Sirisena And Rajapaksa Import Brand New Jeeps Using MP Duty Free Permits

Both President Maithripala Sirisena and former President and Kurunegala district MP Mahinda Rajapaksa have imported brand new jeeps using MP Duty Free Permits.

President Sirisena has imported a brand new Toyota Land Cruiser on 14th October 2016 for USD 62.500. According to the custom’s declaration form the total tax waived off for Sirisena’s vehicle is Rs 33,457,500.00.

Former President Rajapaksa has imported a brand new Toyota Diesel Station Wagon on 19th September 2016 for AUD 82,203.70. The total tax waived off for Mahinda Rajapaksa’s vehicle is Rs 33,457,500.00.

Meanwhile, Rights Activist Nagananda Kodituwakku has said that the country has been defrauded at least 7 billion rupees in tax revenue due to the abuse of the tax-free car permits given to the MPs.

In a letter to President Maithripala Sirisena, Kodituwakku has also once again challenged the credibility and integrity of the former Director General of the CIABOC, Dilruksh Wickramasinghe and has once again accused her of abusing office of the Director General of CIABOC to confer benefits and favours to MPs.

The activist said that from the citizens viewpoint, this is a very important case about the betrayal of their sovereign rights by all three organs of the government that exercise people’s sovereign rights purely on the trust placed in them (Article 4 of the Constitution), misuse or overstep of which tantamount to the breakdown of the rule of law and blatant disregard of the norm of representative democracy.

The activist also draws the attention of the President Sirisena to observe that the absence of accountability process in the exercise of people’s sovereign rights by the organs of the government has already come under scrutiny by the United Nations Human Rights Council, compelling the Government of Sri Lanka to concede that the people have no trust and confidence in the administration of justice system, persuading it to co-sponsor the Resolution (A/HRC/RES/30/1) passed on 01st Oct 2015 in Geneva, Switzerland.

Providing the information inside out about this scam involving the MPs and Cabinet of Ministers, (including an up to date schedule of vehicles imported tax-free) the activist urges the President Sirisena to discharge the office as per his Constitutional Oath and in terms of Article 33 (1)(c) of the Constitution, ensuring proper functioning of the CIABOC, by appointing an independent person with high degree of integrity to the office of the Director General of the CIABOC with clear mandate given to initiate Criminal proceedings in terms of Section 70 of the Bribery Act against all individuals holding office as MPs and the Cabinet of Ministers, including the former Director General of CIABOC Dilrukshi Dias Wickramasinghe for abusing the office held for public good but misused the office to confer benefits or favours for themselves or others causing tremendous revenue loss to the government.

Kodituwakku also urges the President to initiate legal action against all dishonest MPs and Cabinet of Ministers to recover the entirety of the statutory levies defrauded concerning the sale of tax-free car permits to those who are not entitled to use this privilege.

    Entrepreneurs, businessmen and the like who keep the wheels of economy moving and the state coffers filled with the contribution of taxes don’t get any state benefit let a lone duty free vehicles but those who bleed us dry in the state sector get duty free vehicles, foreign scholarships, govt housing, free meals (parliament), state tamashas, etc.

    The University students get free education.

    There is no equality in the country. If everybody pays tax, pays duty for cars, and pay for there education. Life will be more simpler. here the previlage class wants to piggy back on the common man .who pays taxes,pays duty, pays for the childrens education.

    Whether they are in ‘Yahapalanaya’ or Yamapalanaya’, politician are parasites thriving on tax payers. Anyway, it is not fair to expect the President to go around in a ‘Bakki Karaththaya’ after 2020.

    An article appeared in Colombo Page on March 26, 2017 under the heading “Sri Lankan government removes duty imposed on items brought by migrant workers” reported that “…the Customs has decided to give more benefits to the Sri Lankans who are returning after working in overseas. He said that they can bring a bathroom set, a bedroom suite and a motorcycle below the capacity of 350 CC, tax free. They will also be able to bring solar panels, computers, laptops and two mobile phones. The migrant workers can also purchase television sets less than 55 inches duty free.”

    The irony is some who do not earn even a single Dollar to the country are entitled to a duty free allowance of US$ 60,000.00 to import a luxury vehicle but the people who have shed their sweat to earn foreign currency to the country cannot even have the luxury to watch TV in a duty free 55 inch TV. They also should ride in motor cycles, not even in a duty free car less than 1000cc.

    When I decide to return to Sri Lanka, I found that the car prices are very high and checked whether I could bring the 15 year old car I used as a single owner which was in very good condition. I was told that cars older than 10 years are not allowed. However, the person in the Department of Import and Export told me that even if I am allowed to bring the car I have to pay duty. He was so kind enough to contact a person in the customs and told me that I will have to pay Rs. 1.3 million as duty. I thought ‘Go to Hell’. Now I am going around in Three Wheelers. God save our politicians from getting struck by lightning.

      I, too, am an expatriate, & was thinking of bringing my now 6 year old car to SL upon my pending retirement. I have been living abroad for over 25 years & being a car enthusiast, had the privilege of buying a new car every 5 years as it is affordable & more expensive to maintain an older vehicle. However, since I began to plan my retirement & returning to SL to spend my final years among friends & family, I saved for a couple of years to buy the car of my dreams, hoping to bring it to SL as it would last me for the rest of my motoring days. It cost me £28000 brand new & is not considered an expensive car but an ‘Executive’ model of a popular European brand, famed for its quality, reliability & driving pleasure. At that time, the Rajapakse regime was in power & there was even speculation that some duty concessions would be given to returning expatriates on their used household goods & older vehicle brought down for personal use.

      Unfortunately, with the change of Govt., Ravi K, in his infinite wisdom, changed the duty structure for vehicles to a blanket valuation based on the engine size multiplied by Rs 550,000 but worst is, there is no depreciating factor in the valuation for an older car, therefore, though an expatriate is allowed bring his personal vehicle (provided it is under 10 years old & had owned it for 3 years), the duty for the old car & a brand new car is the same.
      Accordingly, I will have to pay almost Rs 11m as duty for a 6 year old car with an engine capacity of 1.9 liters. If I remember correctly, Ravi K has apparently stated that he is the only qualified person ever to hold the position of Finance Minister in SL but though I am not a financial expert, to my knowledge, any asset is depreciated for general tax purposes (apart from land which are considered to appreciate in value, therefore, revalued according to market demand).

      I will only get less than 1/3 the price I paid for my car, even though it has a low mileage & is in very good condition, because of it’s age but with that money, I will be lucky to find even a used Asian car in SL. If I am to buy a car in SL now, it would be, in principal, a drain in much needed FOREX reserves of the country, which would have been saved if I was able to bring my car I had bought with earnings abroad. Either Ravi K is dumb or has bowed down to the franchise car dealer cartel in SL who wants to monopolize their brands by discouraging ‘gray’ imports.

      It is time the duty concessions are abolished & a fair, affordable import duty system is established for everybody.

        I will tell you my similar experience. On my retirement a five years ago, I applied to bring my 9 year old one owner used car to srilanka so that it will be useful in my final days. Car was only worth £4000.00 in the U.K. In spite of declaring that I was repatriating after 32 years, the customs officers insisted that I pay a duty of 100% of their estimated value of the car which was 2.4 million! I had no option but to pay that for a 9years old one owner used car of my own. That is what they do to us general public while these fraudulent politicians rob the coffers of the country while wearing their white sarongs and tops pretending to be such pious Buddhists.

    How can one ask MPs not to import luxury vehicles when their own leaders President Sirisena and former President Mahinda Rajapakse have imported similar vehicles utilizing their duty free permits?

    Pupils follow their teachers or even exceed the teachers. That is what is happening to the Sri Lankan MPs. In this case I am reminded of a Sinhala saying which I heard from one of my former Sinhala journalist colleagues, the translation of which is “when the teacher stands and urinate the pupils will run about and urinate”. That is an apt description of what Sirisena and Mahinda did in relation to luxury car imports and what their MPs are doing now.

    Your revelation has opened our eyes. We have to beware of these cheeky politicians and make sure not one of this lot are elected again.
    We, should team ourselves into a party or caucus and run for public office with a clear agenda and a clean constitution. I am certain we will be able to rally a large portion of the electorate to safely win elections ousting these greedy lot presently representing us.
    Please give this idea a bit of thought.

    I am ready to sacrifice my British citizenship and even to contest for the Executive Presidency. But I should see genuine interest in the people to restore rule of law in this country and deal with all cheats belongs to every political party responsible for robbing the Nation strictly according to the rule of law.

    I am fully aware that people of this island nation is suffering due to the total ignorance of the leaned people who do wish to remain in silence permitting cheats to destroy the nation. It is truly sad but that is the truth and believe you will agree.

    I honestly believe that if we can organize a team of about 12 people with total commitment, very high degree of integrity and selflessness we can easily bring about a complete change, navigate the nation in the right direction. With a firm policy to deny politicians any form of perks including salaries, pensions, liquor shops, tax-free car permits and other perks now being offered to these people.

    In my view this country need not have 225 people in the Parliament, 125 member can represent the whole nation, particularly considering the poor state of the economy which cannot afford to maintain such a large number at public expense. The number of Cabinet of Ministers shall not exceed 12 not over 100 by any means as at present, which has become a bane to the national economy.

    The Parliament shall return to the old building and the building it currently occupy can be used of some other purpose like setting of a class university for the cream of those student qualify for university entrance.

    If MPs cannot move with the general public such people should find a place elsewhere and in the Parliament. If we can do that no cheat will attempt come to politics when they can gain nothing in politics.

      I had a look at your previous essay on your proposals for constitutional reforms.

      Most of these relate to judiciary and rule of law. You may have excellent constitutional provisions but they have to be implemented in their true spirits.

      Now look at the 19th amendment. Under this provision, an independent body was appointed to make recommendations for the appointments of higher officials like the Police Chief and Attorney-General. Regrettably in the end those who were appointed happened to be the favorites of the ruling party like the present IGP.

      So long as the elected Members of Parliament and the members of the government are crooked, nothing will change. They will continue to rule the country in their crooked ways.

      In 2008, people voted against Rajapakse who was perceived as autocratic and corrupt. They elected Sirisena and later his UNP led Yahapalanaya government. Did anything change?

      These new guys replaced Rajapakse and his cohorts but they are continuing on the same path. Sirisena and Ranil accused Rajapakse of mortgaging the country to China. But Ranil is now hell bent on selling the country to the very same China.Tomorrow Hambantota port and Mattala airport will be Chinese owned, China will have a Hong Kong in the form of Colombo port city and China will have sovereignty over thousands of acres of land in the Hambantota region.

      Take the case of the Central Bank robbery under the yahapalanaya government. This Singaporean Arjuna Mahendran and his son-in-law could not be touched whatever commissions Sirisena may set up so long as Ranil is on the side of Mahendran. Arjuna Mahendran’s son-in-law is setting up distilleries and media outlets from the monies he earned from the bond deals. Ranil has opened up all gates for his friends to exploit the wealth of Sri Lanka.

      That is the sad state of affairs in Sri Lanka.

      Nagananda, I know you mean good and have good intentions. But, your good intentions will not work and Sri Lanka will remain the most corrupt country in this part of the world. The problems of the Tamils will remain and the communal divide will continue giving way to another armed Tamil rebellion.

      I am not an aspiring politician nor have I any interest in politics but I am willing to support you all the way to put an end to injustice & corruption in SL.

      Although it is not a bed of roses, I consider my self fortunate to live in a developed country & feel so sorry for my friends in SL who have to undergo so much hardships to educate their children, the relative high cost of living & expensive healthcare whilst accepting the corruption & injustice of the politicians, their cronies & a few selfish state bureaucrats & trade unionists who, ironically, have been educated at the expense of the tax payers.

      Although I had plans to take early retirement & return to SL to spend my final stage in life among friends & family in reasonable comfort, I now think it is better to be where I am, even if I maybe considered a third class citizen. At least, I can expect justice & fair play with the state to look after me in my old age, in a country where I can complain to my MP of wrong doings & expect results & get matters sorted out by telephone without leaving the house, unlike in SL, where it is a hassle, even to get a simple thing done.

In any case every political party promise things…but once they come to power total opposite happens…so we need a totally new set of politicians we ho are not given perks….come to parliament n ho to the electorate’s using ones own vehicles or take public transport…..IF Late Mr.Dahanayaka could come by train from Galle why can’t others…..

      considering it’s past history especially on the National Question and about it’s development policies for resurrecting the country’ s economic development.
      So don’t blame the electorate for it’s lack of confidence of the JVP’s own deficiencies as it has yet to do more to erase memories of it’s past infantile adventurism that still haunts the minds of the island’s people.

        It was the JVP which wanted Mr: Kadirgamar appointed as the PM when Chandrika was in power. hat more does one want of the JVP’s stance on the national question, I will not blame you since the super majority only read the capitalist news spread., read the Lanka newspaper whenever possible to know the stance of the JVP.           Yes that the JVP desired to have Mr. Kadirgamar as PM during Chandrika’s Presidential tenure may be correct, but what else did it do to ensure it happens.
          Wishing and desiring is not enough in real politics. Striving to achieve the goal is important. At that time even Wimal Weeraya too was in the JVP. firing on all cylinders.

          JVP’s hypocrisy and closet racism is well known and well recorded.

          JVP opposed Indo Lanka pact, 13th Amendment, all things Provincial Councils …. however contested elections and enjoys all perks.

          Prior to 1988 JVP never fought to give Tamil equal status or make another official/national language. By overtly opposing 13th Amendment it opposed equal status to Tamil language.

          JVP together with JHU fought to de-merge North East. They worked very hard, along with MR and Sarath de Silva. I was told the Tamil lawyers were never allowed to state their side of the case/arguments. JVP never took issue with Sarath de Silva.

          JVP was a key ally of MR which supported the war despite innocent people were being killed.

          JVP’s position is unclear, may be sitting on the fence waiting for the appropriate time to chose the side which would massively beneficial to the party. For the time being they are opposed to foreign intervention in domestic judiciary. What is the alternative, well they are opposed to foreign intervention. What is the alternative, well they are ………

    Dear Readers,
    It has been proved over decades that SL was not fortunate enough to have a single Stateman since independence but generations of politicians who visibly became worst in their behaviour and money making over the years. Imagine that 94 out 225 of the present idiots in the Parliament have not got through their GCE O Levels. These are the idiots who are deciding what is good for this country and the people.Among them are gold chain snatchers,drug and alcohol dealers, thugs and other criminals.
    No amount of weeping will help us unless the people (voter)decide that enough is enough and chase the whole lot out at the next election. Lets organize a common people’s front and get ready. There got to be a revolution in this country. Not an uprising with arms or other form of force but a revolution to change our own thinking and attitudes.

      In Sri Lanka being educated does not make a politician better. JR Jayawardene was highly educated in British universities and he was one of the worst leaders SL ever had.

    Dear John,
    JR never went to British Unies. There were certain marked failures of JR but on the whole they were superior leaders as far as knowledge, experience honesty discipline simplicity and many other things are concerned. I am not a follower of JR but the truth got to be acknowledged. Similarly here were other politicians like Bandaranaikes, Gunwardhanas who lost their wealth by going to do politics. Can you name a single politician who has lost his inherited or earned wealth due to engaging in politics at present? JVP and Tamil parties may have a few who have not amassed wealth through politics. But on the whole all are corrupt in one way or the other.Some earn and some help others to earn like in the case of the infamous Bond Issue. All are conning and playing politics while people particularly the marginalized are finding extremely difficult to meet ends.
    Its high time the people take serious note of what is happening.
