Things Get Messy For Rishard As 16-Year-Old Maid At His Residence Dies From Burn Injuries

Jailed parliamentarian Rishard Bathiudeen may be in much deeper trouble after a 16-year-old girl allegedly working as a maid at his residence in Colombo died on burn injuries on Thursday (15).

The girl was admitted to the Colombo National Hospital on 3rd July and died on 15th July. The Borella police is investigating the death and an autopsy report is due soon.

The teenager who succumbed to burn injuries hailed from Dayagama and obtained work as a maid in the Bathiudeen household last year.

The minimum age of employment is 16 based on Sri Lankan law, but persons employing workers between the ages of 16-18 are subject to certain restrictions.

Bathiudeen was arrested and detained in April 2021 over alleged connections to the 2019 Easter Sunday suicide bomb attacks. The former minister has filed a fundamental rights application in the Supreme Court against his arrest which he claims are on trumped up charges.

This fresh scandal in his home could compound former Minister Bathiudeen’s legal problems, lawyers said. (NR)

        There is an attempt to portray this as an act of suicide, by placing a container of Kerosine in the room occupied by the maid. People do not commit suicide without a reason. They leave a suicide note before the act. It is said that she poured kerosine over her body inside the room, set fire to herself and came out running. There is strong element of suspicion that it is murder to cover up some crime committed by some member of Badiuddin’s family. Though Badiuddin was in prison when this occurred, she was employed while he was in the house. Thorough forensic examination should be carried out. If she had really wanted to die, she would have remained inside the room without giving a chance to be rescued. If the maid was alive at the time of admission, what she had told the doctor becomes dying declaration which is a strong incriminating piece of evidence.

    This death is a tragedy, after all even the parents of the child expected some money for being a servant only to find a burned body of the daughter. The incident is sad to hear. RB was in jail when the maid was engulfed in fire. So, he may not personally be responsible for the death. Nevertheless, apart from legal issues, everybody would wonder what on earth is this as RB is only well known to perform an abracadabra when it comes to money. Although not proved, anybody could wonder whether he too is a part of the racket using the bodies of underaged females. If that were so, the remaining sympathy he had of some part of the public too would vanish. Children engulfed in fire, children sold as commodities to serve amorous desires of the old are news items that makes any man with a conscience feel sick and revulsive. Obviously, as a failed state, Sri Lanka cannot protect its own next generation which should be primed to accept the responsibility of running the nation in the future.

    The employment of the girl was lawful.
    There is no claim that someone set her on fire.
    Even if someone did, it was not Bathiuddin. Bathiuddin is in jail.

      I have personal knowledge where rich people in their households employ very young Tamil girls, ages vary from 15 to 16,not one or two but more than five or six at the same time in each house supposed to work as house cleaners or maids.

      The girls are from upcountry and Northern and Eastern provinces of Sri Lanka.

      This is in violation of Child and women rights.

        It is true that most of those exploited in garment factories/sweat shops and as domestic servants hail from impoverished Tamil war torn regions of north, east, and the estates. It must be treated as a political issue than merely child/women rights.

        Hello Soma, surprisingly yes still! Quoting from Maureen Seneviratne, PC;

        19 Legislative Enactments of Ceylon;Volume_V;Chapter_135;
        Section_34 of this Act defines,
        A “child” is a person who is under the age of 14 years.
        A “young person” is a person who has attained the age of 14 years but is under the age of 18 years.

        Section_13(1) stipulates, inter alia, that no child shall be employed:
        a)_before the close of school hours on any day on which is required to attend school, or
        b)_at any time between 8.00a.m. and 6.00p.m.
        c)_for more than two hours on any day on which he is required to attend school.
        d)_for more than two hours on any Sunday.

        Section_14(3) of Act No. 47 of 1956 enacted that:
        “If any child is employed in contravention of any regulation made under this section, the employer and any person – (child employed) to whose act or default the contravention is attributable shall be guilty of an offence, and shall, on conviction after summary trial before a Magistrate be liable to a fine not exceeding one thousand rupees or imprisonment of either description for a period not exceeding six months or both such fine or such imprisonment.”

      Does it matter whether the girl was set on fire by herself or by others?
      This is tragic and should be investigated but will not garner any attention (other than the fact that the employer is muslim mp) because she belongs to the most vulnerable section of a ‘minority’.

    Employing under aged men and women is very common in Sri Lanka because of the economic mess of this country and in some low income families it is unavoidable. Of course, if there is something wrong on the part of Rishard or any one in his family in the death of that girl they should be punished according to law. Unfortunately, the law is not applied according to law and most of our politicians including the President have not gone through the law. The country and systems are in a complete mess and law is very low.

    Let us be fair. Suicide by self immolation is very common among Indians and even buddhists as it is considered as a holy death in fire. In India any burn death in young women is investigated under special burnt wife law. Among SL estate sector, among women, it is one of the chosen methods of suicide. Even otherwise SL registers one of the highest in suicide in the world. Age and gender irrelevant. Reason for suicide are several but often very trivial or just impulsive with many referred to as para suicides. Among Sinhalese it is agrochemical ingestion or hanging. In SL however the reasons vary from poverty, interpersonal relationship, impulsive acts, grief, depression, alcoholism, to name a few. One should understand the plight of these unfortunate poor women who work as domestic workers, being away from family, lack of rest, may be harassment at places of work, problems back at home to name a few. Not always one finds a suicide letter. So suicide is a most important cause but often for numerous reasons many including family members refuse to accept suicide. There is stigma, poor understanding of the reasons for suicide, death benefits, roumors, lack of premonition, etc. So instead of blaming the employer in this case let them investigate properly and find out the reason.

      Where is it told in Hinduism or Buddhism that it is considered holy when dying by fire. You are exposing yourself as a bigoted Muslim who want to sling mud on others. I have done post-mortem on a Muslim girl who committed suicide by self immolation because the parents refused to allow her to marry the man of her choice. If this girl wanted to commit suicide, she could have done it by hanging, where you need only a bed sheet and a chair. There may not be suicide letter, but they would shown signs of depression and even talked about taking their lives with others. In this extent none of this has happened. Do not try to cover up by your distortions. I am making this deduction with forensic experience.This is a crime of sexual abuse, and murder.

    I don’t know whether death of this girl is a suicide or murder or an accident. I am not sure whether the Police investigation or JMO findings going to reveal the truth and what is the reason for suicide or murder or accident. Since death involves rich powerful politician the case can go any direction at any time. The girl is from a low income family. So she is also vulnerable like any other low income family but it is in much higher level in the estate Tamil community.
    The problem is not about a death of a girl. It is a problem of the community that was brought to this country as estate workers by British but still the community remains as the same estate workers or you can call them as slaves of this country. The boss of the slavery may have changed from British to Sri Lankan but the slavery remains the same for a century. Majority of them are in poverty, work in estate workers or labourers, toilet cleaners and servants living in small line houses. The fact is that this community is still not considered as a citizen of this country in order to get even the basic needs of other communities.
    Politicians and opportunists may speak loud to achieve their personal goals but the country need change to change the status of poor and vulnerable people.

      JMO report says that the cause of death was due to septicemia and organ failure and that there were no other injuries on the body. If this is so, then it is a case of suicide. While the cause of death is correct, in cases of extensive burns, signs of violence on the skin and superficial tissues may not be apparent. However, the report says that there were signs of sexual activity. Question is with whom and when did she have sex. She was employed for sometime in this household where there would have been no chance for an outsider to come in and commit it. If the family assert that she had no sexual contact before being employed, then it narrows down to someone in the household, either another male employee or member of Rishard’s family. If the girl had not been allowed to communicate with her family all these days, then there is strong suspicion of foul play.

        You have raised very valid points, but it looks as if you have looked at the entire scene from medical angl.

        How did you consider it a suicide? Torture may not be merely physical, but mental too. Such torture will not show any external injuries.

        Even if it is suicide, why did this girl commit suicide at this young age when she was well paid.

        Were there any more girls employed in this household? if so, they could provide valuable information.

        Was this girl treated like a sex slave to service friends and to obtain political favors even from adversaries?

        The possibilities are endless. It may not turn to be a criminal case, but a typical sociological issue.

        Please empathize with this girl. Rich and powerful have many protectors, but the poor and the defenseless have none.

          Srikrish, read my comment properly before making adverse comments about my view. I have stated that it could be suicide going by JMO report. See my earlier comment where I have said that there will be an attempt to portray this as suicide. I have also raised concern about JMO saying that there were no injuries suggestive of force used. Now people are calling for second post-mortem. I have stated that a member of Badiuddin has committed the sexual offence and I am proving correct as police now suspect Badiuddin’s father in law as the culprit. They also feel that Badiuddin’s wife, FIL and MIL are complicit in the circumstances that led to the girl’s death. There is complaint that OIC Borella police is impeding the investigations and want him transferred out. This is clear cut criminal case where nothing is impossible to cover it up with money changing hands.

I have clearly maintained from the beginning that this murder, but I have to accept JMO’s report over which I have made reservations about it. When it was revealed about sexual abuse, I have stated that it had been committed by a member of Badiuddin’s family. I am being proved correct in both. Police suspect Badiuddin’s father in law for sexual abuse and feel that Badiuddin’s wife, FIL and MIL are complicit causing death of this girl.

    Dr Gnana, your view in this case is too speculative and theorotical. It is not fair at all to make a judgement here on this flimsy evidence that needs thorough investigation. Of course in a burnt body obviously it not not possibe or difficult to find surface injuries that are common in such abuses. Leave that a aside and give the benefit of the doubt to the employer. Regarding the report of past sexual penetration or sexual activity, that too is often difficult in the living but more difficult in a dead body. It needs expertise to differentiate this with various other non sexual activities. Is the doctor going by past damage to the hymen, obviously I think so? But hymenal tears are due to any form of vaginal penetration, not necessarily penile penetration of the vagina. Mastubation, is so common, will lead to hymenal tear when one introduces blunt objects or even fingers into vagina for sexual gratification and I need not go into all that in an era like this. So all what a doctor can say if at all, there is evidence of “past vaginal penetration”, and no more. Of course if there is evidence of semen or other form of DNA evidence of ejaculation from other person then one could say there was evidence of penile penetration of vagina.

If a proper post-mortem is conducted, then the whole truth will come out. I have raised my suspicion about the conduct of this examination. It was done by a Muslim doctor, and now there is a demand by people for a second one. For opinion on vaginal injuries, he should have summoned an expert on that field. For every sexual offence, vaginal swabs, scrapings of skin and pubic hair have to be collected for seminal and DNA tests. It is common for Muslim girls to resort to masturbation because they are not permitted to socialize with boys. Already police is suspecting father in law of Rishard Badiuddin to have committed sexual abuse and that his FIL, MIL and wife are in collusion of murdering the girl to cover it up.

      Parents sell them into domestic service. Their poverty was such.
      It was worse before child employment laws were put into place.
      I know a number of instances where children hardly ten years old worked as domestic servants.
      Even after the law was made, children under 14 were employed and employers had ways to get around the law.
      Do not just blame politicians.
      They do not really rule the country.

We are taught forensic medicine for MBBS degree, and it is only after ten years of practice that one gets a chance to be a JMO. There were no local exams those days in posr-graduate forensic medicine. For your information MBBS degree of our time was internationally recognized, unlike the present MBBS degree, even with first class is a worthless piece of pare, needing re-qualification. Secondly training in Sri Lanka was internationally recognized, where you are placed at the level of your experience, unlike now even with specialist qualifications, one has to start from the bottom doing clerking and phlebotomy only. He also said that kerosine was bought to kill rats, and that attempt was made by inmates of the house to douse the fire by dipping her in a tub of water. How can one get 70% burns if the fire was doused immediately as claimed. This shows that she was allowed to be burnt beyond recovery. Listen to the interview given by girl’s mother where she says that the girl was hit with broom stick by a male servant and Badiuddin’s wife. Few days before the incident, the girl over the telephone had pleaded with the mother to take her back as she did not want to stay there anymore. It is said that kerosine was poured on the legs and set on fire. When one self immolates, he sets fire to the body and not the legs. (CONTD)

          (CONTD) Probably the girl would have been hit on her legs with broom stick where there would have been injuries. This is why legs were set on fire to destroy the evidence. Now police are investigating the male employee an have sent his mobile phone for analysis whether any messages have been erased. I am proving correct in all my findings. Sending people to gallows is the work of judges. In trials, JMOs are subject to cross examination by defence lawyers, and any findings which is not correct will be discarded by the court. In all the cases that I gave evidence, court has accepted my findings as correct. Muslim JMO who conducted this post mortem has made lapses either by ignorance or by design. How can you say that there are no evidence at all, just because those who are conducting the case are trying to suppress it and pass it as a case of suicide.

By the way did the JMO say that there was just evidence of past vaginal penetrations or there were penile penetrations. He just cant say that unless of course the offense or incident had occurred a day or two or three and where there was evidence of seminal fluid present in the girl. Even then it cant be rape unless there is lack of adequate consent. In this case she is 16+ and thus can give valid consent for sexual intercourse.         (CONTD) Girl was sixteen only in November 2020, but she was first employed in October 2020 when she was under age which is an offence committed by Rishard Badiuddin. There is an attempt to distort the truth by claiming that she was employed only after her 16th birthday. She may have been subjected to sexual abuse for sometime, and at one point she may have resisted and wanted to go home, which caused alarm to the perpetrators who decided to kill her to prevent it coming to light. So there may not have been instances of sexual abuse within few days of being burnt, and possibility of seminal fluid being present is remote.However there will be DNA of the culprit incorporated in the genital tissues. If JMO had not taken vaginal swabs from all parts (High and Low) and scrapings from skin of vulva and pubic hairs of genitals, then he has erred. Police has erred in not sealing the house from the time of incident to prevent tampering of evidence.

You talk of collecting pubic hair, vaginal swab for what, in a girl who died some time after burns. Thses issues are in fresh cases in order to connect the alleged victim and alleged offender. In forensic medicine we are told that when one commits a crime, he makes a slip which makes him to get caught and for investigators to look for that. In this case the slip is the lighter. In their over confidence the perpetrators have placed a lighter instead of box of matches, and have got caught. Why a girl who does not smoke should posses a lighter. Your Islamic racists will go round saying that she used to smoke cannabis and used the lighter. Secondly from where did the bottle of kerosine come, when they use gas for cooking.         (CONTD) No employer has the right to hit an employee. Here a punishable offence has been committed by Badiuddin’s wife and a male servant by hitting her with broom stick, which the girl has complained to her mother few days before being burnt. Why has the police not taken them into custody. When teacher hits student is taken seriously with imprisonment, why is this being allowed to go lightly. Do not allow this to spill over as ethnic issue by trying to save culprits. Do not underestimate Indian Tamils. They may be docile, but if they spring to action, result will be disastrous. Ceylon Tamils are selfish and may resign such incident to their fate, but Indian Tamils have nothing to loose, and will make Muslims to regret for it.

    My friend Dr Gnana is utterly obsessed without any direct evidence except gossips and his own imagination. He behaves like an eyewitness. He creates a scene where she was beaten in the legs with broomstick and then to mask those injuries legs were set on fire. What a fiction writer this one time JMO. Dr Gnana did you go through the PM report, the distribution of fire and possible flow pattern. Did they take photograph of the dead body. They say there was more than 70% burns hence is more than the legs. In suicide often fire spread from above if the victim in a standing position. Coming to hymen, the JMO has to be well trained in examining various types of hymen and how to interpreter the findings. Good light, suitable instruments like Glaister Keene rod and photography is mandatory. There are normal indentation along hymnal edges that are not old tears. A trained JMO is obviously better than a gynae in examining and interpreting the types of hymen, normal variations that may be misunderstood to an old tear, real tears old or fresh, and laxity of vaginal introitus to indicate repeated vaginal penetrations. Even JMO ought to have looked at the cervical os to establish as to she is nulliparous of paras or even multiparas.

Mother has stated that the girl was beaten with broomstick, and you are denying it. No where it is said that burns were only in the legs. Fire was set on the legs and spread up. It is said that the girl came out of the room running and got into the fish tank. If that is so, there would have not been 70% burns. This shows that she was allowed to burn for sometime so that she will receive fatal burns. This is how it should be done, and the behaviour of Muslim JMO arouses suspicion for not getting expert help from a gynaecologist either a Sinhalese or Tamil to protect himself against allegations. It is pure HEARSAY and has no value at all. Neither the mother nor you saw it. Unless they bring out a reliable independent witness this claim has no value. Or at least there are some wounds on her suggesting the allegation. Then you go on to say as if you were an eyewitness that to cover the wounds she was burnt by the household. Then you are talking of the time period of burn and then jumping into fish tank as if you were there. It was all your speculation or wild allegation. Then you ask why did she jump into the water tank. It is one of many ways of human responses and had you really worked in the field of forensic medicine then only you will see all these and even various other bizarre behaviours sometime cannot be explained logically.

    A doctor who treated this girl says that the patient told him that she set fire to herself. This evidence is independent and valuable than what you or her mother says that are both mere hearsay. The reference to sexual abuse, I have clearly explained to you in simple terms the cons and pros and how the law looks at it. Still you are unable to see the difference between vaginal penetration and penile penetration of the vagina. In SL law on rape it ought to be penile penetration of vagina against her consent or with or without consent when the girl in under the age of 16 and it is statutary rape. This issue has to be established in a court of law beyond a reasonable doubt and also that the so-called vaginal penetration has not occurred before the girl came into the present employment. What mother says about this girl’s conduct won’t be acceptable in a court of law. Dr Gnana is overtly sensitive and agitated and hell bent on fixing this Muslim family and if so why?     When it goes to minority families this has been common style of the rulers, so long the Rajapakshes control the country. Those good governance days, we never heard of the kind of discriminations to the minorities.
    Even if this single case would have occured in a muslim family we must not generalize it – calling them as it is common with MUSLIMS…. our racists take it to attack muslim srilankens, which I think is beyond ethics and morals.

    As some journalists make it very clear, in our childhood days, I have noticed how some of our elders treated their domestic servants (underage). We also had a young boy who worked for us, but i never treated him as ” servant boy”: Also need to mention here, some of those lads would not work as servants, their families would not be able to survive those days.

      Members of Badiuddin’s family deny that they employed an under aged girl. This girl was born in November 2004, and that she came to be employed only in November 2020 when she had reached 16 years of age. Mother of the child says she is not sure of the date, but broker corroborates with claim of Badiuddin’s family. Here is strong circumstantial evidence that they are lying, to protect themselves from the offence. It is said that the girl was employed for a salary of 20,000 rupees per month. If the date of the accused is correct, then the girl has been employed for eight months. Police have found out from bank account of the broker that in total, sum of 200,000 rupees has been deposited as salary for the girl, which mother of the girl confirms as been given to her by the broker. At 20,000 rupees per month, 200,000 rupees is the salary for ten months till end of June. Calculating backwards, ten months from June is September. On this evidence the girl has been employed from September 2020, which means the Rishard Badiuddin is guilty of employing under aged person. It is sad that Muslim racists are getting angry when others are exposing crime committed by fellow Muslims. I am happy that justice is taking its course though slowly to bring culprits to book.
