Spate Of Cases Before Supreme Court Challenging Port City Bill In Spite Of Govt’s Well-Laid Plans

Foiling the Gotabaya Rajapaksa Administration’s plans to prevent serious legal challenges to the Colombo Port City Economic Commission bill, a spate of petitions was filed before the Supreme Court of Sri Lanka on Thursday (15).

Chief Justice Jayantha Jayasuriya has appointed a five-judge bench which will start hearing the petitions on April 19. The bench comprises the Chief Justice and Justices Buwaneka Aluvihare, Priyantha Jayawardane, Murdu Fernando and Janak De Silva.

The Government tabled the controversial draft legislation late last week, restricting the number of days for petitions to be filed before the highest court. Challenges to draft legislation must be filed in court within a week of being tabled in Parliament. Five out of the seven days available to potential challengers were public holidays.

But with lightning speed, the Bar Association of Sri Lanka not only appointed a special committee to study the draft legislation, but it joined several other petitioners to work through the New Year holidays to meet the filing deadline, sources told Colombo Telegraph.

The Bar Association of Sri Lanka (BASL), Transparency International Sri Lanka (TISL), Centre for Policy Alternatives (CPA) the United National Party (UNP), the Janatha Vimukthi Peramuna (JVP), Samagi Janabalawegaya (SJB), a group of engineers were among the petitioners who filed by the April 15 deadline.

Significantly, Ven. Muruttetuwe Ananda Thero, Chief Incumbent of the Abhayaramaya temple in Narahenpita – once the spiritual and political HQ of the Mahinda Sulanga campaign – was also among the petitioners. The SLPP aligned monk said the government’s draft legislation creating an autonomous administration for the Colombo Port City, which was financed and constructed by China, would create a ‘Chinese colony’ and a separate state in Sri Lanka.

Attorney Sunil Watagala, appearing as counsel for the JVP, said the Government was giving the Chinese a separate administrative region with the Port City bill, to govern according to their whims and fancies. Special laws could be made specifically for the Port City, Watagala noted after filing his case.

Transparency International said its challenge was grounded in three central corruption concerns. ISL urges that the bill is in violation of several key articles of the Constitution and that it creates pathways for corruption, by facilitating or enabling illicit financial flows, and money laundering. TISL noted the lack of transparency in ownership of the ‘offshore’ businesses that will be set up at the Port City, since ultimate owners of businesses registered need not be disclosed. “Access to such information by law enforcement is crucial,” TISL tweeted.

The anti-corruption watchdog also said it was concerned about a lack of transparency in relation to the operations of offshore banks in the Port City, that could be free from the purview of the regulatory framework applicable to local banks, posing a risk of turning the Port City into a “secrecy jurisdiction.”

TISL said it was also deeply concerned that the bill leads to the evading of parliamentary oversight on public funds and matters within the port city, creating a serious gap in public accountability.

Observers remained skeptical that the Supreme Court would intervene to bring the Government’s proposed legislation within the framework of the constitution and insist that the reclaimed city conforms to public expenditure regulations.

The Supreme Court has frequently appointed hefty benches to hear multiple petitions filed on singularly controversial and constitutionally existential issues, held days upon days of public hearings and eventually thrown the cases out without providing even one line that would indicate rhyme or reason for why the bench was deeming the cases meritless.

Political observers noted that it had becoming less and less likely that the highest court of the land will intervene to prevent the government’s infringement on citizens’ rights, after the Supreme Court failed to take positions on the unlawful delay in parliamentary elections, the mandatory cremation policy that went to the heart of fundamental rights questions, the 20th amendment, and other key matters.

“Since President Gotabaya’s election, on every burning question of the day that has been the cause of deep suffering for the people of Sri Lanka or struck at the heart of our democracy and constitutional freedoms, the Supreme Court has declined to make a meaningful intervention. The apex court has given us no signal that it will rise to defend constitutional democracy and fundamental freedoms against the headwinds of authoritarianism and executive overreach,” a political analyst emailed Colombo Telegraph.

It was therefore unlikely that the Court will cross the Government on the Port City matter, that was of critical importance not only to the President and his Government but also to one of the world’s most powerful countries which holds the purse-strings and perhaps Sri Lanka’s economic future in its hands, the analyst wrote.         Dear LL: Thank you for giving those “Links”. I watched it live and also that followed by Wijedasa Rajapakse after receiving a “Shower” of “FILTH” from the President. This Wijedasa Rajapakse was the Minister of Justice in “Yahapalanaya” who “Delayed….Delayed and Delayed” establishing the “Special Courts” to hear the cases against the “Maharajas & Co.” and was ultimately “SACKED” from the Cabinet. Now, true to his “Tactics”, he, at that Media Briefing mislead the public once again by telling that he was “Sacked” from his Ministerial position because he voiced against the “Hambantota Sale”. If you missed it, please view it again. In actual fact, a group of UNP MPs led by MP Ajith Perera campaigned to remove him for his “FAILURE” to institute those “Special Courts” for nearly “THREE” years to hear all the cases against “Big Wigs” of “Rajapakse & Co.” Now this MP Wijedasa is trying to pull the wool over the eyes of “Observing” public. I believe only that “Punnaku Eating” (your preference) would fall fo it.

      I don’t think Muruttetuwe hamuduruwo’s stance on the matter , or Wijedasa Rajapaksa’s, should be taken seriously.These are the very people who wanted the people to give Gota two-thirds. So , what are these opportunists whining about? Sovereignty? What the hell were they doing post-2009 when the Rajapaksas borrowed billions to build useless highways and monuments to themselves instead of paying for war expenses? And did they object when the bloated armed forces were not de-mobbed but increased? This is at the heart of the economic problems which will force the regime to sell off its assets. Of course Gota took them for a ride, but do these clerical and legal hypocrites have any viable alternative?

    Definitely to be expected : Supreme Court has declined to make a meaningful intervention. The apex court has given us no signal that it will rise to defend constitutional democracy and fundamental freedoms against the headwinds of authoritarianism and executive overreach.
    The constitution of the bench alone is an indication – it will be 3-2 at best, to 5-0 at worst from them, knowing past rulings of those in it.

    Once again the Chief Justice not appointing the full bench to sit, clearly shows that the Chief Justice is a Rajapakse Slave. Shameless act of his in this most important case of the decade shows that rule of law is not being protected even by the Chief Justice who has become a Cheap Justice. Its sad that the hopes I had that a non-politician Gota will bring about peace and order into the country has been ruined from the time he gave his first acceptance speech in Anuradhapura where he clearly stated that he is the President of the Sinhala Buddhists that too who voted for him. Sad state of affairs. Its better to be a US Colony than a Chinese Colony, looking at how Hong Kong citizens are treated by China and how Myanmar a friend of China is treating its citizens. Sri Lanka under Gota is fast moving towards a Myanmar.

    There is no doubt that China’s Port City Bill go through the Supreme Court that is now just follow the orders of NGR. This will go through only unless the Buddhist Monks protest against it as they did with the East Colombo Harbour deal. Gotabaya has no other option than China to get the money needed to run the country but the problem is he needed the Buddhist Monks support to continue his own agenda of military dictatorship at least for next three years. NGR will not dare to go against Buddhist Monks now like he does with Tamils and Muslims because other partners are now started to ask questions. Other Partners now think that the same will happen to them that happened to former President Sirisena and SLFP. But one day it will happen to Buddhist Monks as well.

    The Supreme Court has to take a decision whether to go for a referendum after two third majority, or simply a two third majority or a simple majority is sufficient.

    What we hope is for the Supreme Court to decide that it is necessary to go for a referendum after two third majority.

    If we get a hang of the “BASICS”, the appointment of a “Commission” to administer this “Reclaimed Land” from the “Sea Border” (still within the country) of Sri Lanka, cannot be an “Ultra Vires” the Constitution. We had similar “Commissions” earlier, e.g. “Greater Colombo Economic Commission” (GCEC) “Free Trade Zone” (FTZ), etc. Those “Commissions” too were established “Exempting” their activities coming within certain Legislations that were prevailing in the country. Those too were established with an “Act of Parliament” with the sole purpose of “Economic Development”. Here, too, the “Purpose” is clear and the establishment of the “Administering Commission” is appropriate. Yet, there could be a question relating to the “Geographical” nature of the “Port City” itself, in that, there is a a “Specified Area” that belongs to China. Is this “Administering Commission” empowered to administer the entire landmass or the portion that belongs to Sri Lanka? How the Government empowers a “Commission” appointed by the STATE to decide on the type of “CURRENCY” to be used in that geographical area of the Country? Like manner, there are many more questions relating to “EXCLUSIVITY” from the existing Legislations of the country. What is the “Role” of “Foreign Entities” such as China in the area called “Port City”? What is the “Composition” of the “Commission” and how does it going to affect the “Political, Economic & Social” activities within the country?

    Today, I found the news item that shows NGR has no other options other than selling the Colombo city to China. One of his MPs Vijayadasa Rajapaksa and few Monks did not like the selling of Colombo Port city and voiced against it. NGR made a direct threat to both Rajapaksa and Monks.

    “Parliamentarian Wijayadasa Rajapaksa today alleged that President Gotabaya Rajapaksa had telephoned him early morning and threatened him over his allegations yesterday that the Port City would transform into a Chinese colony.”

Who follows him? Of all the people “Hon”? Bandula Gunawardane. We know “Prof” GLP represents “GR” and MP Bandula G represents PM Mahinda R. This Rev. Ananda is one of the petitioners, and I am certain MP Wijedasa Rajapakse is behind it. The details of the “Discussion” of Prof. GLP, MP Bandula G, and Rev. Ananda are still sketchy. Keep watch.

    Some compare this to Vatican City, Monaco, New York, Hong Kong. Those places have long historical connotations when the global the capitalism network wasn’t established yet. Hong Kong came about when China became communist, and all the money from China escaped to Hong Kong, with no one to catch them. But no place is becoming communist so Port City can benefit at this time. But the whole of the West is a

      And Singapore made use of the money of its very stable S.E. Asian region to become its commercial sector. The region welcomed Spore’s expertise.

      In Sri Lanka, most of S.Asia is reluctant to invest in Port City, and we have much instability due to separatists.

      Chinese money will give the initial boost, and they hope S.Asia will buy into it for Chinese to keep their banking at optimum. However,
      Western protectionism is strong and the blocks and stumbles will be enormous, save some kind of war, where Motherland will be easily obliterated for the sake of peace.

      The risk of failure is high. It is very embarassing and worrisome to see GoSL going along with plan in the midst of the obvious.

        The best thing is to build some low cost housing and office space in this reclaimed land.
        There are more than enough hotels in Colombo so no need for more hotels.

        Get the state engineering coporation to mange this by giving an opportunity to Sri Lankan expertise and skills.

        More recriatinal space and sports facilities is a crying need for Colombo City dwellers.

        May be this could be the new home for our International level athletes with proper training and lodging facilities.

    BRAVO!!!!!! I salute all our brave Sinhalese, including Maha Sangha, who filed court cases against the Port City Bill to thwart another Kandyan Convention-style betrayal against Sri Lanka.
    Clearly, the Port City Bill is the Constitution of a separate Chinese state in Colombo seas. Actually, we should name the Port City Bill as the “COLOMBO CONVENTION” or the “PORT CITY CONVENTION”.
    Gotabhaya and Basil are utterly corrupt people who have no attachment to our beloved motherland.
    By surreptitiously approving the Port City Bill without anyone’s knowledge, Mahinda and his Cabinet also proved that they are utterly corrupt. Did China bribe Mahinda and his Cabinet colleagues too?
    Will the Supreme Court rule against Sri Lanka’s Fourth Foreign Invasion/Occupation? I highly doubt it.
    The Supreme Court’s previous decision to approve the 20th Amendment demonstrated their partiality towards the Rajapaksas.
    If the Supreme Court and Parliament both have become doormats of the Rajapaksas, the only available option is an instantaneous public awareness campaign followed by a protest.

      I fully agree with the writer of this article about the timing of the Port City Bill.
      Corrupt Rajapaksas deliberately tabled the Port City Bill at the beginning of April New Year Holidays to avoid public attention and leaving only two working days for anyone to study the Bill and file petitions. The government declaring April 12 as an additional public holiday was also part of this.
      Then there is another huge conspiracy to merge the heart of the Colombo City with Port City.
      Through the Ministry of Urban Development, corrupt Rajapaksas are planning to sell government owned heritage and other buildings in Colombo City to foreign investors. If the Port City Bill is passed, then there will be an exploding amount of offers to buy Colombo hotels and various other business establishments. Then one day, Sinhalese will lose Colombo City entirely to foreigners along with Sri Lanka’s sovereignty.
      I don’t think I have to explain the dire consequences of the possible merger of Colombo City with Port City. This will happen. I know it. That is why in my comment to Mr. Rusiripala Tennakoon’s article I asked the Sinhalese people whether they remember the Portuguese, Dutch and the British invasions, how they breach agreements and take advantage of our hospitality.

          We shouldn’t get into this as Colombo Pong Cing has nothing to do with Tamils. It is in Lankawe. Further Colombo is a gone city.     The 22 countries that supported the people of Sri Lanka at the UNHRC must be thanked for having given Michelle Bachelet the authority to inquire into the extent to which we, the people of Sri Lankan need protection from the government that we ourselves elected in polls conducted in November 2019 (Presidential) and August 2020 (Parliamentary).

    We cannot contest the fact that those ballots were really cast by the hands of Sri Lankan voters. If there were instances of fraud those were insufficient to change the ultimate result.

    The problems probably arose within half a million households in Sri Lanka where a dominant member of each household (usually a male) dictated to others how the others should vote. There is no power within the country that can challenge and stop this Junta from now riding rough-shod over our rights. The twenty-two comments already visible make that clear.

    This is what common sense tells me; I have no idea of what the legal intricacies of this are, but that is what one identifiable citizen of the country feels.
