Talking Points – Sri Lanka Muslims Event

Good afternoon! It is a real honour to participate and speak at this book launch, to join the distinguished speakers and all who are present here. I thank the organisers for inviting me, especially Shreen Saroor and Yamini Ravindran for enabling my participation today.

I want to begin by congratulating the authors of this excellent and much needed book, Muslims in Post-War Sri Lanka: Repression, Resistance and Reform.

It is full of insights, critical analysis, and written in very accessible language and form. Some of the pages are heart-breaking to read, but at the same time inspiring as it documents not just the trials and tribulations of the Muslim communities in Sri Lanka, but it is also a candid diagnosis of complex challenges that points to solution—at least to some of the problems, and certainly to human rights defenders in Sri Lanka and their collaborators everywhere.

I will not speak about the book much more—the book speaks for itself and it is an essential read for everyone. But I do want to speak to the context of the book, especially as seen from my perspective as the UN Special Rapporteur on freedom of religion or belief, and one who had made a formal visit to Sri Lanka in that capacity.

I want to therefore use this opportunity to acknowledge the continued efforts by international and Sri Lankan civil society and human rights activists, through their reports and advocacy initiatives, to keep abreast the international community of the human rights situation in the country.

This is a situation, that is characterized by regressive steps, in a number of areas, including the rule of law and the respect for independent institutions; restrictions in the enjoyment of human rights; persistent incitement to hatred and violence against certain communities; and entrenched impunity and lack of progress in the transitional justice process.

In the post-war period,international community, has worked with Sri Lanka to promote national including through capacity-building, as well as through mechanisms to support the transitional justice process, such as the 2015 investigation of the UN High Commissioner on Human Rights into alleged serious human rights violations and related crimes during the period covered by the Lessons Learnt and Reconciliation Commission (LLRC).

However, as the UN High Commissioner for Human Rights stated in February this year, successive Government commissions not only have failed to credibly establish truth and ensure accountability, but they have also obstructed investigations and judicial proceedings on a number of human rights cases.

Little progress has been made with regard to the establishment of the truth and reconciliation commission and the special judicial mechanisms, and there are still many questions around the status and operation of the Office on Missing Persons and the Office for Reparations.

The 2019 Easter bombings were followed by a significant rise in inter-communal tension, specifically targeting members of certain religious minorities and their places of worship, in particular Muslims; a community that has been for many years stigmatized and its existence portrayed by media, religious and political leaders, as a threat to national cohesion and security.

My mandate has been closely following and reporting on the human rights situation of religious minorities in the country, and it has repeatedly called on the Government to take all appropriate measures to curb incitement to hatred and violence against members of minorities and to put an end to securitization of ethno-religious differences for political ends.

During my 2019 visit, I noted with concern that the transitional period, following the lengthy conflict has been marked by simmering tensions, perpetuating a sense of insecurity, with legal and institutional settings that offer majoritarian privilege and undermine the equal protection of the law for minorities.

I had recommended that the Government step up its efforts to ensure accountability for past and current violations; to dismantle the networks of hate; to ensure equal access to justice for all, without discrimination; to repeal the Prevention of Terrorism Act and revise the provisions of the Penal Code that relate to various offences on religion-related matters; to take appropriate steps to ensure that political and religious leaders understand their responsible roles in combatting hateful narratives and in fostering inter-communal trust and dialogue; to undertake educational initiatives to promote understanding, tolerance, gender equality and friendship among communities.

However, the Government’s withdrawal, in February 2020, from the HRC Resolution 30/1 process is not an encouraging development towards an inclusive and thorough reconciliation and accountability process.

Another worrying trend is the shrinking civic space and the increasing surveillance and scrutiny of civil society organisations, victims’ groups and human rights defenders, in particular those advocating for the rights of persons belonging to minorities. The HC’s recent report has indicated that since the 2019 Easter attacks, dozens of organizations working on documentation or litigation around accountability and disappearances issues were visited by security agents, and their members being often summoned by the police for questioning on their activities.

The COVID-19 outbreak has led to further regression in human rights. It has also led to the imposition of compulsory cremation, disregarding the cultural and religious traditions and practices of certain communities, in particular Muslims, when there has been no established medical or scientific evidence that the burial of dead bodies could lead to increased risk of spreading COVID-19.

Counter-terrorism laws have been often used to suppress and criminalize dissenting views and criticism of the Government’s policies, and have led to the arbitrary arrest and detention of hundreds of individuals, most of whom are members of ethno-religious minorities and minority human rights defenders and lawyers.

Heejaz Omer Hizbullah, a prominent lawyer advocating against the rising hate speech and violence targeting Muslims Sri Lanka, as been detained since April 2020, persecuted on vague terrorism allegations, aiming at intimidating him for his human rights work and the practice of his legal profession. He is being held for over a year without officially being charged. In the meantime the allegations appear to have changed focus linking him with an alleged misconduct concerning an education charity he was leading.

At the same time, little has been done to investigate and prosecute individuals, including members of police and security forces, for past violations, such as torture, enforced disappearances and extrajudicial killings, as well as to undertake the appropriate measures to prevent their recurrence. The appointment to senior command of military officers whose troops under their command had committed gross violations during the war, and the control of the judiciary by the executive branch and the unfettered discretion of the President to appoint all judges of the superior courts, as per the 20th Amendment to the Constitution are just few examples of how the Sri Lankan authorities appear to understand the meaning of accountability, justice and national healing process.

Of particular concern is the recent adoption of the Regulations on “de-radicalisation from holding violent extremist religious ideology” of 2021, which expand upon provisions of the PTA, and which contradict Sri Lanka’s international human rights obligations. In August 2021, my mandate along with other UN experts wrote to the Government raising concerns about these Regulations, the violations of the rights to freedom of expression, religion or belief, and violations of due process and of guarantees against arbitrary detention by the imposition of mandatory “rehabilitation” without trial for all those suspected of causing or intending to cause “violence on racial, religious or communal disharmony”.

In addition, more needs to be done with regard to the rights of women and girls, and the Government needs to proceed with an effective follow-up to the National Human Rights Action Plan of 2017-2021, which contained a separate chapter on women’s rights, and to the Policy Framework and National Plan of Action to address Sexual and Gender-Based Violence of 2016-2020.

In this context, I have always reiterated that religion should never be an impediment to the enjoyment of all human rights by any person, irrespective of gender, gender identity or sexual orientation.

We need to keep in mind that the protection of certain ethnic or religious communities against discrimination or violence doesn’t mean an automatic approval of any communitarian practice or belief that may violate the rights of certain individuals within the said communities. Much of my work globally has focused on addressing multiple forms of discrimination or intersectionality—about additional disadvantages suffered by minorities within minorities. Women and girls in religious communities are often in this situation. Religious beliefs or cultural traditions should never be invoked to justify human rights violations against women and girls, as well as against LGBTQ persons.

I said there were very promising elements in this book—and among things that struck me most is the intersectional analysis offered by two others, Nabeela Iqbal and Ameer Faiz, with regard to the experiences of Muslim women, and the prospect of meaningful reform to the Muslim Marriage and Divorce Act. The reform proposals come at time when there is also heightened international attention on the role of women in fostering peace security, and the delivery of the Sustainable Development Goals which pledges to leave no one behind. I understand the Cabinet has approved a full reform of the Muslim Marriage and Divorce Act in April this year.

The proposed reforms include better access to justice for Muslim women and protections against what Professor Frances Raday calls harmful practices and lesser infringments. This is an important moment, that comes after our 60 years of struggle to reform MMDA and the male only quazi system and other infringments of Muslim women’s rights, and this opportunity must not be squandered. I call upon Muslim leaders and politicians to support the reform of the MMDA, to recognise that women have an equal right to freedom of religion or belief as do men.

I further join the UN Committee on the Elimination of All Forms of Discrimination against Women by calling on the Government of Sri Lanka to amend all personal laws, including the Muslim, Kandyan and Tesawalamai Personal Laws, and to remove all discriminatory provisions affecting women and girls.

I want to conclude by commending the work of the vibrant Sri Lankan civil society and their proven capabilities to accurately monitor and report on the human rights situation in the country. I encourage them to continue to do so, including working with the global human rights movement and mechanisms.

And lastly, I want to thank the authors, editors, publishers and other contributors of the book for producing such and excellent volume, Muslims in Post-War Sri Lanka.

        The other side of CIA and US SOF weaponizing religion, particularly Islam and Buddhism through setting up Islamist “Terror groups” is Muslim victims, Human Rights and Victimology of Muslims – a well funded USAID research industry to divide, distract, rule and loot the Global South! A lot of women Muslim academics have made careers out of narratives of Muslim suffering without any wider geopolitical analysis.
        Haniffa and Soor are good examples of this trend – USAID funded academics and activists to promote ethnic division, as we see also on Facebook now revealed by the Facebook Whistl blower who describes how Facebook spread Hate attacks in Burma/Myanmar and Ethiopia. Part of the US destabilization of Asia and the Indian Ocean Region.

        Do not agree in principle, but which religion is exception to your complaints about abuse for imperialist agenda?
        Are corrupt politicians unique to Muslims?
        The Muslims may be a little bend on gender equality, but are other religious communities truly committed to women’s liberation and gender equality?
        There is need to be sensitive in criticism so that it does not undermine support against oppression.

    Does the book present a comparative analysis between status of religious minorities in Sri Lanka and religious minorities in Muslim majority countries.
    If not ( I bet though I haven’t read the book) the book is not worth the money you pay toilet paper.

    In that meeting, Hoole brought in his single issue human right book (Broken Palmyra Tree) and was debuting it, instead of “Muslims in Post-War Sri Lanka: Repression, Resistance and Reform.”, the book that was on the agenda. Very cheap mentality. Sumanthiran PC was very illogical and unprofessional. Sumanthiran was putting forward an argument that the Thesavalamai has to be changed because Muslims extremists would feel defeated if their wrong Sharia laws are reformed. We have many times heard from the Appe Aanduwa’s advocates that because America is doing war crime in Middle East, Aanduwa has to genocide Tamils. But they never proved any of American Genocide, other than the Native Indian were destroyed in the staring years, which was the political civilization underdeveloped time. Sumanthiran had not proved in the courts that his woman client’s stand was right, but argued that the Thesavalamai had to be changed. Thesavalamai can be contested in court and Thesavalamai also administered by the same judicial services judges, unlike MMDA, where untrained Quasi judges issue the verdict. Sumanthiran was arguing in that meeting that because he couldn’t win a case for a woman (he didn’t go to elaborate the issue), the Thesavalamai have to be reformed. He didn’t feel ashamed of himself losing in district court and high court appeal, in both, on that case.

    He wanted the Thesavalamai changed, for whatever the reason, so he would n’t lose again. In all personal laws, there are circumstances that the husband and wife should agree on the decision and to indicate that they should sign the documents, (other than dowry property disposal where the woman has the sole say.) If one party is unfair on an issue, the loser can always apply to court and if the court makes a decision, that will not strain their marital status. They both are bound by that decision and should continue to live as husband and wife. Otherwise, it stems as ground for the other party to seek divorce. The issue on the case Sumanthiran appeared is, the judges didn’t buy his talk that the husband’s stand was unfair, so they didn’t overrule him. Mr. Gandhi once said that the lawyers hang their mistakes. That is what Sumanthiran has to do, but Sumanthiran’s reason was not a valid reason to change Thesavalamai. Thesavalamai recognize dowry, but Lankawe personal law doesn’t so Tamils dowry get overruled on that issue as illegal transaction. Though MMDA picked up its dowry from Thesavalamai, it doesn’t get overruled, So Muslims’ dowry is a valid transaction.

    This is a highly exaggerated statement.

    May be true because it is ethnic-religious minorities (Tamils and Muslims) who carried out terrorist activities and they are the people who are very likely to carry out terrorist attacks in future. Several of them were caught with explosives, detonators and guns.

      There is a reason why counter terrorism laws have not killed Veddas, Chettis, Jews, Bohras, Parisis, real Burghers (not others with European names) and other minorities as many as it has with the others.

      Only Tamils, Muslims and Sinhalese (mostly Buddhists) have been killed and detained by counter terrorism laws because all these had terrorist branches that engaged in violence.

      Every action has an EQUAL and opposite reaction.
      Terrorism ————-> Counter-terrorism (with equal ruthlessness)
      Suicide bombers —–> Mass arrests and abuse (with equal ruthlessness)

      However, people would not tolerate murderous Rajapakshes with all the high crimes (murders, money laundering of high magnitude and crimes in politics) no doubt, time will show how the suppression would turn out to be all aggressions in the forseeable future, no doubt, people though branded as ” sinhala buddhists” will have to destroy high criminals sooner than later. I see the light at the end of tunnel, even if that could take few more months. This time, it is not against Praba but Rajapakshes.

    Only solution is to split the island equitably into 3 mono ethnic nations and relocate people.

      Being a Muslim is not an ethnic but a religious identity and further Chetties or Colombo Chetty is not an ethnicity but a caste amongst Tamils. They are descended from Tamil Chettiar families who migrated to the island during medieval times and later converted to Christianity or Catholicism. Now certain castes like the Colombo Chetty and Parvans or Bharatha and religious groups, like the Muslims amongst the Tamils are now conveniently claiming separate ethnicity for their caste, or religion for perceived advantages. This is also encouraged by the racist Sinhalese led state so that they can divide the Tamils and destroy all of them one by one ultimately. The Muslims should have learnt this bitter lesson by now. In the name of their religion and an imagined Arab origin, which they hardly had, they denied their immigrant Indian Tamil origin and Tamil heritage and joined with the Sinhalese to marginalize and commit war crimes on the island’s Tamils. Now crying foul and unfair, as the very same Sinhalese whom they helped to kill marginalize and commit war crimes on the Tamils have turned on them.

        Like I stated before, Sri Lankan Muslims are ethnic Tamils who started to migrate from South India to the island during medieval times. However, the vast majority of them only arrived during the British colonial period. They have no history of ruling or owning lands on the island. All the ancient history of the island is Sinhalese or Tamil, so are the ancient archaeological ruins. Nothing Islamic. Not even a hundred years old. How can you now claim for land, when you never had one? Moreover, the island’s Muslims deny their actual South Asian or South Indian origin but claim to be descended from foreign Arabs and now dress and behave like alien Arabs. Therefore if they want a separate land, they should claim this in the Arabian Gulf or go there to their Arabian homeland. You cannot have the cake and eat it. Badly want to be Arab, claim to be Arab and now behave aggressively like Arab but want a homeland for you fake Arab immigrant Dravidian South Indian origin converted community, only in the Tamil areas of the island, where only 28% of you live. Very frightened to claim it in the southern Sinhalese areas where 72% of the island’s Muslims live, as they are aware of the repercussions if they do.

    The problems in Sri Lanka is the problem of the Sinhalese community. Sinhalese community are confused because of their political and Religious leadership who are not genuine to the people and country. When the political and Religious is not genuine and honest to the people you cannot expect anything better from them. They created hatred, violence, and terror and became rich while ordinary Sinhalese became slaves of them.

      Spot on ! Few lines , crystal clear ! If the country is led by the Sinhalese ,
      Sinhala Buddhists to be specific , then they take responsibility to
      govern with due respect to all its citizens . Simple as that . When they
      failed to do that , they resort to less hassle , cheap , fraudulent , corrupt
      divisive and racist approaches to win only the majority numbers
      ,making the number game the only outstanding feature in democracy
      which is a severe blow to democratic norms ! So , there is a huge
      responsibility on the shoulders of the majority , not to let anyone take
      them for a ride by cheap tactics that could set the country in flames !
      The first lot to face the consequences by unwise choices are none other
      than the majority ! The fraudsters’ target , the chief target is , the
      Sinhalese themselves . The day they understand this in clear terms ,
      all problems will start to pack their baggage !

    • Started clashes between Sinhala Buddhists and Muslims by attacking Sinhalayo and eventually put the blame on Sinhala Buddhists.
    • Trying to give an impression to the International Community that Sinhala Buddhists are marginalizing Muslim minority to tarnish the image of Sinhala Buddhists and get their sympathy in the same way Tamils did.

        I told you that ISIS took the responsibility for Easter Sunday terrorist attack by Muslims. If they took the responsibility, obviously they had a role in planning.
        ISIS have no grudge with Sinhala Buddhists. They have a grudge with Christians/Catholics. Even in Sri Lanka, the Catholic Church stood with Tamil terrorists who were Catholics and Hindus that kicked out Muslims from Yapanaya giving 48 hours notice and massacred Muslims praying in a Mosque.
        What we do not know is whether there were any other invisible hands behind ISIS. Have you got any idea?

          That is because the Chingkalla rapist Special Task Forces and the Thullukans were massacring, ethnically cleansing Thamizh Hindus and Christians in the east and destroying Hindu temples. The so-called mosque where these Muslims were praying was the brain centre and headquarters where all this was planned and the arms used for this massacre were stored. In the North, the Thullukans were spying for the Chingkalla armed forces and hiding weapons in their places of worship.           ISIS never claimed responsibility for 4/21, First we all believed the Colombo media and because of that we thought 4/21 was a retaliation to the New Zealand Mosque attack. PM Jacinta, who seems to have had Indian intelligence, immediately denied that. It took some time to realize that Tamils Christian were the one targeted, along with Tourists. Aanduwa used its telephone companies to get a connection to ISIS for guys it had imprisoned in Saithamaruthu house. America, which was following every movement of the local guys based on Indian Intelligence, located the telephone answering party and bombed them inside the cave. But Aanduwa only bombed its prisoners in its house. None of the guys in the prison house knew Aanduwa was going to bomb them that night. They were planning that night to shoot as many Armies as possible before they died. Taking cyanide capsules is LTTE’s style because if they get captured alive by the Rapist Army, it will gloom as hell in the earth. ISIS Jihadists do not kill them even after they kill many people on the roads. That is because if had died not for the purpose to kill non-believers but save them from fear of being arrested. then they don’t get their 72 girls. That is why it was abundantly clear they didn’t commit suicide, but Aanduwa bombed them.

    Quiet rightly the book is about Muslims in Posy War Sri Lanka, pre war Sri Lanka Muslims didn’t have any issues. Whereas the Tamils were subject to state terrorism and discrimination and violence since Independence.

    Muslims have to blame themselves they voted for th 20A and in return dead Muslims are treated as carcass and transported miles away from their home for burial/cremation.

    The current regime doesn’t care about the Muslims neither does the Muslim politicians . The Muslim politicians acted like prostitutes and got paid for sleeping with the Rajapasas to vote for 20A

    It’s interesting that “Dr. Ahmed Shaheed – the UN Special Rapporteur on Freedom of Religion or Belief” in his speech didn’t mention the word Tamil even once!!!!

      Here is a dilemma. Book is about Muslims’ rights. Dr. Ahmed Shaheed is a UN official plus a Muslim by name. He had to steer his ship though a narrow canal, where he will not be seen that he was invited to talk about Muslims rights because he is one of the Muslim high official at UN. Yet hosts may have had that as one of their purpose. But he wanted him to be seen as he was talking about Lankawe Muslims issue because Lankawe Muslims are one of the deprived minorities in Lankawe. You are right that Muslims bought the current situation to them voluntarily. Aanduwa, on the first targeted Burgers and Tamils. Influential Burgers escaped. Tamils stood alone as the sacrificial ram under the Rapist Army’s cluster bombs, Chemical Bombs……. Sympathizing for Tamils or felling jealous of thier pathetic status, Muslim politicians voluntary went and told Aamduwa, we too have back, if you will pay us you can swing your whips on our back too.

    The Muslims are trying to divert the criticism of their primitive Islamic desert laws, throttling the progressive Srilankan Muslims in general and Muslim women in particular – FYI Mr. Shaheed both the Kandyan law and the Thesawalamai are secular family and inheritance laws, not religious laws like your Muslim law, which is nothing but another name for Sharia Law. When it comes to the Thesawalamai it was codified under the Dutch occupation of Srilanka, and it was probably on par with any of the western laws at that time. It has had some revisions with time and could be amended on a few more issues like the age of marriage and so on, but it actually has a lot of provisions to safeguard women i.e daughters’ and wives’ rights, whether its property and inheritance rights in regards to their own families and in regards to the husband and in-laws. Kandyan law allowed some primitive practices and was revised under the British, where Polyandry was forbidden – nobody is protesting and going on crusades to bring back those primitive practices. So you please do not try to drag the secular family laws of Sinhalese and Tamils into your Muslim Sharia-law problem.

    This is absolutely not true – dowry is recognised in Srilankan law and no court can overrule that, as Thesawalamai is a law in all courts in Srilanka, not only in the northern province – i.e. a Jaffna Tamil living in Colombo or Kandy or Matara can demand that his/her case be handled according to Thesawalamai, also for the properties outside northern province (applicability of Thesawalamai throughout the country for Tamils of northern province was settled some decades ago). When it comes to dowry, it has to have been done in the proper way, i.e. there should be a dowry deed. Only if there is no dowry deed, the dowry is not legally recognised, but its never considered an illegal transaction. Another legal issue in regards to dowry is that, contrary to popular belief and practice, the husband has no legal rights to sell off or appropriate dowry property, since it is the wife who is gifted with the dowry by her parents and not the husband and dowry property is legally solely hers.
