Dangerous Conspiracy To Repeal The 13th Amendment ?

The 13th Amendment to the Sri Lankan Constitution came by largely as a result of the Indo Lanka Agreement (1987) after substantial and careful study by legal and other experts of both countries. The Agreement came at a time when the JR Jayawardene Government was under extreme pressure simultaneously from the JVP in the South and the LTTE in the North – both having launched island-wide attacks on State utilities as well as the Police and the armed forces. It is reported in a crucial meeting called by President Jayawardena – in the presence of most of the senior Cabinet Ministers the President asked the 4 chiefs of the forces individually if they can hold the government’s writ in the event of attacks both by the JVP and the LTTE. As the Forces chiefs answered in the negative, Jayawardena had obtained the sanction of his Cabinet (1) to call in the IPKF to use both their substantial personnel and material resources to disarm the LTTE within a specified period (2) to concentrate using available Forces personnel in the South to confront the JVP insurrection, which, by that time had succeeded in its mis-information that the JRJ Govt was in the process of handing over the country to India.

It may be recalled from 1971 the JVP had structured their programme, including the initial 5 lessons of Rohana Wijeweera, on an anti-Indian platform. But, in fact, they aimed at the local Tamil population – both indigenous and of recent Indian origin (Estate Tamils) to create anarchy in the country. It was this hatred that was used, in a large measure, to provide the venom for the attack on Tamils and their properties in Colombo and the rest of the country in the pre-planned pogrom against them in July 1983. JVP cadres are known to have created much of the mayhem. It is note-worthy many Indian-owned businesses were also destroyed during this period – although the Sindhi, Gujerati and Memon industrialists, who lost millions then, had nothing to do with the Separatist Agenda – then successfully used to poison Sinhala minds.

While the reality is JR Jayawardena used his considerable political experience and skills to get the better of the younger Indian PM Shri Rajiv Gandhi to Sri Lanka’s advantage to disarm LTTE using Indian soldiers and material resources, the JVP and Sinhala extremists – both lay and cleric – conspired here to project to the Sinhala mind the Indian Govt used coercion on the JRJ Govt to sign the Indo-Lanka Agreement. That mind-set has fertile soil in the semi-educated and confused Sinhala mind in a generation that is now over a quarter century old. The impression then and now in India, among political leaders, historians and academic circles is that India walked into a JRJ laid trap – from which it never regained fully. This is probably why when V.P. Singh took over as PM one of his first acts was to recall the IPKF.

The object of the I-L Accord was to help the alienated Tamils in the North Eastern Province (then 2 Provinces) via the instrument of the 13th Amendment to enable them to secure minimum rights in running their own affairs. Both PM’s and their teams were of the view the Separate State option should be discouraged at all costs. Clearly, Prabakaran and the LTTE were against this line of thought because by then Prabakaran had embarked on his “Eelam or bust” course. There is reason to believe he would have been content with local rule by the Tamils in the North and East, without prejudice to other minorities within, if Mrs Bandaranaike’s or JRJ’s governments had wisely gone on a path to be accommodative to the Tamils. But both failed in that they considered the Tamil struggle as insignificant and, they erre in the belief this could otherwise be addressed by their numerically superior armed forces. This is surely why both refused to yield to the peaceful political agitation of the Tamil people between 1970 to the mid-1980s. This is not to mention the racially-inclined and anti-Indian political forces within both governments which did its share in driving the Tamils to the extra-Parliamentary route.

The Governments of JRJ, Premadasa and CBK could not ignore the potent threat of the Buddhist hierarchy – under the influence of the considerably powerful Sinhala extremist wing – to ignore concessions to Tamils in the NEP. Therefore, the benefits of the 13th Amendment did not go to where it was originally intended. Instead – costly, ineffective, duplicatory and corrupt Provincial Councils came into effect in all 7 Provinces and remain there. Arguably, they are totally unpopular with the people in general. As to the Tamils, Prabakaran and the LTTE have to accept the blame because they did not allow the PCs to take root in the NEP. The merging of the 2 Provinces into a single North Eastern Province was aimed initially to address the two main burning issues of the Tamil Nation viz:- State-aided Colonisation and the engineered demographic change of the ethnic ratio. These have been going on in full force from 1956.

It needs to be mentioned here the issue was further complicated by the emergence of an important judicial officer around year 2000 – who hardly concealed his ultimate aim of getting into Party politics. This is unprecedented becausen all his illustrious predecessors shunned the thought of politics and went into graceful retirement. The Sinhala extremist fringe was to jump at the opportunity. They made certain the man was properly used by the Sinhala supremacists to commit the sacrilege of violating a solemn Protocol entered into between the Governments of both India and Sri Lanka. India cannot be a silent witness to this deliberate act of truancy. The post-2000 (year) period saw rapid increase in State-aided Colonisation where the once majority community in the Eastern Province, the Tamils, are now rendered to virtually the 3rd position.So much so, in the recently concluded PC Elections, for the first time in the history of post-Independent Sri Lanka, Tamils no longer are in the majority in the EP – a grotesque aberration that needs to be addressed soon.

The story does not end there. It is clear the Rajapakse government is under pressure to allow PC Elections in the North. Not that they want to. But India and the international community have given them sufficient notice to get their act together. While he allows Elections hither and thither Rajapakse finds flimsy excuses to allow the Tamil people to run their own affairs in the North. With the UN/Geneve staring him at the face come November 2012, he is forced to yield to the Northern PC Elections by late 2013. He knows the Tamils of the North will reject him soundly – in spite of the intimidating and omnipresent armed forces – working hand in glove with his band of “rejected” Tamil political goon squads and killer outfits. Such a rejection, the extremist and Sinhala supremacist groupings close to him will tell him, can increase the chances of the Tamil NEP seeking (and perhaps succeeding soon) the status of a Separate Nation. The example of South Sudan and Bandermoro is there for all to see.

The Sinhala extremists have, therefore, geared themselves not to take the chance of a NP PC gamble.
The powerful Defence Secretary Gothabaya Rajapakse – a government servant and who should remain loudly silent on political matters – has fired the first salvo in calling for the repeat of the 13th Amendment. Lapdog Weerawansa is carrying the baton, predictably. The ever obliging JHU is doing its bit – with that man said to be a lawyer, Gammanpila, calling also repeating Gothabaya’s call abrogation. Gammanpila’s clearly lacks understanding how global diplomacy moves in matters of violation of protocols between sovreign States.
Whatever mask Mahinda Rajapakse wears here, it is unmistakeable he is behind every one of these infantile moves.

When this question was posed to TNA’s Sampanthan by the local media last week, he chose his words carefully and exclaimed “there will be consequences to pay” The Indian Govt – the other party to the Accord – is unlikely to allow its nose to be rubbed in public by what it privately considers a recalcitrant neighbour. Certainly not when a crucial General Election is round the corner in India . In the interest of all, it is best President Rajapakse review his options with a group of trusted senior academics, analysts and policy-makers. In the political column of a respected and savvy Sunday English newspaper the subject is given much credence and described as “Indo-Lankan diplomatic ties are tense and have reached the lowest levels in years” This is certainly not a compliment to President Rajapakse’s diplomatic acumen. These are careful words that should not be ignored.

He will be packed off to the Hague from where he can make statements on the 13th Amendment.

        Particularly, in a juncture, the country, the nation is divided into pieces as NEVER before not being able to see that the rulers are eroding the nation focusing their pockets rather fulfiling their duties but saying ONLY the fairy tales to the majority (who re the rural poor – naive people), your beloved GOTA should be well aware of this.

    I believe that the writer has deliberately over-emphasised the concern and commitment of Sri Lanka’s neighbour India and her intentions with regard to how politics play out in Sri Lanka. I also feel that his unfulfilled ambitions with regard to the establishment of a separate state lie at the core of his discussion although he is careful not to mention it. It would have been a better article if he had merely focussed on the facts and the background to the facts.

    It is true that there is much discussion about 13A today than we had for decades in patriotic journals and among the general public. Perhaps it is this deliberation that this writer, a known apologist of LTTE ideals has interpreted as a conspiracy to repeal 13A. It is no secret that Gotabhaya is against 13A and opines his thoughts straight. If Sengattuvan want to analyse it well that is his right. We say; 13A should have been repealed the day after LTTE was buried in Nanthekadal. And, Sengattuvan had written many half truths here. So, we should have the right to point it out.

    Main news item in Divaina last Sunday was about futility of PCs. In a write up to Lankaweb, Dr. Gundasa Amarasekara says; Project PC was a dud and a flop. I say it was worse, when N & E was one PC, one could say for sure that the entire PC project was on the fence; the South of it was a unitary Sri Lanka and the North of it was an Eelam. Except a central bank, currency notes and a seat at the UN Piripakaran had everything in that Eelam. Few more years of RnilW’s rule, that would have been through as well. So we rid of the bastard.

    Sengattuvan try to project 13A as a project that was devised by JRJ for his survival. He said; “Sinhala extremists – both lay and cleric – conspired here to project to the Sinhala mind the Indian Govt used coercion on the JRJ Govt to sign the Indo-Lanka Agreement.” Sengattuvan has conveniently forgotten that only few months before signing of the infamous Indo-Lanka Agreement Pirapakaran was cornered and India came forward to save him. And to make sure JRJ did what India wanted, its air force dropped parippu to Tamils and warned the old man of what to come if he doesn’t yield to Indian demand.

    So, it is absurd Sengattuvan says that there is no coercion by India, and JRJ used Rajive for his advantage. I say; in the aftermath of parippu JRJ and Rajeev together may have tried to trick Tamils to accept PCs and neutralize Pirapakaran. When ordinary Tamils realized PC is nowhere near Eelam, many of them helped Pirapakaran to fight and also kill javans.

    So, don’t blame just LTTE saying ‘they did not allow the PCs to take root in the NEP’ and utter rubbish saying; “The Governments of JRJ, Premadasa and CBK could not ignore the potent threat of the Buddhist hierarchy – under the influence of the considerably powerful Sinhala extremist wing – to ignore concessions to Tamils in the NEP. Therefore, the benefits of the 13th Amendment did not go to where it was originally intended.” Anyway when Indians had no choice; they got their stooge, Perumal elected as CM but soon he too had to run to India to save his life.

    The manner in which 13A was brought about s law in Sri Lanka is a disgrace for India. In Supreme Court it was passed with just one vote. MP were hoarded to a hotel, kept them overnight, bussed them to parliament, kept the contents of the bill secret, then twist MPs arms to pass it in parliament. It is against all norms of democracy that Sengattuvans are crying as we don’t have in Sri Lanka now.

    Now that LTTE apologists know they cannot get Eelam by bombs, many say they are for one Sri Lanka and they’ll accept 13A. But all their canard is out because; Tamil Nadu Karuna’s wish is Eelam, TNA, Diaspora and Tamil Nadu big wigs say they wanted to use 13 as a stepping stone for Eelam.

    Excluding the issues with the CONCURRENT LIST and the name VARADARAJAH PERUMAL from the narrative of the NEP is akin to not mentioning atom bombs during the war in the Pacific. Provincial Councils are as irrelevant, as parliament is, today. They merely rubber stamp the wishes of the Executive. If not why would provincial councillors pass a bill, hastily at that, that undermines the very provincial council that they campaigned hard to get elected too? Why not pull, the life support plug, on something that is clinically dead?? At best, they provide day jobs for criminals. All this charade so India can prove to they world that they are very bad at amending other peoples constitutions? Enough is enough I say. Out with this horrible amendment! Gota is right but probably should not have said anything.

    If Terror Gota thinks that he is smart enough to annul the 13th amendments unilaterally he is asking for big trouble. The close link between Indo Lanka pact and 13th amendments is very clear. Abolishing 13th amendment is tantamount to obliterating Indo Lanka pact which established India’s right to interfere in Sri Lankan internal and external affairs.

    Signing of Indo-Lanka pact cost thousands of lives. Annulling it would cost many thousands. China and Russia will not help Sri Lanka as they have some idea as to how they would want to share Indian ocean.

    If anything Sri Lanka will be forced to sign Indo Lanka pact 2 which would serve the Interest of India and not Sri Lanka. Sri Lankan being stupid will ensure further domination of India by default.

    I cannot understand why the commentators stoop so low at mud slinging.Ardent Sinhala mindset of Leela and others do not get a clear picture of the subject 13A.They scratch the surface.The Tamil mindset of commentators is the picture perfect opposition of the sinhala chauvinists.What is needed now is being well pronounced by Hon.Samabandan requesting the Govt. to get the services of highly respected academics to study and report on the subject.Selection of academics in Local governance, Foreign Affairs, Ethnic affairs along with respected politicians and civil society representatives will give a clearer picture about the subject than what is coming out of loudmouthed opponents.

      Hi Sunila, Leela s inputs to this blog I have noticed are inconsistent most of the time regardless of the topics that are being addressed. Her way of thinking is unique. She sounds to be JUST enjoying a lot getting back to a rural village near to Horana. However, I expected her to leave much more constructive comments that could then be useful to many of us the readers of CT – afterall from what she drops to this blog, one can guess at her to be 70 year old woman who got the education in Europe. She seems to be comparing the devlopment in SL by going to the times that she left lanka for the UK. Today, not only srilanka, even poorest of the poor the Ethiopians are doing better than had been in 70ties.

        I’ll be a hypocrite if deny I am happy I returned to Sri Lanka and enjoying living in a village hamlet. I am not 70 but I hope to pass that age in a few years. How could I compare today to the days that I first left Sri Lanka. That was in the mid sixties. Besides, I was just nineteen then, so, I haven’t forgotten what then Ceylon was like then.

        Average man earned Rs.3/- per day or less. it wasn’t enough to pay for essentials. Not that today’s need wasn’t needed then. People just couldn’t afford them. Only sub inspector, estate sinna dorai and phi had motor cycles, etc etc.
        Hardly any village had electricity. School children had no shoes.

        Unlike those who spend three weeks in every two or three years, I have been living here for the last twenty years. So, I never was aloof to the reality here. Unlike the WOGs and Colombo wallah who lives in a fool’s paradise and write rubbish, I live with the people and write the truth about here. Whether you guys like it or not, essence of my writing reflects from every election result since 2005.

        I am not saying everything is hunky dory or the place is flowing with milk and honey, but ordinary people know that they have peace after three decades and also can now afford things that they never could before. That’s the crux of the matter. I am sorry, that the peace I am talking may not be the peace that flows through your mind.

        Separatists and their backers hate me for I talk this truth. But I never have written filth for that wasn’t the way I was brought up. If boorish buggers like Silva thinks their throwing of dirt and muck at me and use of rude language and filth can overwhelm me and provoke me, they are sadly mistaken. I shall ignore the ill-mannered bastard.

      Though I do not think there are Sinhala chauvinist anywhere, if you insist calling me one, be my guest.

      Anyway, I’ll tell you that Sinhalas are not averse to devolution. They are all for towns and villages manage their own affairs. But land and police cannot be considered simple local affairs in a small country that is only a one fifth of Tamil Nadu because it affects everyone.

      Besides, knowing what Tamils have been trying in India since 1920s, and how India is controlling it, we shall not give any kind of self determination to any race in any part of this country and take chances once again.

        “Sinhala chauvinist” and “Buddhist Chauvinist” are just LTTE slogans, along with such terms as “yellow robed terrorist”, “saffron-robed thug”, “Sinhala Hoodlums”, “Failed State”, “Terror State”, etc., etc.

        Noticing such phrases and terms helps identify which of the commentators are still programmed with the Cult of Prabakaran, and how deeply programmed. Most are slowly waking up…unlike the commentators on Lankaweb, who were never hypnotized in the first place, by the Cult of the Tigers and the “separate state” for “ethnic Tamils” that they, and their masters, promised.

    As far as I know, the linking of the JVP to the ’83 riots is inaccurate. JRJ and Premadasa blamed them for it, but I don’t think they were behind it. There have been many Tamils in the JVP, especially in the ’71 insurgency. Even that Tamil guy who recently got away to Australia was a former JVPer.

      It is the nature of many commentators to this blog – that just try to shoot the messenger in order to spread their subjective views. They are talented at combining A with B mostly not seeing even logics.

      As any healthy minded guy would feel it – I too, think that JVP was not connected to 83riots in Sl. But I believe in later stage, JVP started close links with Tamil rebells – this I got to from several tamil refugees I met in France a decades ago.

      Not many as you “glorify” Tamil membership of JVP.

      Tamils cannot be natural allies of JVP for two reasons. Fundamentally Tamils are anything but lefties. Being Sinhala/Buddhist narrow nationalists and pseudo Marxist/Leninist/Maoist/Kim Il-sungist JVP was not open to minorities with their “historical materialism”.

      By the late 1970s JVP had already lost their Tamil supporters due to their perverted understanding of dialectical materialism.

      Yes, David, there were many Tamil youths in the JVP at first (1971) when they were united with the Sinhalese youth during the Vietnam War. They fancied themselves to be “on the side” of the “Socialists”, “Maoists” and “Marxists” against the “Capitalist, Colonialist Empire”.

      They were programmed with “revolutionary slogans” and a smattering of “Socialist Ideology”, and armed with Russian-designed AK-47s and hand-grenades. But who were they armed by, back then? I’ve read that Professor Rohan Gunaratne claims that North Korea was the final source still available to the LTTE for weapons (which may not be true, of course)…but back during the Vietnam War? Did the same dealers sell guns to the JVP and the LTTE “armies” before they were set to war against each other and against the sovereign nation?

      Back in 1983, the LTTE leaders were concerned that the “sleeping Tamils” in Colombo weren’t “involved” in the “struggle”. They didn’t care about, or want, a “separate state”. That’s why, I have heard, the architects of this war engineered the 1983 “riots”, later blaming the orchestrated targeting of Tamil businessmen (such as Donald and Charles Gnanakone’s family) on specific Sinhalese government ministers, including Premadasa and Cyril Matthew, who they said organized mobs led by Buddhist priests who had lists of all the Tamil houses.

      Later, when they were losing the war, and since the war was ended, the most intransigent LTTE propagandists have been claiming that the events of “Black July 1983” was a “pogrom” and even an “act of genocide against the Tamils” (suggesting a similarity to Nazi persecution of Jews). Also, there is the unusual coincidence of British “tourists” being just in the right place and the right time to report events that were televised around the world, and the provocative attack on Sri Lankan soldiers that sparked the war in the north, just before?

      Sounds to me like a carefully planned, premeditated Cold War psy-op. JRJ and Premadasa may have been right to suspect JVP involvement in making the Colombo attacks (and robbery of Tamil businesses) seem like the work of “Sinhalese hoodlums”. They may well have been Sinhalese youths being manipulated by maniacs who were trying to start another war.

    You cannot unilaterally abrogate the IL accord. If you want to hold a referendum then the Tamils will want to hold a referendum to create eelam. So it is not wise to talk about referendum.

    The claim in the second paragraph that “JVP cadres are known to have created much of the mayhem,” referring to the July 1983 violence against the Tamils is factually incorrect. I was allowed to study JR Jayewardene files in April 1993, even before the formal archives were opened, and all reports to the President indicated otherwise. It is true that the JVP had one lesson among their Famous Five on “Indian Expansionism” in 1971, but it was a common position among many Maoists during that time, including N. Shanmugathasan(Communist Party – China Wing) if I remember correct.

    Our 90-year old bungalow in the vicinity of the Colombo General Hospital and many other Tamil homes of professionals around – including that of the TULF President the late T. Sivasithamparam – were attacked by waves of mobs duing July 1983 among whom, Sinhala neighbours in the smaller houses, told us later were men they identified as JVP men. We know that the large home of the late industrialist K. Gunaratnam (Bullers Rd/Jawatta Rd intersection) Maharaja’s at Coniston Place, Colombo 7 and Rajaiyahs (No.2 to Upali Wijewardena in his business) at Sir Marcus Fernando – hidden away in a by-lane were all attacked and looted by mobs who came with lists. The difference was the JVPers did not geneally loot. They simply started breaking windows and creating tension and the slum-dwellers around Maradana-Borella did the breaking and the stealing. It is noted the divided JVP – that is trying to forge a connection with the Tamils in the North now feels embarrassed about this history. But that was another avatar of theirs. What is possible is the canard of Ananda Tissa de Alwis, whom JR used to go on air, and claim the JVP were behind the attacks. They (JVP) did not lead the pogorm, which was the work of mobs under Cyril Mathew, Premadasa and Gamini D in the Colombo areas. Later in 1987 Gujerati Amalean of the Nagindas business family, was shot at point-blank range by a gunman, believed to be a JVPer – carrying a T56 at his factory in Ratmalana.

    I thought I will make this comment because some readers in this blog have denied a JVP involvement in the 1983 attacks against the Tamils.
    I speak only of incidents I know around where I lived. There were many more in Colombo 3, 4, 5, 6, 7, 8, 9, 10, 13 and 15.

    LTTE was not disarmed by the IPKF. This is a false and misleading statement.

    The 13th Amendment although claimed to be based on the Indian practice of devolution of powers to the States given the Provinces of Sri Lanka exceeding the powers enjoyed by the States of India. An article in the Island news paper some time back has cited 35 instances where
    1. Some important provisions of the Indian Constitution relating to central government power have been omitted in the 13th Amendment to the Constitution of Sri Lanka.
    2. The key provisions of the Indian Constitution on the Center- State relations have been watered down in favour of the Provinces in Sri Lanka.
    3. There is more power devolved to the Provinces in Sri Lanka than the power enjoyed by the States of India.

      vichara,then why don’t we have the same quasi federal system as in india for the north and east of srilanka only?Since you say that the 13th amendment gives more devolution than the indian system,tell mahinda to tell singh that to bilaterally abolish the 13th amendment and in lieu of that bring in the indian system,which has withstood the test of time of more than 60 years making india one of the emerging superpowers of the world.Without the thread of devolution which wove it together,it would have by now broken up into 20 linguistically different nations and the world would not have even noticed those,whereas now world leaders are all looking hard at india because of its potential future impact on the world.With 1205 million people and still growing the sky is the limit.

    The problem with repealing the 13th amendment is that it is an agreement between 2 parties and one party cannot unilaterally abrogate it.If srilanka can abrogate it then india too can abrogate the kachativu agreement and the sirima-shastri pact and the sirima -ghandhi pact.So the best advice to those who are hollering like fools about abrogating the Indo-lanka accord is to go ahead and try it and find out what it is like to bang one’s head on a brick wall.Not only cannot it be abrogated without severe repercussions,it will also have to be fully implemented.Devolution of the police and land powers will have to be given,the question is not whether it will,but when.

    The sinhalese are used to making and breaking agreements within themselves and with the tamils. That is the culture,i think and everyone gets away with it,promising everything and giving nothing,but when you take it one step further with foreigners who don’t understand that culture,then you get landed as the Petroleum corporation found out to its cost when it unilaterally abrogated the contracts with foreign banks on the hedging of oil prices.

    So,stop yapping incessantly like these small dogs and get on with life.You can’t have everything you want in life like the divinugema or whatever that crap is called and abrogation of international accords and you have to get used to that.In fact it was Lord Bhuddha who said that life is suffering and we are born to suffer,so if we can have everything we want then it will be heaven on earth,not suffering.
