Scrap Sri Lanka’s Archaic Underage Muslim Marriage Law: WAN

Women Action Network (WAN), a collective of eight women’s organisations that are working in the North and East has emphasized upon the need to establish a minimum age for marriage for all citizens, in the wake of continuing underage marriages, specially within the Muslim community.

Muslim Underage Marriage 1In a statement, WAN also appreciated Parliamentarian Hirunika Premachandra actions during a MP workshop on the formation of the Constitution where she raised the concerns that Muslim Marriage and Divorce Act (MMDA) allows for Muslim girls and boys below the age of 18 to be married.

“MP Hirunika’s comments come in light of the fact that under the Penal Code (Section 363) of Sri Lanka, sexual intercourse with a girl below the age of 16 (with or without her consent) amounts to statutory rape, therefore the provision of early marriages for Muslims is contradictory and requires attention in this regard. As a concerned MP, it demonstrates her apprehension about the practical and potential problems faced by the minority Muslim women and children in the country with regard to lack of minimum age of marriage,” the statement said.

WAN highlighted that even though for over two decades, these concerns have been raised at multiple forums including with religious leaders and Muslim MPs, they are usually ignored on the basis that early marriage is not happening in the Muslim community.

“However, Muslim women’s groups who have been working very closely at the community come across many cases of early marriage on a regular basis. High prevalence of early marriage has also been noted in districts such as Batticaloa, Puttalam and parts of Colombo. In some areas the number of early marriages have in fact increased from 2014 to 2015, and a look at the data on registration of Muslim marriages will reveal the facts and figures. In most cases of early marriage, young girls are removed from schools in order to be married. Thus, early marriage is also closely associated with a denial of educational opportunities and other social, economic and cultural rights. In addition, girls are more vulnerable as a result of their age, inexperience and lack of awareness to reproductive and health problems, gender-based violence, harassment within marriage, economic challenges in case of divorce, or non-maintenance by husbands,” the statement said.

WAN pointed out that minimum age of marriage is first and foremost a serious child rights concern, which the State has the principal obligation to protect and not one that should be left at the discretion of any particular community.

“We are therefore highly disappointed at the counterargument of Minister Rauff Hakeem in response to MP Hirunika, when he stated that the issue of age of marriage is a concern that is being dealt with by the Muslim community through reforms of the MMDA. Reforms to the MMDA have been overdue for 64+ years and we are also saddened that little action was taken by Minister Hakeem during his time as Minister of Justice to expedite the process,” WAN said.

“While we are aware that there is a Muslim Personal Law Reforms Committee that was established in 2009 by then the Justice Minister Milinda Moragoda tasked with recommending reforms to the MMDA, we are unaware of the progress that has been made by this committee in the past 7 years. The broader Muslim community has very little information on the work of the committee thus far, timeline of when its report will be delivered to the Government and whether or not it recommends the protection of rights of Muslim children on par with the rest of the children of Sri Lanka,” the statement said.

“Given these concerns and significant delay to reforms, many Muslim women’s and victims of the injustices faced under the MMDA have gone before the Public Representation Committee on constitutional reforms in district level hearings in Puttalam and the North and East. They have made oral and written submissions demanding immediate reform of the MMDA or to give Muslims the option of choose to marry under Sri Lankan General Marriage Ordinance. It is highly problematic that when it comes to marriage and divorce, Sri Lankan Muslims are governed only by an outdated MMDA with discriminatory provision that especially violates the rights of Muslim women in many ways (such as allowing early marriages). In Sri Lanka fundamental rights should apply to all citizens of the country and not be left to the discretion of minority personal laws. This had to be one of the primary concerns addressed in constitutional reforms,” the organization pointed out.

WAN reiterated that the issue of age of marriage is NOT a ‘Muslim issue’ but rather one of human rights and child rights, and also it was illogical that a different minimum age of marriage applies for a minority community than to the rest of Sri Lankan citizens and this discrimination needs to be questioned and raised as a concern by many more MPs.

“Action also needs to be taken by relevant government agencies such as the National Child Protection Authority to understand the implication of such a discriminatory provision under State laws,” the statement said.

Hence by simple reasoning I think one can conclude that the law on statutory rape does not apply to persons legally married. Hence there does not exist any contradiction! Q.E.D

        1. Make the Marriageable Age 16, 17 or 18, so that the Man will not have to be persecuted for statutory rape,

        2. Change the statutory rape age from 16 to another age.

        What should it be? Different people have different opinions.

        What about the education of the girl? Nobody is worried? Why? What about the country’s loss? Remember, the average IQ of Sri Lanka is 79.

            Registration of the Marriage of a 12 year old, a 7th grader, means that the “ownership” of the girl, the Chattel, Slave is transferred from the Wali, Guardian (father, brother or male relative) to the husband. Now the husband owns the chattel, slave, as wife, and can do whatever he wants with her. The Former Wali has no say in it.

            There is nothing in the Muslim Marriage Act statute that says that the girl cannot be transferred to the “husband” until she reaches 16 or 18 years of age.

            Furthermore, there is no written confirmation, with witness signatures that says the girl gave her approval without being forced.

            Furthermore, in the marriage certificate, there is no bridal signature, that says that the girl signed and her her approval. The Muslim Marriage certificate is a chattel, slavery sheet for exchange of property.

            As consideration the husband gives a Mahar, a bridal pay either to the girl or the girls Wali, guardian.

            So make, Age of Bride: Minimum 18 years.

            Make the bride sign the Marriage certificate, signed by the bride with 2 Witnesses, with written signatures, with Full names and addresses of the witnesses. There should be no fakes.

            The judges will then call on the “less equal” party to bring his/her proofs of equality — family trees, tribal historians, documents, witnesses and others. If these evidence were not satisfactory, then it is up to the judge to order the forced separation of husband and wife.

        Hitunika, Amarasiri assumes, was born a baby girl, and grew up to be young girl, before she became a young women, MP and a wife.

        So she is better qualified, as a former girl, about the issues of young girls being married at an early age.

        Amarasiri’s concern is that their education is disrupted, their life skills will be lacking, because of the early marriages.

        Why, and who are the people promoting it? We all know the characters.

        Many girls are tapped and have no other option than to give in to the pressures of the family. The Parents will have one less mouth to feed. the girl needs to live. If there is law. Then, she will be protected until age 18, at least.

        So, she will try to learn some life skills in the meantime.

        There is also a health issue that should be taken into account.

        Question: What is the optimum age for a women to be a mother?

        16, 17, 18, 19, 20, 21, 22, 23, 24, 25?

        Some women, do not like to be referred to as a “girl”. By referring to them as a former “girl”, it is somewhat “acceptable” to them.

        Furthermore, the word “girl”, rhymes in the current context, as it is the Muslim “girls”, who are marrying, not young women. After all, they are still teenagers, but this is better understood by former girls.

        A girl is a female human from birth through childhood and adolescence to attainment of adulthood when she becomes a woman. The term girl may also be used to mean a young woman, and is often used as a synonym for daughter.

              It is this anthropomorphism that suggests he may have had an occult connection. Ibn Taymiyyah was born in Harran, which in the occult tradition, is one of the most important cities in its history, besides Babylon, Athens and Alexandria.

              Harran was the seat of the Sabians. This was a Gnostic group, that cleverly identified themselves with the Sabeans of the Koran to escape persecution. But they were nothing of the sort. Instead they were satanists who practiced human sacrifice, worshipped Tammuz, and practiced Neoplatonism and Hermeticism.

              In fact, when the Muslims began their great program of collecting and studying the works of the philosophers, by which the West eventually acquired this knowledge, it was the Sabians they turned to as translators.

              What happens then is that it is Sabian influence that results Sufism, and a very important occult work known as the “Epistles of the Brethren of Sincerity”, or in Arabic, Rasa’il ikhwan as-safa’ wa khillan al-wafa. It was largely composed by Ismailis under Sabian influence.

              And so it is that the basis of Scottish Rite Freemasonry is that the Templars supposedly learned their secret doctrines from the Sabians.

              Scholars avoid that subject, but they do study the possible connection between Sabianism and the sudden advent of the Kabbalah in the 12th century AD, following the return of the Templars to Europe. For instance, Gershom Scholem, who is known as the great authority on the subject, devoted his “Origins of the Kabbalah” to a study of the subject.

              What is puzzling is that the ideas of the Medieval Kabbalah were ones that had all but disappeared from Judaism for about 1200 years. So, considering the similarities, Scholem suggest that one possible avenue would have been the Sabians (also known as Mandeans).

              And recently, probably the most advanced study of the Kabbalah is Nathaniel Deutsch’s The Gnostic Imagination: Gnosticism, Mandaeism and Merkabah Mysticism. First he connects Gnostcism with early Kabbalah, but then examines the extensive similarities between Mandaism and Medieval Kabbalah, to conclude that one must necessarily have influenced the other. According to Deutsch:

              “at present, we must be satisfied with acknowledging the phenomenological parallels between the Mandaean and Kabbalistic traditions, although we must also seriously consider the possibility that both Mandaean and Kabbalistic sources drew on a common pool of earlier (Jewish?) theosophic traditions.”
              In fact, the one point which lends the most credence to this hypothesis, is the existence of an elaborate anthropomorphic doctrine among the Sabians. In the Kabbalah, it is known as the descriptions, or the Shiur Khomah, of the image of God called the Adam Kadmon. It mirrors similar speculations among the Sabians about a Cosmic Adam.

              Coincidence?

              In order to understand the connection, we need consider that the founder of the Salafi movement was a Jamal ud Din al Afghani, the Grand Master of the Egyptian Freemasons, who referred to each other as the Rasa’il ikhwan as-safa’ wa khillan al-wafa (Rafaat, Freemasonry in Egypt)

              One possible explanation about the mysterious teachings of Ibn Taymiyyah can be explained from information exposed recently by Nuh Ha Mim Keller, that Ibn Taymiyyah had an esoteric doctrine, that he taught only to his closest initiates.

              This is from Keller’s article:

              “Abu Hayyan, of Andalusion origin, settled in Damascus, knew Ibn Taymiya personally, and held him in great esteem, until the day that Barinbari (d. 717/1317) brought him a work by Ibn Taymiya called Kitab al-‘arsh [The book of the Throne]. There they found, in Ibn Taymiya’s own handwriting (which was familiar to Abu Hayyan), anthropomorphic suggestions about the Deity that made Abu Hayyan curse Ibn Taymiya until the day he died… Abu Hayyan, in his own Qur’anic exegesis of Ayat al-Kursi (Qur’an 2:258) in surat al-Baqara, recorded something of what so completely changed his mind:
              I have read in the book of Ahmad ibn Taymiya, this individual whom we are the contemporary of, and the book is in his own handwriting, and he has named it Kitab al-‘arsh [The book of the Throne], that “Allah Most High is sitting (yajlisu) on the Kursi but has left a place of it unoccupied, in which to seat the Messenger of Allah (Allah bless him and give him peace)” [italics mine]. Al-Taj Muhammad ibn ‘Ali ibn ‘Abd al-Haqq Barinbari fooled him [Ibn Taymiya] by pretending to be a supporter of his so that he could get it from him, and this is what we read in it (al-Nahwi, Tafsir al-nahr al-madd, 1.254).

              As Keller notes, “This is of interest not only because it documents (at the pen of one of Islam’s greatest scholars) that Ibn Taymiya had a “double ‘aqida [theology],” one for the public, and a separate anthropomorphic one for an inner circle of initiates”

              Ibn Taymiyyah just happened to live in Harran at a time to witness the end of the Sabian community, as a result of the conquest of the city by the Mongols. This may explain his continuing vociferous opposition to these new Mongol rulers.

              Because, Ibn Taymiyyah was unique in his pronouncements of the legality and necessity of fighting the Mongols. The Mongols had converted to Islam, but Ibn Taymiyyah argued that it was permitted to fight against them, because they had not been fully orthodox in their application of Shariah.

              The same arguments have been employed in the 20th, in deliberate reference to Ibn Taymiyyah, by the likes of the Muslim Brotherhood, to argue for terrorist activities against the various regimes of the Arab world. In most cases, such as the assassination of the Anwar Sadat, or the “Jihad” in Afghanistan, the fatwas of Ibn Taymiyyah have been cleverly used to manipulate these terrorists to serve a Western agenda.

                Amarasiri, you have cut and pasted the view or opinion of virulent critics of Islam with vested interest, and concluded that their opinion is “Gospel Truth”.
                What about the opinions of the classical, trusted, revered Scholars of Islam, whom you are ignorant of, or you dishonestly omit? Let’s discuss what they have to say.

                Ibn Hajar also says (and this is also mentioned by as-Sakhaawee 8/104): No one says about ibn Taymiyyah that he is a kaafir except two types of people: either one who is himself a kaafir, or one who is ignorant of him… and all the different groups of the people of his time praised his knowledge, Deen and zuhd.

                Ibn Hajar also said in his commendation to ar-Radd al-Waafir (p.68): And if there were no virtues of Shaykh Taqi-ud-Deen (ibn Taymiyyah) except for his famous student Shaykh Shams-ud-Deen ibn Qayyim al-Jawzziyah – the author of many works, which both his opponents and supporters benefit from – then this would be sufficient indication of his (ibn Taymiyyah’s) great position.

                In the biography of ibn Taymiyyah in ad-Durar al-Kaaminah, Ibn Hajar writes:

                As-Suyootee said in Badhiyyatul-Wiaat (1/62): His books have no equal and he strove and traversed the path of the great Imaams in tafseer, hadeeth, fundamentals (usool), the branches (furoo) and the Arabic language.

                His student, the scholar of tafseer, al-Haafidh ibn Katheer, wrote about him in al-Bidaayah wan-Nihaayah (14/246):

                He attained great proficiency in many branches of knowledge, particularly knowledge of tafseer, hadeeth and usool. When Shaykh Taqiyyud-Deen ibn Taymiyyah returned from Egypt in the year 712H, he stayed with the Shaykh until he died, learning a great deal of knowledge from him, along with the knowledge he had already occupied himself in obtaining. So he became a singular scholar in many branches of knowledge. He also continued to seek knowledge greatly day and night and was constant in humbly calling upon his Lord. He recited well and had fine manners. He had a great deal of love and did not harbour any envy for anyone, nor harm anyone, nor seek to find fault with anyone, nor bear any malice towards anyone. I was one of those who most often kept company with him and I was one of the most beloved of people to him. I do not know of anyone in this world in this time who is a greater worshipper than him. His Salaah used to be very lengthy, with prolonged bowing and prostration. His companions would often reproach him for this, yet he never retorted back, nor did he abandon this practice – may Allaah shower His Mercy upon him.

                Another of his students, al-Haafidh ibn Rajab, said in Dhayl Tabaqaatul-Hanaabilah (4/450):

                He rahimahullah was constant in worship and performing the tahajjud Prayer, reaching the limits in lengthening his Salaah and devotion. He was constantly in a state of Dhikr and had an intense love for Allaah. He also had a deep love for turning to Allaah in repentance, humbling himself to Him with a deep sense of humility and helplessness. He would throw himself at the doors of Divine obedience and servitude. Indeed, I have not seen the likes of him with regards to such matters.

                Mullah Alee al-Qaaree said in al-Mirqaat (8/251) that both ibn Taymiyyah and ibn al-Qayyim were:

                … from the great ones of Ahlus-Sunnah wal-Jamaaah and from the awliyaa of this Ummah.

                Al-Mulla ‘Ali Qaari (may Allaah have mercy on him), who said, after quoting Ibn Hajar Al-Haythami’s accusations against them and his criticism of their ‘aqeedah:

                I say: Allaah protected them – i.e., Ibn al-Qayyim and his Shaykh Ibn Taymiyah – from this abhorrent accusation. The one who studies Sharh Manaazil al-Saa’ireen by Nadeem al-Baari al-Shaykh ‘Abd-Allaah al-Ansaari, who is the Shaykh of Islam according to the Sufis, will clearly see that they were among Ahl al-Sunnah wa’l-Jamaa’ah and are indeed among the awliya’ (close friends of Allaah) of this ummah. Among what he said in the book mentioned was the following:

                “These words of Shaykh al-Islam highlight his position as a prominent scholar of Ahl al-Sunnah, and his status among scholars, and it demonstrates that he is innocent of what his Jahami enemies accused him of, that he likened Allaah to His creation, as they usually accused the scholars of hadeeth and Sunnah, just as the Raafidis accuse them of being Naasibis, and the Naasibis accuse them of being Raafidis,, and the Mu’tazilah accuse them of being anthropomorphists. That is a legacy of the enemies of the Messenger of Allaah (peace and blessings of Allaah be upon him) who accused him and his companions of having invented a new religion. And this is a legacy of the scholars of hadeeth and Sunnah from their Prophet, that the people of falsehood give them offensive labels.

                May Allaah sanctify the soul of al-Shaafa’i, who said when he was accused of being a Raafidi:

                If being a Raafidi means loving the family of Muhammad, then let the two races (of mankind and jinn) bear witness that I am a Raafidi.

                May Allaah be pleased with our Shaykh Abu’l-‘Abbaas ibn Taymiyah when he said:

                If being a Naasibi means loving the family of Muhammad, then let the two races (of mankind and jinn) bear witness that I am a Naasibi.

                May Allaah forgive the third – Ibn al-Qayyim – when he said:

                If being an anthropomorphist means affirming the divine attributes and regarding them as being above the interpretation of a liar,

                Then praise be to Allaah, I am an anthropomorphist; bring your witnesses.”

              Shaykh ibn Taymiyyah said in commentary of the hadeeth (where the sun rises) in Musnad Ahmad vol. 5, pp. 372-373 which is graded as authentic (QUOTE): “directly east of the city of the Prophet (p) is where Musaylimah the Liar came from – this one who claimed prophethood after the death of the Prophet (p) – and many people followed him. He was fought by Abu Bakr as-Siddiq” (Al-Jawab us-Sahih li-man Baddala din al-Masih, vol. 6, pp. 127-128). Musaylimah came from Al-Yamaamah and as I showed you in this video, that is located within Najd. This proves that Shaykh ibn Taymiyyah UNDERSTOOD Najd to be within the Arabian Peninsula, (modern day Saudi Arabia) and not in Iraq.

              HISTORICAL FACT: all the scholars who lived before the time of Muhammad ibn Abdil-Wahaab who had the title “An-Najdi” attached to their last names, in every case it was always understood that each of those scholars came from Arabia. No scholar who came from Iraq ever had the title “An-Najdi” attached to his last name.

              Now my brief refutation of the claim and evidences used to suggest Najd is in IRAQ.

              Evidence #1
              The hadeeth of ibn Umar reported by Abu Nu’aym in “Hiliya tul Awliya” of Abu Nu’aym al-Isfihani, 6/133. The hadeeth has two particular narrators in it’s Sanad: 1) Abdullah bin Jaami’i al-Halwaani – He is a Mujhool (unknown) narrator and 2) Tawba bin Kisaan – He is thiqa but also considered weak according to some Muhaditheen. So, due these two narrators this hadeeth is actually weak.

              Evidence #2
              The hadeeth of Jabir reported in Sunnan Ibn Majah (English) Vol. 1, Book 25, Hadeeth # 2915, Dar us Salam Publishers (Riyadh Najd) Saudi Arabia]. This hadeeth contains Ibrahim bin Yazeed who is “MATROOK” “DA’EEF” “MUNKAR UL HADITH” and not to forget Imam Bukhari (rah) himself used the wording “Sakatu ‘anhu” regarding him which proves him to be a worst kind of narrator. So, this hadeeth is not authentic.

              Evidence #3
              The hadeeth of ibn Umar reported in “Mu’jam al Awsat” by at-Tabaraanee. The chain contains: 1) Ali bin Sa’eed bin Basheer and 2) Ziyad bin Biyan. They both have weakness and/or are not approved. Hence a chain from them will become weak.

              Evidence #4
              The hadeeth in “Musnad Ahmed” which appears to have an authentic chain. The hadeeth comes via the route of “Handhalah. In this hadeeth Ibn Numayr narrates directly from Handhalah whereas in Sahih Muslim Ibn Numayr narrates this hadeeth from Ishaq bin Suliman first and then Handhalah and this same authentic hadeeth in Sahih Muslim DOES NOT contain the word “IRAQ” but instead uses the word “EAST” (see Sahih Muslim #6942). This same Handhalah is yet again a narrator in another hadeeth chain, and this hadeeth also contains the word “EAST” (see “Akhbar al Makkah” by Al-Fakihi, hadeeth #1123). So it is proven from this same Handhalah that he actually narrated the word “EAST’. Also, this hadeeth (referring to the east) appears to be mistranslated due to the words “Ya’umul Iraq”. However, “Yushero bi Yaddihi Ya’umul Iraq” does not necessarily mean that “he showed Iraq with his hand”. The literal word by word translation could be: “pointed (yushero) with (bi) his hand (yaddihi) “LEADING TOWARDS (YA’UMUL)” Iraq. The word “Ya’umul” proves that pointing was towards a generally eastern direction and not Iraq itself. So, the possible meaning is: “LEADING TOWARDS” Iraq, not Iraq itself.

              Evidence #5
              Sahih Muslim, book 41, hadeeth #6943. The fact that Muslim narrated that Salim ibn `Abd Allah ibn `Umar applied this hadeeth to the people of Iraq does not limit its meaning to them. Let’s say for example that an evil starts out with it’s roots in Najd (modern day Saudi Arabia) but then spreads to other places, like Iraq or Egypt. The ROOT cause of this evil fitnah will still remain in the territory of Najd even if this fitnah will emerge from different places. It stands proven from the Prophet (p) that no matter where this evil emerges from, it will still be condemned. However, the hadeeth seems to imply that the people of Iraq were simply being warned of the “Horn of Satan” that would emerge in Najd (modern day Saudi Arabia), so that they would also not fall into this evil. Allah knows best.

                The Hadith of Najd is a famous hadith with several chains of narration about three geographical locations. While all Sunni Muslims accept the group of hadith as authentic, the exact location of the area referred to as “Najd” is disputed.

                According to two narrations in Sahih Bukhari, the Prophet(S) asks Allah to bless the areas of Bilad al-Sham (Syria) and Yemen. When his companions said Our Najd as well, he replied: There will appear earthquakes and afflictions, and from there will come out the side of the head (e.g. horns) of Satan. In a similar narration, Prophet(S) again asked Allah to bless the areas Medina, Mecca, Sham, and Yemen and, when asked specifically to bless Najd, repeated similar comments about there being earthquakes, trials, tribulations, and the horns of Satan.

                “O Allaah bestow your blessings on our Shaam. O Allaah bestow your blessings on our Yemen.” The people said, “O Messenger of Allaah, and our Najd.” I think the third time the Prophet, sallallaahu alayhi wa sallam, said, “There (in Najd) will occur earthquakes, trials and tribulations, and from there appears the Horn of Satan.”

                It has been asserted that this hadith is relating the coming events that shook the Muslim nation, these known as fitnah or ‘trials’. Amongst the trials that arose in Iraq and the east was the martyrdom of Hussein ibn Ali, the grandson of Prophet(S), as well as the first battle between the Muslims that also occurred in Iraq. This as well as the tribulations that came along with the multitude of sects that formed in the east, specifically Iraq and Baghdad, being the Qadariyyah, the Jahmiyyah (from Jahm bin Safwan), the spread of the Mu’tazila, and the advent of the emergence of the Shia in opposition to the Sunni Muslims. It has also been identified as where the Dajjal or Antichrist is said to emerge from (according to a narration through Imam Nawawi). There have also been various conspiracy theories instigated against the people of the modern day region of Saudi Arabia known as ‘Najd’ however historically and geographically there is no substantial proof to support these arguments as well as the suggested argument contrasting with a number of sound hadith when objectively studied.

                Location of Najd

                The apparent meaning of ‘najd’ indicates a raised area, it is regarded that there are up to 13 various locations in the region regarded as ‘najd’. Various misconceptions have arisen with regard to the ‘hadith of Najd’ due to the modern day named area of Najd in Saudi Arabia. Historically the location has been accounted as being between the borders of Iraq and modern day Saudi Arabia. This is in accordance to “Najd Qarnu ash-Shaytaan” the definition of Najd depends on one’s own location, and from Madina, Najd would be Iraq. The area is indicated by various scholars of hadith as to be in accordance with this.

                Ibn Hajar al-Asqalani said after quoting the words of al-Khattaabee explaining the meaning of Qarn (horn) ;

                “and others have said that the People of the East were disbelievers at that time and the Messenger of Allaah, sallallaahu alayhi wa sallam, informed us that the trials and tribulations would arise from that direction and it was as he said. And the first of the trials that arose, arose from the direction of the east and they were the reason for the splitting of the Muslim ranks, and this is what Satan loves and delights in. Likewise the innovations appeared from that direction.”


                Ibn Hajr quoted al-Khattabi as saying:

                “The najd is in the direction of the east, and for the one who is in Madeenah then his Najd would be the desert of Iraaq and it’s regions for this is to the east of the People of Madeenah. “The basic meaning of Najd is that which is raised/elevated from the earth in contravention to al-Gawr for that is what is lower than it. Tihaamah [the coastal plain along the south-western and southern shores of the Arabian Peninsula] is entirely al-Gawr and Mecca is in Tihaamah.'[…] by this [saying of al-Khattaabee] the weakness of the saying of ad-Daawodee is understood that ‘Najd is in the direction of Iraq’ [min Nahiya al-Iraq] for he suggests that Najd is a specific place. This is not the case, rather everything that is elevated with respect to what adjoins it is called Najd and the lower area called Gawr.”


                The celebrated 12th century historian Ali ibn al-Athir, who had frequently traveled to Iraq during the era of Saladin and had written his monumental work al-Kamil fi at-Tarikh (The Complete History), writes in his work ‘al-Nihâyah’ ;

                “Najd is the highland region. This name is given to area beyond the Hijâz towards Iraq.”
                It is also related that Imam Nawawi in his Sharh Saheeh Muslim 2/29 stated that this hadith had to with the Dajjal or Antichrist coming from the East.

                The Different regions of Najd

                Scholars have elucidated that there are perhaps up to thirteen various regions known as najd. The geographer and Islamic scholar, of Greek origin, Imam Yaqut al-Hamawi in his encyclopaedic work Mu’jam al-Buldan explained the various regions of najd as;
                1. Najd Yemen.
                2. Najd Iraq.
                3. Najd Hejaz.
                4. Najd Khal.
                5. Najd Al-Shari.
                6. Najd Azaar.
                7. Najd Al-Aqaab.
                8. Najd Kabkab.
                9. Najd Mari.
                10. Najd Alwaz.
                11. Najd-e-Aja.
                12. Najd Barqq.

                Contemporary theories
                A number of authors have claimed that the hadith refers to Muhammad ibn Abd al-Wahhab, the patronym of the Wahhabi movement. It is accounted that the origin of Muhammad ibn Abd al-Wahhab is from the modern day Najd region of Saudi Arabia, which happens to be the only surviving region that carried on the title of ‘Najd’ after the geographical codification regardless that there were several distinct locations known previously as ‘Najd’. This theory is generally supported by adherents to other various sects in Sunni Islam as well as Twelver Shi’ism that have disdain for Wahhabism. This is often speculated to be due to the revival of prophetic traditions, strictly clinging to hadith and negating what was seen at the time to be bid‘ah or ‘heretical innovations’, instigated by Ibn Abd al-Wahhab and later carried on by his followers. Contrary to the accusations there are numerical hadith that discredit this argument due to praise of the ethnic tribe of Muhammad ibn Abd al-Wahhab, being the Bani Tameem tribe, and praise for the region of what is now known as Najd and its peoples. Through anthropological records it is accounted that the Bani Tamim are the majority of people inhabiting the land of modern day ‘Najd’ in present day Saudi Arabia.

                Also related in hadith #2543 and #4366 of Ibn Hajar’s Fath:

                “I have loved the people of the tribe of Banu Tamim, ever since I heard three things the Messenger of Allaah , sallallaahu alayhi wa sallam, said about them. I heard him saying, ‘these people (of the tribe of Banu Tamim) would stand firm against the Dajjaal.’ When the Saddaqat from that tribe came, the Messenger of Allaah , sallallaahu alayhi wa sallam, said, “these are the Saddaqat (charitable gifts) of our folk.” Aa’ishah had a slave girl from that tribe, and the Prophet, sallallaahu alayhi wa sallam, said to Aa’ishah, ‘manumit her as she is a descendant of Ismaa’eel, alayhis salaam.”

                Also from the Musnad of Ahmad ibn Hanbal:

                “Do not say of Banu Tamim anything but good, for indeed they are the severest of people in attacking the Dajjaal.”
                The assertion of the Hadith of Najd as referring to Iraq is further clarified through other hadith which indicate that many trials and tribulations (fitan) will arise from this region. Scholars indicate this includes the rise of the Khawarij and other deviant sects.

                Narrated by Yusair bin ‘Amr:I asked Sahl bin Hunaif, “Did you hear the Prophet saying anything about Al-Khawarij?” He said, “I heard him saying while pointing his hand towards Iraq. “There will appear in it (i.e, Iraq) some people who will recite the Quran but it will not go beyond their throats,and they will go out from (leave) Islam as an arrow darts through the game’s body.’ “

                Imam Ibn ‘Abd al-Barr (368h-463h) said:

          As far as I know there are hardly any Sinhalese willing to invest in land in Jaffna.
          There is no restriction on Muslims to buy land there despite Thesavalamai Law so where is the discrimination against Sinhalese to buy?
          If Sinhalese buy land in Jaffna there are many Tamils willing to sell at the current market price depending on vagaries of supply and demand. They are not going to sell for “Summa”.

          As a Muslim- I would tell you that there are so many areas that Muslim women suffer in this country.

          Do you know that men can divorce a woman without a reason according to our law and with only paying 3 months maintenance where as under the general law women get alimony if they divorce. Even if a woman is 65 she can be divorced without a reason. Of course the men will say that Allah’s throne shakes when a divorce take place but law allows freedom for men. They will continue to say Allah dislikes divorce but those provisions in the religion that supports women are not in the law.

          Men can get married to 4 women without any conditions. Religion says treat them equally and there is nothing in the law to find out whether they are treating equally. Quranic statements tell you that you must get married to orphans or widows but the second marriages are never that. How many married tsunami widows. Men even for the first time do not get married to widows or orphans.

          Muslims are reluctant to change our law and they do not want others doing it also. I tell these type of people either let the Muslims bring forth these anti women laws which is neither Islamic nor based on accepted human rights positions otherwise let the non Muslims come to our rescue.

          Muslims as a community do not want the rest of Sri Lanka to know what we go through. They think that it is akin to looking up and spitting or whatever. We should discuss openly about our problems and we need solutions

    In general, people marry at young age will produce more children which leads to unfair distribution of the countries limited resources and gives economical hardship to the parents as well. Once china imposed law as only one child per family, but in general civilised society strict to two per family. for srilanka’s land problem, two per family is the best option.

      Land does not grow but population grows; this is a serious problem to the world.

      So giving birth to children needs attention. At least it must be in par with development and women should be given equal right for that.

      We have to decide it through development forecasts; what’s the population we can add to the next year or decade and equally spread that number among all the women, and maximum births you can give is two in your lifetime.

      After second successful pregnancy there should be mandatory rule for all the women to undergo a surgery to stop further pregnancies.

      You may argue that it’s inhuman but you can’t help it as it’s based on the reality.

    I thought Sri Lanka has no such issue. It is happening in most of the poorer Muslim countries and the parents sold their daughters at young age to blokes (very much older) to get financial benefit. This is crime should be stopped. Further the blokes marrying four women need to be stopped.

      For Persons other than Muslims, age of marriage is 18. But there are many instances because of the age bar, the couples live together. Sometimes the girl is 16 and the boy friend is 20, but the law does not permit a marriage. They even have children and it does complicates life for these couples. It is a long process sometimes to establish the paternity which is important for legal purposes. DNA tests are not that convenient for ordinary poor folks.

      Supposing the child is below 16, and she CONSENTS for sex and the boy can be charged for rape. According to law consent to have sex by a girl less than 16 is not valid.

      I feel that we should not have a LEGAL age of marriage, but create awareness on the consequences of child marriage, encourage education. I am not approving early marriage and should not be encouraged. When it is a legal matter, it is another issue. As it is our age of marriage is increasing.

    Excellent initiative. We have to change the mind set of these backward people. What they do to little girls
    is a big crime. The little children are still underdeveloped physically, and they are not mature enough to face marriage and what it entails. What do they know of men and consummating these marriages? They should be playing with their toys, and enjoying their childhood. No parent should even consider allowing their little girls/boys to experience what adults are mature enough to face. Of course there is poverty that urges these parents to resort to this custom, but they should not conclude that giving a little child in marriage will help her in any way. She will be traumatized in many ways, and an early pregnancy is harmful to her health.
    Any man agreeing to marry a little girl should be treated like a pedophile. It is up to us to safeguard our little children. I hope we act like a civilized nation and raise the legal age for marriage. It would be good for the adults to learn the consequences of giving their helpless little girl/boy into marriage, it seems ignorance plays a big part too.

        In 1400 years customs of the people have changed. In the period in question it was a common practice for girls from ages 9 to 14 to be married in Europe,Asia, Africa And America. In 350 AD St. Augustine married a 10 year old. King Richard II married a 7 year old in 1400AD. Henry VIII married a 6yr old in 1500 AD. Church of England Ministers could marry 12 yr olds till 1929 in Britain. Catholic canon law permitted marrying 12 yr olds up to 1983. Till 1881 in the State of Delaware, the minimum marriageable age was 7 years and in California it was 12 yrs.
        Now it is well known how the Prophet was physically & verbally abused during his period of time. They called him phony, crazy, even a magician, but none of his worst enemies accused him of being a Paedophile.
        Hence to pontificate on morality of a bygone era without knowing the customs and traditions of that period is not only exposing a lack of scholarship, but also a contemptuous disregard for the judgement of intellectual giants of the caliber of Ghandi, Sarojini Naidu, Annie Besant, George Bernard Shaw, Goethe,Thomas Carlyle, and La Martine, to name a few, who all held the character of the noble Prophet of Islam in very high esteem!

          : something (such as a slave, piece of furniture, tool, etc.) that a person owns other than land or buildings.

          So, the “girl” or “bride” is a chattel, a slave.

          The current Sri Lankan Muslim Law allows for a Muslim man to marry a Muslim girl over 12 years old, yes 12 years old.

          Think about it. What 12-year old girl, a school girl who has just entered grade 7, learning science, algebra arithmetic, geography, civics etc. would like to be taken out of school away from her friends, and fucked by by an older man getting her vagina and uterus torn?

    In UK the minimum age for marriage is 16 years. In US it is 14 years. But they have to get the consent of the parents and/or judges if they are below 18.

    If you want to prevent under-18 marriages, that decision should be taken by that age group only, and not by these old bitches. Do a survey among all the boys and girls of that age group in Sri Lanka to find out whether they like to allow marriages at the age of 14-18.

    In some developed countries high school children are given free and compulsory condoms. If you want to prevent such deterioration of the culture, just reduce the minimum age of marriage.

      HIMACHAL PRADESH, India (CNN) — Amar and Kundan Singh Pundir are brothers. Younger brother Amar breaks rocks in a mine for a living. Kundan farms their small piece of inherited land. They live in a beautiful but remote hillside village in the clouds of Himachal Pradesh, India.

      Both aged in their forties, the two brothers have lived together nearly their whole lives. They are poor and share just about everything: Their home, their work and a wife.

      “See we have a tradition from the beginning to have a family of five to 10 people. Two brothers and one wife.” Kundan says.

      They practice what is known as fraternal polyandry — where the brothers of one family marry the same woman. Why? Tradition and economics

      Life is hard here. The village is precariously perched on the side of a very steep hill about 6,000ft up. Most of the villagers survive off tiny plots of cropland

      In this difficult terrain there isn’t enough land to go around. So, instead of finding separate wives and splitting up their inherited property, the brothers marry the same woman and keep their land together.

      Wife Indira Devi says life with two husbands isn’t easy.

      “We fight a lot.”

      But like any married couple they fight mostly over mundane stuff, except there are three spouses instead of two.

      “Usually it’s about chores, why didn’t you do this? Why didn’t you do that?” she says.

      One thing they agreed on was the need to have children; They have three. So how does a married trio deal with sex?

      And as to the question of which husband is the biological father of the children — the Pundir’s don’t know and don’t care.

      “For me everyone is the same, my mother and my fathers are the same. My mother and my fathers are like God to me,” 17-year old daughter Sunita Singh Pundir says.

      Even as modern society arrives in this ancient village through satellite dishes and mobile phones, the Pundirs say they want their age-old tradition to continue with their children.

      “Absolutely,” eldest son Sohna says.

      He and his younger brother have already discussed it and will marry the same woman.

      Daughter Sunita isn’t so sure.

      “I would like one husband,” she says.

      But when asked if she will marry for love or tradition, Sunita’s answer makes it clear the tradition of marrying more than one man will continue with the next generation.

        Come on my friend if the mother doesnt know who the father is then how does the child inherit? Further if you think that without confirmation of paternity a man will look after the offspring you are living in a dream world. As humans each brother will shirk his responsibility and expect the other brother to shoulder the burden of paternity thereby conserving his wealth.If the brothers fall off the situation becomes worse and the poor child is left at the mercy of the mother to care for him or her as the father is not identified.No wonder they scrapped this crazy practice as the social consequences would have been terrible and not practicable.
        At least where polygamy is concerned where a person has more than one wife paternity and maternity are sure and also the multiple wives may cooperate with one another in bringing up the children born by them and the children too can carry the fathers name so that society will not look at them with a slant. As for inheritance the father will have to divide it amongst all the children his wives bore.

          When one is brought up in that tradition, as was followed in the Up Country areas of Sri Lanka up to the British Times, and still practiced in some parts of the world, including the Himalayan regions, it is about sharing limited resources.

          Everything, including personal feelings are subservient to the tradition.

          Each man does not know who the father is, and besides they are brothers, and each man is either the father or the uncle.

          Work out the Math.

          Polyandry:

          A bunch of brothers, say 4 brothers own 8 acres of Paddy or agricultural land, which they inherited from their parents. The 4 Brothers go and get 1 wife, still work the land as before. Now one more mouth to feed. Now say there are two children, Two more moths to feed, from the same 8 acres.The original 4 brothers and parents, 6, has now increased to 9 mouths to feed. In time the Barents die, and the total mouths is 7, ot 8/7 = 1.4 acres/mouth.

          Monogamy:

          Each of the 4 bothers go and get married. Each gets 2 acres. They have 2 children, and now 2 acres have to feed 4 mouths, 0r 0.5 acres/mouth.

          Polygamy:

          Each brother gets 4 wives, and the 4 brothers get a total of 16 wives. Assume each wife gets 2 children each, and each brother has 8 children, and all 4 bother 32 children.

          Assume that the parents are dead by now,

          Now 8 acres have to feed 4 brothers, 16 wives and 32 children, 52 mouths to feed,or 8/52 = 0.15 acres/mouth.

          Primogeniture

          So, something have to give in. In Europe and many other places, Primogeniture. the Oldest Child inherited the while prophet, and all their siblings had to leave. They found new land, or immigrated, elsewhere like America etc.

          So, in Europe, Polyandry, gives a man to live survive and have a shot at producing his own off spring, in a shared manner, instead of Primogeniture, where he gets nothing.

          Tennent records that an aged chief of the Four Corales, Aranpulle Ratemahatmeya informed him in reply to an inquiry addressed to him, that the prevalence of polyandry was attributable to the fact that when the people gave their attendance at the royal palace, and at the residences of the great headmen, besides contributing labour on the lands of their lords and accompanying them in their distant journeys. “During such intervals of prolonged absence their own fields would have remained uncultivated and their crops uncut, had they not resorted to the expedient of identifying their representatives with their interests, by adopting their brothers and nearest relatives as the partners of their wives and fortunes”.

          This is supported by the studies of Prince Peter of Greece (Polyandry and the kinship group. 1955) who took into account the polyandry of the Kandyan Sinhalese, the Kerala Tiyyans and the Tibetans and concluded that there existed a greater unity and solidarity of sibling groups among those practicing fraternal polyandry. He also emphasised the economic function of polyandry which intensified this unity and solidarity.

          In conclusion, it should be stated that despite the marginal benefits if at all polyandry offers, its potential harm certainly outweighs these. Uncertainty over paternity and the resultant social disorder may be cited as some of the strongest arguments that could be brought against it in modern society. The Kandyans of yore however do not seem to have been the least concerned about it.
