TNA Hopes UNHRC Resolution Will Mark A New Chapter In Sri Lanka’s Quest For Reconciliation

While welcoming the passage of the resolution on Sri Lanka at the Human Rights Council, the Tamil National Alliance (TNA) says the resolution reflects a difficult consensus, and involved the weakening of some paragraphs in the original draft resolution and the strengthening of others.

“We welcome, in particular, Sri Lanka’s co-sponsorship of the resolution indicating their willingness to implement it in full. The TNA has already welcomed the tabling of the draft last week after consensus was reached, and reiterate those sentiments. We hope that the spirit of cooperation that enabled consensus will animate the government’s work in implementing this historic resolution.” the TNA said in a statement.

The TNA said: “The resolution reflects a difficult consensus, and involved the weakening of some paragraphs in the original draft resolution and the strengthening of others. We are deeply mindful that any perceived compromise causes hurt to those most traumatized by the horrific crimes that have been committed in Sri Lanka. Nevertheless, the resolution – if implemented – provides a genuine opportunity for real progress on accountability and reconciliation. We are grateful to the co-sponsors of the resolution for engaging with the TNA throughout the process, and accommodating our concerns and views.

“We welcome the Resolution’s encouragement of Sri Lanka to implement the recommendations of the UN High Commissioner’s Report. In this regard, we urge the government to implement the resolution in a spirit of honesty and cooperation, in particular, the Council’s affirmation of the need for the participation of Commonwealth and other foreign judges, prosecutors, investigators and lawyers in a court enabled to try international crimes, through a Special Counsel for prosecutions. We also note the critical importance of the government’s commitment to a political settlement through necessary constitutional measures. Other important guarantees include those concerning the review and repeal of the Prevention of Terrorism Act; the review of the Public Security Ordinance; the review of the Victims and Witness Protection Act and strengthened witness protection in the operationalization of the Act; a new office to trace missing persons; the acceleration of the return of lands to owners; the vetting of security sector employees through a fair administrative process; the ratification of the Disappearances Convention and criminalization of enforced disappearances; ending military involvement in civilian activities; restoring normality in civilian life; and cooperation with the Office of the High Commissioner for Human Rights and special procedures.

“It is now incumbent on the government to implement the resolution. The resolution, by itself, will not win back the confidence of victims. That would require meaningful implementation in a spirit of cooperation. We call on the government to exhibit the courage to create a conducive atmosphere for implementation.

“As stakeholders in the process of accountability in Sri Lanka, we will fully support the implementation of the recommendations of the OISL Report and the resolution. To this end, we will continue to engage all domestic and international stakeholders, including the Government of Sri Lanka. We hope that the resolution will mark the beginning of a new chapter in Sri Lanka’s quest for reconciliation.”

      Impunity reigns with full vigour when Tamils are killed/abused/raped by the state armed forces/agents. It’s a very disgusting phenomenon, but it’s firmly entrenched in the mind-set of the vast majority of the Sinhala leaders, police and the armed forces. This is clearly illustrated by Ranil’s ‘assurance’ to the heads of armed forces that they would be ‘protected’ in war crime trials as reported by the Sunday Times. How can a head of state give such idiotic assurances to the alleged offenders of extremely serious criminal offences even before the trial commences. You can see that instead of educating at the village level what these leaders saying to the offenders. Before the Vanni crimes, did the GOSL punish a single culprit for Welikade massacre of over 75 Tamil prisoners, murder of 5 students in Trinco or massacre of 17 aid workers in Mutur? In ’87, SL navy burnt down ALL Tamil shops (ONLY the Tamil shops) in Trinco – did the GOSL punish a single person? Never!! With such a track record, how on earth the GOSL conduct a credible judicial process regarding the alleged war crimes. Ranil’s utterances say it all! It’s interesting to see how the international community is going to respond….???

Tamils think that they have changed the government and brought the UNHRC resolution on Sri Lanka, but the truth is the West is making it happen, Tamil leaders are getting along with the program.

    There is almost nothing I can disagree with the TNA statement, except to say that there should be some prioritization of the tasks that the government has to implement in cooperation with all stakeholders, primarily the TNA within the country. I also hope that in this prioritization of the tasks, the TNA might agree to balance the most essential with the most politically sensitive in the country, both in the South and the North. After all, what happened in the country is part of our ‘collective responsibility’ whatever the proportional differences.

    I hope that Sampanthan’s wishes comes true through the UNHRC Resolutions. Even though I am still skeptical, but there is a slight ray of hope after leaving the island and living outside for 32 years with distrust.

    I hope the resolution breaks all barriers and takes the country to a new level where the opportunity is equal for all citizens.

    I believe true trust will take much longer to build. An all encompassing implementation of the resolution will help build the bridge towards building that trust.

    I hope that political promises are no longer broken so that all citizens aspirations can come true.

    I hear from reliable diplomatic sources since there are no stakeholders to take accountability for the war crimes and human rights violations committed on the Tamil side – the LTTE hierarchy being almost completely eliminated, and it was a non-state player anyway – there may be another resolution coming up at Geneva soon to apportion accountability for the above crimes to the TGTE, since it is the only legally constituted government of Tamil Eelam in power at present. More revelations to follow.

    When will that “introspection” happen? Let me give the donkey a head start.

    Politically the Tamils are Left-heavy. A Right/Liberal thinking among Tamils is virtually non-existent. So there is no Feng Shui here.

    ITAK was formed concurrently with MDK of Tamil Nadu. Tamil Nadu’s MDK had identical policies as ITAK. One of its founders Ananandorai was the mirror image of Chelvanayagam.

    MDK relies upon creating ethnic division to keep BJP/Congress from taking a foothold in TN. ITAK creates ethnic division keep SLFP/UNP taking a foothold in NE.

    After forming ITAK they needed a way to create ethnic division in Ceylon – and they went fishing for it.

    The 1948 citizenship policy was stock standard endorsed by Queen of England. However, the plantation Tamil issue is introduced when it should have been discussed as an addendum at a later stage in concurrence with industry needs.

    ITAK creates ethnic division in Ceylon for political expediency. MDK does the same in Tamil Nadu for example with Aryan Invasion Theory (AIT). Its not the northern Indian Hindus who are narrow minded but these Tamils.

    The Tamil Left completely knocks out their meager Liberal/Right in ACTC. Its consumes the Tamils with fascism taking them to the depths of the Nandikudaal Lagoon.

    The imbalance that creates when there is a lack of Right oriented thinking is economics and finance.

    So for example – Tamil Nadu is large enough and it can sustain itself economically without the Hindus. However, its the majority Sinhala tax payer that finance Tamil education, health and other amenities.

    So trying to mirror what MDK does to Hindus in India have been catastrophic to Tamils in Ceylon. Ever since ITAK began rabble rousing against Sinhala people they have cut-off funding to Tamils and taken away their privileges.

    Lets assume Tamils have this prosperous business in Ceylon. What ITAK did was insult Tamils best customer.

    With anything competition is what advances humanity. The narrow minded Tamils have gone backwards after removing their internal and external competition i.e. their left-oriented “Sole Reps” ideology.

    The current wise and pragmatic approach of the TNQ top leadership is quite welcome. The past has definitely taught alesson to the top layer of the TNA and they have learned it well.

    While there are discordent noises from some others within the TNA, the persons making them are increasingly becoming marginalized within the Tamil community as the ‘Mad hatters’.

    While a credible opposition to the TNA should arise from within the Tamil community, the current crop laying a stake to that role do not have the credibility or standing. The develish role of Ellilan, Ananthi Sasitharan’s husband, during the final stages of the war has been highlighted in UNHRC report.

    Even C.V.Wigneswaran, in whom many of us placed much hope has proven unfit to provide the required leadership for the Northern Province, from within the ranks of the TNA.       The news about Wigneswaran and Karthigeyan is much worse than I thought possible. I can only hope that the TNA shows Wigneswaran the exit before he does more damage.

      I still wonder who paid for the Geneva traveling of Ananthi, Ponnambalam, Suresh and Sivalingam. Who arranged them the opportunity to talk using time allocated for four NGOs that have nothing to do with SL?

      Maybe the Swiss embassy provides information on the visa applications of the above mentioned politicians and wannabee politicians.

    This resolution will not make sure any responsibility in accountability for war crimes done by SL government. At the end Tamils will be cheated again. This old fellow just sold Tamils’ sacrification for his own greedy opposition leader post. He cannot achive anything holding an useless opposition leader post, the racist sinhalese will never change.     Mr. Coward Sampanthan should explain how it is possible a reconsiliation without hanging the war criminals. Do you expect a reconsiliation without taking lives of mahinda and gota? Tamils did not fight for begging any requirement, they demanded their rights. A separate state is the only reconsiliation.

    Only time will tell what the outcome of this policy will be. There was much done that was not transparent. Suamanthiren talked with Mangala outside Sri Lanka in Singapore and elsewhere. He made many inconsistent statements in the course of discussions as if he was the highest authority on genocide and war crimes. There was an open warfare between the TNA and Wiggy. All this is unseemly when for the first time there was a glimmer of hope for the Tamils. It seems to be that personal profit has motivated the TNA lawyers as before rather than what is for the good of the people. Sensibly, it would be positive if some good such as the return of the land, the devolution of powers, the removal of the army, the promise of equality etc can be achieved rather than overmuch emphasis on war crimes and whether it should be a domestic or a hybrid tribunal. Accountability is important but it takes time. Now that those who are accountable have been identified, there are mechanisms to ensure that they are made accountable besides trial in Sri Lanka. THe Tamil diaspora can do that with or without the TNA.

    I welcome Sampanthar’s statement that we can’t continue to fight for ever. Tamils living outside can try for ever but definitely not for those who are living inside srilanka and those who are suffering in Tamil Nadu. Tamils on the whole made many huge mistakes for last 60 years which gave huge advantage to Singhalese until UNHRC resolution. Still can’t see any sign that Tamils learnt enough. Those who are living outside can take Tamils issue for their past time or as a retirement job – nothing for them to loose but might win one day if srilanka survive from sharks like US, India or China. Singhalese pour sand on their own head like elephants by fighting for the last 60 years with Tamils – now we both Tamils and Singhalese are losers- big sharks are the only winners – again we Asian Modias can be hard workers but never be Masters.

    Hope TNA will priories the needs and tackle very important issues first. Now there is no hurry for war crime investigation because internal investigation is a vast of time – we all know how Maxwell investigation was – did you get Indian assisted houses , are you growing chickens etc.. The important issues at the moment are reducing army to the pre-war level, handover all the land to the owners, irradiate and punish all thugs, paramilitary modias and drug suppliers (replace all political prisoners with this lot), convert palely as an international Airport, Resolve water issues, tackle pollution due to usage of dirty weapons and chemicals. We need many years to tackle all these things. I think we have to stress for a meaningful political solution to stop what pushed Tamils for the last war. We do not need a war crime investigation – actually we lost many things in the war but gained more than the losses (socially, education wise or financially)

    Firstly I agree with Sri Lankan president and Mr. Sampanthan, the UNHRC resolution with Hybrid court with international components will investigate the events and judge the results with verdict to criminalise certain charectors and people.

    There are some comment about priviously President Rajapakse, I would say the main focus should be to unfold the events and identify the perpertraitors and events leading to the actions. We need to identify the root cause of the problem and rectify the short comings in our Sri Lankan Socities. We know the events in Sri Lanka was not created only in the last Presidency, events were a product of earlier policies from Independence period. I beleave the policies needs to be restructured to be fare and just for all citizens of Sri Lanka.

    Important from the leason learned must be proper implimentation and changes in Laws and ammentments to secure the rights and freedom of all citizens.

    In ordet to create a successful nation we need to have independent institutions with hardware and software( training skills etc. ) components. Politicians and media should be matured and sensitive toward different communities in Sri Lanka.

    Reconciliation without accountability is like building a house without foundation. If you let the perpetrators get away it sets a very bad president consequences to which can only be measured in future bloodshed. As for the solution you have got to go back to pre SWRD times and start again with proper devolution through out the island not just north and east.

    I don’t know why we are wasting our breath, it seems this present administration is same as all the others and are not addressing the real issues. TNA got there by deceit and Sampanthar is a toothless tiger and will retire or the electorate will retire him. Sumanthiran should he want to stay in politics Ranil will find him something. As for Senathirajah, he will probably retire in one of those army resorts.

    India, USA, Sri Lanka are non signatories of ICC.

    The United States is not a participant in the International Criminal Court (ICC).
    The Bush Administration, the US administration at the time of the ICC’s founding, stated that it would not join the ICC. The Obama Administration has subsequently re-established a working relationship with the court.[3]

    Now the ICC is investigating Afghanistan bombing by US.(us claims its clean and followed the ground control orders from Afghanistan)
