Sri Lanka’s Legal Blind Spot: Why We Keep Failing To Bring Arjuna Mahendran Home

When Singapore refused to extradite former Central Bank Governor Arjuna Mahendran in early 2025, the headlines called it a diplomatic failure. But that’s the wrong diagnosis. What we witnessed was not Singapore’s rejection, it was Sri Lanka’s legal unpreparedness laid bare.

For ten years, successive governments have promised to bring Mahendran back to face justice over the 2015 Central Bank bond scandal. Each administration has blamed foreign reluctance or political interference. But the truth is far less dramatic and far more uncomfortable: we did not meet Singapore’s legal requirements.

The Real Reason Singapore Said No

Singapore’s Attorney-General’s Chambers (AGC) didn’t reject the extradition to protect Mahendran. It did so because Sri Lanka’s request failed the tests set out under Singapore’s Extradition Act 1968.

That law requires three things:

1. The alleged act must be a crime in both countries (the dual criminality test).

2. The evidence must be strong enough to justify a trial under Singaporean standards (the prima facie test).

3. The request must not stem from political motives.

Our file stumbled at all three hurdles

Sri Lanka’s charges, built under the Penal Code and Bribery Act, weren’t framed in terms Singapore could recognise. The evidence, though massive in volume, did not clearly prove criminal intent. And the politically charged nature of the bond debate only reinforced Singapore’s view that this could be seen as a politicised prosecution.

Our Legal Shortcomings

Singapore’s decision mirrors rulings by its own courts and other Commonwealth jurisdictions, from Wong Yuh Lan in Singapore to Re Nielsen in the UK; that stress precision over volume, and legality over rhetoric.

Yet, Sri Lanka’s submission betrayed key deficits:

* Mismatched legal definitions: We failed to align our charges with the equivalent sections of Singapore’s Penal Code or its Prevention of Corruption Act.

* Weak evidentiary mapping: Much of our evidence was investigatory rather than admissible under foreign law.

* Political noise: Continuous public statements by politicians undermined the neutrality Singapore requires in extradition requests.

These are not mere technicalities. In law, form is substance. If we can’t translate our offences into Singapore’s legal language or demonstrate evidence that meets its evidentiary standards, we will keep hitting the same wall.

How to Fix the System

It’s time to stop blaming others and start fixing our approach. Several steps are essential if Sri Lanka hopes to restore credibility in cross-border justice:

1. Reframe future charges: Match offences precisely with Singapore’s statutory provisions, particularly those addressing criminal breach of trust and public-sector corruption.

2. Upgrade evidentiary standards: Replace political commissions and leaked reports with certified, court-ready documents: notarised depositions, forensic audits, and authenticated transcripts.

3. Depoliticise prosecution: Create an independent extradition unit within the Attorney-General’s Department insulated from political commentary.

4. Utilise Mutual Legal Assistance (MLA): Build structured cooperation under the UN Convention Against Corruption (Article 43) rather than rely solely on extradition.

5. Maintain lawful diplomatic pressure: Keep the Interpol Red Notice active, but pair it with professionalism—not populism.

A Lesson Beyond Mahendran

The Mahendran case is not just about one man or one scandal. It is a test of whether Sri Lanka’s justice system can operate confidently on the global stage. Extradition is a legal process, not a political campaign slogan.

Singapore applied its law and did so correctly. If Sri Lanka wants accountability, it must speak the language of international law, not domestic outrage.

Until we reform the way we prepare, frame, and present our cases abroad, Mahendran, and others like him, will remain beyond our legal reach.

Our failure isn’t that Singapore protected one of its citizens. It’s that we keep mistaking political will for legal competence.

      If Mahendran had been charged with helping his son-in-law to monopolise a bond issue by way of bribing the Finance Minister, the charge would have stuck, even in Singapore.
      But what do we have? An AG who keeps grandstanding about things he knows nothing about, an “Auditor-General ” who claims that the losses are “uncountable”, and last but not least, a gullible public led by conniving journalists and politicians (yes, the same crowd that invented the 10-second Shafie Sterilisation Process).
      In our moral system, making money is a crime, not how you do it. In Singapore, it’s the other way around.
      Mr. Samarakoon is a good example of the sort of lawyers we had in the past. Mr. Gunaratna Wanninayaka is the sort we have now. So sad.

        OC – “Fixing the system”. A good example, better than ‘Bond Scam’, is the ‘X Press Ship Wreck’ within the territorial waters of Sri Lanka.

        A ‘Top Ranking’ Minister – Dr. Wijedasa Rajapakse divulged in Parliament how a person (he named the person) secured a ‘Bribe’ of US$240 to prevent the S/L Government from filing a lawsuit against the Ship company. Didn’t happen as ‘predicted’ or better ‘arranged’? We lost at least US$5 billion. But, we have paid an extra ‘million’ as ‘Legal Fees’ to lawyers in Singapore after filing a case in that country.

        That is what you called ‘FIXING THE SYSTEM’.

        Setting aside major projects, we ought to consider whether the current government’s “CLEAN SRILANKA” initiative has been effective. You once stated, OC, that Chaturanga Abeysinghe is a unique and capable individual. Why in the world are they unable to effectively lead “CLEAN SRILANKA” so that the message reaches all societal levels? The quantity of plastic debris floating in the stream banks close to the walking trails in Kadawatha and Kiribathgoda astounded me this morning. Apart from pursuing the opposition, what else have they done in the past 12 months? The true curse of this fallen country, in my opinion, is that all of these men are true idiots who were exaggerated by the “mafia-media.” I spoke with a couple of the retired people who also worked out every day. They were mostly critical of the government.

      I’m almost certain there is another giant cock-up currently going on in the “anti-drug” campaign.
      As far as I know, (and I have gleaned a lot by watching the famous chemist Dr. Walter White of Albuquerqe on “Breaking Bad”), the ingredients of Methamphetamine (ice”) are all liquid. If any solids are involved, it is stuff like Ephedrine, a plant extract which is a pharmaceutical available in pharmacies. It certainly doesn’t look like the white rocks being currently displayed as “evidence ” by people who claim to know what they are doing. To be fair, there was one seizure of liquid chemicals along with the chemist, but the containers of white rocks look like BS for the gullible.

Sri Lanka still face the same political motive even under this government. If not why can’t this government cannot take action against those who were proved undoubtedly by the supreme court as responsible for the bankruptcy or those who built a illegal buddhist temple in illegal lands.     A Presidential Commission of Inquiry found Arjuna Mahendran guilty of causing loss to the government. The loss, though may not be immediate, will have to be incurred in the future years.

    The three reasons to be fulfilled do appear to have been complied with. Firstly, a verdict by a PCI must be strong enough in the interim for Singapore to extradite AM if he wishes to appeal to higher courts.

    Causing loss to the country or in the least meddling with operations of central banks must surely be offenses in both countries.

    The question arises as to why AM who was honest enough to return to SL after the wedding he attended, wasn’t honest enough to wait until the PCI report was out. He left surreptitiously after Sirisena took over the Ministry of Economic Development from Ranil.

    A former PM of Singapore is on record of having said to a corrupt minister when caught that he ought to choose between admitting guilt or committing suicide. The guilty one chose suicide.

    Governors of central banks in both countries must be holding ministerial ranks.

    Therefore, Singapore should do all it can to prevent AM committing suicide by arresting and extraditing him to challenge the PCI verdict in courts of law here. Only if he is found guilty, SL could ensure that he lives long in the appointed place and dies only of natural causes.

      Tell us what the hell our coastguard vessels (all of the vessels were gifts from Hindia, USA, Australia, Japan … bought a few from Israel) are doing on our shores? Daily Mirror recently reported according to an audit report “several Sri Lanka Coast Guard vessels remain inactive for years, while others await costly repairs or disposal”.

      As a concerned person you should have raised these issues on Colombo Telegraph.

      Do you recommend Wimal Sangili Karuppan Weerawansa be appointed as the Minister of Defence as he is known to have run several ministries including engineering related ones such as Industries, Traditional Industries and Small Enterprise Development, Supply chain Management, Construction, Engineering Services, Housing and Common Amenities , Urban Development, Construction and Housing, …… . ?

      Don’t you think he is left to rot and waste his potentials?

        Unfortunately, they were not supplied with a lifetime fuel allowance. You know that a bankrupt country cannot supply fuel to its Navy, though it can supply fuel for thousands of imported second-hand cars.
        I hear Harini is negotiating the terms for the next donation, which must include diesel as well. If not, the Navy will auction the drugs to pay for diesel.

          I believe that the AKD’s rule is about to collapse, which is why he permitted Premier Harini Amarasooriya to travel to India and begin enhancing the perception of the current NPP-led government. She is discussing the reputation of her Indian university during her visit for this reason.

    Everyone talks of ‘Arjuna Mahendran’ and ‘Ranil W’s Bond Scam’.

    Does anyone talk of ‘ Thiran Alles’ and his ‘ Go Between’ part played in paying ‘millions’ by Basil Rajapakse to an LTTE operative to prevent the Tamils voting at a Presidential Election, even when this ‘Go Between’ (Thiran Alles) explained how it was arranged, released in a video presentation? Apart from that, many such ‘Shady Deals’ have come to light. For example, the major role he played in the ‘W 15 Hotel’ attack using the ex-IGP Deshabandu Thennakone.

    Shouldn’t this Government be accused of ‘Fixing Files’? Not fixing, those files have been ‘Stone Walled’. If not done, this is not Sri Lanka.

    This is a contradiction. Ranil blocked the extradition of Mahendran.
