Two Supreme Court Judges Refuse To Sit With Shiranee At Monday’s Sittings

Hulfsdorp was agog today with the news that two Supreme Court judges were refused to sit with Justice Shiranee Tillekewardene.

Justice Tilakawardane was presiding over the bench listed to hear 26 cases at Court 502 of the Supreme Court. The other judges scheduled to sit were Justices Chandra Ekanayake and S.I. Imam. However when both judges did not make an appearance, Justice Tilakawardane who was the only judge in attendance was compelled to postpone all the cases scheduled for the day because of the

Reportedly this refusal was over her testimony before the Parliamentary Select Committee which had engaged in an impeachment inquiry into Chief Justice Shirani Bandaranayake and before which justice Tillekewardene had given damaging views against the Chief Justice.

Justice Tillekewardene sat alone as a single judge and postponed all cases coming up before her. A lawyer who was involved in the anti impeachment protests stated to Colombo Telegraph that this was the silent protest that judges with a conscience should carry out against those who ‘collaborate with the Mahinda Rajapaksa in order to degrade the judiciary’. ‘We should have had this happening a long time ago’, he said.

      Justice Thilakawardena heard the Ceylinco case. CJ Shiranie took the case from her and Ceylinco gave the CJ a discount of Rs. 1.6 million for an apartment she bought. She had 20 bank accounts. Rs. 34 million undeclared foreign exchange and so on widely published in newspapers. So we have a corrupt CJ. And not to talk about her husband.

        Black Coats never had sympathy for the public. Wait and see, they’ll get what they deserve. All that black coats wanted is money, money and nothing but money. Ask a man in the street, they would confirm what I say.

        I have seen some black coat here talked about two men (judges) who hadn’t reported to work without giving notice returning their salary for the day. It’s not just their salary for the day, what about cost incurred to all those twenty six or so litigants who wasted their day for nothing. And the difficulties and the miseries that postponement must have bought about to them. They must have paid ten thousand to hundred thousand or more to haultsdorp sharks beforehand.

        If law is equal to all, these two men who put false wigs to fear us should be hauled up to an industrial court and made them pay all the expenses to all the litigants. I wish Mervin or someone in that calibre would do the job for us.

        Dear Dr,

        I dont know what kind of a Doctor you are and from your comments you seem like an animal Doctor.
        We all know that Dr.Shiranee is the victim of a stiched up job by MR and his clan for political ends which is now the familiar story in Sri Lanka.
        It is subjudice to publish malicious information when proceedings have started and and the papers and the Banks now face huge damage claims.
        Any one who stands in the way of MR and his henchmen will pay the ultimate price of paying with their lifes and the only crime Shiranee has commited is to challenge the relentless march to dictatorship by MR and his clan and being married to a Tamil man.

      No wonder cases take two three decades tobe sorted out … Justices protest at each other at the expense of public while people die in courts during their 29 year land disputes which could not be sorted out by justices within a reasonable time.

      Some anti-SriLankan forces think the CJ is above the law of the nation and all allegations against her should be dismissed. I think the integrity of the judiciary should be protected and applaude Justice Tilakawardena for the courage shown in divulging the truth at the inquiry against the CJ. Those judges opposing this inquiry have blackened their name as impartial judges.

    Wow! As a non-legal, ordinary citizen who is still in Sri Lanka only because I love this country, I myself have serious reservations on some of the past judgments of the supreme court (not only during the current CJ’s tenure but before that as well). I don’t want to pre-judge Justice Tilakawardane, but regardless of whether the current CJ is guilty or not, no one, including Justice Tilakawardane, have any moral right to condone the way justice is meted out in this country by the present regime. If Justice Tilakawardane truly believes that the current CJ is guilty, she should have said that publicly AND at the same time publicly condemn the way the kangaroo court impeaching the current CJ was conducted. If Justice Tilakawardane has given incriminating evidence against the current CJ BUT HAS NOT condemned the procedure adopted in the impeachment, the boycott is fully deserved! After all, we are not interested in one individual (guilty or not), but the system that is supposed to be the last refuge of just relief for ordinary citizens like me.

      Thilakawardene is not one of the brilliant judges .Her judgement on certain cases have been appalling . Without examing the evidence she had been quick to advice the petitioner, acting not like a judge but as a therapist requesting them to withdraw the case . What kind of judges do we have in SL ?No wonder the judiciary is in such a pathetic state.

      This is what exactly any peace-loving Sri Lankan would think about our motherland. We love our country and that is the reason why we are worried. Just because the President and his close associates are highway robbers and looters of our national wealth, we cannot say that the Post of President is bad but if that position is given too much of impunity, then it has to be corrected. Similarly, most of the Sri Lankans are fighting for the Independence of the Judiciary and also the general public know very well that the present CJ is very honest. If the former CJ’s like Asoka de Silva or Sarath N. Silva were impeached, then even the general public would have supported the Impeachment motion but here the people know that the present CJ is impeached solely for not giving the recent verdicts as per the aspirations of the LOOTERS and also the President wants the judiciary under his thumb. The Impeachment is purely on BITTER VENGENCE – Are they practising Buddhists or using Buddhism to fool the innocent masses. (Wairayen wairaya …..) Back to the above topic, SAINT MICHAEL and/or PROPHET MOHAMED would NOT sit with LUCIFER to judge the living and the dead. We hail the very brave actions of the two Supreme Court Judges.

      Yes, this sums it up. Justice Shiranee Tilekewardena was a person for whom I had been led to have immense respect. About three years ago I remember she was reported to have spoken out fearlessly against Janaka Ratnayake in some Lalith Kotelawala case where that Rajapaksa relative had traded in shares of Sussex Colleges. I’ve never met any of these people, we have our lives to live and expect the Supreme Court to do its work like that, impartially and fearlessly. I have heard it said that this Shiranee has an impeccable background (Shirani has humbler origins apparently that belie her surname); people who know Shiranee have told me that she is highly cultured etc. And now this shocking development! Shirani stood accused only of bringing money INTO the country – all sorts of others are stashing away our national wealth in foreign accounts.

      The context in which these actions have taken place is all important. We want the Rule of Law to be restored. So, when Mahinda Rajapaksa wants to back down let him do so, without too much loss of face. Instead the U.N.P. comes up with some pettifogging argument that UNLESS he removes Shirani the President himself must be impeached. When can we impeach Ranil Wickremasinghe?

      Please Shiranee and others of your ilk, we simple people want to get on with our lives – not to study convoluted arguments all the time. I give myself a chauvinistic sounding handle because earlier it was claimed that it was only a Tamil she could say such things. This entire country has been made a pariah state owing to actions such as these. Shame on Shiranee for having joined that lot!

    If she were called as a witness by the PSC, it should have been to get her to testify against the Chief Justice. How did she become a witness? Was she required by law to give evidence? Or had she volunteered to give evidence.? Is it not unethical for her to give evidence at a trial from which the Chief Justice had withdrawn saying she had no faith in it? Was she fishing in troubled waters or was she a victim of circumstances? People in the country ,no doubt, want to know the answers to these questions.

      This shows that she does not trust CJ’s judgement by presenting herself before the PSC. Which means why should she continue to sit on the bench. She should resign or take leave of absence until the present CJ is gone. If CJ is not gone then she should never come to the bench again.

    What a sad predicament Justice Thilakawardena has got herself into,if other judges of the SC are not prepared to sit on the same bench with her.
    She finds herself in this situation because her claculations had badly got skewed and missed the target.
    She had responded to the summons to give evidence before the PSC at an ungodly hour thinking that she had the post of CJ within reach,but never imagined that the President would back out saying that he would have another independent body to oversee the PSC’s decision,nor did she excercise diligence to consider why the PSC was calling for testimony from witnesses when it first said that no witnesses would be called.
    As an experienced judge she should have carefully considered this.
    Now she find herself in a limbo and must be kicking herself for taking an impulsive decision and becoming a laughing stock.

    It is a good sign that these judges realize that they become just like bus drivers or bus conductors if they do not act to defend judiciary against dirty tricks of politicians.

    Whether CJ Bandaranayake is good or bad is a different matter. The way govt tried to remove her was wrong. No reasonable person can support this kind of getting snakes under their garment approach of govt. It gives those waiting to derail this govt weapons to attack and kill it.

    The attack by the executive initially was against judiciary in general. Then the issue was diverted to the legislature but it directly attacked the Supreme Court. We lawyers are part and parcel of the Supreme Court . Judges through out the country are also part and parcel of the Supreme Court. Impeachment threat is against all superior court judges.
    There is no way out for lawyers and judges but to work against the ” impeachment procedure” and vulgar attacks to the Supreme Court by elements in the caliber of Hud son, M.Silva , Wansaweera, SenaRajitha, DilPera.

    We must adore the silent pain the superior court judges face and suffer in this whole episode. Good that Bar Association passed a resolution to not to welcome a future “CJ”, a stooge. It blocked appointing ” an stooge acting CJ” as suggested by S.Silva.

    Okay,so the two Shiranees are fighting.Girls will be girls know,you can’t stop that even if they become supreme court judges and wear wigs etc.Now it seems the boys have also got involved with the girls fights and are taking sides.When we were in school we would take sides to get a little bit of pussy on the side,but in this case it seems the boys are taking sides for something called independnce of judiciary or something like that.

        Aiyo,fazeela,I’am not a male chauvinistic pig,only a simple pig because I’am very greedy and eat like a pig. I’am only saying these two girls are fighting because one shiranee was playing with a toy called ceylinco up and down and the other shiranee came and grabbed that toy because she had bought a ceylinco proprty of her own at a discount and wanted the seller to know that she appreciated the discount.Now the first shiranee got naturally annoyed that she could not play with her toy so she went to the Parliament and told the whole story.Now when the second shiranee heard this she stopped two of the first shiranee’s boyfriends from playing with her.I’am getting mud all over me and being called a MCP by poking my nose into women’s affairs..Serves me right.Reminds me of my fiery females in my family tree who will fight like tigresses with each other and when the menfolk like fools intervene and stop their fun they gang up on them finally and tear them to shreds.

    Justice Shiranee Tillekewardene as a Lady who knows Sri Lankan manners would have refrained from appearing before PSC since certain members of the PSC, reportedly insulted a Lady who is also the Chief Justice. Even an uneducated lady will not approve what educated Justice Shiranee Tillekewardene has done against another Lady Justice! Unexcusable bad behaviour! Isn’t it?

    Both these judges rose up the hard way beginning their careers in the minor judiciary. Tilakawardena on the other hand was appointed to the High Court directly and that too in preference to Asoka de Silva who was 30 places senior to her in the AG’s Dept. These two judges are extremely courteous to lawyers and litigants. Their behaviour on the Bench has been exemplary. This is their gentle way of telling Tillakawardena off. Bravo!

    Justice Shiranee should have realized that it is always dangerous to rely on dirty politicians. One ponders that having known that Wimal Weerawansa and Dillon Perera used filthy languages on the CJ, she shouldn’t have given her presence in the PSC. There is suspicion whether Shiranee Thilagawardena was promised the next CJ.

    One Minister (Chandrasena), over TV this morning said the lawyers have set a bad example to the country having a rumpus at their meeting. He has, like all politicians, conveniently forgotten what the Government Members did in the Sovereign, Supreme Parliament’s August Assembly by attacking the Buddhist clergy, going to the extent of squeezing the testicles of priests, when they did not vote with government. This resulted in a priest being hospitalized and later resigning from the Parliament. Is this the example the politicians showed the school children who were in the public gallery of the Parliament at that time and the country as a whole. Does he have little bit of intelligence to understand what thy did was worst and deplorable. These are the thugs/ criminals now ruling the country.

    Today we herd that GOSL has unleashed it’s assassination attempt on Senior Lawyer Gunaratne Wanninayake and could continue this to other Patriot Lawyers and SC and JSC personnel also.

    Therefore I give some security and precautionary measures for them to follow.

    1) Inform UN, EU, USA, UK and Asian Judiciary services on this incident.

    2)Adopt more security and defensive measures and be more vigilant.

    3)Intelligence gathering on these white van personnel and to educate public on the white van abductors with information and photograph gathering hotline and reward them to trace the sources of white van and other murderous sources.

    4)Use of Private Security Agencies to gather information on these sources of white van abductors and to give special security for needed Judiciary and Senior Lawyers.

    5)Using self defense equipments such as Stun Guns, pepper spray, and pepper Guns, Ciren horns and whistles,Swiss knives,etc.

    5)GPS and Google Maps and cellphone photo cameras to locate the white vans and the abductors.

    6)Use International Satellite Imaging and International Intelligence services to locate white vans, their sources and the abductors.

    7)Special Security apparatus for Supreme Court, Confidential Files and all Patriot Judges and Lawyers.

    7)Special training on Firearms and way to counter GOSL. State Terrorism activities.

    8)Complete vigilance and sharing intelligence and information on these abductors among Lawyers,judges and others is a must.

    9)Employ Spies, Decoys,Dummies and Moles to penetrate Govt. Intelligence unit for early information gathering.

    10)Move in Groupes and avoid isolation and isolated travel and constant conferances and updates to inform Citizens and international community on developments.

    11)Also take other Local and International Security related professional help.

    12)Always stay two steps ahead and pre.plan counter Govt.movements on these incidents and also be vigilant on all Govt.security apparatus with constant touch with international community to safeguard citizens from another 1983 like massacre and to work with them on rescue missions.

      She fought land case for 29 years
      Woman dies in Court

      A lady who had been litigating in a land dispute for 29 years, collapsed in the Court of Appeal yesterday, while awaiting her case to be called.

      The deceased N. K. Badrawathi (63) of Parakaduwa, Ratnapura had gone through a District Court case in Avissawella for 17 years and had won it. The defendant party had appealed to the Court of Appeal and the appeal had been listed for hearing since 2000.

      While in the court room yesterday, the woman collapsed and she was rushed to hospital by ambulance. She was pronounced dead on admission. Doctors said she had suffered a heart attack.

      Her husband, a retired military officer, D. Dayatillake Fernando, was with her in the Court when she collapsed.

    Yes. Shirani Thilakawardena was against the Hon CJ because of CJ’s appointment to the Supreme Court slap Shirani Thilaka’s seniority. She was angry of that and was saying this and that. Shirani Thilaka’s appointment was from the back door because her bro was in Lalith Athulathmudali’s group. She is not fit to be a judge.

    Justice Tilakawardana did her duty giving evidence before the PSC and that should be appreciated. Only a few people have the courage to do things like that when a colleague is involved in wrongful deeds. I presume the judges who stayed away will not claim salary for that day.

      You are talking about salary of two men what about twenty six or so litigants money (ten thousand to hundred thousand or more) swindled by ‘black coats’ before hand. Are they going to return it.

    I wouldn’t get all excited about this just yet. The two judges could still come out with some excuses that can thwart the potency of their actions. That will be enough for the MR cohorts to run with.

    But, I do feel good that there are people, specially in the judicial system, who are brave enough to give in to their conscience, at least occasionally. We can still hold on to that glimmer of hope that not all is lost.

    Should Supreme Court judges have collective responsibility for their decisions, irrespective of whether some may dissent while on the bench? In Sri Lanka there is no recourse to appeal against Supreme Court decisions. If this is a fact the concept of collective responsibility sounds logical. Can anyone in the legal fraternity clarify? This clarification seems important in the context of Justice S.Tillekawardene’s evidence at the PSC.

      No, ths concept of collective responsibility applies only to the cabinet. Re the SC, if a Determination is given, it is that of the entire Court (ie all the judges who sat on that Bench). If its a normal judgment, then if the other two judges agree, the judgment is taken as a collective decision. A dissent obviously signifies dissension.
