Sri Lanka: The Human Rights Crisis In The Tamil North & East – An Appeal For International Intervention

I am a Sinhalese from the majority community in Sri Lanka. I have campaigned for the past 70 years for the Tamil people to live with equality, dignity, safety and without discrimination. I cannot think of any time in the past seven decades that the outlook for the Tamil people has been more disastrous than it is today.

Sri Lankan (Sinhalese) politicians are simply incapable of addressing the major human rights problems faced by the Tamil people. They do not have the ability, integrity or honesty to see that what has been done to the Tamil people in the North and East is unacceptable.

This publication is being written for circulation at the 37th Sessions of the Human Rights Council in Geneva (27 February – 23 March 2018) so that those who attend the Sessions will be apprised of the major abuse of human rights in the Tamil North and East, and the absolute need for international intervention.

A military/police state in the North and East

The North and East of Sri Lanka are not under the Sri Lankan government but under the Sri Lankan (Sinhalese) military (99% Sinhalese) and the police (95% Sinhalese). It is a military/police state where the military and police can do what they want with no accountability.

16 of the 19 Divisions of the Sri Lankan Army are in the North and East. There were 170,000 members of the military at the end of the armed conflict in 2009. A year later it went up to 200,000 and the next year it was up to 300,000. The ratio of soldiers to civilians the North-East is 1:5, in Vavuniya it is 1:3.

The Adayaalam Centre in Jaffna and PEARL (People for Equality and Relief in Sri Lanka) in Washington, titled ‘Normalising the Abnormal. Militarisation of Mullaitivu’ published in October 2017, says that the ratio of military to civilians in Mullaitivu is 1:2. There is no place in the world which is so highly militarised.

The military and police are responsible for all the serious violations of human rights of the Tamils people in the area.

The writ of the Sri Lankan government does not run in the North and East. As such, international intervention is mandatory for humanitarian reasons. If nothing is done the Tamil people in the area will simply wither away since they have no means of survival – no land to cultivate, no sea to fish, no jobs and unable to set up a business sine all of these have been taken over by the Armed Forces.

If the Tamil people wither away, it is genocide.

The Tamil Tigers have been crushed. The question is the justification for such a massive military presence. Who is the enemy? Since there is no justification, the military must be withdrawn and the police recruited from the local Tamil population. This is imperative and urgent. It will not happen without international pressure.

The military getting involved in non-military activity

The Armed Forces have gone into non-military commercial activity. They are engaged in large scale property development, construction projects and business ventures such as travel agencies, holiday resorts, restaurants and innumerable cafes in the North and East. Some of these holiday resorts have been published by the British Tamils Forum (see below).

This non-military activity is having a serious impact on civilian life and must be stopped. The military has no place in business activity.

The centralisation of power in Colombo must end

Sri Lanka is a British colonial construct that has failed – as have so many colonial constructs.

For hundreds of years there were three separate Kingdoms – a Tamil Kingdom in the North and East, a Kandyan Kingdom in the centre (Kandyan Sinhalese) and a Kotte Kingdom in the South (Low country Sinhalese).

It was the British who in 1833, the Colebrook-Cameron ‘reforms’, unified that which was divided with no consent from the people, and worse still, centralised power in Colombo. This has had a disastrous effect on the country. To make things even worse, when the British left Ceylon in 1948, they handed over the country to the Sinhalese despite serious protests from the Tamils that they feared discrimination at the hands of the Sinhalese. The very least the British could have done was to have left a Federal State for the Tamils.

If what the colonial British did was wrong, what followed after the British left was worse. From Independence (1948), the Sinhalese governments totally isolated the Tamil homelands from all economic development programs undertaken with massive foreign aid from donor countries. As a result, over the past seven decades, while the Sinhalese people and their homelands have prospered and flourished, the Tamil people and their homelands in the North and East have suffered and become the backyard colony of the Sinhalese.

It is essential that all of this is reversed and power to govern is returned to where it was, if there is ever going to be peace and justice in Sri Lanka. This will simply not happen unless there is massive pressure from the international community, especially the aid-givers.

Fear and Insecurity in the Tamil North and East

The overwhelming problem facing the people in the North and East is fear and insecurity. They are justifiably afraid of the Armed Forces, Police, Sinhalese who have been settled there and are supported by the Armed Forces and Police, Tamil paramilitaries working with the government, and, alarmingly, fear of each other. No one is confident that what is told to someone might not be conveyed to someone else for monetary gain.

One such case is described in my book “Sri Lanka: Sexual Violence of Tamils by the Armed Forces”. A prospective asylum seeker who wanted to flee Sri Lanka found that just before he left, the Armed Forces got all the details. This happened over and over again. He then realised that the information was being passed to the Armed Forces by a member of his family for financial gain.

Living in insecure homes is another major problem. Armed Forces and Police can kick the door down (if there is one) and sexually assault those inside – including children. A photograph of one such case is in my book on Sexual Violence.

Until the Armed Forces are removed from the North and East, this fear and uncertainty will remain.

Return land to civilian owners

Under the previous Rajapaksa government, 70,000 acres of land were under military occupation. Only 2,000 acres have been released by the Sirisena government. This is only 3.5% of the total land occupied by the military.

What is being released is usually infertile land. Fertile land is still being acquired even today.

The Tamil people are unable to exist since agriculture and fishing are not possible. This land grab (and ‘Sinhalisation’ – see below) will permanently change the demography of the Tamil homelands and make the Tamil people destitute in their own homeland.

The return of land to civilians is mandatory and urgent. Unless the international community, especially aid-donors, exert the necessary pressure, this will not happen.

Sri Lankan (Sinhalese) governments – unable to govern

A feature of every government since Independence in 1948 is that they have had no idea of proper governance. This is a serious problem especially where there are two separate nations in one country – in Sri Lanka a Sinhalese Nation and a Tamil Nation.

The Sunday Leader, the only newspaper in Sri Lanka worth reading put this well. Four days before the 2010 General Election, the editorial was blunt: “None of the individual contenders, political parties or opportunistic coalitions are worthy of our respect or our vote. Together they comprise the most mind-boggling array of crooks, thugs, conmen, hypocrites, unprincipled racists, rapists, drug dealers, money launders, and general all-round scum that is without parallel elsewhere in the world. Other nations have their share of such undesirables, no doubt, but among them are a handful of honest, sincere, principled folk who have distanced themselves from the corrupt majority. Not so in miserable Sri Lanka.”

These are the people who have governed Sri Lanka. If the Sinhalese are happy with them, that is their choice but the Tamils can find better folk to govern them.

Tamil Eelam

This leads me to the de facto Tamil State run by the LTTE for a decade. I have not been to this place but I know someone who has and has written extensively on his experience. Professor Kristian Stokke, Professor of Sociology and Human Geography, University of Oslo, Norway, who spent some time in the area wrote an outstanding account “Building the Tamil Eelam State – Emerging State Institutions and Forms of Governance in LTTE controlled areas of Sri Lanka”. It is on the net and also in the 3rd World Quarterly 2006.

The most striking feature was a well-organised legal system and an excellent police service, as a result of which serious criminal activity was rare and rape virtually unknown.

The judicial system included several District Courts, two High Courts, a Court of Appeal and an apex Supreme Court. Particular care was taken to ensure that the Courts were just.

Despite their relative youth, the ‘Judges’ were perceived by the public as professional. The entire Judicial system carried substantial legitimacy and public confidence.

Penalties were generally more severe than those imposed by the Sri Lankan government Courts which also functioned in the same area. Despite this, the people had so much confidence in the efficiency and fairness of the de facto Courts that they opted to take their legal problems to these rather than those run by the Government.

I spoke with a former Supreme Court judge who had visited the de facto State and he said that he was most impressed by what he saw. Although the ‘judges’ were young, he said that they knew the law and applied it without fear or favour – which is more than what he could say for the legal system in the South.

The Police (Tamil Eelam Police) was the other key institution for maintaining law and order. Police stations were established throughout the LTTE-controlled areas, and assigned duties to prevent crime, regulate traffic and disseminate information about crime prevention. The community involvement with the Police was a key feature responsible for the low crime rate in the de facto State.

There is not the slightest doubt that where law and order and serious offences are concerned, the civilian population in the North and East are far worse off now, after the area was overrun and handed over to the thoroughly corrupt and undisciplined Sri Lankan (Sinhalese) Armed Forces and Police, and the highly dubious judicial system.

The most impressive thing the Tamil Tigers did was to show that an outstanding State, the de facto State of Tamil Eelam, could be run – something that has never happened in the rest of the country under Sinhalese politicians.

Is Sri Lanka too small to be divided?

No, it is not. It is already divided – into a North and East under military rule, and the rest of the country under civilian rule. What is need is a division that addresses the ethnoreligious chauvinism of the Sinhalese – that Sri Lanka is a Sinhala – Buddhist nation. If it is a Sinhala-Buddhist nation, there is no alternative except to set up a separate Tamil nation – since the Tamils are neither Sinhalese nor Buddhists. It is as simple as that.

With a land area of 25,200 sq miles, Sri Lanka is not a particularly small country and is much larger than many UN countries. It is double the size of Belgium. To claim that Sri

Lanka cannot be divided is arrant nonsense. If divided into a Tamil State in the North and East and a Sinhalese State in the rest of the country:

The Sinhalese State – 18,200 sq miles is larger than 63 UN countries

The Tamil State – 7,000 sq miles is larger than 38 UN nations. 30 times larger than Singapore.

When compared to Israel and Palestine, the results are even more interesting:

Barack Obama in his Cairo speech on 4 June 2009 said,

“The only resolution is for the aspirations of both sides to be met through two states, where Israelis and Palestinians each live in peace and security.”

If a Two-State solution is the only solution to the Israel-Palestine conflict, why not Sri Lanka?

      Having said that Aboriginals issues are similar in down under as well over here. They too like the Sinhala Buddhist think everything on this earth belongs to them but they don’t know how manage or improve but to use and destroy. Education is open to everyone they are not using it or like the village idiots of Sri Lanka they are listening to their scamming leaders and living in poverty while blaming everyone else.

      At this end things have changed for the better a bit. More and more aboriginals are entering higher education and taking hold of their own destiny.

          Yes it will and it has. Simple reason being he is better respected than people like DJ or Tamara who people believe are just crying for their own breakfast.

          Material that he puts out serves even Sri Lankans Tamils and Sinhalese who don’t read the papers in their own language and the international community goes without saying.

          He is doing his duty honorably, putting out the information what others do with it is within his control.

      Taraki,
      You know well he has talked about every possible case for him. How brilliant or efficient even at this age he has his human limitation too. And a day is only 24 hours.

      Unlike us, we talk only about Tamils’ problems, he talk about general Human Right issues. He is known advocate about women rights. As a young boy, when he saw some injustices to upcountry Tamils, he resolved to talk about Tamils issue importantly.

    Well said Dr Senieveratne. I do hope your letter goes to the UN. The present Government like the one in the past is incapable of settling the Tamil issue. As usual a modaya has written about Australia above when he does not know the facts.
    A separate state for Tamils is in the offing.

        Mariakade is in Maradana an area bounded by Darley Road and Deans Road and not in Kotahena. St. Joseph’s College is in Mariakade and would have never tolerated Jim softy in their precincts. He may have attended Ananda College to be an expert in Sinhala Buddhist racism, or more probably St. Lawrence school like Premadasa.

    Sumanthiran, MP is denying that Tamil can refer their case to ICC
    Ananthi made a record in 2013 Provincial Council election, by toping to the second in the list, only below to the biggest Cannon in the North, NPC Chief Minister, C.Vigneswaran. Ananthi was virtually politically unknown that time other than as an activist, who was looking for forced disappeared, including her husband. In the professional Politics Ananthi is a High School Girl if Sampanthar and Sumanthiran, MP are the Dean and the professor of the faculty. But in 2015, in the presidential election, with a sound commonsense, she opposed TNA going on auction to Sinhala Parties with one more time colluding with Sinhala Parties, with the promise of Secret Solution.
    After the non TNA parties’ (Both Extremes, From South Pole SLFP though Independences to North Pole TPNF) massive surge in the Local Government election, the TNA’s main element ITAK is studying in every district of its base to find out happened. Well, everybody does know the reason; TNA blindly supported Sinhala Parties and Tamils feel they don’t want TNA but anything else is ok for them, now. But while the eye washing internal study is yet to be concluded, in a hurriedly convened special meeting in Colombo, ITAK has decided to fire Ananthi and Sivaharan, in the name of in obedience to party decision, for having opposed TNA colluding with Sinhala Parties in 2015 election. In a democratic party, majority decision count. TNA has been criticized for long for being under dictator leaderships. Further the decision to Support Sinhala parties has caused dynamited splits in TNA; the smaller parties have left TNA. Now it is abundantly clear that TNA’s leaders are starting realizing its ultra-foolish guidance of the Alliance to its dismay.

    But the strange here is, instead of taking responsibility, fixing the reasons for the mishap and start with a fresh message to Tamils, the leaders out there on revenging and weeding within the party. When the party is urgently need the Tamils support to revive it, the untimely dismissal from the party the two, Ananthi and Sivaharan, who receives abundant support from Tamils, is not the only problem here. Sumanthiran’s new call for abandoning the Genocide Crime investigation initiations, while it has progressed a lot in the UNHRC, is a clear indication the TNA leadership is no longer for Tamils, but for their minister posts and UNP only.

    Referring the Tamils’ case to UN SC is not all about referring to ICC, as Sumanthiran MP trying to convolute the issue. Tamils intention of having their case referred to ICC is about establishing what happened to Tamils in Sri Lanka (Genocide) and have their UN recognized Self Determination right invoked. That is only one of the outcomes they are looking for.
    So, it is true Tamils want it be referred to UN SC so it can be, in time, referred to ICC, by any way possible, including the UN SC direct voting by Veto members. There is nothing as veto members absolutely “write and give” that they will veto anything coming to UN against their friendly countries. That is another concoction Sumanthiran, MP is trying to stir up. What always gets implemented in UN SC is the veto member countries negotiated within them behind the curtain. It is the supporting members (America, Britain and France) , who have to convince the non supporting members (Russia and China) to let it go through ahead Tamils’ Genocide case in SC. It is not a standalone case of Tamils is dealt in SC.

    Instead, if West decides to ask Russia and China to give up veto on Tamils issue, normally they agree to give up on something else that China and Russia would be willing to have done in UN SC without West using its veto. That is how the non-veto member countries’ interest is cared in UN SC. Though this is not something new for Sumanthiran, but now he is trying to fool Tamils and save UNP.
    America has banned LTTE. But when Sri Lanka banned LTTE, Ambassador Robert Blake pointed out to them that it will make hard for them to negotiate a permanent peace treaty with Tamils. Sumanthiran, MP purposefully creating chaos in Tamils’ case by saying America is not in ICC so never Sri Lanka can be referred to ICC. Interesting point in this is, Sumanthiran talk indicates that he is doing his best in blocking the American Polices issue evolving towards they work and get a fair solution to Tamils. Otherwise, if he feels America is not putting enough effort, he would stand front in the line to convince America, rather than deterring even the other organizations showing willingness to work with America and convince it.
    Sumanthiran is openly threatens that now America is consulting him only on Tamils matters. He indicated if others, who are interested in Tamils wellbeing, not coming under his authority then he can sabotage and revenge them too.
    America was not in UNHRC. America is not in ICC. But there were many international human right violations cases have been referred to ICC and successfully investigated. China has been the closest ally of North Korea. But there are many Western resolutions have been passed in the UN SC against North Korea.

    Further Sumanthiran, MP knows well that even the ICC is only an evolving organization and nothing there is firm or finally decided. So by trying ICC, Tamils are not going to commit a sin as big as Sri Lankan government’s Genocide crime.
    If the matter is referred to UN by UNHRC, even if veto countries use veto for any unified action, West still will be able to take many actions against Sri Lankan government and China will have to corporate and comply with that on global level.
    Further America never said that Tamils’ case doesn’t need to be referred to ICC. What America so far has been trying is, using its single effort to resort it in its way. America has not received any tangible success on that and it knows it failed. Further there are many indication it is keeps trying different techniques to bring Sri Lankan government in line. That does not excuse Tamils to go lazy and releasing them from their responsibility of pointing out to America that “Justice delayed by American error and trials is effectively Justice denied to Tamils. So, America has to get on some proven methods”.
    After all UN SG always has the ability to request the Chief Prosecutor of ICC to take up the Tamils case as on her will. She can take it in that way when a serious references given to her. This can be done if UNHRC refers the matter to UN and then UN SG advises her situation of Tamils. .
    Sumanthiran, MP is clearly dancing to Ranil’s Music. Ex CB Governor, who danced to Ranil’s music, is now hiding in countries, where the INTERPOL hand doesn’t reach and the names those countries are not very public.

    It seems, by overly surrendering to Ranil, Sumanthiran’s hiding days in those countries is not too far away from now. It is only for Sumanthiran’s wellbeing him not to take the path of Mahendran. There is every evidences that Ranil did not believe Sampanthar’s promises. Sampanthar was well known to oppose Ranil’s candidacy in EP election of 2015. So Ranil had once again has shown what DS did to Tamils Ministers after he got ratification to Soulbury Constitution. Ranil is saying he will follow what Don Stephen did. (That means buying the Tamils MPs with a cup of coffee and splitting Muslims and Tamils). But in Reality he is a combination of the nasties of his Uncle JR and the nasties of Don Stephen.
    Ranil is working on a program this is worse than DS’s unitary government or JR’s EP administration. What is Ranil trying to do is abolishing the opposition, practically. (To form a government, in future, all major Sinhala parties have to be together under National Unity Government- so only small ethnic minority parties will be in opposition). This leave Tamils’ future goes down not questioned at all. Even in future if one party campaigns within Sinhalese (Like Chandrika’s first election promise of making peace with Tamils by abolishing the war), but after winning the election, never any political parties can do anything for Tamil, inside the Parliament. No party in future will be getting 2/3 majority in the Parliament. As there cannot be a strong opposition, nothing undemocratic activities happening in parliament will be opposed. With DS’s constitution, Sinhala Community was able to do all what they wanted against Tamils. With JR’s constitution, one Sinhala Man dictatorship was oppressing the Tamils.

    Once Ranil’s ideas go into operation (at this time there is nothing visible that can prevent his plans going into operation- it has already gone into LG Sabas), then there will be One dictator Exertive president and one Opposition less parliament, both will be getting together and ever most efficiently going to oppress Tamils. This combination is going to be an extremely effective Nazi Machine that has not even came into the wildest dreams of Hitler.
    Ranil, on his own, went to New York and had a fight with that time UN SG, Ban Ki Moon to have the Expert Panel Report destroyed. But, in 2015, UNHRC passed a watered out resolution identified as 30/1, believing Ranil would initiate internal investigation against war criminals. Instead, Ranil planned well, one after another step, cheated Sampanthar on the solution to Tamils as revenge for Sampanthar not supporting Ranil’s EP Candidacy. (I am not telling if Sampanthar had support Ranil’s election, Ranil would have given the Tamils rights.) Sumanthiran, MP, somewhere in October, 2016, in Kilinochchi, said that “On December 10th 2017, the Draft Constitution is coming to Parliament, finally. It took all these time because there was only a simple delay. That time our people are going to say we are not given Tamil Eellam and they are going to say Tamil Eelam is given out”). Right before the OISL report was released, (it was delayed too long to make modification to save the War Criminals, whose names were mentioned in the report) Sampanthar said that the inquiry was over and investigation (of UNHRC involved) will start after September, 2015 sitting of UNHRC. But in reality nothing anything even near to whatever Sumanthiran or Sampanthar said happened.

    After LG election, Sampanthar did not tell in the parliament in way the foreign countries, who gave him pressure to support Ranil, could hear that that TNA had been forced to shrink by the false promises of the UNP led government. Instead he accused that SLPP was struggling to give Tamil Eelam, by its divisive speeches during the LG campaign.
    As a constitutional Law expert, Sumanthiran understand everything going on. He is more than aware that none of the promises to TNA will be delivered. He has only one solution for him to escape. Destroy the Federal Party; Split and pick few core supporters to him; completely merged with Ranil, like the way some of the Muslim parties are now operating.
    Tamils have to die hard to make the UN, UHRC sponsored investigation to materialize. If that is not happening, the history of rest of the Tamils remaining Sri Lanka will be the past history of the so called Cinnamon Peelers.

      Pre election promises for Tamil votes by a party which otherwise would pole less than 40% are not valid after the government is formed. This has been proved time and time again. For the simple reason that these crooks are making deals on thing they are not empowered to deliver. Donkey Tamil leaders never realise that nothing can be achieved against the will of the majority of Sinhalese. These racists are like crabs in a pot until water boils.     I do not normally comment on my articles (or criticism of them). i lave that to others to do.

    However, the suggestion made above that this be translated to Sinhala is a very important one. My Sinhalese is not good enough to do this. I wish someone else with a better command of the language will do this.

    i am aware that it is being translated to Tamil.. That is fine but the Tamils know the problem. there is no need for me to point it out to them. That said, it is important for the Tamils in the Sri Lankan North and East to know that they and their problems have not been forgotten.

    My section on the “International community” (which has yet to be published) is not well written. It should have been much more comprehensive. I should certainly mentioned the countries currently attending the UN HRC meeting and the aid-givers. I should also have mentioned that it s crucial for ordinary decent people across the world, to see their MPs and ask what their government is doing to address this human rights crisis. As for the country I live in (Australia), nothing is being done except sending back asylum seekers from Sri Lanka – a gross violation of the Refuge Convention, signed and ratified by Australia. Australia has a major case to answer.

    Frankly, I do not have an answer, which is why I asked the question so that others can focus on this crucial problem(s) which is destroying the country – certainly the North and the East

      you claim to be sinhalese but doesnt look like you lived a day in sri lanka or even been here. If you have, you wouldnt write a phoney article. Everything you wrote in this article isnt true. The north/east was deprived due to terrorist war. That is why majority of tamils moved to south to live with sinhalese where there wasnt a war. They lived, educated their kids, and stayed away from war. Stop spreading hate and lies! If you want your separate country, go to India! Sri Lanka needs developement and investors, not fake people pretending to be sinhalese crying crocodile tears without being able to speak a word of sinhalese in order to translate a fake hate article written by themsevles.

      Myself and my family and friends greatly appreciate your human rights and other advocacy work you perform for the Tamil civilians, especially those who live in the North and East of Sri Lanka. Many years ago, I am aware that you publicized the plight of the upcountry Tamils who were previously, mainly living and working in tea and rubber estates.
      I am so very impressed and grateful to you, for the time and effort you are spending on your advocacy work!

    Saying the same old lies is not going to convince the UN. They have heard it all before and can see through separatist rhetoric that has been repeated ad nauseum for decades. The Sri Lankan armed forces need to be alert to and prepared for a resurgence in militarism, given that the LTTE is still active overseas. Last year Prabakaran’s birthday was celebrated and honoured by LTTE flag-waving youth in the UK, who filmed it and posted it on YouTube. There are numerous Facebook and YouTube sites glorifying Prabakaran and the LTTE.

    Brian Senewiratne is trying to convince us that the LTTE ran a well-functioning “de-facto state”. He has no idea about the ground reality in Sri Lanka now (or in the recent past), and doesn’t write what he knows about the LTTE’s crimes over the past decades, which were considerable (against the Tamils as well as the Muslims and Singhalese). This would not be so if he had any integrity. He also fails to mention that he is a “senator” of the LTTE-supporting TGTE.
