Senanayake<\/p><\/div>\n<p><span style=\"font-size: 13px; line-height: 19px;\">The President has expressed his annoyance with the TNA Manifesto\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">perhaps because of their demand for the merger of the North and East-\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">the original provisions of the 13th Amendment which were overturned by\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">a Chief Justice who lawyers would say, certainly exceeded his mandate.<\/span><\/p>\n<p><span style=\"font-size: 13px; line-height: 19px;\">At the end of every conflict there is a peace treaty or Agreement\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">where the two sides that engaged in the Conflict agree to co-operate\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">in future on some agreed basis. The Government has failed to engage in\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">such talks and reach a solution to the demands of the Tamils despite\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">promises to India and the UN. The International Community has been\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">urging the Government to reach out for a political solution. But the\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">Government has looked upon the Tamil problem as merely the result of\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">the neglect of the development of the Tamil areas by previous Sinhala\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">Buddhist governments and proceeded to spend an enormous amount of\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">money on restoring and even developing the infrastructure of the North\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">and East. The cost of this program will have to be borne by all the\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">people particularly the majority Sinhalese Buddhist population in the\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">days to come. The Government has ignored the cost that people have to\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">pay for this development either by way of inflation or taxation or\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">both. It would have been much easier and less costly if a political\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">solution was put in place giving the Tamil people the necessary\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">devolved power to enable them to develop the area themselves since the\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">expatriate Tamil population has enough resources having made good in\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">the West.<\/span><\/p>\n<p><span style=\"font-size: 13px; line-height: 19px;\">Anyway economic development is no substitute for the resolution of the\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">political demands of the Tamils. True that the LTTE wanted nothing\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">less than Eelam and hence the war had to be fought to a finish. But\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">the TNA is asking for autonomy and not for a separate state. There is\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">really no case for refusing a wide measure of autonomy to them except\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">the fears of the Sinhala Buddhist nationalists that autonomy would\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">lead to secession. It could but not necessarily so if enlightened\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">policies are put into effect to work in co-operation with the Northern\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">Provincial Council instead of trying to dominate and dictate to them.<\/span><\/p>\n<p><span style=\"font-size: 13px; line-height: 19px;\">But Tamil people are settled all over the Island and there are also\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">the Tamils of Indian origin living in the Plantations who also form\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">the backbone of our economy. They have also migrated to Colombo in\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">search of employment and there are significant numbers of them in\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">Colombo. So any partition of the country as took place in India in\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">1947 is not feasible and those now leading the TNA must be conscious\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">of it. Sinhala Buddhist nationalists would undoubtedly demand then\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">that the Tamils in the South should be driven away in the event of a\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">separate State being established in the North. But won\u2019t it lead to\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">sectarian violence such as prevails today in Syria and Iraq. Won\u2019t it\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">end with disastrous consequences to both communities?<\/span><\/p>\n<p><span style=\"font-size: 13px; line-height: 19px;\">Peace and Stability in the present international context in the 21st\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">century will only be achieved when trust is established between the\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">minority citizens and their states across the globe. It will be so\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">whether in Sri Lanka, Iraq or Pakistan. Those States that fail to win\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">such trust of their minorities are doomed to perish as we see in Syria\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">today.\u00a0 Decades of persistent conflict in the world have exposed\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">millions of people to insecurity, loss of opportunity, and increased\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">risk of falling into poverty. Failure or willful discrimination\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">against the minorities has been at the heart of this crisis of\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">governance and human rights violations in many countries ranging from\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">Bosnia-Herzegovina to the Islamic States of the Middle East and the\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">African States.<\/span><\/p>\n<p><span style=\"font-size: 13px; line-height: 19px;\">The Loss of legitimacy is the primary cause of the fragility and\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">failure of such states. The vicious cycle of violence begins with loss\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">of trust in the state by the minorities. Yesterday it was the Tamils\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">in the North and East. Today it includes the Muslims and the\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">Christians as well. The attacks on the Muslims and their cultural\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">practices cannot be justified. If Buddhists don\u2019t like animal\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">slaughter they only have to abstain from eating the flesh of animals.\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">They cannot use State power to enforce their ethical code on the rest\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">of the population. The Islamic countries try to do the same- the\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">enforcement of Sharia on all people but this is being resisted by the\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">Christian and other Muslim minorities including the enlightened\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">liberal Muslims as in Egypt or Pakistan.<\/span><\/p>\n<p><span style=\"font-size: 13px; line-height: 19px;\">The Sinhala Buddhist political class which was swept into power in\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">1956 failed to create an inclusive political, social, and economic\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">order made predictable by the rule of law. Our ancient Sinhala kings\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">and Queens often acted arbitrarily. The last king ordered a cruel and\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">brutal form of death for Ehalepola family sans a trial. The post 1956\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">MPs are resorting to the same behavior pattern for they think power\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">gives them the right to act arbitrarily.<\/span><\/p>\n<p><span style=\"font-size: 13px; line-height: 19px;\">So the Sinhala Buddhist State spearheaded by the SLFP has lost\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">legitimacy and the present regime has become sectarian catering mainly\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">for the Sinhala Buddhist majority. But a plural society cannot hold\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">together if the State is sectarian. One has only to look at the Middle\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">East today where Sunnis are fighting Shiites and Egypt where a Muslim\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">Brotherhood wants to establish an Islamic state where the Sharia law\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">will be imposed on non-Muslims and liberal enlightened Muslims. It is\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">the same issue in Afghanistan or Pakistan. But sectarian violence is\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">tearing up these states.\u00a0\u00a0 Some of the markers coincident with loss of\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">legitimacy are: an increase in illegality (vide the criminal acts of\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">our Provincial MPs such as rape and sexual harassment of women),\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">informality in the conduct of State business, and criminality in the\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">economy; ineffective delivery of basic services; failure to maintain\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">or expand essential public services like health and education;\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">increase in corruption; and appropriation of public assets for private\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">gain as in the elections.<\/span><\/p>\n<p><span style=\"font-size: 13px; line-height: 19px;\">As a result, administrative control weakens and the bureaucracy is\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">seen as an instrument for abuse of power, in turn leading to a crisis\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">in public finances\u2014where both revenue and expenditure are\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">unpredictable and budgeting becomes an exercise in emergency\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">management postponing bills and accumulating payment arrears on a\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">selective basis. The ultimate marker is the loss of legitimate use of\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">violence by the state and emergence of armed groups that openly mock\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">the authority of the state and gain control of various areas of the\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">country.<\/span><\/p>\n<p><span style=\"font-size: 13px; line-height: 19px;\">Accountability, effectiveness, transparency, and rule\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">of law\u2014the interlinked concepts that are now considered the basis of\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">good governance and economic development have vanished. It is easy to\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">destroy institutions which are not rooted deeply. The values of modern\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">democracy, human rights and justice are not familiar to the post 1956\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">generation educated in Swabasha. The attempt to romanticize the\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">ancient past of feudalism of our Sinhala kings and the imagined golden\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">era of Sinhala Buddhism has now given way to the harsh realities of\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">the present world, particularly the economic realities.<\/span><\/p>\n<p><span style=\"font-size: 13px; line-height: 19px;\">The legacy of the War has been an important contributing factor to the\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">undermining of humanitarian values. During that period, political,\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">military, and financial resources were provided to the military and\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">they were looked upon as heroes when the LTTE was roundly defeated in\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">a \u2018no holds barred war.<\/span><\/p>\n<p><span style=\"font-size: 13px; line-height: 19px;\">The emphasis during the war and since the war victory is on\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">personalization of rule rather than on institutionalization of\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">authority, as particular individuals were considered the lynchpins of\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">the war victory. They could get away with any misdemeanors. Those in\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">the media who exposed their misdeed or criticized them demanding\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">accountability were marginalized, or repressed.\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">As a result, a systematic dismantling of state institutions and the\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">diversion of massive public assets for private gain takes place. It is\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">doubtful whether the present State can embark on any meaningful\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">process of reform to bring back the Rule of Law. The risk of\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">state-failure is evident today in our post conflict State.<\/span><\/p>\n<p><span style=\"font-size: 13px; line-height: 19px;\">About 50 percent of countries that have entered a peace agreement\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">after persistent conflict have descended to conflict again within 10\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">years according to evidence gathered by think tanks.<\/span><\/p>\n<p><span style=\"font-size: 13px; line-height: 19px;\">A comprehensive discussion of a development strategy with\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">state-building as its ultimate goal requires equal attention to the\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">creation of the market and the constitution of civil society because\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">functioning states, markets, and civil societies are all essential\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">ingredients of a developmental paradigm. As civil societies and\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">markets depend by definition on the existence of a stable and\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">functioning state for their security, an enabling environment for free\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">economic activity is essential. Instead we find a crony capitalist\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">structure where every big business must pay pooja to the new gods\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">often accompanied by offerings as well.<\/span><\/p>\n<p><span style=\"font-size: 13px; line-height: 19px;\">Private sector business can triumph only if they assume the form of\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">patron-client dependence.
