Women’s Action Network Condemns Statements by President on Missing Persons; Urges Government and U.N. to Deliver Truth and Justice to Families of the Disappeared

Last week, President Gotabaya Rajapaksa had told U.N. Resident Coordinator Hanaa Singer that those reported missing from the war are “actually dead” and that the government would soon issue death certificates. Although the President has since clarified that death certificates will follow proper investigations, his remarks are an affront to mothers, wives, sisters, and daughters of the disappeared who have for years been demanding answers in monthly street protests, before the Office of Missing Persons, and in cases pending in our courts.

Maybe the President realized his comments amounted to an admission of guilt. Former Prime Minister Ranil Wickremesinghe made a similar remark in 2016 that those missing were in fact dead. WAN condemned those remarks then, as it does now. But Mr. Wickremesinghe was not in power during the last part of the war or in the years that followed. As Defence Secretary, the Current President Gotabaya was. On May 18 2009, thousands surrendered with Rev. Fr. Francis Joseph to now-Army-Commander Shavendra Silva’s 58th Division. Families watched as their loved ones surrendered and boarded buses, never to be seen again. If those missing are dead, how did they die or who killed them? When, where, why, and how were they killed? Where are their remains? How long has the truth been silenced? 

To take just one case, what became of young Balendran Mahinthan who, after being handed over by his mother Jayakumari Balendran for rehabilitation, was pictured in one of the government’s LLRC publications? Is he dead too? His mother was imprisoned for over one year under the PTA in 2014 and still has cases pending. All this ordeal is partly because she was on the front lines holding up irrefutable photographic evidence and demanding justice. Does the government now expect her to accept a death certificate and compensation without knowing what happened to the child she voluntarily handed over for rehabilitation?  

The President claims that most of those missing were abducted by the LTTE or forcibly conscripted. But what about those who disappeared after the end of the war? Journalists and civil society actors were taken in white vans even after Gotabaya Rajapaksa proclaimed the terrorists had been defeated. Where are they now? What about those who were surrendered by their family members in front of many witnesses and never heard back?  

Without details of what happened and who was responsible, it is impossible to simply ask families to move on. The question betrays either a profound ignorance or cruel indifference for what it means to deal with enforced disappearance at a human level. Families have long resisted the government’s efforts to silence their demands with death certificates and compensation. Their concerns and input helped create the Certificate of Absence procedure in the OMP Act (Act No. 14 of 2016, section 13). As relatives of the disappeared passionately show by occupying the streets, truth is not just about determining if loved ones are alive, but instead determining the full scope of what happened. Until a full picture emerges, families will struggle to heal, reconcile, or find peace.

Sri Lanka will be on the agenda before the U.N. Human Rights Council this February. The government will have to speak to its progress on implementing resolution 30/1. Our President’s remarks last week seem calculated to that meeting—a first step toward withdrawing promises previously made. Indeed, we have already seen changes on the ground. Officers involved in investigating high-profile human rights cases have been intimidated and demoted; victims pursuing their cases before the OMP and courts have been harassed; and some lawyers fear for their family members’ safety. By suggesting that those missing are probably dead, President’s comments undermine the vital work of the OMP. This is true despite his clarification that death certificates will follow investigations – the clarification suggests investigations are a formality, with death certificates a foregone conclusion. Moreover, Sri Lanka’s history of fruitless investigations brings little solace those seeking truth.

The U.N.’s silence after a head-of-state’s remarks to its top official in country, is deeply concerning.  In a 2016 report, the U.N. Working Group on Enforced and Involuntary Disappearances stated “the lack of a comprehensive, transparent and effective mechanism to find missing and disappeared persons” had led families of the disappeared “to experience great emotional distress.” (A/HRC/33/51/Add.2, ¶19.)  In a 2019 follow up report, the Working Group noted that “ten years on from the end of the civil war, there remains a long way to go” to deliver on promises made to families of the disappeared. (A/HRC/42/40/Add.1, ¶19.) Consistent with these findings, it must remain the U.N.’s view that Sri Lanka is obligated to deliver truth and justice to victims of enforced disappearance. The President’s remarks reveal his intent to undermine Sri Lanka’s promises in this regard. Heeding this signal, the U.N. should declare that commitments made to the international community on behalf of the Sri Lankan people cannot so easily be pushed aside.

Sri Lanka has now ratified the International Convention for the Protection of All Persons from Enforced Disappearance and passed enabling legislation into Sri Lankan law. It is now the law of this land that “Every victim and relative of the victim shall have the right to know the truth regarding the circumstances of an enforced disappearance, the progress and results of the investigation as are carried out by the law enforcement authorities, and the fate of the disappeared person.” (Act No. 5 of 2018, sec. 14(1).) Unless the Government of Sri Lanka respects this right – by committing to a full truth-seeking process – victims are bound to believe their only recourse lies through the international community.

    For every sleuth who uncovers incriminating evidence against criminals, there are ten persons to suppress evidence, destroy evidence, hide case files, withdraw court cases, obstruct justice, intimidate witnesses, harass complainants, protect criminals, instruct the police to lay off, refuse leave to proceed in FR cases, throw spokes into the wheels of justice and thwart the dispensation of justice.       You forgot one thing. What about giving presidential pardons to a hate speech monger who was imprisoned on contempt of court charges and to the murderer of a teenage girl? Sirisena did that.     There are several categories of “missing persons”. We call them missing because they are neither found alive nor the dead body found. Some may be actually dead, perhaps in a battle and the dead body cannot be identified. Some may have gone hiding either inside or outside the country, for their own security. Some may have been taken away, abducted or other wise and can either be dead or alive. As appearing in the article the cry is for the latter category of individuals. Incidentally an Office of the Missing Persons (OMP) was created by the “Yahapalana” Government by law to deal with this sad situation. Unfortunately its work is not available in the public domain. SO, missing persons continue to be missing and the cry continues. The specific allegation where persons were handed over for rehabilitation and not found thereafter must be seriously looked into. It undermines the standing of the country as a whole. Many years have passed but take the trouble to dig into the archives publish a list of persons received for rehabilitation and where have they been released to after rehabilitation.

    Our deep gratitude to you in the WAN for keeping this issue alive when most people are tired or complacent. The ‘experience[of] great emotional distress’ by others may not be an issue that bothers the everyday lives of most people. Most of us have learnt to be selfish and insensitive and get by. We are a nation of frivolous people, fit to be ruled by knaves and fools. We take little notice of Parliament and take for granted the inanity of presidential pronouncements. The disappeared we try to forget never disappear. They rot and fester within our being and poison our lives and everything around us. That is a selfish reason why the quest for justice is inescapable.

      that there are some Sinhalese at least (it may well be many – so difficult for me to estimate), who are not happy with what our Sinhalese-dominated government, and our almost entirely Sinhalese armed forces have done to so many of our Sri Lankan citizens who happened to talk the Tamil language, and who were culturally somewhat different from us.

      Our people voted like fools. No, I’m not talking about the actual outcome of the elections – it was inevitable that the UNP government headed by a septuagenarian who insists on leading his Party for another five years, was going to fall. Our problem is that people went to the polls without educating themselves on even the system of voting. Have I arrived at that conclusion from objective observation? Yes. What I have said is not just my “wish being father to the thought”. However, it is too complex an issue to deal with here.

      Even if one can excuse the 34 “other candidates” for failing to raise the issue of Gota’s citizenship on nomination day, how can they be excused for not responding when that article appeared eleven days later? They had the usual ten days to do so. I expected a chorus of protests from the defeated candidates. Not one of them made a comment. I telephoned the sole woman candidate, Professor Ajantha Perera of the University of Colombo. She said that she wasn’t going to comment. She had added one more experience to her life: contesting an election. Her daughter and she had visited Royal College, Colombo 7 to observe the counting and were not very happy with what they saw. Why tell that to me on the phone? That should have been a public query (even if short of a protest). Clearly we got the sort of candidate we deserved! Surely, when a candidate comes forward and asks us for support, there is an obligation on her part not to chicken out.

      Terrorist tactics were indeed used by the LTTE, but that was (for some cadres at least) in pursuit of a political goal. The Tamil suicide bombers sacrificed their lives not for them to get to heaven (contrast with the Easter Sunday bombers) but in their futile quest for a better life for “their people”. Part of the tragedy is that in this one country we speak of “our people” and “their people”.

      No, I’m not advocating any more public money LTTE members, but we could at least speak more charitably of them.

      As I’ve kept telling people, you are “nationalist” rather than racist. Our emphasis should fall upon settling all issues, so that all Sri Lankans are able to live in peace in Sri Lanka. I’ve deliberately left out the word “dignity”. We seem to have reached a point where that word seems a luxury.

        You are underestimating their “political goal.” The goal was to first create an apartheid Tamil state in the North and East. And then expand this state to include the entire island. The goal was to kick all Sinhalese and Muslims out of the island. It seems impossible, but keep in mind Sri Lanka is very small. Even without a conventional (normal) army, the LTTE at some point controlled all of Jaffna, Kilinochi, and Mullaitheevu. They would have used their “separate state” to create a conventional army (including airforce) and then go after the whole country, province by province.

    What is there to condemn, I don’t understand.
    If the Women’s Action Network is not ready to accept that the so called “missing persons” are dead, then they admit that the missing persons are actually living somewhere, presumably in Western, North American and Oceanic countries. As everyone is aware, there was a huge outflow of Tamils between 2006 and 2010.
    And about compensation, I would like to ask the President as to how much his previous government paid as compensation to military families other than the salaries of those who sacrificed their lives. The same question will also arise with regard to dead civilians during the 34 year period where terrorism plagued the entire country.
    Compensation to terrorists is not acceptable as it will be an encouragement to such activities and organizations.

      The President has to make some explanations in order his statement not to be another white flag statement.
      First, he is answerable to Sinhalese as to why he did not appear before various Commissions that were appointed by his own government when he was the powerful Defence Secretary.

      On a separate matter, I understand the President is now all out to bring down the megalomaniac Donald Trump to Sri Lanka!!!!!!
      In 2015, Obama was also tried to come but later his visit was cancelled as Sinhalese were furious about America after they admitted that they were instrumental in unseating Mahinda.
      It’s no secret that the American duo, Gotabhaya and Basil have given a pledge to the US that they would sign MCC/SOFA!!!
      What a betrayal is this to Sinhalese Buddhists who placed their immense trust on Rajapaksas to protect the country!!!!!!!!
      All Sinhalese Buddhists now be united to show their serious protest to the President for inviting Donald Trump whose ONLY intention is to destroy strong nations and unique cultures in the world.
      This is the biggest betrayal in Sri Lanka’s history as this visit will be an attempt to sign MCC/SOFA, despite strong opposition of Sinhalese who voted against the UNP to STOP signing the very agreements!!!!!!
      Moreover, signing of MCC/SOFA will cause a serious threat to the peace and stability of our region.
      Sinhalese Buddhists seem to have removed one slave government only to be replaced by an American boot-licker who now tries to sell our beloved motherland to the US.
      If the President tries to sign the MCC/SOFA in FEBRUARY “as A PRESIDENT-TO-PRESIDENT AGREEMENT” in parallel to the proposed visit of the megalomaniac Donald Trump, I seriously suggest the U-turn President be IMPEACHED to protect the country from the danger he poses.

      Champa, the missing persons are dead, not due to natural causes or suicide, but killed in cold blood by agents of the government. Just saying that they are dead will not do, but information must be given how they died, when they died and where the dead bodies are. Are you cruel to say that the relatives of those who were killed do not deserve to give their beloved ones a decent funeral.

    ‘Para’ Demalu who declared war against the Government of Sri Lanka by killing 13 soldiers should pay war reparations. The Sri Lankan Government that defeated the LTTE barbarians are the victors and Demalu are the vanquished.     Champa: I think you are confusing this “Compensation” promise. You said: “Compensation to terrorists”. Did anyone say it? Looking at it from your point of view to say “compensation to terrorists”, you have rated all those “missing persons” to be “Terrorists”. No not at all. Those “Missing Persons” are the people who have been either “surrendered ” on their own or through some one like that “Bishop”. In either case the “Surrendered” were “Listed” and “Accepted” by the Authorities. So, it is “INCUMBENT” on that receiving Authorities to “Hold” and “Protect” them until those surrendered are handed over to their respective guardians. If anyone of those “surrendered” on “record” are “missing”, the guardians have a “RIGHT” to demand to “Produce” and “Handover” their loved ones back to them. Now the President says: “After in inquiry, we will “Issue Death Certificates” to “Missing” and “Compensate” them”. No. That is not what is needed. What is needed : “How did those “Accepted” and “Registered” gone “Missing”? “Who are RESPONSIBLE for such “Missing”? “What action would be taken against those responsible”.? So, please don’t allow this to be “DECIMATED” to a “Death Certificate” and “Monetary Compensation”. Human lives must not be allowed to be DEGRADED to such low levels.

    No doubt, there were mass graves in the last stages of the war. Rather than count figures, it is better to ask how these graves were created in the first place. They were created when the LTTE took several hundred thousand Tamil civilians hostage. LTTE hid behind these civilians and launched missiles, artillery, mortars, etc. at the Army. When the Army fired back, many civilians died in the crossfire. They were not intentionally killed. There was no time for funerals, the dead were simply buried in pits. The real story is that LTTE caused a mass genocide of Tamil civilians by refusing to surrender.

Because the majority of the Sinhala population do not think or want to accept that what the Rajapaksa govt did was wrong and need not be accountable.
    Tamils can only depend on the International Community to implement the UNHRC Resolution.

    Sri Lanka is entering a new phase of the conflict. Hope the Judiciary will Remain independent and bring justice.

    I doubt whether Mr Abraham Sumanathiran will lead a TNA delegation to the UN Council this time.
    I also doubt whether Mr Sampathar and his ITAK bit of the TNA will contest in the North and the South.

    The relatives of the missing persons are not concerned with those who died in battle against the Sri Lankan armed forces. Nor they are referring to those who got killed by bombing or shelling by the armed forces. They are asking to tell them what happened to those who surrendered to the army on May 18th 2009 in the presence of many eyewitnesses but not seen thereafter. In fact, the surrender call went from the army through the public address system.

    LTTE cadres surrendered to the 58th Division commanded by Sarvendira Silva at Vadduvakal/Mullivaaikkal in two batches to the 58th Division commanded by Sarvendira Silva, the current Army Commander. The first was on the morning of May 18th morning at Mullivaikkal. Those who surrendered are 3 LTTE political leaders, 60 other LTTE fighters. And about 40 civilians. The political leaders were B.Nadesan, Head of Political Department. Seevaratnam Puliththevan Head of Peace Secretariat and Col.Ramesh, Police Chief. This surrender was popularly termed “White flag” surrender was facilitated by Basil Rajapaksa and Mahinda Rajapaksa.
    The surrender was facilitated by President Mahinda Rajapaksa, his brother Basil Rajapaksa, Defence Secretary Gotabhaya Rajapaksa and former Lankan envoy to the UN in New York Palitha Kohona. They had full knowledge of the envisaged surrender of LTTE leaders, members and civilians. An intermediary former MP Chandra Nehru was in communication with Basil Rajapaksa, brother of Mahinda Rajapaksa and a powerful minister in his cabinet. Those surrendered were tortured and shot to death. Their bodies were seen lying on the ground with burnt marks and gunshot injuries.
    The second batch surrendered on the evening of May 18 at Vadduvakal to the same 58th army division. The surrendees included Elilan, Yogi, poet Rathnathurai, Balakumar and another 50 odd cadres. 1/2

    They were herded in CTB buses in the presence of their spouses, friends and the public. They were told that the LTTE personnel were being taken for a short inquiry.

    But they were not seen again. A photograph of Balakumar and his son seated in a bench which gave the appearance of a camp. A soldier is seen walking behind them. All these cadres were never seen again. Rumour has it that all of them were summarily executed. Their bodies were never seen.
    President Gotabaya who was the then Secretary to the Ministry of Defence claims no LTTE cadres surrendered to the army. Since their bodies were not found they must be presumed dead. This is a lame excuse to hide a heinous war crime committed under the watch of Gotabaya, Sarvendira Silva, Mahinda Rajapaksa and a few others. These are the people who hold the secrets regarding the disappearance.
    The mothers and relative of LTTE cadres handed hundreds to army stationed at Omanthai called Joseph Camp.
    The OISL has produced a report giving details.

He has the obligation to accept responsibility and explain and prove himself not guilty before International Courts.

      It is simple if you really want honest answers, demand Gota and his single handed generals to publish details of all those persons who surrendered to the armed forces. Also demand them to publish the names and details of those who were released from camps and detention.

      Then some honest people can sit down, compare and reconcile the details.
      There are many ways one can identify the missing persons murdered and buried in mass graves, or dumbed in seas, fed to animals, …. dipped and given acid bath, …..
      Many relatives of victims have already given evidence to two commissions and two army investigations.

      Please stop your nonsensical attempts to cover up or deny war crimes.
