“Rise Above Politics, End Persecution Of Shani Abeysekera”: Ex-Justice Minister Tells AG’s Dept Officials

The Government’s thirst for revenge and personal vendettas were putting Sri Lanka’s economic security in danger, former Justice Minister Thalatha Atukorale said on Sunday (13), urging the ruling administration to end the witch-hunt against former CID Director Shani Abeysekera and other political prisoners.

Thalatha Athukorale – Ex-Minster of Justice

Main Opposition Lawmaker Atukorale said the European Parliament had already taken note of Abeysekera’s politically motivated imprisonment. The Government’s “undemocratic and autocratic conduct” has put Sri Lanka’s GSP+ import duty concessions, which made the country’s exports to the EU competitive in grave risk, MP Atukorale’s statement said. She warned that the UN Human Rights Council had already raised the issue of Abeysekera’s detention. “If the countries that purchase most of our exports start to see Sri Lanka as a lawless and undemocratic country that arbitrarily punishes professional public servants for doing their job, we will face an economic catastrophe,” her statement warned.

Athukorale’s statement said that senior law officers of the Attorney General’s Department had independently reviewed the evidence presented by the police against Shani Abeysekera and his fellow detectives at the CID.

“All these prosecutors found serious contradictions and inconsistencies in the allegations made against the former CID Director by the Colombo Crime Division. They have all issued independent reports to their supervising officers concluding that there is no basis to prosecute Mr. Abeysekara and recommending that he and his colleagues should be discharged. However, these reports have been overruled and dismissed by a senior official of the Attorney General’s Department, with a vested political interest. Without examining the underlying evidence, we understand that this officer has ordered that Mr. Abeysekara and his colleagues be held in remand for as long as possible,” Atukorale revealed in her statement.

This is despite the fact that the Department is unlikely to ever bring charges against them in a court of law since there is no credible evidence to support a prosecution, the former Justice Minister said.

Issuing an impassioned appeal to officers of the Attorney General’s Department, the former Minister of Justice said: “Rise above politics. Be professionals and do your jobs independently.”

“As officers of the court, our first and foremost duty is to the rule of law, not to personal career ambitions. This is no longer just about your own reputations or the fundamental rights and liberty of Mr. Abeysekara and his colleagues. The international reputation of our entire system of justice, our country’s export economy and the hundreds of thousands of jobs it supports now rest squarely in your hands,” Atukorale’s statement that directly addressed prosecutors at the AG’s Department emphasized.

We publish bellow the full statement by SJB MP and Former Justice Minister Thalatha Atukorale:

Last week, we learned that the European Parliament has taken note of the politically motivated imprisonment of the highly respected former CID Director SSP Shani Abeysekara.

It has been nearly one year since police officers came to the house of Shani Abeysekara to arrest him at the crack of dawn. The only allegation made against him and his colleagues Nawaratne Prematillake and Sugath Mohan Mendis is that they are said to have fabricated evidence to falsely implicate former DIG Vaas Gunawardena, who was unanimously convicted of murder by three judges sitting in a trial-at-bar for running a contract killer squad within the police.

Since then, Mr. Abeysekara contracted Covid-19 in police custody, suffered a heart attack and has had to undergo cardiac surgery. We have now learned that the evidence presented by the police against Shani Abeysekara and his fellow detectives has been independently reviewed by multiple unbiased senior law officers of the Attorney General’s Department.

All these prosecutors found serious contradictions and inconsistencies in the allegations made against the former CID Director by the Colombo Crime Division. Abeysekara and his colleagues be held in remand for as long as possible. This is despite the fact that the Department is unlikely to ever bring charges against them in a court of law since there is no credible evidence to support a prosecution.

In consideration of the risks posed by the Covid-19 pandemic, the Judicial Services Commission (JSC) has urged the Attorney General’s Department and judges to grant bail even in cases where they otherwise would not. However, due to the personal needs and ambitions of a few senior department officials seeking to please those in power, the recommendations of career prosecutors are being overruled. Innocent, patriotic and outstanding police officers are being punished simply for doing their duty.

We cannot keep putting our economic security in such danger merely to indulge a thirst for revenge and personal vendettas. The government must immediately stop the witch hunt against Mr. Abeysekara and all other political prisoners. As a former Minister of Justice, I appeal to the law officers of the Attorney General’s Department to rise above politics. Be professionals and do your jobs independently. As officers of the court, our first and foremost duty is to the rule of law, not to personal career ambitions. This is no longer just about your own reputations or the fundamental rights and liberty of Mr. Abeysekara and his colleagues. The international reputation of our entire system of justice, our country’s export economy and the hundreds of thousands of jobs it supports now rest squarely in your hands.

6.9 million Modayas including cardinal malcom and Narahenpita Monk are responsible for the death of several garment industry companies and Fish export companies or financial bleeding.
Malcom and Monk should lead the protest on the road without saying that we need to pray to the Gods. Why didn’t they do that when Yahspalanya rogues were in power why did they get on the roads to bring in Murderers into power

MaLCOM ‘s genetics is similar to that of MaRa (Mahinda Rajapakshe)

If Malcom was as he diplays today, why on earth, knowing the CRIMINAL records of Rajaakshes, but supported their comeback, totally ignoring that EASTER sunday disaster.
      .
Those CRHISTIANS are made to believe, it was god took the lives of the INNOCIENT worshipers on the easter sunday, no matter, megalo Rajapakshes and Sorrysena to have been the mastermind of that disaster.
      .
These figures publicly behave like PULLI GONAS and pass it to the GOD… god punishes…. and that is why the country is thrown to the clutches of proven high criminals today. Elephant is in the room, but Malcom Ranjith behaves as if he is totally deaf and blind. Aiyoooooooooooooooooooooooooooo ?

leelagemalli, Sorrysena and Malinda genes influenced Mal Col to believe the lie vesus the truth that Shani knows how the easter bombings were planned and worked out. It’s like Thajudeen knew where the birth mark was. Murderers try to save themselves here though karmic justice will eventually overtake them. They can turn to God of love, mercy and forgiveness to receive when obeying his laws.

leelagemalli, There is a tree of knowledge which is dangerous. Shani knew the workings of the easter bombings like Thajudeen knew the birth mark. God only wanted us to know and eat of his life only.

          DTG,
          .
It has always been dangerous where MARA-GOTA-BASIL-CHAMAL-NAMAL touched. Ridiculous truth is people (filled with majority PUNNAKU drinkers) would not grasp it, nor see I the least sign of their sanity becoming better.
Ginipenellen batakaapu miniha kanaamadiri eliyatath bayayi lu. The man who has been beaten by a fire-brand dreads the light of even a firefly. When someone goes through a traumatic experience, he/she tries to avoid everything that even closely resembles that experience.

In these times of frustration, stuck between covid and an unthinking govt., may be some comic relief is in order. To the 6.9M voters (69 has other connotations), a Mid Year present was given:
    Octane 92 up 20/- Octane 95 up 23/- Auto D up 7/- Super D up 12/- Kero up 7/-
That is a total of 69/- up for you all to enjoy.

      My View,
.
Needless to bring examples if you live in SL, but to those live outside world…
.
“There are LORRIES with its displays ” BUDUSARNAYI” but transporting ” slaughtered cattle” also in today s srialnka, even a high criminal of Mahinda Rajapkashe nature, wear all the talishments to show that he is BUDDHIST by belief, though each and every murders known to the people sofar would not have occured without the man’s knowledge. Lasantha W, Ekanaligoda, and lately held gun shoots on Makandure madhush, Urujuwa and the like… also Late Mr Kadir… and all…. the list would not cease easily..
So is the case also with EASTER sunday human slaughter. Why powerful world further allows MR to continue is more than questionable to me… aiyoooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooo!!
.
And this culture… mlechcha culture promoted by uncultured bastards ……. is PART AND PARCEL of this SOCIETY, even more once Mafia Bosses take the ground control. Whoever whatever being said and done against GOOD GOVERANCNE; but that govt had a charactor until puppet SORYSENA was kidnapped by MaRa-Gota.
:If So called fake buddhagama MONKS and fake Christian Leaders and their stupid ignorances/backing are there, the vicious cycle of Rajapakshe politics would not be stopped. …. making tangible changes towards properity… would remain a dream. forever.

Who is the Senior official in the AGs Dept: who is falling over himself to keep Shani Abeysekera in Jail?
The consideration for his services is a place on the Supreme Court Bench?
What is the oldest Profession in the World?

I hope one day, this Senior official would be asked to stand up on the Bench so that the whole class [ Nation ] could see him?

Has payback time come so soon for the New AG?

If judges are honest and straightforward, they can give the correct verdict, whatever AG says.

Here, we have to stand up against (1) The “Abuse” of the Justice System that is supposed to be “Independent” and (2) The “Prostitution” of the system by “Individuals” towards personal gains. The “Victim” under both of the above, “Abuses” is this officer, Shani Abyesekera. There are many more.

The previous “Yahapalanaya” Government undertook to “Change” these draconian laws, but did not do anything. The present “Saubagaya” Government continues with it because there are very many cases they have to “Deal” with. Now this “Previous” Minister of Justice who writes now must address her own conscious and ask: “Why I did not do the correct thing when in power”? How strange, these “Authoritative” powers realize the “Wrongs” when in “Opposition”?
