TNA Welcomes The Adoption Of UNHRC Resolution

While welcoming the adoption of resolution 34/L 1, at the UN Human Rights Council, the Tamil National Alliance (TNA) has urged the Government of Sri Lanka to honor its commitment with regard to these resolutions and implement the same in letter and spirit.

Issuing a statement the TNA said: “The Tamil National Alliance (TNA) welcomes the adoption of UNHRC resolution 34/L 1 which reaffirms the full implementation of resolution 30/1 of 2015, promoting reconciliation, accountability and human rights in Sri Lanka.

“The TNA also welcomes the fact that resolution 34/L 1, gives specific time frames for the Government of Sri Lanka and the Office of the High Commissioner for Human Rights to report on the successful implementation of the 30/1 resolution at the 37th and 40th UNHRC sessions respectively in 2018 and 2019.

“We urge the Government of Sri Lanka to honor its commitment with regard to these resolutions and implement the same in letter and spirit. In keeping with its commitments, we also urge the government to sincerely address the issues of land release, the detention of Tamil political prisoners, grievances of the families of missing persons, and the enactment of constitutional reforms.

“The Tamil people have reached their limits of tolerance, and urge that their deprivation and suffering on these several issues be brought to an early end.

“We welcome the continued engagement and assistance of the international community in achieving the aforesaid. The TNA, as the elected representatives of the Tamil speaking people, reiterates its commitment to closely engage with and monitor the implementation of the UN recommendations and other proposed processes related to reconciliation and transitional justice in Sri Lanka.

“The UN and the Human Rights Council and the International Community, we submit, should also take all necessary actions to ensure that the benefits of the implementation of the UN resolution are derived by the people who have been victims.”

      Tamils are better off than Indigenous people in Australia and Canada. Therefore, the UNHRC must focus on those people first.

      Since the invasion of Australia, the Aboriginal people resisted the colonisation of their land. The invaders pushed Aboriginal people off the fertile lands into controlled settlements. Some areas of the Northern Territory that were inaccessible and unwanted were set aside as ‘Native Reserves’. Later on these reserves were given ownership to Aboriginal people through the land rights act 1976. Many Aboriginal people worked on cattle stations. For decades they were not properly paid; nevertheless they stayed in their country and continued their responsibilities.

      There was the shameful treatment of Canadian Aboriginal people in early treaties by means of which valuable land was obtained “for an apple and an egg,” amounting to theft. As Aboriginal protesters frequently state: there can be “No Justice on Stolen Land” There has been widespread duplicity of settlers who have refused to stick to treaty agreements. Settler society has flouted its own treaty laws if obeying the law meant that greedy land grabbing would have to be curtailed. Canadian government, in cahoots with corporate interests, have been following a devious and destructive policy of “divide & conquer,”

      Clearly, it was easier for the Westerners to create a country for the Jews on others’ homeland to have a Jewish state as “the representatives of the West”, in order to control the Middle East. The same people who acknowledge the Jewish state have refused to acknowledge indigenous people in their homeland. It is nothing but a double standard of the Western governments. Can both freshwater and saltwater flow from the same spring? Obviously, the Westerners who have refused to acknowledge Indigenous people in their homeland for centuries would not worry about Tamils for nothing; they have an ulterior motive.

    The corrupt regime has its own internal and external problems, and wont be bothered with the UN resolution which if implemented in full, will liberate the masses, especially those of the northern and eastern provinces from the iron grip of the military who too have to be probed by jurists from within and without Sri Lanka.

    Meanwhile the ‘fat cats’ within and without parliament are getting richer, and citizens are struggling to survive.
    Political Survival is the name of the game.

      If you have the will and commitment you do need only 24 hours to grant justice to Tamils. After all Sinhala only to please the Sinhalese was brought in 24 hours. Problem is that except a few fair minded Sinhalese, the rest do not want to concede anything to Tamils, and want them to be kept suppressed. Excuses will be given to delay and finally deny justice to Tamils. Only an impartial foreign intervention will bring justice to Tamils as what happened in other countries with similar problem.

      Tamils must wait patiently at the same time exert pressure on Srilanka and lobby international community. This reprieve is only temporary as evidenced by the announcement made b the British High Commissioner in Colombo asking Srilanka to honour all commitments. This is only a carrot and the stick will come down on Srilanka at one point, which may be faster if Mahinda usurps power. After all prabaharan was given carrots for six years to reform and when he did not he was eliminated.

        Tamils should forget this fake accusations, talk of injustice, discrimination etc. etc. learn Sinhalese if they have to and work hard to improve their lives and live like thousands of other Tamils living among Sinhalese in the south. More than 70% of the poor uneducated Sinhalese also go through similar social problems. Blaming racism is not the solution.

    The first meaningful attempt was he B-C pact of 1957. Another one which caused great hope was the offer of unconditional talks with Tamil liberation movements by Chandrika. In 2014 MR made the white-van offer “Known devil is better than an unknown devil”.

    Unwittingly successive GoSL through pogroms created the Eelam Tamil Diaspora who pressed for international support and UNHRC stepped in. Annual promises decked with flowery words came with astronomical (and astrological) regularity. This has now been made into biennial event.

    TNA was given a Hobson choice. Opposition to the acceptance is justified.

    History will show as to whether TNA was bullied or the acceptance is a master stroke.

    TNA led by the Hon.Sampanthan needs our congratulations for this decisive stand.It is the only way forward for the Tamils of SRI Lanka,whatever some negative critics may say.Pirbhakaran and all evil he did,including lamp post killing of his own people,is the worst period in the history of SRI Lankan Tamils.To the last man woman and child , the Tamils who lived in Sri Lanka, without running away abroad and been arm chair critics like Usha Sriskandaraja , will say in unison Never Again.Bravo TNA!!

    TNA is part of the Sirisena-Ranil government though the TNA MPs sit in the opposition benches. Sampanthan and TNA had a big role in creating the Presidency of Sirisena.

    If not for Ranil and Sirisena, Sampanthan would not have been made the Leader of the Opposition and he owes this position to the two.

    Opposition Leader Sampanthan does not act like a true Opposition Leader.Dr Pieris has rightly pointed out that Sampanthan is the only Leader of the Opposition in any country and at any time to vote for a Government Budget. He has pointed out that Sampanthan had even voted with the government in Parliament to suspend a fellow Opposition member. Sampanthan had never raised any issues of national importance in Parliament in his role as the Leader of the Opposition.

    The fact is that being part of the Sri Lankan government, TNA has no option other than to support and welcome the UNHRC resolution that was co-sponsored by the Sri Lankan Government.

    TNA may have four constituent parties and MPs from these four parties may be sitting in Parliament but only one man, Sumanthiran, makes major decisions for TNA. There is no internal democracy in TNA and both Sampanthan and Sumanthiran are autocrats.

    TNA was returned as the major Tamil party at the last General Election but on the ground things are different now. TNA has been gradually losing support among the Tamils in the North East. But, the positive news for TNA is that there is no alternative Tamil party to replace TNA.

    It is important that TNA should get the British involved in this process because, it was the British who took the Lands occupied by the Tamils in the North and the East of our Island for thousands of years, when they made it a unitary state after 1815. When the British left in a hurry in 1948, they gave the rule of the whole country “Ceylon” on a plate to the majority; without any protection for the Minorities.
    After 1948, the majority even re-wrote the History Text Books to ascertain that the Sinhalese are the Only Indigenous people of the entire island of Ceylon and that the minorities are remnants of the Indian invaders whom the Sinhalese spared.
    The Sinhalese claim was underpinned by the ‘Mythological Fact’ that Lord Buddha visited Lanka to bless and proclaim the island a Buddhist shrine and it was the duty of every Sinhalese to preserve it.
    Successive Tamil politicians have failed to enlighten the majority by parliamentary proclamation or dialogue or interventions through Historians, UNESCO the Tamils artefacts in Jaffna Library or any other international organisations about the ancient Naga Tamil heritage of the island which runs to King Ravana’s period.
    British even acknowledged the Tamil legal system ‘Desa-Valamai’ forfeiting all others in the island which is clear evidence that the Tamils were independent of the rule from the Majority Sinhalese.
    Britain should mediate with the majority to enlighten the majority to accept the true history of our island and that Tamils are the indigenous people of this island and that all minorities deserve parity.

    Like it or not The date expired Resolution 30/1 is gone. Please welcome,taking the hand of TNA, the freshly dated, brand new resolution 34/1 , the Sadukudu game of Yahapalanaya and West. Not many choices! After the war with LTTE, including Norway, promised of heaven in the earth for Tamils. Yes; when Old King was gone, New King came. But Tamils yet to get their lands to hang in the hell, the Lankawe.
    Every Tamils’ face is pale though TNA hiding the wound of hanging behind the “Mother Player”, the Yahapalanaya in Sadukudu, though still limping in its team. Every eye is reflecting the blue sky. The question is what the resolution 34/1 will do in the coming 2 years that the 30/1 didn’t do in 1 1/2. No, they don’t know the answer, including the TNA.     Resolution 30/1’s Main actor was Mangala. But, Harsha played that role in 34/1. Mangala’s too sharp opening session could be the blunt. Mangala’s excessive manipulation might have had a negative impact in the circle.

    But we had seen this game of Lankawe from Kathirgamar’s time. Kathirgamar was abolished by Old King. This continued through Thero de Silva, Rajiva, Tamara, Mahinda Samarasinghe, Chris Norris, GL and Mangala. Many times, from 30th sitting, it was suggested Mangala is going to be removed as he had given out too much. It has not happened, yet Harsha, his deputy only finalized the 34th sitting. Thero had explained during the January 2015 election that why this musical chair take place during the Lankawe’s UNHRC presentations. Lankawe send with its entourage best Indian Biryani, top illegal arrack and Sinhala Supporting actress, booking hotels like Astoria Waldorf in Geneva and New York, only to defend its Genocide crimes but not to telephone back what the West wants to teach about Human Rights. Thero had said the he had negotiated to implement 13A but the Old King listened to Brother Prince and abandoned it. In foreign diplomacy, Lankawe goes on the path of a mono rail. No switching or track changing for forth coming train. From his Geneva experience, GL had let know how difficult is selling this Aappa Diplomacy. But Lankawe’s order of “do or die as a Smart Patriot to your country” to its diplomats have made the Aappa diplomacy astonishingly successful. Without doing one single constructive thing, but working day and night, 24X7, 365 days in a year, its diplomats have more than doubled the allowed time in the resolution 30/1 to 2 years in 34/1. Holding TNA behind the “Mother” player, carefully covering without exposing to West, Yahapalanaya has played perfectly well its Sadukudu.

    Lankawe had agreed in America’s Resolution 30/1 for March 2017 dead line, after carefully planning the American presidential election of November 2016 and new administration coming in end of January 2017. Yahapalanaya had not thought of seeking Chinese protection at that time. Further, its number one strategy was keeping Sampanthar in the dark room of secret solution that no Sinhalese would ever have come to know of. Originally it was proposed as 90 days solution to get Tamils support to EP election. But the actual 6 month solution, the 19th A, did not give any relief for Tamils and that is what was, latter, replaced as secret solution, after the September, 2015 of Parliament election. The secret solution was dragged up to November 2016. When the November Election gave an unexpected enthusiasm, secret solution vanished in thin air. American election put the West on serious disadvantage and put Lankawe in many feet ahead on its Sadukudu. This rang an alarm bell to China. “Just computer hacking or milking on loan may not play too well on China side.” China changed the tactics from bullying in Colombo Pong Cing to wooing with friendlier industrial development for Hangbangtota, with 200 year lease. Lankawe wanted to go for known devil instead of unknown angel. Instead of sex with black widow, it went for Chinese “Buddham Saranam Gacchami”. It realized hanging heavily on with Trump may hurt Lankawe on Chinese loans. Lankawe wanted to change its tactics too. Also Trump had an anti-China policy. That is where West (EU) was willing to give additional one year instead of letting their Star Candidate Ranil hide under China. When America came out of the election stunts to see the UNHRC, the new term had to be extended to two year extension to keep Lankawe with them.

    Lankawe never takes a sweep ticket. But the windfall is always with it. Yes the pig is thrust with a Chocolate cake for its birthday party. But it has its favorites of Chinese import. Lankawe will not use this forced extension, same like the last one. Instead of forcing this extension on Lankawe, taking it to ICC might have been easy on to it for its racist election propagandas saving criminal from UN electric Chair.

    West (EU) has been talking about extension for some time. Lankawe has been gathering its demands to agree for that. In an unusual manner, Tamil had waked up too. It was thunderous show in Geneva. TGTE like organization who knows Lankawe’s negotiating tricks has been protesting against the extension staring even before the time the UNHRC 34th sitting started. A massive campaign was launched from every corner of Tamils and NGOs, other than TNA and GTF. As there was no Ex State Secretary John Kerry’s pressure on UNHRC HC, he had given an excellent present. Many other UNHRC official went to Lankawe in the past two years has given their finding s too. Other than Indian representatives almost all democratic countries had censured Lankawe. After all these, the 47 member country body unanimously decided to extend the date. Two years are longer for Tamil than the two century lease of Hangbangtota, to Sinhalese. Those all 47 countries who had talked against and for Lankawe have passed the resolution 34/1 in favor of Lankawe without voting. A Sinhala Jury may consist of 7 members, but the UNHRC Jury has 47 countries. We would like to remind the readers of our earlier quotation from Valampuri’ s example of Panchali Sabatham. Not one of these democracies stood up and asked “Stop Guys! What this madness is about? “.

    It looks like Tamil politicians have got lost in the wilderness after the political changes that took place in USA, UK and Tamil Nadu.

    During Obama Administration Sri Lanka was like another State in USA. All kind of guys came one after the other. They landed in Sri Lanka and next day they were sitting with Tamil politicians in Jaffna. With Obama gone those stooges have disappeared. Tamil politicians and Diaspora had high hopes of Silly Billy Hilary. Diaspora poured lot of money to Hilary’s campaign funds thinking that they can have her in their pockets when she became the President. That hope also dashed out. I heard that one Tamil politician cracked 1000 coconuts in a Kovil in Jaffna and prayed to make Hilary the President. That God, at least for the time being was sympathetic to Sinhalese and gave the chance to Trump. If Hilary became the President, Sri Lanka would have been in real trouble.

    In UK, David Cameron was licking the ass of Tamils to get their votes. He once visited Sri Lanka and behaved as if this country is still a British colony. Thank goodness, he had to leave politics because of Brexit. That change is also an unfavorable thing for Tamils. Theresa May is bogged down with Brexit planning.

    In Tamil Nadu, Amma is gone. So Vigneswaran had to cancel his appointment with her. It will take some time to know how things will turn out in TN.

    At UNHRC, things are not the same as during Obama Administration. Samantha Power is no more there to bark at Sri Lanka. Have to wait and see what would be Trump Administration’s stand point on Sri Lanka.

    China has given a warning to India not to mess up with Sri Lanka and Nepal.

    With these changes, things are not that rosy as they used to be.

    TNA welcomes the roll over of the resolution !!!!!, but what is the message from TNA to the victims, the mothers waiting for their loved ones, the widows, the orphans, to the prisoners of war, those IDPs waiting to return to their homes and land, and to those who voted for TNA to represent them.

    Is TNA’s purpose to safeguard the government or to seek justice, accountability, reparations and the future of the Tamils in the Island – political solution for the Tamils?

    Please explain?

    And what is TNA strategy for the next 24 months, and what if, GoSL further delays implementation, or will TNA last the 24 months?

        This is why we need an independent international investigation with foreign judges, prosecutors and lawyers to find out the truth, on how and why more than 100 000 people were killed, by whom, where, why and what was the intend and purpose of the Mullivaikkal war. The High Commissioner has stated in his report that the war crimes, crimes against humanity need to be thoroughly investigated.

        It will then be clear as to why schools, churches, temples, hospital were bombed, and importantly who shelled into the No Fire Zone.

        Why fear the truth, to put the genocidal intent to rest and to move forward.

          As a Sri Lankan I will never allow foreign judges/prosecutors/lawyers to be part of any legal proceedings within SL. Only way they should be allowed is through obtaining licenses to practice law in this country like any Sri Lankan. Can you list any country that allowed this type of nonsense?
          By the way, killing 100,000 of our citizens by suicide bombing in public places does not need to be investigated for whom, where and why etc., by foreign lawyers. In fact the LTTE has taken responsibility to each mass murder as soon as they happened. I want every Tamil who supported the LTTE by moral, financial and any other way to be brought to Sri Lanka first. Those foreign countries who harbor them should extradite all these Tamils to Sri Lanka before agreeing for any investigation. I want Adle Balasingham, Usha Sri Skanda Raja and all people involved in The Transnational Government of Tamil Eelam here in SL. These are terrorists.
          Where ever there is suspicion of terrorists activities those places should be bombed just like what the US, UK and Israel is doing.
          Are you suggesting that the DFSL should say, “oh terrorists are in a school so we should retreat to the barracks”????

            1) international criminal tribunal for Rwanda

            2) Khamer Rouge international tribunal for Combofis.

              You better do some research before you write trash.
              Rwanda never had international judges/lawyers inside the country. The courts they had was called “Gacaca courts”. It was a local court system. The UN established the International Criminal Tribunal for Rwanda, which was based in Arusha, Tanzania which was closed down without any impact on the committed crimes.

              Khmer Rouge Tribunal, was a court established to try the most senior responsible members of the Khmer Rouge for alleged violations of international law and serious crimes perpetrated during the Cambodian genocide. In 1997, Cambodia’s two Co-Prime Ministers wrote a letter to the Secretary-General of the United Nations requesting assistance to set up trial proceedings against the senior leaders of the Khmer Rouge.
              Basically it was established on request of the Cambodian prime Ministers. Nothing like that happened in SL. The UN knows it is illegal to establish a court system with foreign judges/lawyers in a country without the country’s consent. If they establish without consent the country can any time disregard its decisions making it useless. The UN can however, establish a hybrid court outside the country, which SL has the right to boycott.

                1) You just agreed Cambodia requested international tribunal in your response. so Cambodia IS an example. it had judges even from Sri Lanka. you better do some research before you write TRASH like “Can you list any country that allowed this type of nonsense?” Cambodia did invite even you agreed to it.

                2) Did I say Ruwanada had their tribunal INSIDE Rwanada. I am very well aware of Ruwanada tribunal and i have even visited the site of the tribunal personally. (I also visited the Zimbawawe tribunal wihch was brought agaisnt the famrmers agaisnt Mugabe in Windoekyou in Namibia. I also visited the site of Khamoure rouge massacure).                   REQUESTING and ALLOWING are two different actives. Cambodia by itself REQUESTED an international tribunal (one reason being they did not have enough manpower). UNHCR is trying to force Sri Lanka to have one. That is why it is not going to happen in SL. Let me put it in a way so that you understand. Do you know any country that ALLOWED this type of court within their country when forced by a foreign entity or the UNHRC????

                  OK, now you are saying ” Did I say Sri Lnkan investigation must be held WITHIN Sri Lanka?” That is good, in that case they should have started this tribunal long time ago. I am sure escaped Tamil terrorist and asylum seekers are all ready to give fake evidence, so why wait?? Do you think the GOSL will patronize such a tribunal?? Whether it is inside or outside SL, the GOSL is never going to conduct such a circus! If you think otherwise you are a fool!

                      This is the last response to you. You have no idea of what I am saying. You are holding to a part of the paragraph (“Can you list any country allowed this type of nonsense”) and showing your weak comprehensive ability.
                      Read again what I wrote;
                      “As a Sri Lankan I will never allow foreign judges/prosecutors/lawyers to be part of any legal proceedings within SL. Only way they should be allowed is through obtaining licenses to practice law in this country like any Sri Lankan. Can you list any country that allowed this type of nonsense?”
                      Do you see the word “within Sri lanka”?

                      Cambodia REQUESTED the tribunal, they were not FORCED! In other words Cambodia allowed because they were the ones who requested! Did you read and understand what I said in my second post?? (Cambodia by itself REQUESTED an international tribunal (one reason being they did not have enough manpower). How many times do I have to repeat this for you??

                      In fact no country has allowed tribunals inside their country with foreign judges/lawyers if forced on them by the UNHRC (as they are trying to do in SL). Good example is Rwanda where they rejected and a tribunal was establish in Tanzania which ultimately ended up with no useful outcome! As I have said million times to you Cambodia requested help to setup one and the UN helped them, which is totally different from what is happening with SL.

                      AJ, I don’t know what kind of education you have but I feel you are lagging behind many others who write here. You are asking me “Why are you talking about, they should have started the war crime probe before but now?????”
                      So, you haven’t understood why I said so. Your statement “Did I say Sri lnkan investigation must be held WITHIN Sri Lanka?” indicate that it can happen outside SL too. SL has no interest to have a tribunal anywhere else other than in SL. If the UNHRC wants to have a tribunal by themselves they could have that at any anytime and anywhere other than in SL. This is what happened in Rwanda.
