The Malicious “Shafi Frame Up”: Will 2023 See The Guilty Being Punished?

As 2023 dawns how short is the memory of our people ! How fleeting their sympathy for the victims of monstrous crimes! How indifferent to the moral imperative for the guilty to be held to account ! Nevertheless wherever the history of our time is read by future generations the case of Dr Shafi, an innocent doctor who was diabolically framed up and cruelly vilified for a crime he never committed, will  stand out as a permanent blot on the Sinhala Buddhist society of our day and age. The good news that he has at the very least and very belatedly been paid his back wages having been totally vindicated of the dastardly racially motivated  false accusations made against him, is something to momentarily cheer the hearts of those few who yearn for justice and truth in what is now a corrupt bankrupt failed Sinhala Buddhist beggar State, currently perishing amidst the inability to pay its debts, provide for its people, or effectively govern itself.  

The reports that Dr Shafi has graciously donated the whole of his salary arrears to charity underlines the stark contrast between the gracious generosity of a good and decent member of a minority community and the malicious wickedness of the militant fanatical Sinhala Buddhist bandwagon which sought to destroy him. That Dr Shafi  has been fully vindicated and grudgingly paid his back wages by the Ministry of Health  having been unfairly sent on compulsory leave for 3 long years is small consolation indeed. Surprisingly the government has still not formally withdrawn the case against him which means that technically he is still on bail ! That is how the ‘rule of law’ works in Sri Lanka. More importantly, we cannot forget the diabolical conspirators in this monstrous crime involving malicious defamation of character  with the intention of  inducing hate,  provoking ethnic conflict and ruining a man and his family. This article is a call to bring those responsible for this crime to justice. Regrettably the miscreants are nearly all alive and kicking, nonchalantly enjoying prosperous lives and social recognition. That is the quality of justice in Buddhist Sri Lanka today ! 

Lest we forget the principal villains in this historic scandal included leading Buddhist monks one of whom a sanctimonious humbug  continues to sit smugly as a member of parliament  and pontificate on the issues of the day. At that time  evidently another  senior Buddhist figure from the Asgiriya chapter publicly called for the doctor to be stoned. Yet another is reported to have demanded (no doubt according to his own twisted understanding of the five precepts!) that the doctor should be brutally punished according to ancient barbaric practice that may have included torture . 

Other culprits included at least  one of today’s dime a dozen University professors with small brains and  great ambitions  who inundate academia in this day and age. Particularly blameworthy were various hospital administrators dominated by a shameless dental surgeon (as it happens a student of mine!), who as hospital director had the audacity to confidently advice court on gynecological matters far removed from his training in  dental health. That such a misfit was astonishingly given a hearing in court hardly speaks well for the independence of the judiciary. Nor can we ignore the complicity of a fake print and electronic media  especially the  prominent Sinhala Buddhist oriented national Divaina newspaper which set the ball rolling with a palpably false sensational headline in May 2019 accusing a Muslim doctor of sterilising Sinhala women. This was accompanied by widespread gutter journalism where the print and electronic media stubbornly continued to spit out the same false story even as new evidence emerged to exonerate the doctor. 

Others more peripherally involved in this diabolical slander included those in the police and intelligence services,  various hospital staff, a docile politicized Ministry of Health, and the foolish Buddhist women (some of whom subsequently became pregnant!) who either induced by bribery or motivated by primitive religious fanaticism, or driven to panic by provocative newspaper headlines  were lured into falsely claiming that they had been rendered infertile. Finally one must reluctantly point the accusing finger at the rest of Sinhala Buddhist society in this country including respectable professional organizations, political parties, the GMOA and the general public all of whom by their silence apathy and indifference in one way or another acquiesced in this abominable crime.  

The pain suffering and alienation experienced  by Dr Shafi and his family during  five  long years  of persecution following the grotesque defamation of his character is incalculable. The story might be a fiction writer’s dream. His arbitrary arrest and callous treatment by the police was an outrage. He had to experience the unspeakable humiliation  of being paraded in handcuffs amongst the staff of the very hospital where he had rendered yeoman service for many years. His being denied bail and remanded for 4 months was a gross violation of the basic principle that a man is presumed innocent until proved guilty. Adding to the  anguish of prolonged separation from family, the  squalor, overcrowding, foul atmosphere, physical discomfort, and dubious company he was forced to endure while under remand, are painful recollections that might torment a sensitive human being for the rest of his life. 

 Nor can we even begin to imagine the severity of the  psychological trauma suffered by the Shafi family whose lives were totally disrupted  by this sordid scandal. Amidst the shame and embarrassment of the vile stigmatization of an innocent  husband and father, the humiliation of widespread public hostility and being treated as social outcasts, and the fear and insecurity  provoked by even death threats, the family was compelled to leave their home  and take refuge in  a far off city. The cussed attitude and sadistic cruelty of the intelligence services (which have evidently been brutally purged of its most outstanding and fair minded sleuths) was such that  Dr Shafi even after being released on bail was forced to travel many miles from a distant outpost once a week to fulfill his bail requirement at the CID in Colombo, instead of being allowed the courtesy of doing so at the nearest police station.

From a historical perspective  Sri Lanka’s “Shafi Affair” is comparable to the notorious “Dreyfus affair” which to quote Wikipedia “ was a political scandal that divided the French Third Republic from 1894 until its resolution in 1906. The Dreyfus Affair came to symbolize modern injustice in the Francophone world and it remains one of the most notable examples of a complex miscarriage of justice and anti-Semitism”. Unlike in Sri Lanka where the role of the media was negative if not destructive and discriminatory, the role of the press and public opinion in the “Dryfus affair” proved influential in serving the cause of justice.

The “Dreyfus affair”  is the story of one of the most shocking “frame ups” in modern history where in 1894 Captain Dreyfus  an innocent French officer was falsely tried and convicted of treason and sentenced to life imprisonment in  the draconian “Devil’s Island” in French Guyana. The account of his suffering and final exoneration in which the great French author Emile Zola played a heroic role in proving his innocence, is one of the most captivating and turbulent episodes in French history with many lessons for future generations. Long ago  as a young boy I recall my father taking me to the long extinct “Fawn cinema” in Union Place one afternoon to watch the ‘Emile Zola’ movie that was being screened ! It was my turn about two years ago to return the favour by sending the Shafi family the link to the 45 minute historical video documentary of the “Dreyfus Affair” in the hope that it would be a source of comfort inspiration and fresh courage in the face of their own comparable experience in Sri Lanka  more than a century later. As one contemplates the  decline fall and  shameful disintegration  of a once thriving nation it becomes clear that  Sri Lanka  is an island where  wrongdoing flourishes with little accountability and complete impunity. At the recent 51st Sessions of the UNHRC the UN acting Commissioner for Human Rights in a damning indictment mentioned how 13 years since the end of war, tens of thousands of survivors and their families continue to seek justice and to know the truth about the fate of their loved ones. as well as the lack of progress in establishing the truth about those responsible for the Easter massacre.

In a manner of speaking Sri Lanka is a place where you can do almost anything and get away with it, where  so often the administration of justice  seems zealous  in pouncing on the good and recalcitrant in allowing the evil to slip away, where a decent man  who loves justice can be arrogantly thrown into prison for 4 years for being momentarily carried away in his criticism of the system, where monstrous criminals including war criminals  rapacious politicians and their families who  cover up their crimes while robbing the country dry are never brought to justice.

The Bible records that in 740 -700 BC Almighty God through the utterance of  the great  prophet Isaiah  pronounced a series of “woes” on a decadent nation whose people  were  alienated from God being “deaf and blind” to the Truth. These fearful imprecations included: “Woe to  those who call evil good and good evil, who put darkness for light  and light for darkness ,  who put bitter for sweet and sweet for bitter . . . . .  who acquit the guilty for a bribe, and deprive the innocent of his right!“ (Isiah  5: 20,23) Though uttered  millennia ago that sounds like a description of Sri Lanka in this day and age. 

Amidst all the superficial distractions at the dawn of a New Year this article is intended  to ensure that the “Shafi affair” is not forgotten but rather the painful memory of a national disgrace kept alive. One longs for the day when under a righteous government a “Special Commission of Inquiry” would be set up to bring to light the whole truth about the Shafi frame up where all who were complicit in this dastardly crime will be brought to justice, those who were peripherally involved forced to confess their guilt and apologise, and those who were dominantly involved punished more severely with fines deprivation of civic rights or even prison.  

This is not because the Shafi frame up is any worse than the countless unsolved murders, massacres, prison massacres, crimes, war crimes, atrocities, abductions, racial riots, summary executions and monumental robberies and their cover up that this writer now in the 8th decade of life has lived through and which stain the post independence history of Sri Lanka. But sometimes the cruelty malice bigotry  and cover up underlying the maltreatment of one man, mirrors the true degenerate character of an entire society.

Meanwhile Dr Shafi himself to his credit bears no malice towards his persecutors. But the demands of justice would be better served if he sued the main offenders for defamation of character compelling them to pay crippling damages which he can if he wishes donate to charity in these hard times for poor people.

Hopefully 2023 will not be remembered for the vanity and humbug of sham celebrations commemorating 75 years of independence in a failed state that would arguably have been far better off if it had remained a British colony. Rather one hopes 2023 will be remembered as the year in which those responsible for the shameful Shafi frame up were held to account, as a first step towards ending the culture of impunity in this otherwise beautiful island.

      Anyone can violate citizen rights, jeorpardizing all the livelyhood of a family, putting them in a highly serious situation of unhthinkable nature, nevertheless, law and order fails to protest those victimized families. Then there exist a real lawlessness situation in this country. Recently than anytimes before, main stream media the way they acted in this country was to a ” racial script”: None of them respect ” ethics and morals” or the like related laws. If there are not yet such laws why not lawmakers create or reform them in accordance with world standards ?

If Dr Safi underwent jail sessions, whistleblowers of the planted incident should too be given due punishments. What would the judiciary say on this ? Travesty of justice is governing even more before minorty citizen s victimization.

    I think Dr. Shafi should file legal action, claim damages and insist on punishment for all those who accused him of immoral and illegal acts, slandered him, persecuted him and made life hell for him and his family. He is in a very strong position to do so and must proceed on this matter as a public service and a lesson to all those vicious miscreants. It will not be seen as revenge but as a great service to the country.

      I doubt it is “malicious wickedness”. Sinhala Buddhists are as good or bad as any other community. But since there are more of them, there are more bits of cowdung in the curd. Most of these bits of cowdung masquerade as monks.

        This attitude (Herd instinct) is the reason for 2 nations, in one country and would amplify how the two communities deal with the issues!!!
        That is their greatest fear, of being crucified, if that becomes a reality!!?? The differentiation of the 2 communities (Major and Minor) would be stark naked and would not allow any escapist routes!!! Same with every aspect of Governance – economy, health, agriculture, Food and Consumable distribution within community!!!
        Post 2004 Tsunami, (leaving aside Helping Hambantota to a side as irrelevant), we could see the way the CONVOYS OF FOOD AND NGO AID CONVOYS WERE WAY LAID EN ROUTE TO DEEP SOUTH AND SOUTH EAST SL, YALA, MONERAGALA, AND BEYOND AND THEREON AND THEREAFTER, supposed to head to South East coast and thence to East coast!!??? Arugam Bay etc., which areas never received, what was destined to them!!!!
        Proud 2600+ years of Civilisation!!! My Foot!!?? Difference was beyond Kumana, they were minority community – Tamils – Christians, Hindus and Muslims!!!!

    I share your thoughts & sentiments 100% & my heartfelt sorrow for Dr Shafi & all those who have suffered so badly by the injustice of the SL judicial system. Even the recent exposure by a MP of an alleged sexual conduct with a pet by a former Presidential advisor, shows how low our standards have become. It was a matter for the police to investigate & take action as necessary, instead, a man was judged & humiliated in public by an uncouth politician & the gutter media. On the other hand, we have a former CJ who boasts in public of the power he wielded, that if not for his, obviously, biased judgement, a former President would not be a free man today. The blatant acts of thuggery & intimidation by political Buddhist monks, appointed as advisor to the state, continue but the citizens are helpless in rejecting these despicable yobs who have brought the country to its knees by corruption & abuse of power.

    Will 2023 usher in better times? I don’t think so but I live in hope . As for punishment of the guilty, not in this lifetime, unless, by act of god or karma.

      With this knowledge available how can Ranjan Ramanayake sent to jail. What Ranjan said absolutely 100% correct. He is another victim of miscarriage of justice. As if the judges did not know this. The judgement it self proves the accuracy of Ranjan’s statement.

      Thanajudden and Lasantha were exhumed when Ranil (and Sirisena) needed votes before the parliamentary election. ……… Going to the judiciary is an utter waste of time …….. if he wants some redress, Dr Shafi must find a way how his case can garner some votes for Ranil in the next election. :))

          If I’m not mistaken, even the Cardinal went and held Ratana’s hand when he was pulling that “hunger strike” stunt in Kandy or some place.

          In SL, these bastards do these things against innocent people and always get away without any consequences.

          In America, Rudy Giuliani and Sidney Powell are facing the music for their outrageous lies. You won’t believe their defence – their accusations about the voting machines were so farfetched that no rational mind would believe them!

    Fully agree with you, as for the Jurisprudence of the SL judiciary, less said is the bets!!
    It was in the downward path, but momentously hit the bottom, with the famous judgement on the helping Hambantota case 2005 and the infamous apology or ‘Mea Culpa’ of 2015 by an ex = Chief Justice!!! That was instance of hitting the Nadir of the “DECLINE OF JURISPRUDENCE” in this country!!??
    No wonder international organisations do not trust the justice system of Sri Lanka!!?? What more evidence one needs to prove the lack of uniformity in dispensation of Sri Lankan justice!!?? The very reason in 2015, UNHRC requested foreign judges or at least a HYBRID court to mitigate this menace!!!/?
    Sri Lankan name has been tarnished beyond repair, we need a name change to mitigate and move forward in this world, thanks to specially, Sinhalese Buddhists who have been of immense help in this regard!!!?? They must hold their heads high in realisation of this momentous achievement!? Definitely, not be their last attempt at self-contempt!!!???

    When the purported victims were requested to come forward and give evidence against Dr. Shafi, no woman showed up. They were afraid the real culprit for their infertility would be exposed: it was hiding inside the “Sinhala-Buddhist” pants of their husbands.

    A very humane analysis by Prof Ekanayake, as always. But we all know Sri lanka is a cursed country and some yay cursed by Kuveni,whow was betrayed by Vijaya that started the Sinhala race, according to Mahavamsa. No wonder we have become a pathetic, begging country that survives day by day while majority are starving. Buddhist practice has become utterly corrupt by totally corrupt buddhist monks who have made Buddhsim into a business. These guys want super comforts, expensive vehicles, sit on thrones and many other goodies. The corrupt, rougue politicians survived on racism for political success. This act againt the good Muslim doctor was executed by racist mercenary gang of a priest, a bunkrupt corrupt politician, a so-called cheap bum sucking professor and the cheap media. To my mind I just cannot understand how anyone calling themsleves as humans to do such an evil things? For majority Sinhalese, until recently, only issue that can unite them is, rabid racism. Even the most evil JR said in 1983 a few days after the holocaust that moree and more I punish the Tamils, more happy will be our Sinhala people. But when this same JR fellow was dying of cancer, only a Tamil surgeon treated him.

      Shafi is still out on bail in respect of the case filed by the AG, accusing him based on Athana, Methana, Hithana, Natana, Saffron Robbed Gynaecologist assessment of making SB women baron, though is active, although he has been reinstated and back pay arrears restored and paid!!!
      In the circumstances the AG should have withdrawn charges against him, which has not happened for a year!! Why??? Stranger things happen in this blessed country!! God only knows why!??
      Be that as it may, and due to this anomaly, Shafi is still and accused in a PTA case and practices as doctor in the health system!!
      In the circumstances, I am made to understand that he has no right to file a case against the AG representing the state for action for wrongful and malicious, confinement to custodial restraint and consequent compensation!!
      Probably, AG deliberately letting the sword dangle to ensure Dr. Shafi doesn’t get the opportunity to claim damages!!?? Master stroke!!!
      There has been much stranger things have happened in this resplendent isle!!!
      What for the telling??? ALL IN THE GAME!!!??

We should be ashamed that the racist Jayasumana or others have not been arrested for this racist incident. In this preliminary action against the Muslim doctor, Jayasumana’s Ph.D. and MBBS titles should be subject to cancellation. In a civilized country, his fellow doctors would not be so sloppy knowing that what he did was an “inhuman act” against Dr. Safi.

If anyone with any knowledge listens to Jayasumana, it will be readily apparent that he is highly biased in his statements about echoing the number of caesarean sections performed by the doctor per nation. If the areas are filled with Sinhalese people more than Muslims, how can the number of Muslim patients in those areas be more than the Sinhalese patients?-

          I wonder how those mothers who complained that their surgeries were aimed at their infertility, many of them were lucky enough to go on for their next child. To those with a basic knowledge of “human biology” it must be a medical miracle.


          As is obvious to anyone with any knowledge of surgery, Dr. Safi is not the only one in that team. Anesthesiologists, OP nurses and colleagues should support it. That is common to such ops. So in such a group environment, experts believe that block of the fallopian tubes of targeted patients leading to targeted infertility practices is just a fairy tale.. Don’t forget, medical ethics exist regardless of geographic locations. Whether the operating room is in Africa, Asia or Europe.
          . The same is the basics for other surgery rooms too.

          Therefore, no one can stand against my opinion in this regard. This is what I have always predicted that if the SAFI case is investigated, the Sri Lankan nation will have to face very harshly those who committed acts against humanity who will be branded as “extreme racists against their own minority fellow citizens”.
          The level of racism shown by some Sinhalese against minority Muslims and Tamils and other minorities is several times higher than the racism Israelis do against their own minority palasetniann fellow citizens.

            Given that this is the true reality of our society, how can we repeatedly argue in defense of our human rights improvements at the UN Human Rights Council annual session on Sri Lanka?

            How will they be able to face the UNHRC session again? I wonder how he of all other people can act like this? He is a young man in the medical field, he became a doctor thanks to the taxpayers of the country.
            Or else the sons of beasts should think before running away, as suspicions of war-end violations in Sri Lanka’s human rights records will be convinced by the new “Ethnic Incident of the Nature of Dr Safi and His Family”. Then there will be trade embargoes or similar long-term consequences for our nation. It is my wish that these racists should be imprisoned forever.

            Thank God, Dr. Safi has now nurtured a daughter, who is lately reported to have got through her olevels with flying colours, amidst all the obstacles she faced due to her famiiy ‘s racial victimization. Her counterpart in Afganista, Malala, who recently won a great price for peace. I hope that the SAFI young daughter will be able to raise her voice more about such massive racist acts in the future.May her be blessed with all powers to do so !

          I generally don’t respect all of Sannasgala’s expressions (he comes from a very poor background and suffers from some mental issues), but am adding this one focusing on the incident that I think is quite important.
          When mad Sannasgala calls Buddhi “Machang”, Buddhika calls him “Sir”. This is the twisted culture.
          Under the belt comments usually come from – street women and men also in Europe.

          However, Hirunika revealed a lot to the world about her willingness to go for it. She might have lot to achieve by hook or by crook.

          To pretend and mislead the “Punnaku Kana Majority” Rajapaksa is doing the same by wearing their scarf around their neck, now wearing a Hirunika saree and holding a hairstyle in their hands showing the traditional character.

          None of these followed by RW and a handful of politicians btw.

    This is the country where we the major race sinhalese, expected the blessing of the people for a “new dawn”. Now I though we should rather present Dr Safi’s case to the Nobel Committee, giving Gentleman a high credit for his generous act of donating his ” salary arrears” to Ministry of Health of the country.

    At this highly critical stage of country’s economy, it was a great support by a volunteer, not even Mahinda Rajapskeh had hearts to donate his bank accounts filled with his own salaries (he has such accounts which is not even touched by him for the last 10 years), even if MARA s wealth is reported to be beyond 18 billions of US dollars. .
    Saddest reality is that country’s MBBS doctors like fake prof. Jayasumana” or such irrational “educated idiots” are too misled by Rajapakshism. Dhammika Paniya (Pancea to COVID 19) proved the true nature of the society, and people at large are controlled by myths in this country.

    These men should be punished by law and order not allowing them further be out of jails.

        You don’t necessarily have to be a surgeon, but if you have some knowledge of how such operating theaters work, it will be enough for these bastards to convince that there is no room for one, regardless of the position on the team. “Fallopian tube suppression” can be a part of a fairytale.

    Reading this article has only sent me into deeper despair and sorrow about our motherland . If professionals like doctors, journalists and the legal system stoop to such low acts of behaviour, and manipulation then what about the man in the street?
