(C) SUMMARY:  Assistant Secretary for South and Central \r\nAsian Affairs Robert Blake urged Sri Lankan Foreign Minister \r\nBogollagama September 15 to allow freedom of movement for \r\ninternally displaced persons (IDPs) by the end of September, \r\nwhen monsoon rains will begin.  A\/S Blake stressed that the \r\ncontinued detention of IDPs is contrary to international \r\nstandards.  Bogollagama restated the challenges Sri Lanka \r\nfaces in screening for former Tamil tiger (LTTE) combatants \r\nand the slow pace of demining.  He sought to assure A\/S Blake \r\nof substantial progress on IDP returns over the next month. \r\n\r\n\u00b62. (C) SUMMARY CONT'D:  Blake told Bogollagama that the \r\nreport being prepared by the State Department Office of War \r\nCrimes Investigations (S\/WCI) is a Congressionally mandated \r\ncompilation of information about potential violations of \r\ninternational humanitarian law committed by both sides of the \r\nconflict in its final stage -- not a political message.  That \r\nsaid, accountability is an important part of political \r\nreconciliation.  Bogollagama expressed concern about the \r\npotential negative impact of the report on the bilateral \r\nrelationship.  Blake and Ambassador for War Crimes \r\nInvestigations Stephen Rapp met later on September 15 with \r\nSri Lankan Ambassador Wickramasuriya to make the same points. \r\n Wickramasuriya also expressed concern for the potential \r\nimpact on the bilateral relationship, noting that the public \r\nand media would respond negatively. (C) In a September 15 telephone call to Sri Lankan Foreign \r\nMinister Rohitha Bogollagama, SCA A\/S Blake underscored the \r\ndifficulty the international community will face in \r\ncontinuing to support the IDP camps.  More than three months \r\nsince the end of hostilities, IDPs remain behind barbed wire \r\nand, contrary to internationally accepted practice and \r\nstandards, are not permitted to leave.  Bogollagama sought to \r\nassure A\/S Blake that a substantial number of low-risk IDPs, \r\nsuch as children, the elderly, would be returned over the \r\nnext month.  He noted the 9,400 returns that had recently \r\nbeen announced and pointed to successful, ongoing \r\nrehabilitation efforts for former LTTE combatants. \r\nBogollagama blamed the slow pace of returns on the need to \r\ndemine the areas IDPs had fled, which he maintained was a \r\nprecondition for returning them to many of their home \r\ndistricts.  He argued that progress on demining is being \r\nmade, namely on roads, and pointed to recently purchased \r\ndemining equipment from the Czech Republic.  At the same \r\ntime, he questioned the level of productivity of \r\ninternational NGOs being supported by the U.S. and others in \r\nthe international community. \r\n\r\n\u00b64. (C) A\/S Blake said he understood the need to ensure that \r\nIDPs return to safe areas, but argued that the process of \r\nscreening former LTTE has slowed GSL's effort.  He noted the \r\napparent lack of a timetable to complete the screening \r\nprocess.  Bogollagama called the process time-intensive, \r\nsaying the focus to date has been on feeding and sheltering \r\npeople.  A\/S Blake reemphasized that more progress on IDP \r\nreturns will boost Sri Lanka's standing in the international \r\ncommunity, suggesting that the rolling targets announced by \r\nthe GSL -- targets that it has successively missed by a wide \r\nmargin -- undermine GSL credibility. \r\n\r\nREPORT TO CONGRESS ON POTENTIAL VIOLATIONS \r\nOF INTERNATIONAL HUMANITARIAN LAW \r\n------------------------------------------ \r\n\r\n\u00b65. (C) Blake stressed the report was ordered by Congress and \r\nis not a political message.  The report will catalogue \r\npotential violations of international humanitarian law by \r\nboth sides of the conflict.  Blake emphasized that \r\naccountability is important so that Sri Lanka can have a \r\nprocess of political reconciliation.  Bogollagama expressed \r\nconcern about the impact of the report on U.S.-Sri Lanka \r\nrelations, suggesting that the Administration could have \r\n\r\nSTATE 00096501  002 OF 002 \r\n\r\ndelayed the report or responded to the request from Congress \r\nin a manner \"sensitive to our relations.\"  Blake responded \r\nthat was not an option.
