at least 90% of them.
    So long as +50% of them are satisfied with the status quo we are wasting our our time discussing a non existing problem.

      When the world provided a solution to Jews in 1948, it was not a 90% solution. In US alone has more Jewish people than living in Israel. Just because there were long outstanding Muslims in Israel, it did not prevent the UN to go ahead with its solution.

      There is no TAMIL ETHNIC PROBLEM however there is a humongous “Sinhala/Buddhist Fascist” problem which has to be dealt with in a manner in which it does not raise is head one way or another.
      Finala Solutions:
      1. A Separate entity of 10 Square miles allocated for the use of mutants as their homeland.
      2. A major relocation of the mutants back to their ancestral homeland in Soouth India.

    A new Committee needs to be appointed to bring a definitive solution to the ethnic issues.
    It should consist of the President PM and Rajapaksa group + Buddhist Monks. They should start this project as soon as possible

    What national question please? – Yep let us build a wall/fencing Israel style and arm both sides should get the global ‘death industry’ going for a long time thank you. which way you think the territory will shrink over time?? one will end up in the sea?? This gives more excuses for the Indian Ocean to become the play ground for geo political military games…what else can the powers do with their military machines they built in the first place ha??….ghettos of North and East managed by one and the rest by the other until the last man stand in our Island.

    Yep a man from TNA talking for the National Interest as an opposition leader really ? what else a bunch of lawyers do? making legal case for the past 70+ years as that is all they know but from a Nation Building platform? recently they were making a case for devolution by saying they never supported separation??

      Can you please go and ask your boss Mahinda Rajapakse when he promised about 13+.
      Can you please also ask the constitutional expert Professor GL Peries when he was in the negotiation in 2002 what was the agreement signed between LTTE and Srilanka?
      Can you please go and ask SWRD (SLFP) what was the agreement he signed with SJV?
      Can you please go and ask Chandrika(SLFP) what was the proposal she put forward?
      Can you please go and ask JRJ (UNP) when he signed Indo_lanka accord in 1987 and created NEP?
      Do you think the national question is whether Mahinda has to sell Srilanka to China or Maithri has to sell Srilanka to China or Ranil has to sell Srilanka to China?
      Did you consult Mahinda before making this question?

        First of all, as I said many times, I am my own master now and in future will also be the same. Mahinda never was my boss and certainly, never will be. I don’t see any reason to be under any politician.
        He may have promised 13+. I don’t know. Ask Dayan. However, there is no record that he had taken any steps to fulfill any such promise.
        Do you know what national question this Jehan is talking about? If so, please tell me.
        About the last question, I don’t consult anyone. I have my own mind.

          The national question is the problem that lead to misuse of power, misuse of constitution, massacre of number of innocent Tamils by the state, institutiionalised racism, 30 years of armed conflict and 70 years of unarmed conflict and complete destruction of democracy and justice.

            1,) Misuse of power and misuse of Constitution are not national questions. There is a Supreme Court to look into such matters.

            2.) Massacre of number of innocent Tamils by the state is a fabricated allegation. Name one innocent Tamil who was killed by the state willfully.

            3.) What is institutionalized racism?
            – The current Parliament has 28 Tamil MPs and 23 Muslim MPs. The total is 51.
            – There were Tamils who acted as Leader of the Opposition.
            – There were Tamils who held Chief Justice post.
            – There are Tamils and Muslims in the Army, Navy, Air Force, Police, Voluntary Force and Sri Lanka Civil Security Force. They held even Navy Commander and IGP posts. The current Commandant of the prestigious STF is a Muslim.
            – There are Tamils and Muslims working in each and every government Ministry, Department, and Statutory Board.
            – Any school admit Tamil and Muslim children.
            – Tamils and Muslims have Kovils and Mosques all over the country and practice their religion freely anywhere in the country.
            – Finally, Tamils and Muslims have freedom to live anywhere in the country. Name any institution which denied that right to Tamils and Muslims.
            4.) 30 years of armed conflict was successfully defeated.
            5.) 70 years of unarmed conflict and destruction of democracy and justice orchestrated and carried out by SLFP/SLPP, UNP and JVP will be defeated at the next President Election. I invite you to be a part of it!!!!!!

              1. It is well known fact that Supreme Court decision in the matter of President Sirisena’s actions was illegal and unconstitutional. So, it is a crime. What happened to Sirisena now? Did the Supreme court send him to prison?
              Do you know the former Chief Justice himself acknoledged later that his verdict was wrong on the Mahinda Tsunami Fund case? What do you call this? Misuse of power by both Rajapakse and the Chief Justice.

              In 1958, more than 300 Tamil civilians were killed in Colombo. In 1977 & 1983 hundreds of Tamils were massacred? Are these fabricated allegation? Who organised fire to the Jaffna library in 1981? Did your state find those criminals? How many were arrested for those murders? Even the murder of Lasantha and Thayudeen murder were not investigated and still no one is brought under justice. Are these fabricated allegations? Don’t kill your conscience to defend the murderers.
              2. Can you tell me what is the proportion of Sinhalese, Tamils and Muslims now?
              3.Can you tell me about why there was Banda-Chelva Agrrement, Dudley-Chelva Agrrement, Indo-Lanka accord, LTTE_Srilanka Oslo accord and 13+ promise and Vithrane lead all party conference, and the current New constitutional arrangements etc. over the 70 years if that is not a national problem?
              If you have defeated 30 year armed conflict successfully why you should keep 95% your Sinhalese only military in the North East?
              Finally, are you contesting for next presidential election? What is your political party? You already said that every one is treated equally and there is no problem in this country now, but you also say that SLFP/SLPP, UNP & JVP are responsible for destruction of democracy, justice and so on.

              Champa, no matter how much ‘multicultural’ face lift you give to the state machinery and institutions i.e. through the use of Tamil/Muslim military or police personnel, it doesn’t change the fact that Sri Lankan state is Sinhala buddhist to the core. What is the point in having Tamil representatives when they cannot independently make decisions without approval from the governor, who again acts as the agent of this Sinhala Buddhist state, centralising power. There may be Kovils, Mosques throughout the country but none have the foremost place, according to the constitution, as Buddhism does. This state needs structural reforms to share power with the stakeholders , to refuse is being chauvinistic.

          I don’t understand what you want to have varied from Thero?
          1). You didn’t know what is “Nation Question and 13A”, but as natural Racist Sinhala Buddhist, want to have managed the whole Lankawe under your direction.
          2). You never know that 13A is an amendment to Constitution, and which attempted to solve National question but as they purposefully did it without implementation clauses so government stayed out of implementing it.
          3). Thero do know that you don’t know the 13+ submitted to Sonia, Krishan, Manmohan Singh team, to fix the existing 13A problems.
          4). Thero is denying there was ever 13+ promised or/and he is an open advocate of 13+ not being a solution to the national question, or he is an opponent to use 13A’s improvement to use to solve the national question or he insist it is a solution to something else.
          5). You never know that Old Royal appointed a Presidential Commission under the Chairmanship of Nimal Siripala De Silva, which pretend to India they were going to improve 13A and Thero knows that?

          Can you come forward and tell what you know about the 13A and not. Are trying to tell that if you are corned with your tongue twisting comments, the master in the artist Thero will come and save you?

          What kind of witness Thero is? What king of understanding that you and Thero have supporting each other on these matters? Can you clarify it please that why, how, where, ……. that deal was negotiated?
          Don’t wish to you tear off Thero’s cloths by inducing him to write another nasty racist article or ask him to tear off yours by helping him you writing another imbecile comment supporting Thero’s theories. Because the entire would know you two don’t care of shame.

              Well said. We as Sri Lankans should be free to think what is best for the country independent of others view/understanding/being cornered into a box others want us to be? Instead of having a productive discussion from lessons learned we get tagged is the issue with our National politics?? This victimisation used to be at gun point now ‘not so possible at will’ turned into this media circus/head lines of fake this and that without any substance? rational discussion and wonder how all other general public read what they are presented and able to exercise what they think is right for their own destiny in their own mother land under Democracy??in fact this activity of daring to stand up and be counted itself is the shaping of democracy itself is required to serve Mother Lanka at this critical time….we need to remove fear/patronising/victimising politics out of our life for the democracy to mature? this can only happen when we show maturity?
              What any SL believe and express does not have to be inked to UNP/SLFP/JVP/TNA/Sinhala/Tamil….RW, MR, Sampanthan, MS etc either. There is so much of truth to be uncoverd as to what happed in our Country? we hardly touched the subject as all our collective ignorance are currently banked in the accounts of Sinhala Buddhists/LTTE conveniently? Yet the real terrorists may well be very alive and kicking right in-front of us…….hence after all the misery we are not united.

    Can you tell us what is this ‘NATIONAL QUESTION’ that you keep on repeating like a ‘Mantra’. We know very well why you and several NGOs keep on repeating this ‘Mantra’. An imaginary problem highlighted by a handful of elite Demalu cannot be considered as a ‘National Question’. Some Sinhala politicians also keep on repeating this without knowing what the hell they are talking. Elite Demala politicians keep on asking for more powers but ordinary Demala people in the North have told loud and clearly that they do now want land and police powers given to NPC controlled by Wellala elite Demalu. Whose voice is more important; voice of a handful of elite politicians who are backed by ‘Koti Diaspora’ or the vast majority of ordinary Demala people. If elite Demala politicians are not there, ordinary Demala and Sinhala people can live in this country without any problem.

      Eagle Eye, the vast majority of Demala people in the north and east have, at various points in time, collectively made it clear that they have no interest in national politics. They have voted for TNA, a party that has ‘tamil nationalism’ in its name, not because they have trust in sri lanka electoral politics, but to collectively express that their political aspirations matter as opposed to this development rhetoric pumped out. They have reminded you once again at the last Maaveerar Naal/Heroes day celebrations what is resilience amidst all this militarisation. People will always want to break free from oppression.

        I do not think you know who is oppressing vast majority of Demala people in the North. It is not Sinhalayo but high caste Wellala people who are a minority in the North. So encourage those oppressed by Wellala elites to rise against the oppressor and free themselves.

The Sinhalese are divided by regions low country, up country, caste, class, and even among these buddhist priests/maha sanghas but they stand united against Tamils to make this island a Sinhala buddhist one. They would spin off caste elitism, unemployment, etc in the north to reduce the narrative to one that suits them. They are nothing but bunch of hypocrites.

      Dear EE the need for Tamil speaking (fluency to the right legal level) is missing in the Tamil areas need to be addressed urgently.

      Hopefully there are enough candidates applying for the Police positions the way it was before the war? TNA Elected officials should write an investigative factual article on this subject for North and East without confusing the Provincial Council/Devolution of power /13th ++++++ etc.

      Then the PM, President and the Governor General/GA appoint a body to confirm TNA official statement/report on this issue and set out to solve accordingly by employing local officers being sought in proportion to reflect the population.

      The problem exist because both parties playing politics when the population is deprived of their normal right enshrined in the constitution………so much for the constitutional correctness from this lot is the point. Have you seen any objective articles on CT on this issue????Not sure about the SC position on this?

      The land issue also need such approach and have you seen any article set out to factually educate on this subject?? I am not sure if we can ask University students to take up this study??

      At the moment all is pushed under the devolution of power/constitutional assembly not about human rights being abused by the same……it is just a game never to have solutions that is all……..I been part of this journey all my life am very familiar with game makers.

      Recruitment to Armed forces also facing the same issues too?? the entire SL territorial waters have enough fish stock to take care all employment issues for the entire country yet no modern fishing fleets brining money to the country while the coast guards chasing away all the foreign thief’s steeling our stock for the past 70 years??

    Looking at these above comments, I think these comments are not from matured people. I do not think they treat their married partners equally. You treat every one equally where they come from, their race, colour, sex, ethinic origin, sexual orientation, religion and language. These above people need to be educated as human beings. Live is short but still want discriminate others. I have not surprised that if you have president behave insane then how do you expect the ordinary people speak or write sensibly. God help Sri Lanka.

    There are lots of people who backed this illegal political coup lost their mental status after the decision of the supreme court. That is why they ask the same question. You can’t educate these individuals because they don’t have the mental capacity to understand even who is Mahinda.They still think Mahinda is the President of India and Gotapaya is the President of America.     Cunning Jehan PhD is not asking why the people have not gone to court and have him put in prison for his ultra vires acts. He gazetted orders without authority. He rejected parliament’s NCMs. He refused to appoint the one who had command in Parliament. Is Jehan PhD trying to say is all because of the grace of the New King. Is this also parallel in logic with that Old King killed 150,000 Tamils with carpet bombing with Cluster and chemical bombs because of his graceful operation of “Humanitarian Rescue Mission”?
    New King and Old King captured the power only to save them from war crime. Unlike Old King, who is struggling to have him and his family saved from the cases of local murders, rapes and corruptions, there is no court cases other than his White Flag Murders on New King. Then, can Jehan PhD explain why New King initiated the coup? Can Jehan PhD explain why Mangala was removed from FAM? Now he is losing even the Finance Ministry. Can Jehan PhD be honest in discussing what the destruction Mangala did to Sinhala Community so he is being punished but nobody else? The Only explanation is “UNHRC”. Now New King is using Rapist Army only in North East. UN is just watching not acting. But, if New King has used the military Island wide he might have faced UN Peacekeepers Immediately. No point in Jehan PhD covering this up. Even the lowest Modaya knows why New King didn’t use the Rapist Army. So, he is not getting any special treatment from Sinhala Buddhist for that; he is not getting any votes for not using army from Sinhala Buddhist.

    Any political solution coming out from this Sinhala Buddhist state will seek to preserve the foremost place given to buddhism and will not go beyond unitary structure. They would not even fully implement the 13th amendment, so what political solution are we talking about? With deeply entrenched militarisation of north and east and the 6th amendment, Tamil people cannot freely articulate their political aspirations or politically mobilise, fearing intimidation from this military. Under this context, Tamil people should focus on dismantling the military from the north and east than anything else.

    A person who violated the constitution, according to the supreme court , cannot continue to function as the president because he didn’t uphold the rule of law in several instances. He ought to be removed from the position. Who will do it?

    Whatever he does now lacks legitimacy.

      Jehan PhD knows that after it leaked in media that when the SLFP MPs went and asked to resign but Old King answered that because of his and his family’s legal status that he couldn’t, the Slap party MPs are openly bragging that they worked with New King only to destroy Yahapalanaya’s 2/3 support to prevent it from dividing the country with the New, proposed constitution. There was many strong arguments when West was trying a regime with the White Flag murderer, this Yahapalanaya was only gimmick, not sincere on anything but remain corrupted and promote the Sinhala Buddhist Chauvinism by hook or crook methods. So Jehan knows well under these conditions calling the “unknown”, who never have to take any responsibility but could help spread the blames for not taking one more excellent opportunity, to come forward and negotiate with New King for solution is utter dishonest.

      There is a concern that Jehan PhDs like ones building a hope to put forward an argument that Tamils lawyers won this case so the justice for them is there in Lankawe so need for Resolution 30/1. Resolution is not about country trying to get back the lost democracy. The resolution is Yahapalanaya is setting an investigation and proving a solution to Tamils. Now the UNP who returned to power has the responsibility of implementing the promise the Lankawe’s Yahapalanaya Aanduwa gave to international community. This has nothing to do with the “unknown” staring a fresh negotiation with New King to settle the National Question. As we mentioned above, coup was only to destroy the implementation of Resolution 30/1 by bringing in dictatorship. They achieved that object, as least as per Slap party MPs, though they failed to establish dictatorship. Further that fear of dictatorship and/or another 18A is not removed by the Tamils lawyers’ winning the case. Jehan PhD has not said anything on those, but pretending that there is hopes of Tamils having there problem solved within Lankawe.

    Resolve National Question With President’s Support;
