Shocking Discovery Under RTI Act On Death Of Two Jaffna Students  

An enterprising effort by an investigative journalist using the Right to Information Act (RTI Act) to unearth the truth behind the killing of two University students in Jaffna as a result of the police shooting at them in October 2015 has resulted in a shocking discovery that the police explanations for the deaths were a string of lies and that particularly, the students had not been drunk, as claimed by the police.

Tharindu Jayawardene of Lankadeepa successfully applied for the post mortem reports from the Jaffna Hospital under the RTI Act which established that the police reports were false.  

The two students, 24-year-old Sundiraja Sulakshan of Kandarodai in Chunnakam who had been studying media at the Jaffna University and Nadarasa Gajan of Kilinochchi studying political science at the Jaffna University died in late 2015 after police shot them allegedly for disobeying orders to stop their motorcycle at a roadblock at the Kulappidi Junction. It transpired that Sulakshan had taken his friend for a social event the previous day had been returning on his motorcycle to drop Gajan off.   

The police had first tried to say that the deaths were due to an accident and then later claimed that the students had been drunk.  However, the post mortem report found no traces of alcohol in their systems and found also ammunition lodged in the body of the rider of the cycle, Sundiraja Sulakshan while the death of the other had been caused by a grievous fall. 

At the time, the Government Information Department declared that five policemen had been arrested in connection with the student deaths. After local protests, a special team from the Criminal Investigation Department (CID) conducted the investigation but it is not clear as to the status of the court proceedings in that connection.  The accused policemen were given bail late last year.

Trigger-happy law enforcement officers shooting anyone whom they see as errant roadusers on sight have been a major problem in Sri Lanka with several such incidents in the South as well, one being the shooting of Nawalage Kushan Thakshila Cooray (35) of Gampaha on 23rd October 2017.

No effective action has been taken either by the Inspector General of Police (IGP), the National Police Commission (NPC) which has been labeled as one of the least satisfactory independent commissions or by the Ministry of Law and Order.

    This doesn’t look like a case of police shooting errant road users. Because of the initial contradictory statements by the police and the subsequent attempts to cover up, it is pointing in the direction of the conspiracy that is being carried out by the police and military in the north to create the impression that the LTTE is raising its head again. Military intelligence set up by Gotabhaya is still working for the Rajapaksas. It is especially active in the north, staging violent incidents at regular intervals. After each such incident there’d be a huge uproar in the parliament by Rajapaksa minions, and in the rogue media and by the racist monks. In this manner inflammatory conspiracy theories about LTTE’s return are being spread in the south whipping up anti-Tamil racism in order to bring the Rajapaksas back to power. People in the north have lost all faith in the government and dark clouds seem to be gathering again. It is disgusting to see political parties trying to use the Tamil people as pawns once again in their greed for power.

          Five students in Trinco were killed by STF on the order of the then SP Kapila Jayasekera. Unfortunately for police, the brave Sinhala DMO gave the correct finding of gun shot wounds. Tamil journalist who was present at the post mortem examination and brought out the truth was later killed by armed forces.

          French aid workers in Mutur all Tamils except one Muslim were killed by Army and Muslim home guards. One Tamil employee who witnessed it had managed to escape and is resident in Australia. Once Basil Rajapakse had told whether there is a possibility in killing him through a fake traffic accident.

    This is not shocking. I think that many of us knew that the Police can be a law unto themselves, especially when they feel secure in the knowledge that nothing gets investigated properly if the victim is from a “despised group”. Add to that My3’s statments that all soldiers are heroes, and that, a priori, any action taken against “enemies of the State” should remain uninvestigated: this is what you get.

    What is amazing is the work done by “Tharindu Jayawardene of Lankadeepa” . This is what we so badly need in this country. Investigation and Justice, irrespective of who the perpetrators are – and who the victims are.

          If I may indulge in some practical criticism, let me salute Sandy for the first comment – but how sentimental and inadequate. This story is so bad that there’s little point using wishy-washy emotive words.

              Please note Provincial Councils can pass any number of resolutions, declare war on the centre, however they cannot enforce their resolution if Centre does not agree.
              On the other hand Wimal Weerawansa could enforce everything he demands its only a matter of time. Wait until Gota’s come back.

        Now look at the AG office through which all criminal proceedings take place.
        “Revelations in open court by the head of the Criminal Investigation Department (CID) about how a high ranking official in the Attorney General’s Department had interfered in a probe led by his men into the abductions of 11 Tamil youth in 2008, allegedly by Sri Lanka Navy personnel, sent shock-waves through the legal community this week.
        In open court last Tuesday (31), CID Director SSP Shani Abeysekera alleged that the lawyer now appearing for the navy suspects arrested in connection with the case, also appeared to represent the suspects instead of the CID or the aggrieved parties even when he served as a senior official at the AG’s Department.”

        This is the same with Rajvirs case, the AG’office made sure that no jury would find them guilty. All these cases are only an international show.

        The AG’s office and the courts including top ranking judges have to be sent on compulsory leave if justice is to be served. Without that don’t waste money Lasantha or Thajuden’s family are never going to see justice. Tamils will never see justice without international involvement. Sri Lnka is not going to see a cent of thee billions stolen during the last regime.

      However, what cannot be denied is that “there has been a long history of systematic killing of Tamils by the Sri Lankan State.”
      .
      Start counting from the ’56 riots and the periodic racial riots orchestrated by the State up where the State did systematic killing of Tamils quite openly, up until ’83..
      .
      Since then, and especially under Gota, the killings by the State continued to remain systematic, but hidden to public eye via White van and other grotesque means.
      .
      Though Sinhala people may not be directly responsible, they do need to take some responsibility for repeatedly and unmistakably electing “a regime worse than the one before” in as far as the Tamil killings go.

          I will also admit that there are scores of you who share identical sentiments. It is the Tamil arrogance that we failed to harness such goodwill of the large number of moderate, humane and sympathetic Sinhalese. Instead we shunned all Sinhalese as evil, stupidly confident we could solve our problem all by ourselves, armed or otherwise!

          The Blacks in the US would not have seen the light of day if they similarly shunned all Whites and took to arms in their struggle – It was indeed the enlightened White youth who joined and then led in the massive political tsunami to bring the Black’s struggle to its victorious resolution.

          Having said that, I think the need of the hour is not regrets, guilt, shame and head-hanging. Why are the well-meaning Sinhalese still incapable of or ineffective to at least begin a reversal of the racial rot? That responsibility is mostly up to the majority, and I fervently hope the Tamils will this time intelligently and in humility embrace the sincerity of the well-meaning majority among the majority!

          If you, the well-meaning Sinhalese concede that the country is not being just to all citizens, why is it not the responsibility of all citizens, especially the majority, to “howl and protest?” Why should it be just for the Tamils protest?

          With your prescription, you are sending the wrong message to the politicians – that Tamils are on their own, if they are to struggle towards justice. Politicians are molded (adopt themselves) by the message the majority voters send. Our politicians have increasingly fashioned their policies with worsening racial bias (remember JR’s “the harder I kick” statement) because of the sentiments sent to them by the louder section of the voters. A cause-and-effect situation, if you will. So, blame the “loud extremists” as well as the “silent majority” for how the politics have evolved in this once-pearl-of-the-orient nation – the “extremists” for their loud support of racism, and the “silent majority” for their silence and inaction, if not cowardice (recognizing unfairness, but not acting on it).

          Therefore, your prescription should be to the majority, moderate Sinhalese to “howl and protest”. That alone can reform the politicians towards their aspiration to get elected next time.

              However, I am truly disappointed in your position that you as a majority will not take the lead responsibility to reform the politicians so that you will not have to hang your head in shame in the future! What message is the majority then sending to the politicians?

    Tharindu J is most probably under threat due to his investigation/revelation.

    Police have been killing people in custody for many years and none have been investigated fully, or, at all. All know this.
    This type of sporadic killings too happen occasionally. There was the police shooting death of a man seated on top of a lorryful of sand which was suspected to be illegally obtained.

    The police and army have ‘enjoyed’ impunity for a long time. Sri Lanka has become a “police state” – but no one talks about it.

    There are many more to follow at least until this RTI is smothered.
    At the time this happened the NP Governor saw to it those who preformed the post-mortem were gagged.
    In the Thajudeen case this was difficult and so SAITM was commandeered.

    Police may be prosecuted for writing false reports. Other than that, They by any means can not be successfully prosecuted for shooting at the students. It is the RIGHT TO SELF DEFENCE OF POLICE IN A VERY HOSTILE AREA PARTICULAR TO VERY HOSTILE FOR POLICE AND SOMETIMES TO STF, ARMY AND NAVY. IF INVESTIGATED TWO STUDENTS SHOULD BE BRAIN WASHED BY POLITICAL EXTREMISTS. [edited out]

    The abuse of fire-power is terrible. What I have said before in comments is that with the change from Jan 8, 2015, Sri Lanka was converted from a Military State to a Police State. Jaffna may have its own problems on law enforcement but trigger happy thugs only makes things worse than solving it. In the specific issue of the death of these two students, wasn’t there an inquiry on their deaths, say by a coroner or a magistrate, as it happened on the road? If so, what was the finding of that inquiry? Further, wasn’t this report on the autopsy produced at the judicial inquiry? Wasn’t any discrepancy detected at the inquiry? This is the vital part of the whole story.

      The truth comes from a Sinhalese Journalist while all the politicians including Tamil politicians keep silence on the brutality of the police. It is nothing new for Srilanka since 1948. The reality is that Srilankans are not capable of producing a good leader who can govern the nation for the people. No other country in the world suffered like Srilanka continuously for the seven decades under Srilankan rule. We cover up everything in the name of Buddhism. Majority of the people whether the Sinhalese or Tamils or Muslims do not understand the real motive of our politicians. They come from very richest and educated in western countries and established their life in very developed nations while doing their politics in Srilanka. None of them suffer. Only ordinary Srilankans suffer. They create an image that they are patriots of this land. Sinhalese made to think that Tamils and Muslims are enemies and our politicans are to save them. If you look at the fact do you know why thousands of Sinhalese murdered in 1970s and 1989-90. How many Sinhalese youth who joined the military lost their lifes and how many became disabled? How many children of our politicians died in the war or riots? Can you count the numbers. It is zero. When will this country become a land for ordinary people? When will the peace come? Some people claimed they won the war? If that is true how come you say now LTTE is there? Alquida is there? Do we want another war? Who will be benefitted? Think! Think!

He is doing the “Globe Trotting” with his other brother “Namal Baby” and now they are in Russia. For “WHAT” and on “WHAT BUSINESS”?       Is it true British Foreign Office has destroyed 200 files relating MI5’s activities in Sri Lanka and on LTTE covering the period 1978 to mid 1980?

      You should demand to see the files. The Brits overtly and covertly supported Sri Lanka’s state though it knew all the human rights abuses and war crimes committed by successive government.

      You know the usual suspects need to see the files for themselves as to how these countries helped Sri Lanka the failed state perpetrating state terrorism.         The files were destroyed already but other agencies like MoD may have copies if they were involved.

          So none of the Tamil has the b***ls to retrieve it from British authorities. I was told at one of the rally in 2009 about 300,000 Tamils gathered in London to protest against the war. Can’t you get all of them to protest against Brits?

            I am a key board protestor and unable to organize others. If I remember correctly anybody can make Freeedom of Information request in the UK but it can be expensive. Somebody should ask what British MoD knows about Sri Lanka, for instance, the role of SAS.

    What the RTI unravelled were specific cases.
    In 2009, some anguished parents met Gota and pleaded for death certificates of their near and dear who were very very dead (killed).
    Gota said “Bring the bodies”.
    We knew what happened to other disappeareds!
