UN Corruption Files: UN Knew Its Money Went To The LTTE But Hushed Up

A leaked UN email suggests that UN money went to LTTE.  Last May, Colombo Telegraph exposed how United Nations funds were paid to three Sri Lankan companies which were physically not contactable.  US$ 1.57 million ( Approximately RS 167,000,000.00 – valuation 2008) was paid to supply companies which the Food and Agriculture Organisation (FAO) of the United Nations could not contact.

This is the level of UN transparency and accountability. This in fact undermines the UN’s system of independent investigations.

The FAO in Sri Lanka purchased project deliveries for the Northern and Eastern Provinces of Sri Lanka to a value exceeding US$ 1.5 million from three suppliers, namely, Dev Trades, A. F. Associates and YCO Farm. These suppliers could not be found at their given registered addresses. Two FAO staff members Niranjala Gunaraj, Finance Assistant, and Thevarajah Vaigunthan, National Project Officer, both attached to the FAO Emergency Unit, collected the payments on behalf of these three companies.

We asked the UN to publish the report of the investigation it claimed to have carried out.  We wrote to the FAO Country Representative, Patrick Evans and Assistant FAO Representative (Administration), Dihan Hettige, asking what happened to the inquiry findings but they have so far failed to send us the investigation report.

Instead of making the report public Patrick Evans maintains  “The issue has been thoroughly investigated and addressed in a proper manner.” Quoting The Rome-based UN FAO headquarters spokesperson The Italian Insider wrote;   “corrective action was taken” as soon as the problem was brought to light.

We wrote, ‘’Interestingly, Patrick has never denied they paid US$ 1.57 million to “ghost” companies. We can categorically state that the UN FAO Country Representative is in a cover-up game’.  We asked more questions form Patrick Evans in an open reply but UN FAO has so far failed to respond.

The issue was not addressed in a proper manner. Patrick says: 1.  no money was stolen or lost, 2.  all inputs were delivered to the beneficiaries and were of suitable quality,3.  no crime was committed, 4.  transparent procurement procedures were not properly followed and 5.  immediate action was taken to correct the situation including removal of the staff member involved and publication of an article in the local newspapers informing the public of the same.

Let us examine these responses one by one; 

He accepts transparent procurement procedures were not properly followed. Why did the UN FAO organization fail to follow transparent procurement procedures? This is in itself a crime. He says, ‘no money was stolen or lost’. When you purchase goods from “Ghost” companies where has the money gone? Today we can expose part of this corrupt deal. It shows where the money went. Bank details of one of these “ghost” companies, A. F. Associates shows that millions of rupees had been transferred to the personal accounts employees of the UNFAO.

Bank details showcasing transfers of monies from A.F Associates prove that millions of rupees were transferred to two employees’ personnel accounts. In 2008 September and October alone A.F Associates transferred Rs.  4.1 million to A. Sivanandan’s personnel account in Jaffna and C.R. Moses’s personnel account in Batticaloa.

Evans says,  ‘all inputs were delivered to the beneficiaries and were of suitable quality’. How can “Ghost” companies deliver goods to beneficiaries? Where is the proof? Patrick’s own files which were obtained by us shows low quality inputs were delivered to the beneficiaries; effectively cheating Sri Lanka’s poor – the farmers – by supplying low quality seed and agricultural products.

An email dated October 1, 2008 from Benziger, from the FAO office in Trincomalee says;  “I regret to inform you that there are long term pending issues with procurement system connected to inferior quality of inputs, in which we brought this issue to Colombo level is not at the first time now. Anyhow, it is very much worrying that such issues is keep on continuing in the FAO system and expanded to other UN agencies. ….Further we came to know that the price different is unreasonable and price difference were very high ( please check with Poultry purchase order).

The point however is this. Patrick Evans says no crime was committed.  Is purchasing from “Ghost” companies and paying for same not a fraud? Is fraud not a crime?

Evans also maintains that immediate action was taken to correct the situation including removal of the staff member involved and publication of an article in the local newspapers informing the public of the same.  Patrick is again misleading the public. If there was no crime committed why was the staff member removed from the organization and his contract not renewed? Why was there a delay in the publishing of such notice in a local newspaper and informing the public of the same? If he was involved in a fraud, why was he not reported to the Police or CID in Sri Lanka?

Immediate action was not taken. According to UN files, whistleblowers within the organisation kept raising these irregularities from 2006 onwards, but no action was taken until the end of 2008. In 2008, an inquiry was initiated through the FAO Headquarters Audit Department, where three officials, namely, Ms. Maria Carbone, Ms. Georgina Costello and Mr. Dennis Richards came to Sri Lanka to conduct the inquiry.

On May 10, 2009 UN FAO placed an advertisement in the Sunday Observer business page with a photograph of Thevarajah Vaigunathan and said “This serves to inform the general public that Mr. Thevarajah Vaigunathan former National Project Officer of the Food and Agricultural Oraganisation (FAO) of the United Nations, is no longer employed by FAO, and FAO is not liable for any of his transactions/actions.”

So, is this enough? Was it only Vaigunathan who was involved in this fraud? Who are the others? Why did not the UN hand over the investigations to the police?

With FAO denying there was no crime committed, and with all the other staff both in the office and in the field intact how could the FAO played a major role in supporting the re-settlement process in the north and east of Sri Lanka assisting returning IDPs to resume productive livelihoods? What is the assurance of the quality of the assistance provided and that there was no further fraud?

This issue is about accountability for the funds received for the development of Sri Lanka. Evans says, “the FAO continues to assist the Government to addressing priority needs in the agriculture, fisheries, livestock and forestry sectors.” Why was the Government not informed of the said fraud when it was clear that there were many staff members both local and foreign involved?

This is the level of UN transparency and accountability. This in fact undermines the UN’s system of independent investigations.

We managed to find one reason why the UN FAO is covering up the whole corruption saga.

This week we can revel another ‘Confidential’ email sent to FAO Country Representative, Patrick Evans by  Assistant FAO Representative (Administration), Dihan Hettige. On October 4, 2008 Dihan Hettige wrote “We have confidentially checked with our personal contacts from the main commercial Banks to find that Mr. Thevarajah VAIGUNATHAN (National Identity Card No 723580277) in one of the 2 partners of M/S Dev Traders. All of the above establishments are formed after Vaigunathan was transferred to Colombo in 2006. On the whole apart from the tsunami rehabilitation, more than 1/3 of the total procurement has been done through this handful of suppliers mentioned above. As per the recent confidential information received the other companies are run by his family members/close relatives. As per our investigations these companies do not exist in reality. The phone numbers quoted are unanswered and the addresses quoted are bogus. When I had inquired about the suppliers sometime back, his reply was that the suppliers do not want to reveal their identity due to security reasons (including that the mentioned suppliers are directly connected to LTTE). I too have sufficient information to believe that Vaigunathan is directly connected to the LTTE, with his capabilities of operating in the LTTE controlled areas easily.”

“I believe if an investigation is sensed by him or the connected individuals, they might disappear suddenly and FAO might not be able to operate in the uncleared areas thereafter. Also not ruling out the danger of having the details exposed to the Government of Sri Lanka, which could bring long term bad reputation to FAO.”

The FAO Country Representative, Patrick Evans replied within two minutes; Thanks Dihan, let’s keep this to ourselves for the present and consider our options. Patrick

It is clear Assistant FAO Representative (Administration), Dihan Hettige, encouraged FAO headquarters to bury this incident. Was it only this LTTE connection or to protect FAO reputation? We can categorically say the FAO investigation team has not investigated the bank accounts of its employees and bank accounts of the “Ghost” companies. If you investigate those bank accounts you will definitely find that the money not only went to LTTE but to high profile employees as well.

    @Uvindu. There is no proof that 167 million rupees went to the LTTE. There is no proof if at all any money reached LTTE, other than some donation or big gift to the LTTE from the FAO or the employee and family.

    There was no reciprocity from the LTTE to the FAO.

    Looks like high and lower rank officials have connived to rip off the people of the North East and pocket the money. It was easy to blame the LTTE that they accepted the money, via third parties. But absolutely no proof.

    As suggested it the article, the FAO should have gone to the Police and a complaint of fraud should have been filed. Where is this employee now and the others?

    There were many NGO’s in Colombo also did the same thing and profitted heavily, blaming they had give it secretly to the LTTE and there will be no receipts, affidavits or evidence that the cash or products was delivered. When public or UN or INGO funds are used, cash transactions should have been avoided and only materials and products should have been delivered.

    Anyway, most of the cash was carefully packed, covered in rolls of plastic and buried by the LTTE and many billions of rupees, dollars and gold coins/jewellery. So were the money and gold of 400,000 Tamils. (300,000 plus the 100,000 who died). The army acknowledged finding them but no accurate accounting was provided. The central bank and treasury received some of it and the army guys pocketed huge amounts. “They said -Finders Keepers”. That is also why the demining took so long. two reasons. Searching for gold and money. Covering of the war crimes, bodies and bones, destroying all evidence.

    The Colombo based NGO’s had a great day from the Tsunami time like the Hambantota Horas… It is the poor people who finally suffered and the living beneficiaries are the GOSL and army… Check their bank balances, assets both personal and NGO’s, and values of their vehicles running into hundreds of millions. What services did the perform? They all steal from the poor and live rich. None of them were rich when they started small NGO’s many years ago.

      Donald, There is no proof that you funded and raised funds for the LTTE either but we all know the truth. There is no proof the LTTE killed anybody because they were terrorists, didn’t leave receits. There is no proof the LTTE robbed banks because they bombed the banks after wiping out the staff. There is no proof the LTTE existed, because the Army had fun. But any sane person knows the LTTE were drug trafficking, money laundering, terrorist paedophiles who proscribed children and who went on a killing spree of innocent people for fun for 30 years at the behest of the diaspora. There is no point in denying their (or yours) terrorist related activities.

    A factual report as to how the UN HAS BEEN EXPOSED AS AN UNETHICAL AND FRAUDULENT ORGANISATION. What right has it therefore to blame SRI LANKA by illegally appointing a team of prejudiced members to accuse her of committing acts of genocide during the last stages of the defeat of the murderous LTTE?     Sri Lanka can leave the UN and UNHRC if it does not like them. They can even leave the commonwealth!!!!

    The UN-FAO was subject to a fraud by the employees. They are trying to put the blame on the LTTE. If the LTTE was alive, then they won’t say all these things. lol.

      I absolutely agree with Donald. The fraud that was carried out by the FAO staff in no ways or means guarantees that the funds were given to or received by the LTTE. It is therefore of serious offence to publish an article, tarnishing the reputation of the UN for corruption involving some of it’s staff. As in any large organization, corruptions CAN and may arise by employees that work for it. It doesn’t necessarily make the organization Corrupt. There is a significance difference. PS: I do not understand what the Image of the Secretary General represents in relation to the article. It would seem like people WANT the UN to appear on these negative propagandas.

        Ha ha, birds of a feather, flock together. True, the FAO staff’s actions do not prove the funds went to the LTTE, because there is no receipt. Neither is there any proof the LTTE had funds from the diaspora, bought weapons, trafficked drugs, laundered money, proscribed children, murdered innocent civilians in thousands, trained suicide bombers who blasted their balls off killing innocent people etc. LTTE’s only crime appears to be that none of their members demands to know what happened to the chief maniac’s body. It is always good to affiliate two criminal accomplices together as well, as in this case the LTTE and the UN. The UN has aided and abetted directly or indirectly all the crimes the world has seen in the past several decades including bombing Vietnam, Iraq, Afghanistan, Libya and crimes committed by the LTTE . Still for the diaspora, the UN is corrupt-free because they are partner’s in LTTE’s crimes.

I said, the UN either directly or indirectly had a hand in most atrocities. For example, directly, when they approved some attacks like Afghanistan and Libya and indirectly, because the bloody organisation ignored the US arrogance in cases like Iraq.

        I am amazed as to why you feel that the writer has unjustly tarnished the reputation of the UN.

        The reputation of the UN has been tarnished by their very own actions in dealing with fraudulent and corrupted staff who were/are a part of the organization.

        If the organization is accountable, why has it failed to submit the so called report and make an official statement regarding the articles in question?

    As for FAO in Sri Lanka, they have erred if they are unable to account for 167 million rupees in half or one year. The whole of NE was not under the control of the NE and the UN operated in LTTE controlled areas. Gordon Weiss has documented such presence and they were all asked to leave by the GOSL by September 2008 before the massacres took place.

    No UN or UNICEF spent a single penny during the trouble time. They only constructed the Road with the assistance of World Bank but they bribed the politician to keep their presence in Sri Lanka.
    The only sole players were TRO (Tamil Rehabilitation Organisation). I totally agree with Donald, he him self a good example, he was a millioner in Sri Lanka but the government took all his property and burnt down their business and wealth during 1983.

    Donald Gnanakone…your comments are showing how deeply involved you have been with the LTTE. How else could you know what you wrote in your first comment? Of course the genocide of Tamils you speak of was orchestrated, not by the Government of Sri Lanka or its armed forces, but by foreign governments and extremist Tamil Nationalists, many of whom regarded themselves as “Christian Tamils”. I should know, being born into such a family.

    Australia, Belgium, Canada, Colombia, Ethiopia, France, Greece, Luxembourg, the Netherlands, New Zealand, the Philippines, Thailand and Turkey, The Union of South Africa, Denmark, India, Norway.

    Before Your madness came into the conversation Romesh, I remarked that “Let the mad rabid dogs bark, but the caravan rolls on”.

    The governments of SL knows who I am personally for the past 40 years. I have been in and out of Sri Lanka, since the CFA, although I was forced to leave the country in July 1983. In fairness to the Rajapakses they were in the wilderness until 1989 or really 1994. I was at Lakshman’s funeral as well. But I have to confess, did not shed a tear.

    Beyond that I would not dignify anyone’s comment. It does not deserve it. But Sri Lanka as a country does not belong to one corrupt family. Things will change although the wheels of justice turns slowly. Some of the war criminals will certainly be brought to justice, and others will have to deal with their own Karma.

    Well, LTTE money went to the army and treasury/central bank. By the billions in currency and gold. So was the 400,000 Tamil civilians gold and cash. Romesh, reread what I wrote first about this 167 million rupees, which the FAO officials and employees defrauded and want to put the blame on the LTTE. May be they gave some to the Police and GOSL/first family so that they are let go free. I bet none of them or their assets are in Sri Lanka.

    Thanks Allison, that you have the intelligence to understand how organizations like the UN/FAO works. I have experience in Sri Lanka and world wide for decades at various levels.

    BTW, Lakshman and one other family clashed and fought to be Prime Minister. So there were many interested parties whether Lakshman lives or dies. 99% Tamils did not give a damn about Lakshman. That is why I was the only Tamil, other than some of the Kadirgamar family was at the funeral, and I would not write what we spoke. Lakshman never even saw his own grand son in his whole life. That says a mouthful.

    The issue is whatever happened to the FAO money of 167 million rupees, and nothing else. Stick to the damn article, and not about the writer or anyone who makes a comment.

    Even NGO’s like Seva Lanka and Harsha Navaratne (Nephew of Ariyaratne of Sarvodaya fame) operated in and out of the LTTE areas.

We also know who funded the mad dog LTTE ranks.Quite right, you may have joined the LTTE, were you a Tamil judging by your comments (it is an IQ thing) but those who went to school with us, who are life long friends are not LTTE proxies, nor they are militant minded. This particular staff or staffs could have been members of the LTTE but to blame that on the UN is utterly ignorant and shameful.

      Sri Lankan government is blamed for what Army personnels has done, why is that? Is was unable to prevent them and again they are in a cover up game. So the same rule applied for UN as well. Interestingly UN is demanding an independent enquiry re the Sri Lanka’s war crimes, I’m fully support for that, but we need an independent inquiry too for this issue and also why UN couldn’t prevent this happened . As Uvindu says this is ; This is the level of UN transparency and accountability. This in fact undermines the UN’s system of independent investigations.

    Niranjala Gunaraj and Thevarajah Vaigunthan were very strong LTTE representatives. They were appointed by FAO due to LTTE’s request. One James Breen, FAO emrgency coordinator and former FAO representative (Thai person) supported both of those guys to access to LTTE area. Vaigunthan was a very close friend of Karikalan, Daya master and the very top of LTTE. he threatened FAO officlas those days, if FAO did not distribute as his will, will be given maximum punishment through LTTE. so all supported him adn collectively misused UN funds. He collected the funds on behalf of LTTE. Vaigunthan joined LTTE top every time they sucessful in defeating Sri Lankan forces. no one beleive if FAO says all these craps now. there are so many still working at FAO who knows all these.

    top of all these. LTTE distributed FAO assistance only for the people under LTTE list. other people were chased away from any support.

    Don’t hesitate even if you are an employee of the FAO. Bring the information to the GoSL. Give the names of all local and foreign officials and let them be interrogated/investigated and the culprits punished.

But the chances are with that sort of money, a lot of bookkeepers in FAO or where ever the hell also made some “Baksheesh” or commissions. It is how the game is played. Look how well those UN and FAO buggers live in third world nations. Most of these buggers are hired through a corrupt system and through nepotism and not really because they are professionals. But once they get into the UN system they have a bloody good life with vehicles, nannies, houses whenever they go to third world assignments. often these buggers are also other third world people feeding off the trough of Western generosity. The US provides bulk of the money for UN operations. I wish the US tax payers know how some of these third world buggers live in the UN system. Padded expense accounts for example. Also white fellas in the third world on UN pay.. So I am not surprised at this at all. Helping Hambantota and Helping Tiger Tamils…same principle different set of scoundrels.
