Sri Lankan Authorities Must End Violence & Discrimination Against Muslims: Amnesty International

Sri Lanka’s Muslim community has suffered consistent discrimination, harassment and violence since 2013, culminating in the adoption of government policies explicitly targeting the minority group, said Amnesty International, in a new report published today.

From Burning Houses to Burning Bodies: Anti-Muslim Harassment, Discrimination and Violence in Sri Lanka, traces the development of anti-Muslim sentiment in Sri Lanka since 2013 amid surging Sinhala-Buddhist nationalism. This discrimination has evolved from a rising series of mob attacks committed with impunity, into government policies explicitly discriminating against Muslims, including the forced cremation of Muslim Covid-19 victims and current proposals to ban both the niqab (face veil) and madrasas (religious schools).

“While anti-Muslim sentiment in Sri Lanka is nothing new, the situation has regressed sharply in recent years. Incidents of violence against Muslims, committed with the tacit approval of the authorities, have occurred with alarming frequency. This has been accompanied by the adoption by the current government of rhetoric and policies that have been openly hostile to Muslims,” said Kyle Ward, Amnesty International’s Deputy Secretary General.

“The Sri Lankan authorities must break this alarming trend and uphold their duty to protect Muslims from further attacks, hold perpetrators accountable and end the use of government policies to target, harass and discriminate against the Muslim community.”

Rising hostility towards Muslims

Incidents of violence towards Muslims have risen in frequency and intensity since 2013, with a series of flashpoints in which attackers and those responsible for hate speech have enjoyed impunity for their actions.

This escalating hostility began with the anti-halal campaign of that year, when Sinhala Buddhist nationalist groups successfully lobbied to end the halal certification of food, which demarks food permissible for consumption by Muslims, in accordance with Islamic scripture and customs. The campaign gave rise to a number of attacks on mosques and Muslim businesses, with the lack of accountability for those responsible acting as a signal to others that acts of violence against Muslims could be committed with impunity.

The following year, anti-Muslim riots in the southern coastal town of Aluthgama began after a Sinhala Buddhist nationalist group held a rally in the town. Here too, perpetrators of violence enjoyed impunity and authorities failed to deliver justice to victims.

Despite a new government in 2015, which promised justice and accountability for ethnic and religious minorities, attacks against Muslims continued to occur. Shortly after the election, anti-Muslim mob violence flared in the southern coastal town of Gintota in 2017, while similar violence was seen in 2018 in Digana and Ampara, towns in the central and eastern provinces respectively. Not only did perpetrators escape accountability, victims and witnesses alleged the police and armed forces did not offer sufficient protection or act to prevent the violence.

Escalation since 2019 Easter Sunday attacks

Hostility towards Muslims increased markedly after more than 250 people were killed in coordinated suicide attacks committed by a local Islamist group and claimed by the Islamic State on Easter Sunday 2019.

Following these attacks, on 13 May 2019, Muslims in several towns in the North-Western Province of Sri Lanka came under attack during Ramadan, one of the holiest months in the Muslim calendar. Mosques across the country were also attacked and a spate of ‘hate speech’ posts and anti-Muslim vitriol was seen on social media. Emergency regulations rushed through by the authorities were also used to arbitrarily arrest hundreds of Muslims in the wake of the attacks.

Since taking office, the current government has continued to target and scapegoat the Muslim population to distract from political and economic issues.

This was evident in the mandatory cremation policy on the disposal of the bodies of Covid-19 victims, which was implemented despite cremation being expressly forbidden in Islam, and a lack of scientific evidence to substantiate the claims that burying victims would further the spread of the disease.

Government policies targeting Muslims

While the forced cremation policy has been reversed after the government succumbed to international pressure ahead of a vote on Sri Lanka at the UN Human Rights Council, the authorities are still seeking to implement discriminatory legislation, including a niqab ban and a ban on madrasas. If adopted, these restrictions would violate the freedom from discrimination based on religion guaranteed and safeguarded by Sri Lanka’s Constitution, and international human rights law which Sri Lanka is bound by.

The authorities have used existing legislation to target Muslims, including the Prevention of Terrorism Act (PTA), which permits suspects to be detained without charge for up to 90 days, and without being produced before a court. This is in addition to the misuse of the ICCPR Act, a law intended to prohibit the propagation of racial or religious hatred, amounting to incitement to discrimination, hostility or violence.

The report documents several cases in which these laws have been abused to target individuals, including Hejaaz Hizbullah, a lawyer and activist who has been detained for more than 15 months, and Ahnaf Jazeem, a poet and teacher, who was arrested on 16 May 2020 following unsubstantiated claims about his Tamil language poetry.

“From anti-terrorism laws and forced cremations to niqabs and madrasas, the Sri Lankan government has pursued a blatantly discriminatory policy agenda against Muslims. We urge the authorities to reconsider the proposals currently under consideration, and for the international community to monitor and take measures to ensure the freedom and protection of minority communities in Sri Lanka,” said Kyle Ward.

    I Can not see any Muslim discremination after the takeover by this President .

    If there are bad policies with evidence lets critisize it as Common Citizens not influnced by politics.

    The only politician to whom the most inhuman injustice was ever done for building the nation financially strong,with a large foreign reserve, setting up the 1st two FTZ 1 in katunayake & other in Ratmalana *and when Farmers became kings , was no other than Late Madam Sirimavo Banadaranayake.

        As a Tamil person who suffered discrimination and violence since independence, until I left the country, I can fully understand the plight of Muslim people. Tamil people suffered and still suffering as the orphans of the world.
        Since the defeat of LTTE, the ethno nationalism has turned their attention towards the Muslims in addition to the Tamils.
        Based on our experience, my recommendations to the Muslim people is not to suffer in silence. They must at least use the social media for that purpose. Please remember that weak people should not resort to violent means because we are living in a cruel world and geo politics is a cruel political force filled with lies and deceit.

        You are correct Burqua, Niqab are not their tradition and they are not even talking about this but burials are their tradition just like for Christians and this should be allowed. As for the monk, it was a cooked up story and even if had happened by some Muslim miscreants, it is no excuse to go around killing looting and burning innocent Muslim homes, businesses and belongings when they had nothing to do with this. The same happened in 1983 the LTTE shot and killed 13 soldiers, who were there to fight them and this was used to start a pogrom to burn and loot thousands of Tamil homes and businesses and to kill, rape and injure thousands of innocent Tamils down south. Starting the 30-year-old war. Most probably looking for another war.

          From the time of independence marginalize discriminate ethnically cleanse one minority after another so that they flee, or be made stateless and forcibly deported like the Indian origin Tamils, or forced to assimilate or live in fear as third rate citizens in their own land. First made the Indian origin Tamils stateless and forcibly deported most of them to India, after living on the island for more than 150 years, then chases most of the Burghers to Australia and other parts of the west. After that started on the native Tamils, discriminated marginalized them and ethnically cleansed them, that they were forced to take arms to safeguard whatever was left. Used that to chase around a million of them largely to the west. Now have started on the Muslims who ironically were their supporters and co-partners during the previous marginalisation and ethnic cleaning activities on the other, especially the Tamils. Even so-called friends and partners are not safe. Use them and then discard them when the use by date is reached.

    Amnesty International is only confirming what other human rights agencies, and the UN, already knows. Whether India or Myanmar, the minority have had to pay for the hatred, and divisive policies, that racist leaders have decided to implement in these countries. For lack of common sense policies they make up with arrogance and stupidity. No country that is mired in ethnic and racist unrest, where the majority like mindless sheep does the bidding of their leaders, and attack the minority, can ever progress and be a successful nation.

    The Rajapaksa’s chose to follow the Modi/Myanmar Junta model and the country will suffer the consequences. We depend on aid to survive, and if the Rajapaksas think discriminating and harassing the minority is going to help our endless need for international aid and help, they must be even more stupid than we think.

    By attacking innocent people, their homes, their businesses, and locking up members of their community for no reason, they are only confirming to the world that they are not interested in uniting this country, or have the best interests of all Sri Lankans, and that they will use racism as a tool to divide the country they pretend to care about. They also bring shame to Buddhism, like Myanmar has done.

      In Sri Lanka it is the other way around. Majority indigenous Sinhala Buddhists had to pay for the hatred, and divisive policies of racist separatist Tamil politicians in the North.

      The only community that is eligible to ask for a separate region/State in Sinhale are Vedda Eththo because they are the only indigenous minority who evolved in this island and co-existed with indigenous Sinhalayo for thousands of years. Moreover, Vedda Eththo are patriots who fought along with Sinhalayo to liberate this country from British rule. During the liberation struggles, other minorities took the side of British who oppressed and killed indigenous Sinhalayo and Vedda Eththo.
      Therefore, we will propose that an ‘Autonomous Region’ should be given to Vedda Eththo in the East carving out parts from Kandy, Badulla and Ampare Districts because this area has been the ‘Traditional Homeland’ of Vedda Eththo. Then, Vedda Eththo scattered in other parts of the country can move to this area and protect their traditions, customs and engage in hunting and gathering.

    The sad part is, politicians like Rauff Hakeem and Rishad Badhurdeen who are supposed to be the political leaders of the Muslims have failed the Muslims. For money and positions, they have allowed their own party members (who claim openly that they wanted the MPs) to vote for 20A which is now being used to suppress Muslims and other non-majority citizens. First, these two have to be kicked out of politics together with all the Muslim and Tamil MPs who voted for 20A. Only then we can build a clean political environment that would protect the non-majority citizens.

    Srilanka has been torn apart into pieces by almost all available institutions that
    were meant to build it for all to live as one . Majority of Sinhala Buddhist rulers
    or almost all of them were inclined to be majoritarian rather than being a genuine
    National figure head . Time to time , antagonising good relations with other
    countries by various means but definitely to please local racist rogues is continuing .
    It is quite obvious and crystal to any open mind that the country is not doing
    anything in the right direction . That includes the opposition on most circumstances
    as well . The opposition except the JVP is still trying to depend on the same old
    tricks of fooling the vulnerable majority who can not see anything beyond their
    noses .

    Sad but from the time of independence until the end of the war in May 2009, the Muslims for all sorts of benefits and perks were staunch allies of every Sri Lankan government and the Sinhalese. Were their partners and helped them to discriminate, marginalize, ethnically cleanse and commit war crimes on the island’s Tamils. They were even seen openly celebrating, holding victory celebrations and dancing on the streets in May 2009. When horrific war crimes were committed on innocent Tamil civilians, that the UN is still investigating. A Muslim minister during the 1970s introduced standardisation, to deny deserving Tamil students higher education. This move greatly benefited Sinhalese and Muslim students to enter coveted science courses at the expense of more qualified Tamil students. This was one of the main reasons many young Tamils took to arms, seeing they were being denied a livelihood. Little did these Muslims, who are in reality ethnically Tamil realize once the Tamils were marginalized, the Sinhalese will turn on them, they thought they will keep on benefitting at the expense of the Tamils. Many Muslim politicians with the aid of the ruling Sri Lankan governments, were still marginalising the native indigenous Tamils in the east and were on the verge of grabbing their lands from them and busy Arabizing/Islamanizing the ancient Hindu Tamil east.

      Until the Easter bombing. The Burqua, Niqquab or the Hijab and many of the current Muslim dress forms or customs the island’s Muslims are now complaining they are not allowed to practice of wear, are not local Muslim dress forms or customs that did not evolve with them but only now being ardently practised within the last three decades, as a deliberate move to remove and distance themselves from their ancient Tamil Islamic culture, practices and dress forms, that they brought from their original South Indian homeland and to deliberately identify themselves with Western Asian Muslims and customs. Even the forms of Islam they now practise like Wahabism belong to the deserts of Saudi Arabia and not here. They have largely forsaken the Sufi form of Islam, that came with them from the Indian mainland. A gentle tolerant form of Islam, that blended with the island’s Hindu/Buddhist cultures. However, a person has to freedom to practise anything they like and wear what they like, even if it does not blend or jars with the surrounding. This freedom to do this should not be banned. Hope the island’s Muslims at least now would have learnt their lesson and stand with their fellow non-Muslim Tamils, against state-sponsored Sinhalese racism. If they had from the beginning, this will not be happening now. The Sinhalese would have backed off but they did not and made the Sinhalese very powerful little realizing that one day it will be their turn too. Even now some have not learnt this lesson and are still seen fawning to the Sinhalese and claiming for an Islamic homeland only in Tamil areas, where only a minority of them live.

    Very disturbing to read as a Tamil who has faced discrimination from the Sri Lankan state and was forced to migrate. I now feel sorry for them. Muslims should now realize belatedly at least if you support and take part in evil, finally, it will come to bite you. They supported and took part with the Sinhalese in the marginalization of the island’s Tamils and on the large scale atrocities and war crimes committed on them and benefited immensely at the expense of the Tamils. This was going on even after the war ended in May 2009, especially in the Tamil east. Little did they realize that once the Tamils were marginalised, it will be their turn. The Sinhalese also got a shock after Easter 2019, when they realized that Islamic extremism and Arabisation of the island’s Muslims, which was used as a tool to marginalize the Tamils, especially the eastern Tamils, has now also come to bite them. Burqua, Niqab, Abaya, the long gown and even the Hijab are not local forms of Islamic dress, it was the saree with the end covering the head that was the traditional Islamic dress, and sarong shirt and the cap for men. All these western Asian Islamic dress forms were only adopted very recently in rush to Arabize themselves. However, people should be allowed the freedom to whatever dress forms they want to and to practise whatever religious forms they want to, as long as it does not affect others or affect other peoples rights.

    Lot of of exitment is seen among networks of a certain minority group and are again leading the common and mostly the poor to believe the change of power to the current opposition will give them total freedom,for the common and poor among this community life is all about simple living , basic security for their families , right for religous traditions , free to access religous dietry, attires and practice of rituals, but to the circle promoting this , it is all about dirty money and we all know how it works.

    The present opposition the common minority is hopping to bring back into power, should first analyse what they have ever benefitted for past seventy years from them ,only their Cartels benefitted.

    Whatever, if you are prejudised with Rajapakshes , just remember that the opposition lead by a Zealot will be suicidal.
    You will regret it badly .

    The party itself is just thee other side of the same coin of Yahapalana.Even a commoan man’s simple internet privacy will not be spared ,the underword will rejoice.

    How can a citizen even with a simple mindset ever immagine the same politicians responsible for the 1983 genocide, the ruthless masacure of our young revolutionists whose passion was to see a political change, will be the answer to change a political party , may be some of their soldiers are guilty of human rights on battle field.

    I will never condone any crime against humanity, but that is the saddest part in begining a war in haste, no winners all are losers, it happens in all battle fields.
