In a fiery speech delivered in Parliament today, MP Harsha de Silva, Chair of the Committee on Public Finance, passionately criticized the Sri Lankan government’s latest move—the introduction of the online safety bill. MP Harsha minced no words, calling it an “archaic and draconian piece of legislation” that violates fundamental principles and represents a significant overreach by the government. His critique underscores the potential damage this bill could inflict on both investment prospects and freedom of expression in Sri Lanka.
At the heart of MP Harsha’s criticism lies in the bill’s creation of a commission appointed by the President, which would be tasked with determining the veracity of online content. He rightfully questions the credibility of such a commission when the government itself has been accused of misleading the public, including misrepresenting its financial reserves to the tune of billions when they were merely in the millions. How can a government notorious for disseminating misinformation claim the moral high ground in discerning truth from falsehood?
MP Harsha de Silva’s critique is grounded in the potential ramifications of this bill. He points out that global tech giants such as Google, TikTok, Meta (formerly Facebook), and others are unlikely to comply with laws that impose restrictions on their operations and force them to police content based on arbitrary judgments. This begs the question: can a financially troubled country with an authoritarian regime realistically dictate terms to some of the world’s largest tech companies?
The online safety bill, according to MP Harsha, “imposes unfair obligations on platforms to police content over and above what is necessary” and lacks foresight in considering future technological advancements, such as AI and its role in verifying authenticity. He raises a valid concern that these restrictive laws could drive these major tech players away from Sri Lanka, thereby contradicting the government’s apparent desire to attract foreign investment.
As MP Harsha articulates, “On one hand, you want them to come and invest, and on the other, you’re bringing legislation to curb their operations. This is a major contradiction.” It is a contradiction that could have far-reaching implications for Sri Lanka’s economic growth and technological progress.
MP Harsha’s feedback on the speech highlights the fundamental importance of the right to express views freely—a cornerstone of any democratic society. The government committee’s power to determine the veracity of content and force platforms to remove it is an affront to this fundamental freedom. It is essential to recognize that a government-appointed committee cannot effectively discern truth from falsehood in an era where information flows across borders at the speed of light.
Furthermore, MP Harsha’s astute observation about the regressive nature of the bill rings true. In an age where technology continues to advance rapidly, the future of communication and content moderation will heavily rely on artificial intelligence and sophisticated algorithms. Imposing archaic legislation that doesn’t account for these advancements is not only backward-looking but also hinders Sri Lanka’s potential to adapt to the evolving digital landscape.
It’s worth noting that tech companies already have their own community guidelines in place and are vigilant in ensuring their platforms are free from hate speech, harassment, and other forms of harmful content. Therefore, the government’s heavy-handed intervention seems unnecessary and counterproductive.
In conclusion, MP Harsha de Silva’s scathing critique of the online safety bill highlights the significant concerns surrounding this proposed legislation. It not only threatens to deter foreign investment but also jeopardizes freedom of expression and the country’s ability to embrace future technological advancements. Sri Lanka must carefully reconsider the consequences of such an overreaching law and seek a balanced approach that respects both the rights of its citizens and the needs of its digital economy. In an increasingly interconnected world, it is vital to navigate these challenges with wisdom and foresight, rather than resorting to draconian measures that stifle progress and liberty.

Are you joking, you are not comparing Harsha the Sinhala/Buddhist with Madiba.
Don’t take Harsha seriously, he is an opportunist and an educated stupid politician

This is what he said in the parliament of crooks in November 2014 just before the elections of 2015:

Excerpts
…
“UNP MP Dr. Harsha De Silva told Parliament today that his party is fully committed to protect the security forces who freed the country from terrorism and the political leaders”
..
“I am telling to the world. We (UNP and myself), will not allow anybody to take President Rajapaksa or any other leader to International court about War Crimes, We will not allow the President whether he won or lose to be tried before war crime tribunals,” Dr. de Silva stressed
…
“I am a proud Southerner and a Sinhala Buddhist. I have no desire whatsoever to align with the Tigers and betray my country,” the MP stressed responding to the accusation against him from the government Minister.

Native,

Please don’t dodge the issue ……. by dragging in Harsha: he is not a leader. The clip is about Ranil.
–
Ranil is the current leader of the nation. What do you have to say about his humility and principles: if he has any?
–
If you can’t be honest about Ranil, you are no better than Harsha. Unfortunately, that’s the fault with most Lankans. And why the country is in such a mess.
–
People change their “principles” according to the leaders they support! The same people who were hell bent on criticizing the Rajapakses for suppressing free-speech and human-rights are now supporting Ranil to the hilt to suppress free-speech and human-rights.
–
Now, I’m not naming names! :))))
–
Ranil is not trying to suppress free-speech and human-rights for the good of the country but for the benefit of him: to cling on to power illegally indefinitely: a crude human trait common around the globe with power-hungry despots.

That’s why I said very early in the forum, I know what most Lankans are going to think before even they begin to think. It’s so predictable: how their emotions (likes and dislikes) take over. Their emotions don’t give their intellect a chance to come to the fore. ……… Look, what I said about Easter Bombings a day after the incident.

That’s why I say, no Lankan will save Lanka: I know them only too well! …… If we are redeemed, it’ll be by fortunate accident/coincident.

–
Where do I start?
–
Ranil was and is being surrounded by people like Harsha.
The problem didn’t start with Ranil, nor with JR. If you want to talk about humility and principles you will have to go back to the public racist Anagarika Homeless Dharmapala and his followers. Then of course D S Senanayake (who opposed free education to all and then disenfranchise the hard working upcountry Tamils).
–
Then of course the Banda’s ‘Pancha Maha Balavegaya’ unleashing the mad dogs.
Socialism and all those crap, followed by self sufficiency drive of SJ’s old flame or crush, …. corrupt practices which has become part of the culture.

I thought Dr Harsha was above the general riffraff in Parliament but the above quote puts him firmly back with yobs. How can an educated man confuse justice & nationalism? The Military of a democratic country has to abide by the rules of war which differentiates them from terrorists. In the heat of the battle, atrocities are committed but the govt. cannot condone kangaroo courts & vigilantism. In particular, the President of the country should be above board, & by blindly defending him in public, Dr H was probably playing to the gallery but by doing so, he has shot himself in the foot. In this context, DR H would be obviously safeguarding GR, therefore, can we expect an impartial investigation to the C4 accusations of bombings & unsolved murders, or for that matter, any atrocities by politicians?
What a hypocrite, now championing for freedom of speech. C4 documentary has put our political system in a dangerous light but discrediting C4 will not convince the world. The only foreign investors would be dodgy businessmen, the damage was done without On-line safety Bill.

“Did you really think that we want those laws to be observed? We want them broken. You’d better get it straight that it’s not a bunch of boy scouts you’re up against—then you’ll know that this is not the age for beautiful gestures. We’re after power and we mean it. You fellows were pikers, but we know the real trick, and you’d better get wise to it. There’s no way to rule innocent men. The only power any government has is the power to crack down on criminals. Well, when there aren’t enough criminals, one makes them. One declares so many things to be a crime that it becomes impossible for men to live without breaking laws. Who wants a nation of law-abiding citizens? What’s there in that for anyone? But just pass the kind of laws that can neither be observed nor enforced nor objectively interpreted—and you create a nation of law-breakers—and then you cash in on guilt. Now that’s the system, that’s the game, and once you understand it, you’ll be much easier to deal with”.

Sirisena’s inaction – once the warning was received – and keeping the rest of the cabinet in the dark and the gloating of Mahinda and Namal after the event makes me deeply suspicious this is a paid and planned plot by the last Octobers’ coup plotters to capture power at the next presidential election. I suspect this plot was hatched by Basil and executed by Gota with some rouge elements in the forces.
–
Just like Prabakaran (who had suicide-bombers aplenty) was paid to prevent Tamils from voting ………… Money changed hands between the Rajapakses (with the knowledge of Sirisena; listen to the defence secretary) and the “Leader” of this insignificant “Muslim” outfit to carry out the dastardly act.

The attackers have had unhindered accesses to training, weapons, funds and freedom to execute their plot. This could not have happened without the knowledge and tacit approval of powers that be.

I am not taking sides, but consider how these things work in Singapore, a country much admired by Sri Lankans.
Singapore has what it calls ” libel laws” , according to which anyone making statements deemed false by the government, can be fined to the point of bankruptcy.
Then there is India, where “anti-national” statements on social media are strictly controlled. Hysterical YouTube channels such as we have here are not found in either country.
Thailand still has lese majeste laws, under which criticism of the King is absolutely forbidden, even though everyone knows the guy is a playboy or worse.
Even without these laws, people do get locked up here on the say-so of some monk or other. So, what’s new?

RGS was Dudley S’s cousin and his communalism was unlike the rabble rousing of KMPR.
There were many of his kind in the UNP, but many choose not to talk about such things.
*
KMPR was a populist rabble rouser who whipped up communal feelings. (He was held in house arrest after the July 1958 riots.)
He and his wife Kusuma founded the first JVP of the country in 1957. (Jathika not Janatha).
*
RGS contested JRJ in Kelaniya in 1956, and rendered a humiliating defeat (RGS 71.55%; JRJ 27.42%. That injury was self inflicted by JRJ.)
This may interest you:
“He joined the government of S.W.R.D. Bandaranaike, having been appointed again Minister of Trade and Commerce. He along with Philip Gunawardena, Minister for Agriculture and Food; was instrumental in convincing Bandaranaike to award the lucrative shipping contract to import rice from Burma and Thailand to the government own Ceylon Shipping Corporation and lucrative sugar manufacturing contract to the government Sugar Cooperation, preventing these going to companies created by Mapitigama Buddharakkitha Thero and his associate H. P. Jayawardene. This was found to be the reason for the assassination of Bandaranaike in 1959.”

Controlling the internet requires a sophistication that Ranil Rajapakse and his acolytes do not have. China tries it but its people have means of circumventing it. Singapore more wise, simply does not do it, opting instead to publish its own version whenever what it disagrees with it is published so that the public can judge. Ranil Rajapakse swirls in the pool of untruths from the denial of bribery, the killing of Tamils, the missing persons and the murders of journalists. Who is going to trust this government and its “truths”. At every human rights review, a poor diplomat prejudices her professional ethics and becomes a laughing stock of the world trying to defend her government. In the past this was done by Ministers. But, their credibility is gone for ever so a poor diplomat is forced to make statements she hardly believes in. Why does she not do so instead of doing something so unBuddhistic.

However the former Gota’s hand picked Sri Lankan Ambassador to Germany Manori Unambuwe thought otherwise.
Please read the following excerpt:
–
“During the tele-conference Unambuwe floated the idea that an anti terrorism task force on cyber security should established to monitor social media platforms of youth in Europe, especially Sri Lankan Tamils living in the area.
“I am looking at how to build an idea of inclusive nationalism and promote the Sri Lankan identity, rather than Tamil, Muslim identity” the new envoy said. “We must develop different story lines that will have traction in Germany such as emphasis on sovereignty and territorial integrity. We must highlight that terrorism is very much alive with the LTTE, ISIS and others. The fight today is in cyberspace for example there was an Instagram campaign recently which ran the tag line – I am a Tamil and the genocide is a part of my identity. These things must be monitored closely and countered. You have to have a Counter terrorism Task Force on Cyberspace to monitor these campaigns in Europe and use Sri Lankan (Sinhala) youth as a front to counter these things,”

We know every crook’s heroism. He has in history the part of his share of protecting Evil. After signing the Resolution 30/1 of UNHRC, there was finger pointing among New King, Evil Emperor and Mangala about who was the culprit who signed the resolution. As Mangala was the junior, the honor of having the “sin of traitorism committed against the Great Land of Mahavamsa Buddhism, which was discovered by the Lion cup Vijeya” was conferred to Mangala. Mangala was promptly withdrawn form UNHRC meetings after that. Until another suitable Noble Sinhala Buddhist Intellectual Knight was selected to save The Wildlife Sanctuary of RavanaLE, Langkang at UNHRC, temporarily that job was vested with Harsha. Harsha immediately proved what a talented crook he was at the meeting of UNHRC Peer Review sitting. Tell me if it is something about plotting against Tamils, every Sinhala Buddhist Intellectual is a master mind; they surrender the Body, Soul and Property to that noble deed. But, here, not one requirement out of the 262, which Harsha lavishly signed at the meeting to fix was ever done.
