Sri Lanka: A Haunted Nation – The Social Underpinnings Of Communal Violence– Part 7

During the 6th Amendment debate in Par- liament on 4th August 1983, Lalith Athulathmudali told the House: “The time has come for the misguided youth in the North to lay down arms. We will not stop at enacting laws. We will use every weapon at our command to eradi- cate terrorism.”

Athulathmudali, an intelligent man, must have known that it was a most inappropriate message to the Tamils just after his Government had given them a good thrashing. Indeed, refugee youth from Colombo were just then, in Jaffna, joining the several militant groups. The rhetoric was part of Athulathmudali’s bid for power. By this time India had given notice of its interest in the problem and prevented the Gov- ernment from going much further then in marginalising the Tamils. India then sent its envoy G. Parthasarathy in a bid to hammer out a political solution. While talking to India which was mediating between the TULF and the Gov- ernment on the one hand, Jayewardene had also tied his hands with the extremism he had un- loosed in July. Jayewardene was in New Delhi that November for the Commonwealth leaders’ summit. Some TULF leaders went to him with the Annexure C proposals for a settlement worked out with Parthasarathy. Mr. R. Sampanthan recalls being surprised by Jayewardene’s attitude. He did not read it, but merely asked, “Where do I sign?” The impression given was that he was not serious.

There was a good deal of belligerence in the air. Lalith Athulathmudali was made in addi- tion Minister for National Security in March 1984. It was a high profile job and, in private, he was frank about his presidential ambitions. It was make or break for him and, for the estab- lishment as a whole, the lives of ordinary people that would be sacrificed were immaterial. Break- ing up any vestiges of a Tamil Homeland had become an obsession. Athulathmudali was widely quoted as wanting to deal with the Tamil problem by settling the likes of Sinhalese ex-convicts and fishermen in their midst, a move that was bound to place innocent civilians on both sides in great peril. This is where the Joint Ser- vices Special Operations and the Mahaveli Authority came into the picture. The JOSSOP’s areas of operation were precisely those districts with projects coming under the Mahaveli Plan and, on paper, meant to receive Mahaveli water after the construction of the NCP (North Central Province) canal. The latter had for all practical purposes been abandoned. Yet, the Mahaveli Authority was vested with the legal right to take over land in project areas which would never receive Mahaveli River water!

The settlements to be so established were of a military nature without economic value. The idea itself was reflected in the last speech Athulathmudali made in Parliament just before the July 1983 holocaust: “In those days it used to be said that there was a Tamil majority in the North. But now it is different. The time has come that the majority of Tamils live among the Sinhalese.”

Scholars and the Tamil Homeland 

W ith India pressing for greater autonomy for the two provinces (then Northern and Eastern) with a Tamil-speaking majority, those vested with the task of demoli- tion also found that a scholarly counterpart would come in useful. It is here that G.H. Peiris, professor of geography, and K.M. de Silva, professor of history, both of the University of Peradeniya and the ICES (International Centre for Ethnic Studies), Kandy, came in. The paper, ‘An Appraisal of the Concept of a Traditional Tamil Homeland in Sri Lanka’, was presented by Peiris at an ICES workshop in August 1985.

What G.H. Peiris did roughly was to plot on the map of the Eastern Province its villages, as given in the 1921 Census. These were given dif- ferent markings according to ethnicity. It was a time when the Sinhalese formed 5% of the popu- lation of the Eastern Province. He then says “…. In 1921, almost all Tamil settlements were confined to a coastal strip barely extending even 10 miles to the interior. The Sinhalese settlements on the other hand, though comparatively few in number, were scattered over extensive areas of the interior.” He then argued that this state of affairs was the cul- mination of a long drawn out historical process featuring “territorial advances of the Tamil population on the one hand and, on the other, retreat and recession of the Sinhalese population.” In conclusion, he says,”… the interior, at least, of the eastern parts of the island… remained throughout a traditional homeland of the Sinhalese peasantry.”

K.M. de Silva presented “The ‘Traditional Homelands’ of the Tamils of Sri Lanka: A Historical Appraisal” at an ICES co-sponsored workshop in July 1987. He concentrated on challenging the credibility of the Tamil Homeland claim – that the North-East had been a Tamil political entity since ancient times. This job of demolition is as easy as demolishing parallel myths among Sinhalese nationalists, which K.M. de Silva did not touch. He moreover, treated the Tamil myths in isolation from myths propagated as state ideol- ogy and the supervening questions of conflict, violence and the use of state power. This was questionable in a responsible academic histo- rian.

In conclusion, de Silva, commending G.H. Peiris and in complete agreement with him, elo- quently supports the policy of state-sponsored colonisation. He says, “Indeed, these [Sinhalese settlements in the interior of the Eastern Province] had survived several centuries of war and invasion, of pestilence and privation, and ravages of nature in the form of droughts, floods and cyclones, till they were … revitalised as peasant colonies.” (For a discussion of the papers and correspondence, see the Counterpoint November 1994 – June 1995.)

The conclusions of the scholars are based on reasoning that is elementarily flawed. Suppose a state of things (or place) A can be reached by process (or route) P, among many (more than one) processes (or routes), it is then wrong to infer that A implies P (or that a traveller arriv- ing at A had necessarily travelled by route P). Peiris’ reasoning paints a picture of Sinhalese who were from ancient times populous in the area retreating into the inhospitable western jungles in the face of a Tamil advance from the coast.

Against this most unlikely picture, history does not speak of such enmity and conspiracy. Those were times when people wore their lin- guistic and religious allegiances lightly and caste was rather the dividing line in South Asia as a whole. Indeed, the Tamils of the region owed allegiance to the King of Kandy with no hard feelings.

The truth is quite something else. Folk tradition with available Dutch and British records of demographic changes (see Counterpoint above), point to the general movement of Kandyan Sinhalese into the East following the devastation resulting from the suppression of the Kandyan rebellion of 1818 by the British and their Kandyan allies. The true nature of the tragedy of the Kandyan Sinhalese victims is being shifted onto the Tamils by playing tricks with the 1921 Census. The interior of the Eastern Province, the jungles of Bintenne, was in earlier times (vide Robert Knox) regarded disease-prone and inhospitable, and mainly served exiles either on punishment or fleeing from civil unrest. The other inhabitants were the aboriginal Veddahs.

Contrary to K.M. de Silva’s claim that these Sinhalese villages (of exiles from the 1818 rebel- lion) were revitalised by colonisation projects, they were rather marginalised. They were swamped by recent state-aided colonisation and politicians take little notice of them since they have, by comparison, few votes to offer. It is the common plight of all earlier inhabitants irrespec- tive of ethnicity. The importance of these older Sinhalese villages arises only as figures on pa- per, which are useful in polemics. Occasionally one aspect of their tragedy gets publicity. This is when the LTTE attacks their isolated villages and massacres innocents. That too was partly the result of the thrust of military backed de- mographic transformation, in which politicians, administrators and scholars close to the ruling interests, all played a role.

    TULF went to JRJ to get an endorsement of a “Tamil Homeland” ? On what basis?

    Only 47% from North and East voted for Tamil Eelam in 1977 isnt it really? In fact the east has never been fully part of this palava. Isn’t that the inconvenient truth one learns after Karuna broke away just before the final battle?

      One gets perplexed with these exercises. We’ve gone through these processes of who was where and when and how but neither side budges from their positions.obviously both can’t be right. both can’t be wrong.

      My take is that until extremists buddhist began making issues out of every damned thing in this country, the Sihalese were quite satisfied with having a slew of Tamil kings lording it over them in Kandy. Even their queens were from India.. and pretty fetching I presume.To me, all this talk abouta pure Sinhala race is just Balderdash.         You raise some interesting points there.

        However, all I said was there is no mandate for the political stance popularly known as “Voddokodai resolution” .

        This makes everything that flowed from it ILLEGAL. Do you feel what I am trying to say here? Its that simple really.

          What happened after independence in 1948:

          Ceylon was granted independence in 1948 under the Soulbury Constitution which conformed to the well established constitutional principles of separation of powers and rule of law. The inhabitants of the island through their representatives had agreed unanimously on this constitution for governing the island. This constitution made the island a unitary state and the minority communities agreed to this structure on account of Article 29 of the constitution which prohibited discrimination.

          However, the Sinhala majority soon began to pass discriminatory legislation such as the Official Languages Act. Matters came to a head in an unrelated case that arose in 1964 – the Bribery Commissioner v Ranasinghe which reached the Privy Council. Analysing the law making powers of Parliament as contained in Article 29 their Lordships of the Judicial Committee of the Privy Council stated that “Article 29 represents the solemn balance of rights between the citizens of Ceylon, the fundamental conditions on which they accepted the constitution and these are unalterable under the constitution”. So Article 29 cannot be amended even with a two-third majority in the House of Representatives. Thus all discriminatory legislation including the Official Language Act were invalid.

          The only way open to the Sinhala majority to get rid of Article 29 was to get rid of the whole constitution using a two-third majority in the House of Representatives and then draw up a new constitution that allowed discrimination. All Sinhala political parties were united in this aim. The SLFP-LSSP-CP alliance led by Srimavo Bandaranaike campaigned for the 1970 general election asking the Singhalese people to give them this two-third majority needed to abolish the Soulbury constitution. The general election gave them a landslide victory and they secured the two-third majority.

          Srimavo then went about dismantling democracy in Ceylon. First the upper house (Senate) was abolished. then the right of appeal to the Privy Council was abolished. The government declared that all elected members of the House of Representatives were concurrently members of a parallel body called the “Constitutional Assembly” and went about drafting a new constitution. The Federal Party initially attended the Assembly but when their suggested amendments to protect the Tamils were rejected they walked out. So the constitutional procedure was a sham.

          The draft produced by the Sinhala MPs ignoring Tamil rights was not then put to a constitutional referendum which would have resulted in all he Tamils totally rejecting it. The draft was produced and approved by the Sinhala MPs in the House of Representatives which is nonsense. It is the people who are sovereign, not parliament which is only an elected body. So the draft has no legal status until it has been validated by the people in a constitutional referendum. It is not even an approved draft because the Tamils MPs did not approve it. In 1977 the UNP alliance won a two-third majority and similar constitutional nonsense was repeated by the newly elected Sinhala MPs producing a new draft. ……………

          JR had had prior briefings on what was agreed upon with Parathasarathy and Gamini had a copy of the draft. There was nothing else for him to do except ask “where do I sign”. Sampanthan’s surprise was that he did not know the extent to which Delhi had twisted JR’s arm…a comparatively naive Sampanthan to the man we know today. For how long did JR read the fie print in the Indo-Lanka Accord and 13A before he signed them ? He had read each page in draft form well ahead of the signing. He could have as well asked Gandhi too ” where do I sign” [ that man makes me puke, what a bloody political upstart !]

          All I will say at the moment is that a quiet man on the sidelines at that time, Mahinda Rajapaksa, saw the ignominies in which Sri Lanka was compelled to waLlow in at that time PURELY BECAUSE WE HAD NO POWER OF ANY SORT, AND WERE VIRTUALLY DRAGGED WITH NARY A KICK OR GRUNT, TO THE NEGOTIATIONS TABLES, SIGNING ANY AND EVRRYTHING PLACED ONA TABLE BEFORE OUR LEADERS.

          THEREIN LIES THE RATIONALE FOR MR’S FOREIGN POLICY OPTIONS AND THE DECISION TO BE cHINA’S RUNNING MATE IN REGIONAL POWER MANEUVRES AND MANIPULATIONS. AND NO ONE HAS ACTED AS TOUGH WITH COLOMBO BEYOND A DEGREE POST SINO-lANKA NEXUS.tHAT IS EXACTLY WHY WE SEE BIG C’WEALTH NAMES ATTENDING CHOGM TOO.       I praise JR for what he did in Jaffna library and July 1983.

      Just imagine it had not happened? Then Tamils would have taken control of SL.

      Sometimes you have to do a few bad things to achieve a lot of good.

      JR for his meritorious acts lived a long life and died peacefully. May the greatest SL leader rest in peace. May SL have more leaders more frequently like Hon JR.

    Rajan Hoole,

    Todays Eastern province was part of the Kandyan Kingdom when the British arrived and prior to that it was part of the Ruhunu rata when Sri lanka had three kingdoms, Ruhunu, Maya and Pihiti.

    It would be highly appreciative if you can write an article giving historical details to prove Eastern province is the Tamil homeland and needs merging with the north permanently. Though you have briefly challenged KM De Silva and GH Peries your arguments lack details and is not at all challenging the arguments put forward by GH Peries and KM De Silva.

      I will put out of your misery and tell you why we Tamils have a Stronger claim to the Eastern Province.

      Ancient period[edit]

      Evidence of a settlement of people with burial practices similar to that found in the Tamil Nadu region in India and further North was excavated at megalithic burial sites at Pomparippu in the western coast and in Kathiraveli in the eastern coast. These are dated between 2nd century BC and 2nd century AD.[6] Although it is not known when ethnic Tamils first settled in Sri Lanka. Tamil royal dynasties in this period are known to have patronized Tamil Saivite culture in the east that paralleled the growth of the community in the area, and by the 6th century, a special coastal route by boat was functioning to the Koneswaram temple of Trincomalee and Thirukkovil temple of Batticaloa. It wasn’t until the 13th century that there was firm evidence of the rise of a significant Tamil Hindu social formation in the Jaffna Peninsula, complete with a Hindu king and a palace, in the aftermath of the collapse of the classical Sinhala Dry Zone civilisations.[7] By the 11th and 12th centuries AD the upper half of the eastern province had a large Tamil community.[8]

      Eastern Tamils had feudal organizations that centered around Ur Podiyar[9] at a village level and the Kudi system that controlled social interactions. They also were organized politically as Vannimai chiefs[10] who came nominally under the Kandyan kingdom. The most important social group were the Mukkuvar who had originated from South India and had repeatedly invaded Sri Lanka as evidenced by Sinhalese literature of that period called Kokila Sandeśa as the Mukkara Hatana. One of the local traditions that records the landing and settling of eastern Sri Lanka is called Mattakallappu Manmiam (Tamil:மட்டக்களப்பு மான்மியம்).[11]

      Among the medieval Vanni cheftaincies, those of Panankamam, Melpattu, Mulliyavalai, Karunavalpattu, Karrikattumulai an Tennamaravadi in the north of the island were incorporated into the Jaffna Kingdom. The chieftaincy in Trincomalee was at times incorporated into the northern Kingdom. Hence Vannimai’s just south of the Jaffna peninsula and in the eastern Trincomalee district usually paid an annual tribute to the Jaffna Kingdom instead of taxes. The tribute was in cash, grains, honey, elephants, and ivory. The annual tribute system was enforced due to the greater distance from Jaffna.[12]

Dixit repeatedly pointed out the action goes against the spirit of the agreement between the 3 sides then. But Lalith helped by extremists in the army went ahead.
    This was one of those incidents where the army exceeded the powers of the civilian authority.

    ” To sum of the evidence so far discussed, we have in the first place references in Pali chronicles to the presence of Tamil traders,invaders and mercenaries from about the second century B.C. There is no reliable evidence in the chronicles to say that there were Tamil settlements either in the pre christian period or the early centuries of the christian era. Om the contrary the general impression given by the chronicles is that the Tamils were foreign to Ceylon.
    Their usurpation’s and unpleasant intrusions are dealt with unfavourably. It is only the archaelogical evidence that points to the existence of a tamil settlement probably at Pomparippu and possibly at Katriveli, between about the second century B.C and the second century A.D After this there is a long gap till we reached the seventh century, we get some flimsy evidence that points to possible Tamil settlements in this century. It is only in the 10th century that we get definite in the Sinhalese and Tamil inscriptions, in the archeological sources and to a small extent in the Pali chronicles.That by the 10th century permanent Tamil settlments had begun in the Island is clearly borne out by these sources. Looking back at the whole body of evidence that is available to us, we have to conclude that there were no wide spread Tamil settlements in the island until the 10th century.
    The settlement of Pomparippu and Katriveli have to be regarded as isolated settlements.On the basis of the present evidence we could say that the Tamil settlements started only in the 10th century. These settlements were by no means extensive but their importance lies in the fact that they formed the nucleus of the later settlements that covered the greater part of the Northern Ceylon”

    What we can learn from history is that lack of emotional intelligence, commonsense, petty mindedness, pride, and inability to accept mistakes due to pride, Inability to self asses and correct ourselves , in ability to forgive,has lead to this problem.
